No bail for Bolante

Yesterday (Sept. 27, 2006) the US district Court in Wisconsin held a hearing on the petition of former Agriculture Undersecretary Jocelyn “Jocjoc” Bolante for bail. Strange, his lawyers mentioned a suspected quid pro quo for the acquittal of US servicemen suspected of raping a Filipina , known in media as “Nicole” in Subic.

Anyway, the court denied Bolante’s bail petition.

Here’s ABS-CBN’s report:

US immigration officials denied the petition for the temporary release of former agriculture undersecretary Jocelyn “Joc-joc” Bolante, ABS-CBN North America News Bureau reported Wednesday.

The report said that Bolante’s lawyers are now trying to bail out ex-agriculture official by strengthening the petition for habeas corpus filed before the US district court in Wisconsin.

The US attorney’s office, meanwhile, has moved to deny the petition. Government lawyers argued that as an arriving alien without a valid visa, Bolante’s detention is lawful.

During a status hearing on September 20, the US attorney agreed to ask the field office director of the US Immigration and Customs Enforcement whether or not the agency is willing to release Bolante on bond.

On Tuesday (Wednesday in Manila) the court was told that the immigration officer was not willing to set bail.

Related reports earlier said Bolante’s petition only questioned the legality of the revocation of his US tourist visa and not the validity of his detention.

Harry Roque, a University of the Philippines law professor monitoring the case, said that Bolante’s legal counsels were left with only two options after the court decided to junk his petition for bail.

Roque said that Bolante could choose either to be deported immediately to the Philippines or remain in detention.

He added that Bolante’s lawyers could face contempt for saying on record that the case might be used as a trade-off with the Subic rape case in Manila.

Bolante was arrested on July 7 at the Los Angeles International Airport after arriving from Seoul, South Korea due to a canceled B1/B2 visa. He is detained at the Kenosha County Detention center in Wisconsin.

Bolante was tagged as the mastermind of the P728-million fertilizer fund allegedly diverted to the campaign kitty of President Arroyo in 2004. The scandal is now pending investigation before the Senate food and agriculture committee.

  5. I believe news only in Tribune and Malaya. Otherwise, I consider the rest as mere publicity stunts paid with public funds!

    This Nicole deal is BS for I doubt if the US will try to jeopardize US interest on 4 horny shitting soldiers who are not even high-ranked officials, and not on mission when they did the crime of raping this young Filipino lass, who may be apt to looking for a US boyfriend like her sister’s, but these soldiers were on a furlough apt to have fun with some wannabe prostitutes as they have claimed they thought Nicole was, and more reason why the US government will not dare make a deal with the corrupt Philippine government to keep this high profile criminal in the US without due process in exchange for the freedom of these wannabe US rapists, meaning deportation and/or prison term in the US for Bolate, who will eventually be deported to the Philippines after serving his term in jail if convicted for some other crime like money laundering, etc. Surely, when that time comes, the US will make sure that he is put on a direct flight to the Philippines, and no other country will accept him with “Deported” stamped on his passport!

    At least, we know now that the US government is doing things according to the rule of law, and more reason for real concerned Filipinos to support the likes of Atty. Roque and Senator Magsaysay who are doing their best to help justice and truth to prevail and perhaps the return of the rule of law in the Philippines.

    I have actually interpreted for similar cases in Japan, and in countries where there is rule of law as in Japan and the US, it is impossible for wannabe criminals to be given any consideration but be deported and tagged as an undesirable alien.

    Why is it so hard for some people to believe that the US can do anything to protect their own interest? Even if that means letting go a criminal in exchange for saving their own in a foreign land? Time and again, history tells us that the US knows how to bend their rules and laws to accomodate even her enemies if her greatest interest is at stake. Aren’t some of her best friends today her enemies in the past? How’s Japan and the US today?

    It’s always been a policy of the United States of American never to negotiate with terrorists or criminals. We don’t know it yet but, if I’m not mistaken, USA considered illegitimate Gloria as exactly that, illegitimate, criminal and a terrorist. Illegitimate Gloria has been terrorizing the Pilipinos since she overthrew President Estrada. Then, governing the Philippines with criminal intent, to deceive and hide all her crimes under the protection of Malacanang, the People’s House. As mentioned in the talking point, Bolante’s lawyer, perhaps not in so many words, is using such rumor of negotiation to technically get a full pardon for Bolate. Obviously, Bolate is quite desperate with his new found home in which he has not accustomed to in comparison to the lifestyle he used to enjoy. It took a USA rule of law for some of us to realize to the reality that other countries actually respect and enforce their own laws as written. A lesson to be learned!

    It’s of my belief, the 4 accused may not get what they deserved only because the Philippines judicial system are incompetent, and not because the USA is dictating. Can’t blame others for Philippines govt. incapability to prosecute the 4 accused in accordance to the evidences provided in court. Philippines judicial system is just too unfit as an institution, it has been proven. President Estrada, a president of the Philippines yet, how long it’s been going on? Right! Philippines is sovereign nation which is something to keep in mind.

    JocJoc Bolate is in the custody of the USA, and everyone are watching. I’m confidence bolate’s case will be in accordance as the law requires under the USA law. It’s already happening, as we all know, Bolate since 7/7/06 upon entering USA was grabbed by the authority and detained like a common criminal that Bolate is. He got it coming for him, and not bit sorry. To date, Bolate still being held without bail, that’s fact. I trust, Bolate will not be used for bargaining for the release of the 4 accused of rape. And I believe the USA will take the high moral ground in this case and will let the ax fall where it will. Will the Philippines do the same?

  12. I feel sorry for Filipino victims of US soldiers’ atrocities even before the US bases were buried by asses from Mt. Pinatubo that forced the US to give up fighting against then decision of the Philippine Congress and Senate to scrap the bases. Even when it is possible for erring US servicemen to be punished for offenses committed against the law of their host countries, I cannot understand why Filipinos themselves would say that they cannot be prosecuted and not insist on having them prosecuted the way for example Japanese courts punish them when they err, or break Japanese laws and even when they commit their crimes inside the US bases in Japan as in the cases that I interpreted for ranging from rape to drug trafficking.

    If the Japanese can do it, why cannot the Filipinos do the same? Ganoon ba katakot ang mga pilipino sa mga kano? Matapang lang ba ang ang mga pilipinong dumaldal!

    Lalo na ang mga kalalakihan, saan na napunta ang mga bayag? Puro na lang ba bayaran? Ngek! Pwe! Kaya ngayon hanggang Super Atsay/Atsoy at Super Taputo/Taputa na lang ba sila? Kawawang Pilipinas! Lalong nabulok dahil kay Pandak! Nakakaiyak! 😡

    Kahit na ba i-suggest ng mga gagong abogado noong mga kano ang ganoon, kung ayaw ng korte ng Pilipinas, walang magagawa! Kagaguhan ang pinagsasabi ng mga ungas na iyan na puro dolyar ang nakikita at hindi iyong kapakanan at kahihiyan ng bansa at mga kababayan nila.

Court hearing done in a Japanese court, and I interpreted. Kaya bakit hindi puedeng gawin iyan sa Pilipinas. Dito kasi abogado ng kano na court appointed ay fair lang at sinasabihan ang mga kliyente nilang magsabi ng totoo, hindi tinuturuang magsinungaling. Sa pulis pa lang nakukuhanan na ng statement. Nakatingin lang ang mga legal adviser ng base o kung civilian naman ay legal adviser na galing sa embassy at ang layunin lang ay to make sure that their rights are protected. Pero malaki ang tiwala ng mga kano sa palakad ng hustisya dito. Bakit hindi iyan magaya sa Pilipinas?

    That other Gonzales, the U.S. Attorney General (not Raul, but Alberto) may have something up his sleeves. The families of the accused soldiers in “Nicole Case” may also be pressuring their politicians to help their own, and now they are holding a ‘bargaining chip’. Speculation it maybe, but if the U.S. had no hesitation sending a Canadian Citizen to Syria (Mahir Arar), where he will be tortured for informations they need which by law the U.S. can not do themselves, then it is not beyond possibilities that The Bolante case may unravel as one to serve their own interest.

    In Ms Nicole case, the United States Armed Forces in the Philippines are guest of the host country, according to the agreement, the supposedly and exercise between two countries, a no limitation military exercise. The Philippines, if possesses some credibiliy, perhaps illegitimate Gloria Arroyo should remind the USA about the Philippines laws in which applies to all in the Philippines, including the 4 accused of rape. But, ain’t going to happen, simply because of the corrupt system. Nothing is above board, everything being done behind the scene when no one is looking. It’s an acceptable standard like a decease hard to do away without.

    Illegitimate Gloria doesn’t treat the citizens as human being with rights, yet commodities that can be sold and bought for a price, e.g. OFW’s. That’s illlegitimate that we know too well.

    Anna, at least for this time you share my opinion about the US and not your comadre. The US doesn’t negotiate with terrorists and criminals? Tell it to the four Marines, Toney. Noriega was a big time drug dealer but the US took care of him for 20 years. Bin Laden was once a US ally, Al Qaeda being a CIA creation. I can mention more but the fact remains that for the US, there are no permanent friends and enemies, only their permanent interests.

    Abu Sayyaf: The CIA’s Monster Gone Berserk

    The Philippines is under watch by America’s “anti-terrorism” network. This is so not only because of the presence of active Moro and Marxist guerrillas but also because of its special concern on the Abu Sayyaf. In the ‘80s, just as it was waging its last surrogate wars against the Soviet Union, the U.S. was also engaged in new forms of covert operations — the training of Islamic militants to fight the Russians in Afghanistan and elsewhere. A product of this war – the Abu Sayyaf – was once hailed by American presidents as a group of “freedom fighters.” It was an exaltation that would haunt them for years.

    To those who have been following the Abu Sayyaf’s exploits, the offer of military assistance by the United States government in tracking down the extremists in Mindanao (southern Philippines) has sent a chilling effect particularly among the patriotic sectors.

    Related to this, similar concerns have been raised as to why despite government’s “total war” policy on the small group of bandits – whose hostage-taking spree is a purely police matter – not one of its active ringleaders has been caught. Previous suspicions that the Abu Sayyaf enjoys the protection of some top Armed Forces officials have surfaced again.

    In a surprise operation last May 27, Abu Sayyaf gunmen kidnapped three Americans and 17 Filipinos from the world-class Dos Palmas resort just off Arracellis in Palawan. It was not immediately known where the new hostages were taken but the gunmen reportedly operate from the southernmost islands of Sulu, Basilan and Tawi-Tawi.

    Abu Sayyaf spokesman Abu Sabaya on Saturday said they also took 10 fishermen hostage on their way to Basilan. The kidnapping was pulled off just barely two months after their last hostage – American Jeffrey Schilling – was freed after nine months of captivity.

    In declaring a “no ransom, no negotiations” policy to the Abu Sayyaf, President Gloria Macapagal-Arroyo ordered military assaults on the group’s suspected lairs and offered a P100 million (US$2 million) reward on the ring leaders’ capture, dead or alive.

    Meeting Arroyo in Malacañang on May 30, U.S. Rep. Robert Underwood offered military assistance to the Philippine government’s pursuit operations against the Abu Sayyaf. Underwood, who was accompanied in his visit by U.S. Charge D’Affaires Michael Malinowski, is a member of the powerful House Armed Services Committee and was in the country to explore how military relations between the two countries can be enhanced. Malinowski had earlier pledged continued American military support to the Arroyo administration.

    On the same day, U.S. State Department spokesman Phil Reeker demanded the immediate and unconditional release of the hostages, particularly Americans Guillermo Sobrero and missionary couple Martin and Gracia Burnham. Among the 17 Filipino hostages is construction magnate Reghis Romero, said to be the front man of former Estrada crony Mark Jimenez in the purchase of The Manila Times. The latter, who has just been elected Manila congressman, is himself wanted by U.S. authorities.

    Warplanes

    Since the Dos Palmas abduction, at least 12 American warplanes had been seen hovering over Puerto Princesa City in Palawan. Then on March 31, two U.S. destroyers – the USS Curts and the USS Wadsworth — and the landing ship USS Rushmore arrived in the country with 1,200 American troops. Philippine armed forces officials squelched speculations of U.S. intervention in the hostage crisis, claiming that the American troops’ presence was in connection with ongoing war games in Palawan and Cavite.

    Efforts to downplay reports that U.S. military assistance has indeed come into play in the latest hostage crisis were of no effect, however, when Press Secretary Rigoberto Tiglao himself revealed that military contacts between the two governments are ongoing. The U.S. Federal Bureau of Investigation (FBI) – whose agents have been in and out of the country in connection with “terrorist” cases – was also placed on alert. Former Philippine Ambassador to Washington Ernesto Maceda also revealed that in last year’s Sipadan hostage crisis where 20 tourists were held hostage by the Abu Sayyaf, the Americans backed military and police operations through the use of high-powered satellite surveillance equipment.

    ‘CIA monster’

    U.S. military efforts to intervene in the Abu Sayyaf hostage crisis appears to be a turnaround from their reported links to the Mindanao extremists several years ago. In May last year, Senate President Aquilino Pimentel Jr. described the Abu Sayyaf (“Bearer [or Father] of the Sword” in Arabic) as a “CIA monster.”

    Abu Sayyaf members, Pimentel said, were initially recruited by the Central Intelligence Agency as mujahideens to fight the U.S. proxy war in Afghanistan in the ‘80s. Before their deployment, they were trained by AFP officers in Sulu, Tawi-Tawi, Basilan and other remote areas in Mindanao. But the arms and funds came from U.S. covert operations connected with the CIA, Pimentel said.

    The mujahideens returned to Mindanao after the Afghan war to constitute the core of the Abu Sayyaf, the Senate president added.

    In his revelations, Pimentel cited the book, Blowback by Chalmers Johnson. But it was American writer John K. Cooley in his book, Unholy Wars: Afghanistan, American and International Terrorism, who made “the most direct statement regarding the training and funding of the (Abu Sayyaf) by the CIA,” he said. Cooley was the Middle East correspondent for the reputable Christian Science Monitor and ABC News.

    In his “Ghosts of the Past” report for ABC News in August last year, Cooley said the Abu Sayyaf, like many “international terrorists,” has its origins in the 1979-89 jihad or “holy war” to expel the Soviets from Afghanistan. Wanting to tie down the Soviets to their own little Vietnam war, the CIA recruited and trained thousands of Islamic militants to support the Afghan resistance against the Soviet invasion forces. The American quarterly Foreign Affairs reported that some 35,000 Muslim militants from 40 countries — including the Philippines — took part in the Afghan jihad. Related historical accounts said among the recruits was Osama bin Laden, now the U.S.’s No. 1 “terrorist enemy.”
    ‘Freedom Fighters’

    “The CIA orchestrated massive arms shipments via Pakistan, including state-of-the-art Stinger surface-to-air missiles,” Cooley said. Three American presidents – Jimmy Carter, Ronald Reagan and George Bush — hailed the mujahideens as “freedom fighters,” he said.

    The Abu Sayyaf, Cooley said, was the last of the seven Afghan guerrilla groups to be organized late in the war – in 1986 or three years before the Soviets withdrew. It was founded by an Afghan professor named Abdul Rasul Abu Sayyaf. And like Osama bin Laden, the group was financed by Saudi Arabia’s wealthy elite and influenced by Wahabism, an ultra-conservative form of Islam that dates back to the mid-18th century and is espoused by the Saudi royal family.

    “Some of the original veterans of the Afghan jihad, and their sons and grandsons and those trained by them, have been operating with destructive effect since the 1980s from Egypt and the Philippines to Algeria and New York,” Cooley wrote.

    With the Soviet withdrawal from Afghanistan in 1989, the CIA’s powerful Pakistani partner, the Inter-Services Intelligence Directorate (ISI), lost control of the Afghan fighting groups. The Abu Sayyaf had established a training camp north of Peshawar, Pakistan, “to train terrorists in the methods taught by the CIA and ISI,” Cooley reported. Some 20,000 volunteers were trained in the “Peshawar university” to “look for other wars to fight” including in the Middle East, North Africa, New York and the Philippines.

    The Abu Sayyaf moved its operations to the Philippines ostensibly to support the war for a separate Islamic state. Emerging from these operations were two leaders – the brothers Abdurajak Janjalani, who was an Afghan war veteran, and Khaddafi Janjalani.
    Early Operations

    In a privilege speech in July last year, Pimentel named former Interior Secretary Rafael Alunan and then Southern Command chief Maj. Gen. Guillermo Ruiz as knowing about the group’s early operations in Mindanao. He also asked the Senate to summon former President Fidel V. Ramos and ex-Defense Secretary Renato de Villa to shed light on the matter.

    Pimentel also cited revelations by a police asset, Edwin Angeles, who has since died mysteriously, that the military equipped the Abu Sayyaf with vehicles, mortars and assorted firearms for its raid of Ipil in April 1995. In the raid – the group’s first large-scale action – 70 people died while 50 teachers and schoolchildren were kidnapped.

    Following its “split” with the MNLF in 1991, the Abu Sayyaf resorted to illegal logging, kidnapping, bombing, looting, burning, killing and other criminal activities for its logistics and operations. So far, they have kidnapped at least 32 foreigners, including five Americans, Europeans and Asians. This does not included hundreds of other Filipino hostages, a number of whom were Catholic and Protestant priests and nuns. Some of them, including priests, were killed.

    The metamorphosis of the Abu Sayyaf from “freedom fighters” in Afghanistan to sheer bandits in the Philippines is a new dark spot in the U.S.’s covert dirty tricks operations throughout the world. The CIA has created not just one Frankenstein’s monster in the mold of the Abu Sayyaf but hundreds of others who are now wreaking havoc in other parts of the world – including right in the belly of the United States itself.

    But in war and in modern “counter-terrorism warfare” – which the U.S. now is eager to wage in the Philippines – there is at least one advantage that can be drawn. The anti-Soviet Afghan “resistance movement” promoted the U.S. arms industry. The U.S. may as well be doing the same thing as it embarks on a new crusade to destroy one of the “monsters” it created.     That I will agree with wholeheartedly; without exception all western powers are the same; Japan might be the exception among foreign powers today because they maintain on the whole, good relationship with virtually every nation without a shadow of doubt, well, until Kozumi that is (don’t know how the new one will shape foreign policy – they say he’s for the re-armament of Japan) because Japan, like Germany are weighed down by a moral clause: anti-war!

    It’s debatable whether the CIA really created Bin Laden. There had been links as usual with the underground Saudi Arabia movement (apparently, Bin Laden had supplied some intelligence on the Saudi family but I’m not sure how far the relationship with the Americans went!)

    But I do know that Taleban was supported by the US when the Afghans were trying to oust the Soviets but when the Soviets were ousted, the Talebans “rejected” alliance with the US by imposing their harsh regime. The US were surprised at the turnaround. Meanwhile, France was supporting the Northern Alliance faction all througout the Soviet-Afghanistan war. The Northern Alliance which was the enemy of the Talebans started to fight it out. France provided the US with intelligence reports supplied by the Northern Alliance that Al Qaeda anti-US operations were supported by the Talebans; the Lion of Peshwar, the Northern Alliance chief even went to the US to tell them but the US didn’t believe or were sceptical – the day before 9/11, the Lion of Peshwar was assasinated by Taleban-Al Qaeda operatives.

    Only then did the US seriously looked into the intelligence reports.

    The US (with Northern Alliance help financed by the French) finally bombed out the Talebans from Kabul but couldn’t hack it because of the Iraq dilemma – US forces stretched – the US asked NATO to take over “mopping up operations”. France acquiesced – there were infightings in NATO at that time because US was badmouthing the French for not supporting them in the invasion of Iraq. NATO decisions are supposed to be unanimous decisions; had France vetoed, NATO could not have gone and the US would have been lone, lonely, devastated force in Afghanistan.

  21. The Philippines must be on the lookout:

    Secretary Cruz is going to ram an RP-Australia treaty into the throats of unsuspecting Pinas.

    The treaty, according to Cruz himself will be patterned after NATO/SOFA and if so, it would mean that Australian forces will be able to station forces in the Philippines with some kind of military base.

    If so, the stationing of foreign troops in the Philippines is supposed to be unconstitutional.

    It is imperative for people to read about SOFA and be prepared to challenge the treaty! (RP-US VFA is a kiddie contract compared to an RP-AUSTRALIA, NATO/SOFA based treaty.)

  22. France informed the Philippines even before during Erap’s time that Filipino muslims were being trained in Afghanistan but along the Taleban lines (not Northern Alliance which is French supported).

    France provided lots of pertinent details to the Philippine government about the “bandits” even before the Abu Sayyaff. I know that Lacson was handed some of the inputs (as Police chief).

    I would have opted for the case to have been conducted by American military investigators – a suggestion I made from the onset (and published by Ducky Paredes) and for the trial to have been held on a US ship but on our seas. Nicole would have had a fairer trial because I know US military justice, they are a lot more fair than our current Gloria and Gonzales judiciary could ever be – in other words, the US military prosecutor would have taken Nicole’s side come hell or high water!

    The other factor that plays greatly in the favor of the 4 accused Americans is our own judiciary’s bias against our very own compatriot, the victim, the plaintiff. By showing our hand in such bias fashion, the goose was half cooked so to speak. How can you respect a nation whose own government puts very little value on the dignity of its own people?

    America do not and will not see us on the same footing as they do Japan. They respect Japan but they do not respect us. They are our allies because of our nation’s strategic position in the region (for their needs.) They cannot trust our nearby neigbours as much to accord them the same subservient treatment that we give them.

    Few western powers have genuine respect for Pinas. This is the honest truth. The UK is perhaps prepared to send Prince Andrew to Pinas but only because UK businessmen have something to sell to Pinas.

    Pinas is not respected abroad not because of Filipinos per se but because of our political system, rampant corruption and incredibly poor governance. Because of that, they find the Philippines a highly unreliable partner.

    When you do business with someone, you want that someone to be trustworthy and reliable, unfortunately the same thing is true with country partnerships.

    If the prosecution of the US marines will not prosper, it’s not because of inadequacy or incompetence of the Philippine judicial system. Philippine laws are sufficient and on equal footing with any country especially those concerned with heinous crimes. It will be because of lack of interest or to put it bluntly, “more of inferiority complex” of the prosecuting authorities to apply the full force of the laws. Kasi, mga Amerikano sila, and even if hurts, we have to admit the truth that most Filipinos still idolize the Americans, or the white people. They looked at them as if they were the Gods. They are all cowards and they just don’t want to become a winner at the expense of the master.
    If we may recall, similar cases have been filed against US servicemen stationed at the US bases before, but I can’t remember any one among those charged served a term here in this country. They can’t afford to displease Uncle Sam, prosecute and put these criminals behind bars. Back-channeling was always the business of the day, and it is possible that is what happening today regarding the Nicole case. By all means, they have to block the return of Bolate, and who is a mere Nicole alongside the Bolate, the man who knew too much, and who can put a doom and gloom in their already shaky hold on the seat of power. Nicole’s case is for them to lose, and if they loss, that is already a given and expected and that will not come as a surprise anymore. And if whispers become louder and real, it’s up to the people and some military men who are untainted to decide and do what they have to do, whatever and however to free the country from the clutches of evil that is Glueria kapit-tuko and Fat Mike Pidal.

Not, Anna, when the US servicemen commit a crime outside of the base, and you and I know that there is none in the Philippines and they did their crime on a furlough, meaning out of the uniform. So, as in Japan, they get imprisoned in a non-military prison after being stripped of their military ranks and dishonorably discharged.

    This is what is done to US military servicemen in Japan, and I bet similar procedure can apply even under the VFA Agreement that I don’t think is that different from the US-Japan Military Agreement. If not, then the Philippine government should insist on upholding its sovereign right to protect its own citizen, the Filipino victim regardless of claim that she consented to kissing the guy she was being friendly with, but I doubt if she had agreed to be sexually assaulted not by just one but by four horny servicemen, some of whom were prevented from consummating the act because there was the patrol that suddenly came. They could have succeeded even in silencing the girl forever after feasting on her that they likely thought they could as they are likely expecting they can do with the crooks waiting for them to pay them with their dollars!!!     I don’t know about the US-Japan military agreement but I do know the RP-US VFA, it is lopsided and is protective of US servicemen than of RP servicemen in the same situation (e.g. suspected of committing a crime).

  39. In the case of sovereign rights, RP surrendered a bit of it’s sovereign right in RP-US VFA when it consented (and signed) to allowing the US to have general custody of American servicemen suspected of committing crime in RP.

    In Nicole’s case, if ever these guys are convicted, I don’t believe the US will allow them to serve their sentence in the Philippines – not a chance! Anyway, I don’t know if they’d be convicted at all. America doesn’t believe that RP has a fair judiciary.

    I do hope am wrong but I am sceptical that these guys would be “punished” in RP!

    For all you know there are lots of Japanese descendants in the Philippines especially in Mindanao (Davao) and the Ilocos region (particularly the Mt. Province because of the Kennon Road Construction in the early 20th century.) The Japanese government I guess wants them to stay foot in the Philippines and be useful citizens and hope that the grants given to the Philippines will for good use.

    There has been delay in fact in the granting of the loans, and other aids due to the graft and corruption after Cory. Erap did not get a single yen I am told, and the grants that were asked by him are the ones promised JdV when he came here. This is the information we got in fact from the agency in charge of giving such ODA. There is no secret to these deals as far as Japan is concerned. The secret is on how the Philippines make use or no use of them. Datas, fact sheets, etc. are freely provided if you ask for them.

    Unannounced are the Scholarships and other Aid from Japan. There’s this Three-year Trainee Program given to Pinoys also. Our Kababayans work here for three years and they are forced to save para may maiuwi sa Inang Bayan later on. I am working for several of these Companies, yet, there is no news whatsoever about them. And there are more Pinoys coming this year… It is a continuing process.

    The US-Japan Military Agreement was signed in the 60’s and goes through some bits of changes according to the needs of the times especially with the handling of military servicemen committing crimes during their furloughs and when not in uniform, and this has become possible because of public clamor added by media bashing of the military treaty, etc. So, it can be done, but not without a great sacrifice.

    I know a lot may officials here even got assassinated when the treaty was undergoing changes to be more favorable to the people of Japan. When I first came here in the late 60’s in fact, I witnessed members of labor and trade unions, student organizations, etc. snakedancing along the streets of Ginza and Kasumigaseki (the seat of government in Tokyo) and being tear-gas bombed by riot squad of the Tokyo Metropolitan Police backed up by policemen from neighboring prefectures (provinces) not really to kill them but control their violent activities, but boy, it surely made me see what Japanese discipline was all about. Kahit na may violence na, maayos pa rin!

    Shops just close their windows, doors and blinds, and the customers stay put inside and do their normal shopping, or sipping of teas. No looting, etc. that is common in the Philippines and elsewhere, including the USA.

    In short, Anna, it is a matter of commitmetn and determination to do what is right for one’s country and people on the part of those who lead the country. Unfortunately, what they have there in the Philippines as leaders are mostly crooks, robbers and thieves!!!

    Just look at Malaysia where there is also corruption but it is done in such a way that there’s a CEILING in terms of bribery: The corruption money is pumped back into Malaysian industries and there is virtually no flight of capital abroad. The money is RE-INVESTED at home!

    You will notice that Malaysia is so far ahead in terms of infrastructures and technology than RP.

    In the Philippines, the problem of corruption is it is so widespread from top to the bottom that it’s pure ANARCHY! The worst part is that the corruption money is taken to foreign banks and not re-invested at home.

    Capital flight is a blood letting in any nation!

    The ceiling in Malaysia hovers from 3 to 5% whereas in PINAS it can go up to more than 100%!!!!

    That is pure suicide because for every penny that you use to corrupt, it is the poor people of the country that pays with their blood – health care and education suffer!

    As I have stated previously, I have handled cases of US servicemen convicted in Japanese court, and I have interpreted for them during investigations likewise in the police. I make lots of money because I am paid both for written and oral interpretation because they usually ask for English translations of the statements written by Japanese investigators in Japanese, and I make sure to translate them into English to make sure that we can get them to sign the confession that they are told even by legal adviser in the US bases to sign them if they are flawless, and actually what they have given as facts.

    The shortest sentence a military serviceman I interpreted for got for drug trafficking was 5 years served in a Japanese prison after which they are deported to the US and dishonorably discharged. Walang patawad.

    This is just to show you, dear friend, the mutual respect between the US and Japan with the US-Japan military agreement being called in fact as “U.S. and Japan Mutual Defense Treaty!” Why then can the Filipinos not have such kind if not better treaty with the Americans? Kundi di nila magawa ang gaya ng na-accomplish ng mga hapon, e bobo na nga ang mga tao sa Pilipinas kasi iyong mga matatalino naubos na at nandoon na sa ibang bansa at wala nang pakialam kung anong mangyari sa Pilipinas. Baka dasal pa nga nila, mawala na sana ang Pilipinas sa mapa para makakuha sila ng asylum sa ibang bansa! Unbelievable!

    I don’t know how much is the wife’s influence on this treaty, but I know for a fact that Filipinos in Tokyo in general do not like the wife, who is called “Kazuka-zuka” as her name is “Kazuko.” I am not sure if he is really ander de saya, but the image of being a henpeck is used more for expediency as the kind of rumor I’m told was talked about when he was UNIDO Chief in Geneva.

    Someone has told me about him charging the UNIDO extra money for his housing that he was able to buy a property there. When questioned about it, I’m told that he reasoned out that the house was owned by his wife, and he was renting the house from her, thus, the amount needed to pay her as rent. I wonder if you have heard of this story since a British journalist in fact wrote about it, and caused Siason to be replaced at UNIDO.

    The wife is very civil to me knowing that I am part Japanese, but that is all my contact with this couple.

  68. There is nothing impossible in Japan, Anna, as long as here are evidences to prove a case, especially when the crime was committed outside of the base, and the 4 horny soldiers did their crime when they were not wearing their uniform, for justice to prevail and be done.

    This is what I understand is the rule when we investigate cases involving these servicemen in Japan. There is a military court to try the US servicemen to discharge them dishonorably, and then turned over to the civilian court in Japan. Investigations of the case is left entirely to the Japanese police when a Japanese or foreign civilian is involved. Otherwise, it is a purely US affair, and the Japanese court is not asked to interfere if the involved parties are all US military personnel and dependents.

    In the case of Nicole, the only hindrance if any is that the crime did not happen in Japan, but still since the horny soldiers are stationed in Japan, the Japanese court’s assistance may be sought for especially with the assistance of concerned groups, legal and civilian, in Japan. For this reason, concerned lawyers handling her case may just as well study all kinds of possibilities. Sabi nga, “If there is a will, there is a way” especially when the purpose is for justice to prevail and give these horny soldiers their lessons in propriety!

    A true story. Happened in America, only in America could this happen. I’m not much of telling a story, but this I thought very funny and if many of you have not heard of this, I would like to share it with you. This couple names are Gloria and Miguel, they owned a beautiful home in San Francisco with a magnificent vegetable garden in the backyard over looking the Golden Gate Bridge. The couple are into fresh vegetable, they love fresh Pilipino vegetable. They’ve a neighbor name Iggy, nobody what kind of business is Iggy in and his wife. Iggy never work, but somehow he’s living the rich and famous envious lifestyle.

    One day, the two neighbors had a falling out about money, that somehow Miguel and Gloria was accused by Iggy of not paying what they owed him for covering up for them. I don’t know what’s that all about, they are very zip lips about it, since they don’t want to sink the ship. Anyway, Iggy was pissed one day, so mad that he called the FBI, San Francisco Police and reported Miguel and Gloria of producing Marijuana Plants in their vegetable garden yard. San Francisco Authority and FBI showed up at Miguel and Gloria’s door, told them that Iggy called them about you two producing illegal Marijuana Plants. Miguel and Gloria told the FBI, that Iggy is just jealous of our Plants since I won’t give him any when I harvest the fruit of my labor. FBI asked Miguel and Gloria, do you admit that you’ve planted and producing marijuana plants. Miguel and Gloria both said, yes sir. They were both happy of their plants. FBI went around the yard with Miguel and Gloria, but they couldn’t find any marijuana plant in the vegetable garden, So, the FBI went next door and fetch Iggy. You called us and told us that Miguel and Gloria planted and producing an illegal plant marijuana. Where are there, asked the FBI. Iggy said to the FBI, there right next your feet. FBI still keep looking can’t see the marjuana plant. So, Iggy getting frustrated touched the plant, said here – and it was instead an Ampalaya. I thought it’s funny.

Former PM Martin committed our troops to move to kandahar from kabul and expecting them to shake hands with talibans, but no, the talibans met them with suicide bombers, and improvised roadside bombs and rockets attacks. That is why PM Paul Martin lasted only a good few months as Prime Minister and lost the majority which Jean Chretien had no trouble winning all of 3 elections. And instead of Public Protest against the war, today we have a “red shirt” to show support to our troops and their mission.     Recently, she came here in Hawaii.     Talking of ODA to Africa, I did a translation of a tape that the JVC now uses for its trainee program. It was a documentary of Japanese ODA to Tanzania that proved successful because the people there are more serious to make things better for themselves. They have even adopted those unique Japanese public toilets with the typical Japanese toilet bowl, and they prove to be popular with the Tanzanians willing to do things according to Japanese specification.

    In the Philippines, I’m told that volunteers are not as keen to serve there because of the “yabang” attitude of most Filipinos kahit walang ibubuga. And to the Japanese volunteers, they love the Tanzanians who show their gratitude by making good use of Japanese aids unlike in the Philippines where most of the aids go only to some people’s private account! Tarantado mamimintas pa!

Ang yabang nga e alam ko namang rejected iyan the first time she tried to get into UP and her father going ballistic against then UP President Cinco.

    The Pandak is actually my contemporary, and her not being able to enter UP was then talk of the town.     ANC, ABS-CBN Global news channel has been continuously airing the devastation brought by typhoon Milenyo especially in Southern Tagalog- Quezon, Laguna and Cavite.

    Most of those affected were unable to save any of their belongings. Kung ano ang suot nila nang nanalanta si Milenyo ay iyon pa rin ang suot nila. Ang mahalaga daw ay buhay sila at ang kanilang pamilya.

    These events are being viewed by Filipinos overseas as subscribers to the ABS-CBN Global transmission. Donations and relief goods will be pouring in again.

    It should go directly to those affected and not to the politicians who will manipulate these goods for their own benefits.

(They should come up with some procedure somehow).I remember those donated blankets directly from Sweden (if am not mistaken) for the victims of the earthquake in Baguio were substituted with local blankets. Golly, halatang-halatang wala namang program at kinukurakot lang ang milyong-milyong yen na ibinibigay sa kanila. Kaya after that, mas active ako sa mga bigayan ng abuloy sa ibang lugar gaya ng ginagawa tungkol sa mga batang nawalan ng mga paa at kamay sa Afghanistan.

    Kaya iyong mga walang alam kung anong terrorism ang ginagawa ni Bush, e puede ba tumahimik na lang. Iyong mga maling policy nitong mga gunggong din na binoboto ng mga kano ang sumisira sa pangalan ng kanilang bansa na ang pagkakawanggawa ay nakikita mong plastic. Iyong sinasabing interview with Bin Laden, in fact, I was able to watch in its entirety when I was asked to translate it into Japanese for a portion of it to be included in some news presentation when the WTC was attacked on 9/11/2001. It was actually the first time I saw an interview of Bin Laden on TV although I had heard about him when he was kicked out of Sudan on US recommendation.     for ones I agree on what you’ve said NPongco…but in fairness with Japan as I have seen in here whare I am working for more than a decade now…the “strings attached” on Japan’s aids are not as MANY as what the Kanutos are “attaching” on every pennies that they dole out to poor countries. At least we can say that Japan’s “intentions” have more “heart” than hte Yankees.

    Now with a new PM for Japan, let’s just hope that our Kababayans in the Land of the Rising Sun can make a better move in “lobbying” to Mr. Abe-san and his government to start “turning off the valve” on the “aids flow” to gloria’s “shit of a government”, so as not to help in giving her the chance to bolster her “war chest(election funds)”.

    With the new Japan PM, let’s hope the country shall now review its policies toward the Philippines under this Arroyo government.

    The US just donated money to the Philippines for the typhoon victims directly through the Philippine Red Cross and not Malacanang. The US has become wiser not to commit the same mistake in that Bolante scandal. Japan should do the same; that is, directly giving to the NGOs and the victims themselves.

    The way I understand the ODA to the Philippines are long overdue aids that still has to be released, and most are ODAs to projects even espoused by NGOs. The 80M yen promised JdV accompanied by the ambassador whose wife is into some kind of NGO likewise (self-interest involved no doubt) are promised ODAs long before the Bansot usurped the presidency from Erap.

    Japan you bet is more interested in helping the Philippines get on its feet so it can pay back its debts to Japan, etc. As condition for the aids, in fact, I am told that the Philippines is obligated to pay a great portion of its long overdue outstanding accounts to Japan. And there are many willing Japanese to work on this aids as a matter of fact like one group that is trying to negotiate for the Philippines to agree to becoming dumpsite for some hazardous industrial waste somewhere in Mindanao, and you know what this means.

    As for what we do in Japan, puede ba tigilan na ang daldal lalo na iyong wala namang ginagawa. At least, over here, we know that what we do will eventually bring results kahit na mabagal, because despite some graft and corruption, at least, over here, we can bring down a corrupt administration unlike in the Philippines where Filipinos can be swayed by propaganda instead of using their heads!

    BTW, are you really the Spartan we know. Mukhang clone ka ha. For one thing, Spartan also has had difficulty getting to this blog. That I am informed.

  168. Tell you what, Nelbar, most stable companies I know in Japan would not want to invest in the Philippines because of the high risk. It is not favoritism! It is more self-preservation.

    Sony for instance back out of a big project there when Ramos was president. When I asked a friend at Sony why, he told me it was just too risky.

    On the other hand, I know a lot many “tarantado” Japanese finding the Philippines a haven for their illegal activities especially when they can always pay whoever there to protect their business interests. So, why blame them for finding the Philippines a good haven for money laundering that unless you and I cooperate will never be discovered for them to be properly investigated and convicted especially in less corrupt courts like the ones we have in Japan?

    In short, yagit na hapon ang mahilig maki-deal sa mga yagit ding pinoy. And they definitely do not represent the whole of Japan, nor the Japanese government for that matter.

    nelbar: i donot know in detail the project you wrote about, but in my experience in handling large projects, it is the owner or in this case the dept of highways who define the project,i.e., limitations in speed and curves etc., and the consultants just produce solutions in accordance to the client’s wish.it could also be that the builders built it not in accordance with the plans or some people changed the plans after the consultants have submitted theirs. for projects where contributing countries has some money, normally they send the best consultants available.the problem you described is so elementary that i doubt if it is the consultant’s mistake.

    Tom, I know what you mean. Napansin ko nga. Yung galit nila kay Gloria napupunta dun sa halos lahat ng lider, kasama si Bush.     Yung sa grammar, hindi ko naman pinupuna lahat, dun lang sa magaling magbatikos sa kapwa nila bloggers dito pero hindi nakikita may uling din sila sa ilong. Pa english-english pa mandin, mali naman ang grammar. Kung unintentional mistake, ok lang yun sa akin, gaya ng nasabi mo – na sa mabilisang pag click ng Submit Comment button, meron pang naiwang typo. Hindi naman tayo perfectionist, at walang perfect writer. Pero yung iba diyang mahilig magpuna banat ng banat, kala mo ang gagaling nila talaga at sila lang ang tama. Pinoy nga naman, kahit saan, payabangan. Kaya dito sa labas ng bansa, yan ang reputation sa atin. Sabi nila: How come Pinoys are smart? But your country remains poor, and your leaders are corrupt.

    I recalled Ms Tordesillas reminded us all a little while ago that her Blog is open to all commentaries and all kinds of opinions and views and thoughts, sans ad hominens and personal insults and personal criticisms; grammar and spelling mistakes, languages deficiencies included. Now, for those who are not satisfied with the sophistication of the participants of this forum, there are thousands of blogs that are highly intellectuals in nature that can make use of your thoughts and views.

    There are some of us commenters of this Blog, that when we submitted our profile to the administrator, we gave our location and the tone and perspective of our comment as to reflect our experience and observation in our land as compared to the political landscape in the Philippines, thus comparison is not unavoidable. Some of us are dual citizens, and we believe that we are bound to still get involve politically and socially with both our countries in whatever way we can.

Aywan kung bakit kailangan pa nating gumamit ng complete sentence, agreement ng subject and predicate, etc. Nasa blogging ka iho, hindi tayo gumagawa na thesis o kaya hindi tayo mga journalist na maging perfect. gumamit ka ng phrase, clause, o kaya isa o dalawang word, Ok na basta nasabi mo ang gusto mo, at nasa nagbabasa na yon. Ang mahalaga may sense yong sinasabi mo at hindi yong puna ka na lang ng puna sa mga ibang blogger, tuloy nawawala ka dahil ang tinitira mo ay yong poster at hindi yong laman ng comment nila. Kung ayaw mo ang comment, di sagutin mo, di ba ganoon lang ang tama? Sabi nga ni kitamokitako, and I quote:

    regarding dun sa mga nangongorek, I have a personal experience with ruffyb…handle yun ni Congressman Ruffy Biazon..we had a good “arguements” in two threads here that he got “obliged” due to his SENSITIVITY to the issues involved…aba’y bigla ba naman akong sabihan na “bawas-bawasan ko daw ang pag-gamit ng quotation marks” sa mga comments ko….hello??? I got my own reason(s) for using and maybe abusing the quotation marks…pero ang bottomline, bigla na lamang iyon ang ipinasok ng “magaling” na mambabatas mula sa Muntinlupa…kaya tinanong ko siya kung nagte-tex ba siya ay hindi ba niya sino-short cut ang mga messages niya? HINDI DAW…kasi daw he makes it a point na turuan even his children ng tamang grammar kahit sa tex messaging…galing nang sagot, siya kasi maraming load sa cellphone niya…hehehe.

    Now, please….sana lang wala nang bangayan dito…nawawala talaga tayong lahat sa issues. If you mind reviewing the history of that “debate” or “argument” you will notice that it’s a response to a mudrack hurled at me, as if they are immaculately clean and knows everything.     hawaiianguy, just got home from work and I came accross your comments asking me where I live. I’m live in scarborough, now part of Toronto and been a resident of Toronto since ’75. I also maintain a residence in Brookside Hill, Cainta and in my Hometown in Alimodian, Iloilo. And since when I took my oath of citizenship,(Canada)I did not renounce my Filipino Citizenship it automatically makes me a dual citizens by virtue that Canada allows multiple citizenships and the Philippines allows its natural born citizens to keep theirs. Just like every natural born Filipino, we can be anywhere, but we can never be anything but Filipinos. Thanks..

    Sniper is the husband who is in New York.
    Florry is the wife who is in Toronto. Sniper went to Toronto yesterday to pick up Florry the wife and used her laptop forgetting to log on to his user’s name. Ellen was informed about this. Is there something wrong if a husband and wife were into the same blog? Anyway Sniper just registered a week ago and if he is not welcome, he can just stop logging in. He don’t have any problem with that.

    Sorry if I “opened up a can of” something. For the record, I don’t think anything is wrong with one person using more than one username in this blog–not for me to decide what’s right since this is Ellen’s blog. In at least one other forum I visited before, the posters’ IP addresses are posted with their username. In that forum there were suspicions of certain people using more than one username altough the IP addresses seem to betray their trickery. But that’s because some who resort to that appear to be maliciously perpetrating the deception in order to “win” blog arguments. Not having even thought of a husband and wife scenario, I could only think of a multiple username situation as the logical explanation for florry’s 9:51 post in apparent response to Ellen’s 6:03. I do remember adb having problems logging in here at one time so she used a different username which she readily identified. Seemed perfectly alright. Thanks for the explanation, anyway. Not that I needed one. End of story for me.
