Ang asylum ay binibigay ng isang bayan sa national ng ibang bansa na namimiligro ang buhay sa kanyang bansa dahil sa kalupitan ng ginagawa sa kanya.

Dapat matuwa ang NPA at epektibo pala sila sa mga taong nang-abuso ng kanilang kapangyarihan nang sila ay nasa poder. Si Bolante ay nakaharap sa imbestigasyon ng Senado tungkol sa sobra P3 bilyon na pera para sa magsasaka na kanyang ginamit para sa kampanya ni Gloria Arroyo noong 2004. Kasama doon ang P728 milyon na pambili ng abono ng mga mahirap na magsasaka.

Nahuli ng U.S. Immigration si Bolante noong July 7 sa Los Angeles nang siya ay nagtangkang pumasok sa United States gamit ang kanselado na business at tourist visa. Kaagad siya nag-apply ng asylum. Nakakulong siya ngayon sa San Pedro Processing Center. May hearing raw siya sa susunod na linggo ay inaasahan na yun ang gagamitin niyang rason bakit hindi siya dapat ibalik dito sa Pilipinas.

Suspetsa ng marami na strategy lang nina Bolante at nina Arroyo ang pagpahuli sa Amerika para siya maka-apply ng asylum. Maari naman siyang mag-post ng bond na sinabi sa report ay $100,000. Aabutin raw ng tatlo hanggang limang taon ang pagdining ng asylum application. Kaya manatili doon si Bolante sa Amerika.

Akala ng marami noon sa Senado siya takot. Sa NPA pala. TNT (Tago ng tago) na ngayon sa NPA si Bolante.

Maniniwala akong tatargitin siya ng NPA. Sa dami ba namang mahihirap na magsasaka na kanilang pinerwisyo. At siyempre hindi naman makakuha ng hustisya ang mga magsasaka dahil hawak nina Arroyo ang korte. Tingnan mo ang nangyayari sa isinampa nina Frank Chavez na kaso laban kay Bolante sa Ombudsman. Inaamag. Kaya hindi nakakapagtaka kung NPA justice ang hahabol sa kanya.

Inis na inis si Harry Roque, professor sa University of the Philippines College of Law
na malawak ang karanasan sa kasong asylum dahil ito ay para sa mga taong inosente na inuusig ng mga walanghiyang na sa poder.

Si Bolante ay kasama sa mga walanghiyang nasa poder. Sila ang nagpapahirap sa mga inosenteng tao. Siya ang lumabag sa batas. Siya ang gumawa ng krimen. Tapos siya pa ang may ganang humingi ng proteksyon sa batas.

Itong ginagawa ni Bolante ay nagpapakita na kahit marami siyang pera, kahit malapit siya sa nasa poder, hindi pa rin siya nagkakaroon ng mapayapang pamumuhay.

Tama ang kasabihan na “You can run but you cannot forever hide. (Pwede kang tumakbo ngunit hindi ka habang buhay magtatago.”

    Ito ang tinatawag na abuso bansot style. Gagamitin ang NPA for convenience to seek assylum, and then turn around to make NPA as reason to allocate billions of peoples money for the military to exterminate the NPA. It would be interesting to see if bansot can get away with insulting the intelligence of dubya.

    The latest feedback is that Gloria’s government is meeting US Embassy officials for a top level discussion on Bolante’s case. That only shows how sensitive and important Bolante is to this Arroyo government.

    By policy, the US doesn’t recognize threats from NPA as ground for granting asylum. Many tried and failed. If Bolante is granted such relief, then it’s obviously a government to government secret deal to protect this fake leader’s crimes.

    This Joc-Joc is one big joke. With the NPAs branded by the U.S. as terrorist, he’s got a chance he’ll be accommodated by the U.S. I’m starting to smell something fishy. We could all have been taken for a ride. Could it be a result of backchannel talks with the U.S.? The Australians have also done this with the administration. Soon we’ll have Aussies in our backyard too. No wonder this leprechaun is so sure she’ll get the funds she needs for her theme park. Mukhang nabenta na ni bansot ang Pilipinas.

    Ang unang balita ko, ang US Embassy sa Manila ang nagpakansel ng visa ni Hok-hok. Siguro kakutsaba dito si Pandak. Para hindi na pahuli si Hok-hok sa Pinas upang tumistigo sa kanilang mga kabalbalan, NPA ang ginawang dahilan para mag-apply ng Asylum. Madaling napa-paniwala nila ang US embassy because NPA is listed as a terrorist organization in their books. Magagaling silang dumiskarta sa mga kawalanghiyaan, sa kabutihan puro palpak.

    Kung abutin man ng tatlo hanggang limang taon ang hearing ng asylum application (assuming na tanggapin ng USA ang application niya), basta nakakulong siya the whole time, okay na ring partial na parusa kay Bolante, IMHO. Marami daw milagrong nangyayari sa mga kulungan, kahit dito sa USA. Mula nung 9/11 ay tuwing dalawang buwan halos na nagdo-donate ako ng blood sa Red Cross. Tuwing donation ay sang-katerbang questions ang required na sagutin ko. Kabilang na dito ay kung nakulong ako ng mahigit na 72 hours at kung “yes” ang answer ko, hindi tatanggapin ang dugo ko dahil delikado sa AIDS. Hindi na nila hihintaying testingin ang dugo ko pagka-donate. Stop na ang process at pauuwiin na ako. Of course hindi pa ito nangyari sa akin kahit minsan. Hindi lang tinanggap ang dugo ko for one year after nung last na uwi ko sa Pilipinas nung 2003 dahil sa possibility ng malaria.

    When one applies for asylum in the US, he doesn’t necessarily have to be detained. In fact, he is entitled to work by applying for work permit while the case is pending. Many illegals resorted to filing frivolous asylum cases but still got the due process allowed by the US Federal and Immigration laws. The case can be appealed. Many went the other routes while the case is pending such as marrying US citizens. Many succeeded. All one needs is to hire a good immigration lawyer. That’s who it works in the US. Bolante and his cohorts could have long planned for this. This asylum thing didn’t come at a spur of the moment. Obviously, it was a well planned legal strategy.

    Unconfirmed report has it that the US donated a huge sum of money in Arroyo’s government fertilizer program that was stolen by Bolante. Hence, he was arrested and detained with a bail of $100,000.

    No one and not even the US will buy Bolante’s reason for asylum application pointing to NPA. Why? Can’t GMA’s Police and Military protect him from NPA? I can see the US immigration judge denying his application outright. But, the process must still be followed and this includes appeals. So, we’re looking at a few years of stay for Bolante in US.

Oh! my goodness??? Sabi ko nga sa mga nauna kong mensahe, baka sabwatan lang ng US at ni bansot ang paghingi ng asylum ni bolante para matakasan ang pag-uusig ng bayan sa kanya. Kaso, nagkamali si bansot, hindi niya naalala na marami nga pala silang ipinagkatiwalang mga pera at ari-arian kay bolante na nabisto ni Uncle Sam. Por diyos por santo!!!     Here’s a bit of off topic update on Ambassador Del Rosario. For those who still don’t believe he was fired, here’s about him and what he said:

    Former Philippine Ambassador to the United States Alberto del Rosario yesterday belied Malacañang’s announcement that he resigned from his post as he challenged President Arroyo to exercise political will and to “do what is right” for the country.

    In his first public statement since returning home from Washington early this month, Del Rosario, who spoke before the Makati Business Club, said “I stand by my original statement that I was recalled and I don’t want to dwell on it. I think I like to move on.”

    One thing good about progressive societies like Japan’s and the US’s is that signature campaigns actually work to bring a change kasi hindi naman gawa-gawa lang katulad sa Philippines na idinadaan sa signature for a 100 or a 1000 pesos depende sa kung sinong pipirma!!!

    Many people still don’t know what a political asylum is. The recent Bolante case and his reported application for asylum all the more has made this topic more interesting. May this information benefit you all:

    Some people consider asylum as a possibility in order to stay in the United States. They wonder what the requirements are for asylum. First, let us address the issue about requirements.

    The law states that an asylum application must be filed within the United States once someone has arrived. People who are afraid for their safety while still in their home country can apply for refugee status at a U.S. embassy, but cannot apply for asylum at the embassy.

    These are the requirements to file in the U.S. (1) The applicant must file within one year after arriving in the United States. He can also file for immediate family members, which includes spouses and children who are under 21. The form needed is called Application for Asylum and for Withholding of Removal, Form I-589. (2) The applicant must be able to prove that he or she is of a certain social group that is being harmed or mistreated by the government of the home country, or that the government would allow harm by other groups with the government’s knowledge. (3) The person applying for Asylum must prove (by evidence including letters and witnesses) that he or she has been specifically pointed out for persecution. That person must be able to describe in exact detail, with credible testimony, the kind of persecution that he or she faced in the home country. (4) The applicant must also be able to prove, that if returned to the home country, he or she would face even more persecution.

    The U.S. government assesses country conditions in the home country of the applicant. At the asylum interview, the asylum officer will assess the facts and determine whether the applicant was personally persecuted in the past; or, if conditions are now better in the country, the applicant no longer needs asylum protection. The applicant will be asked if he or she fears being returned to the home country. (5) The applicant will be asked if he or she has ever applied for asylum in any other country and also asked what countries he or she has resided in prior to coming to the U.S.

    All questions must be answered honestly to demonstrate that the application is not frivolous. This point is important. If the interviewing officer determines that the application was made frivolously, then the applicant will not be able to secure any other type of immigration benefit, such as a family petition filed in the future.

    All asylum applications must be timely. That means that if it is filed more than one year after arrival in the U.S., the application will be turned down because it was not filed on a “timely” basis. It is possible to file after a year only if it can be proved conditions in the home country have changed and it is even more dangerous to go back. There must be proof that there are new, specific, and personal threats against the applicant if the application is filed after the one-year deadline. This is very difficult to prove and most people fail if they file for asylum more than a year after coming to the U.S.

    A person applying for asylum can stay in the United States for quite a long time as long as the case is being decided. Once a person applies they are called an “asylee applicant.” There will be no effort on the part of Immigration and Customs Enforcement to remove an asylee applicant until all interviews and hearings have concluded. Oftentimes, this can take a number of years. Also, 150 days after a person applies, he or she can get a temporary work permit as long as a final decision has not been made. It is important to file for the temporary work permit after waiting the 150 days, because the work permit will not automatically be given. Lately, the Immigration Service has been opposing the work permit applications of some asylees on technical grounds. In all asylum cases, the applicant needs to get the services of a good immigration lawyer. With the work permit, the applicant and family members in the U.S. can get a social security number and a driver’s license.

    I dont know with “the joke” claiming he’s in the hit list of the NPA as a lame excuse for him to seek asylum in the US of A??? him being the friend of the big fatso??? i dont even know if the NPA could even close to him. People, know what??? this is the same tactic/s being done by friends of the marcoses during the martial law years, the tactic/s is used so that people will not be questioned here in the Pinas. “The joke” is not being persecuted here in the Philippines, much more he is being protected by the higher up, he is being told seek asylum by the people in the palace so he could hide from the people who want him to speak the truth about the fertilizer mess.

    So-called NPA assassination plot against Bolante a mere fabrication to seek US assylum — “Ka Roger”

    Communist Party of the Philippines (CPP) spokesperson Gregorio “Ka Roger” Rosal today refuted claims by former Agriculture Undersecretary Jocelyn “Jocjoc” Bolante that he is the target of an alleged New People’s Army (NPA) “assassination plot”. The CPP spokeperson issued the following statement:

    Claims by former agriculture undersecretary Jocelyn Bolante that he is the target of an alleged NPA assassination plot are but ploys to make him eligible for political asylum in the US and thereby avoid repatriation and evade trial for his and his president’s large-scale corruption, malversation and plunder of billions of government funds.

    At this point, like the rest of the Filipino people, we want Mr. Bolante who is a principal player in the P2.8 billion million fertilizer fund scandal to be repatriated to the Philippines so he could spill the beans about how he connived with Malacañang to use the fertilizer fund as well as the recovered Marcos wealth to bankroll Gloria Arroyo’s 2004 electoral campaign and bribe various government and election officials to secure her victory. The disclosures he may must are of utmost interest to the Filipino people and the revolutionary forces.

    He must come clean about the details of the cases of large-scale plunder of government funds that have so far been uncovered. At the same time, he and his principal must be made to face the judgement of the Filipino people and their demand for the criminals and plunderers to be punished.

    If the US government were to grant political asylum to Mr. Bolante on the basis of his fabricated claims, it would only show itself to be covering up for the large-scale corruption and plunder committed by Mr. Bolante and his principals and accomplices in the puppet regime.

    Bolante – Prosecution, Not Persecution

    Senator Rodolfo G Biazon today said the Philippine government should assure the government of the United States of America that Jocjoc Bolante would be well protected against threats to his life from the NPA, the excuse seemingly being used by Bolante to justify his request for the grant of asylum.

The Senate Committee had referred its conclusions to the Ombudsman.”

    Biazon asserted, “The sincerity of the two governments to fight corruption now has an opportunity to be proven.”

    “The government of the United States recently gave a grant to the equivalent of P1 Billion to our government to help in our fight against graft and corruption. The government has allocated a counterpart of another P1 Billion. Bolante’s case is about graft and corruption in this country.”

    “Protection of Bolante against the NPA is the duty of the government. This must be provided to convince the United States government that there is no basis for the request for asylum.”

    Biazon recommended, “Instead, extradition efforts should be mounted by the government by persuading the US government that Bolante will be appropriately protected maybe even put under the Witness Protection Program administered by the Department of Justice.”

    Biazon concluded, “The government should invoke the existing extradition treaty between the United States and the government of the Philippines. Bolante is a test case of the sincerity of the RP and US governments to fight corruption in this country.”

    Ms. Ellen, I know it has been written weeks ago regarding the request of the senate to the US Embassy on the case of “the joke”, to which the embassy replied that they should course it thru proper diplomatic channel. I agree that all communications must be coursed thru the diplomatic channel. But wait, …………why is it that the US embassy writing directly to malacanan, the senate, the hous of representaTHIEVES and other government agencies, is that the proper diplomatic channel??? if the US embassy can do it why not our government institutions can’t do the same??? the US is treating us with double standards, again and again.

    Sorry for being off-topic again:

    Anyhow, its like this: heard that manny villar is being sorry for railroading the impeachment of erap in 2000(???). kapal muks din naman talaga ano, its just good that erap showed him how a man should be, like telling his (erap’s) wife and son to support villar for the senate presidency.

    Now he is being sorry for railraoding the impeachment??? tsk, tsk, tsk….. (may kunsensya naman pala) As I said before ms. ellen, i don’t trust this guy, imagine he is directly/indirectly involved in putting the man in jail for 5 years without conviction, now he is being sorry???@?!)*&^% NA NYA, saying history will be the judge. But how can you judge the man??? tapos lalapit din pala sya kay erap para makuha and senate presidency. !@#$?*&^ NA TALAGA ANG KAPAL NG MUKHA.

  31. What a flimsy excuse this Bolate has in fact! He should in fact be an original, and the Pandak should feel embarrased for this unfounded claim for it only proves that she is only talk and no walk!

    Look, over in Japan for instance, we have such underground and criminal organizations as the Yakuza, Red Army, Aum, etc.but I doubt if the US would grant a Japanese national asylum simply on the ground that his life is threatened by the Red Army, Yakuza, etc. and the US government would readily grant asylum on such absurd claim.

    Parang sinabi ng Bolate na ito na kontrolado ng mga NPA ang buong Pilipinas as itong si Pandak na kaibigan niya ay hindi siya kayang protektahan sa mga NPA, and by this claim in fact makes the Pandak looks really ridiculous with all those claims that she is ready to face her enemies because she is that powerful and can crush and defeat them all!

    Isn’t this in fact a contradiction of all the claims of the Pandak in her SANA speech, and that she is in fact contradicting her own self? And if she is not in connivance with all this fiasco of the Bolate arrest, why is she is not telling the Americans that she can protect the Bolate in the Philippines against the NPA as she claimed she could in her SANA? Sa katarantaduhan ng aleng ito at ng mga alipores niya nagkakandagulo sila ngayon especially when she has to agree that her government cannot actually defeat the NPA especially now that she has declared war with them, but even then, Bolate’s claim will look ridiculous and absurd especially when the Americans demand from the Pandak an explanation of what she has been doing with the money the US government has been giving her to fight terrorism in the Philippines!

    Diyan mo makikita ngayon na puro lang pala dada itong si Pandak at walang ibubuga. Ang tawag diyan sa Tagalog ay “manduduro” o nanakot lang pero kapag pinatulan at hinarap ng kalaban ay kakaripas na takbo!!! Marunong lang ngang mandaya, manakot, magnakaw at magsinungaling.

    Hindi komo gulo ang isip ng mga kano ngayon ay akala ni Pandak, Fatso at Bolate ay kaya nilang bilugin ang mga kano. Humahanap sila ng panakip butas e lalo naman nilang pinalaki ang kanilang mga butas.

    BTW, bakit nga ba kamukhang-kamukha ni Fatso itong si Bolate. Hindi kaya sila magkakambal o magkapatid sa labas?

Look, kahit na akala mo parang tanga ang mga hapon, hindi nakakalusot ang mga kano sa kanila. Pa-wais-san Like kung may request ang mga kano sa gobyerno from the US embassy, lahat iyan ay coursed through the Ministry of Foreign Affairs except when there is a special ruling agreed upon like in the case of criminal investigations of suspected criminal offenders for example inside the base na walang mga immunity hindi katulad noong mga nasa embassy. Sana ganyan din sa Pilipinas para naman hindi magmukhang alipin pa rin ng mga kano ang mga pilipino.

    Iyan ang dapat natin ipamukha sa mga kano—na the days of the occupation of the Philippines are over matagal na! Kahit na noon lang pumutok ang Mt. Pinatubo!!!

Iyong isa nga writer who now lives on royalties of his books. Kaya as far as livelihood is concerned, walang problema iyan. Ang problema ay may criminal case si Bolate sa Pilipinas and government level ang nature. Kapag hindi pinagbigyan ng America na ma-solve ang kasong ito ay lumalabas na palpak sila na dapat at tumutulong sila sa pagbatikos ng mga ganitong anomalya lalo na’t reflection ito ng kung papaano nila hinubog ang Pilipinas!!!

    Iyan ang dapat na tema ng panlaban sa amor propio ng mga kano! If you touch them on their psyche, umaalma ang mga iyan at hindi papayag na lokohin sila ng isa lamang pandak from some country na most Americans kahit na sinakop nila do not even recognize!!!     Kaya I relate my personal experiences and what I have come to know why Japan has succeeded to even be with the biggies in the world despite its size and almost zero in natural resources but people who are kept in the country, nurtured and nourished to be useful unlike in the Philippines na hinuhubog ang mga pilipino na walang kuwenta ang bansa nila kaya lumayas sila at maging export ng bansa nila na pingungunahan ng isang bansot na bugaw!!! Sabi ko ay baka makakuha ng idea ang mga pilipino at maging determined na palayasin ang bugaw!

    What compelled the US to act like what they did to Bolante was her donations given to the fertilizer projects. American money was involved; hence, they got him.

    The US is known for respecting due process especially if an accused is represented by a private lawyer. So in the meantime, we just have to give up on wishing that Bolante be sent back to Manila to answer for his crime which of course directly is pointed to Malacanang. From my experience and what I know, Bolante should be enjoying his stay in the US for at least three or even four years. If he’s denied his asylum application by the judge after hearings which is most likely, he has two options: To appeal the case or request for voluntary departure.

Buti nalang…now we know what it is this white powder they were offering my dad…and as far as i remember, these containers were passing by HK frm Japan cz my dad were importing surplus tires frm Japan….sadly all stopped when macoy banned the importation of tires due to the american giants wanting to monopolize the tire industry way back then…masakit yuko talaga but the truth hurts that most(almost 90%) chinaman roaming the chinatown area are hoodlums. the tsinoys right now are being casts aside bec hindi sila ganun ka-agressive ng mga taga mainland na baguhan ngayon. as my hubby said, mahilig din sila sa bahala na kung mahuli…kung hindi swerte!..kawawang ‘Pinas!

    Persecution of Jocelyn Bolate by Ka Roger is nothing but bunch of malarkey and we all know it, Gloria Arroyo knows it and everybody and his uncles and aunts knows it. It’s all but to save Gloria’s butt and everyone are being bought and sold including the U.S. Immigration. It’s very clear, Bolate stole the money with directions from Bonnie and Clyde Arroyo and Bolate can’t account for it or refuse to testify. And, now once again the Pilipino nation is the one holding an empty bag. This thing is getting too familiar and so tiring to even argue on the subject. We are not getting nowhere and Gloria still doing her lying, cheating and stealing. What a perpect system for crooks. Only in the Philippines! Hang those bastards.

  52. Why be defeatist? I told my friend at the US Embassy about Bolate, at nagulat sa ginagawa ng embassy nila sa Manila. Alam kasi niya hindi uubra ang tactica nila doon dito sa Japan. Baka mangyari diyan, magpalipat siya sa Pilipinas. Pero sabi ko sa kaniya, huwag kasi baka ma-corrupt siya doon katulad noong mga hapon na nagtratrabaho sa Japanese Embassy sa Manila. Marami sa kanila, pagdating sa Japan, mal-adjusted! Bakit kaya? Ang lakas ba talagang makahawa ng corruption sa Pilipinas? I wonder kung may nilalagyan din si Pandak sa mga embassies diyan sa Pilipinas para kunyari iyong mga ibang bansa ay approve sa kaniya. Alam ko iyong Vatican nalagyan niya pati na iyong CBCP. Buti na lang hindi ako Katoliko!!!
