Warrant of arrest

I have just been informed by Malaya that I have to go to court to post bail because there’s a warrant of arrest issued for me in connection with the libel suit filed by Mike Arroyo.

I was already dropped from the case but Arroyo petitioned that I be re-instated. The judge approved it.

Have to go. Will update you.

  1. Wow! What an injustice. Over in Japan, when a libel suit is filed by a civilian, it is considered a civil suit and not criminal, and the police will have no right to arrest someone being complained about.

    Thus, if this is not abuse of power, what is? Can’t help the profanity but this is the only way I can express disgust at the lousy justice system in the Philippines. God forgive me!

    Ellen, we are behind you. Now, will show you what friends are there for! At least, I know I can count on the Barkada! Will see what we can do to put pressure on this bogus government from this part of the globe.

    These “libel cases” being filed by TABAng LAMIG are just “nuissance cases” the main purpose of which is to try and “harass or gag” the media people critical to all these crooks’shenanigans. The problem is, we all know it’s not “cheap” to fight it in the court, for both the complainant and the respondent….kaya lang ang HAYOP na “LUMBA-LUMBA” na mike arroyo na ito, maraming kuwarta dahil “NAKASAWSAW ANG KAMAY” sa KABANGBYAN. Sarap tusukin ng sanlibong aspili ang TABATSOY na yan, ng makita kung ano talaga ang laman ng katawan ng WALANGHIYA!

    Ingat lang Ma’m Ellen…gusto lang kasi ng HAYOP na iyan ay “ma-picture-an” ka.

    Just a thought, why not all the defendants in libel case filed by the “First Gentleman”, come together and return the favor and file a case of criminal Harassment and we’ll see if there is a Judge who has a set of balls to issue a warrant of Arrest to be served to the ‘Master of the House’.

    Am sorry to hear about the warrant of arrest against Ellen.

    Fatso was getting really crazy with anger because his Junior has been telling him that Ellen is allowing commenters here to call him, the greediest fatso in Malacanang and Mrs Fatso seriously humiliating names – hence, one call to the judge and presto: Warrant of arrest for Ellen!

    Two weekends ago, a mother and daughter friends from Manila visited. When the mom told me that she finally had her marriage annulment (her hubby was philanderer), I was stunned because it took less than 2 years to do it – pretty short!

    Long and short of story is: She admitted pointblank that she bribed the judge with lots and lots and lots of money and trips (plural) to the US (she’s an extremely wealthy Chinese Pinay.)

    Re Ellen: I am not saying that the the judge in Ellen’s case was bribed by Jose Miguel Fatso Pidal Arroyo or his immoral midget of a wife to re-include Ellen in his dastardly complaint – but in the Philippines, I am more and more sceptical of the thing they call JUSTICE… I think our justice system is anything but just. I may be wrong but there you are.

    Anyway, what I do believe in is that Fatso and his midget wife are corrupt to the bone, they are evil and will do anything to hold on to power which is not midget’s by right!

    Justice would be best served if the Filipino people skewered the fatso in his own fat!

    Even when I heard all these kawalanghiyaan even before we left the Philippines in the mid-60’s, I still find myself oftentimes astonished and bewildered that this kind of anomalies still exist in the Philippines, especially in the court. Over here, it will mean a lot of resignation, even suicides for that matter especially with a powerful media backed up by a power press club and the deferation of lawyers.

    I’m glad that at least, despite the corruption (almost nil by Philippine standard as a matter of fact), we have real honest to goodness upright and very proper judges in Japan who will be willing to die to uphold the rule of law. I cannot help in fact to take my hats off to these wonderful men of the law in Japan.

    Lamentably, the kind that we have in Japan are very rarely found in the Philippines where perjury is only a crime in paper and if you are not part of the abusive crowd!!!

    Yup, I’ve heard of the bribery. Imelda is in fact the number briber of these judges I’m told because of mountains of graft and corruption charges against her and family. But the Bansot is probably helping her get out of her court troubles to get the Marcos Loyalists’ support. Pathetic, eh?

    Even my own mother had told me that it’s difficult to trust the Philippine justice system, that even if you are right you might not win a case unless you have the money to bribe someone in judge’s office, etc. or to spend for lawyers’s fees.

    I almost fell off my seat when she told me that a couple of years ago!

    In Europe, justice is blind (Lady Justice is blindfolded, remember?)and will render justice regardless of one’s creed, color, race, wealth, political position, status, etc.

    Not even a question of having the money to pay for or hire lawyers! The Bar Association and State will take care of that if plaintiffs or defendants don’t have the money to pay for lawyer’s services.

    And boy, you try bribing a judge here! You end up in prison right away!

    Am not one to be easily embarassed about Pinas at all BUT Gloria and her husband, their disciples of doom, their band of thieves and cheats and what have you, have turned democracy into a real travesty of sorts that one is almost embarassed about Pinas – it’s become another Zimbabwe in that regard!

    A refugee judge has been charged by the RCMP after a South Korean woman alleged he offered to assist her in her refugee claim in return for sexual favours.
    The woman and her boyfriend secretly videotaped a conversation she had with a man she said was 47-year-old Stevan Ellis, a Toronto-based adjudicator with the Immigration and Refugee Board.

    A copy of the tape was sent to IRB chair Jean-Guy Fleury, who suspended Ellis and forwarded the information to the RCMP.

    Ellis, who has adjudicated 1,279 refugee claims over his tenure, has also been banned from IRB premises.

    The RCMP charged Ellis with breach of trust, knowingly making or issuing a false document or statement, or accepting or agreeing to accept a bribe or other benefit in respect to a refugee application.

    Several weeks ago, Toronto Starreporter Nicholas Keung reported that the woman and her boyfriend, Brad Tripp, met with the Mounties to give a statement on her allegations of sexual misconduct against Ellis and a copy of the videotape that was broadcast by CTV.

    On the tape, Ellis, a lawyer and former Toronto city councillor, told the woman known as Kim: “Let see what I can do. I’m going to work on it. I really want to be friends with you.”
    He allegedly suggested he could approve her refugee claim if she had an affair with him, but warned her not to tell her boyfriend.

    The couple told the Star that a copy of the tape had been mailed to IRB chair Fleury two weeks previous.

    In a statement posted on the IRB website, Fleury said he became aware of “allegations of a serious breach of the member’s code of conduct” and removed Ellis from hearing cases, pending an internal review.

    “The allegations of misconduct in this instance are very serious,” wrote Fleury, who was not available for an interview.
    “Canadians have a right to demand that the IRB’s processes are conducted in an ethnical and fair manner. There is no tolerance for abuse of any kind in this institution.”

    Tripp told the Star that Ellis first met Kim at a refugee hearing in July and subsequently visited the restaurant where she was a waitress five times — but only twice while she was there.

    “The first time, she called and told me the refugee judge was here. I thought that was coincident. But at the second time, he actually asked her out for a coffee to discuss her case,” recalled Tripp, who has been seeing Kim for 15 months. “We talked to some people and thought it was odd and we decided to record it.”

    This is believed to be the first time allegations involving sexual favours between an IRB member and a claimant have occurred since the board’s inception in 1989.

    Ellis, a two-term member of the old Toronto city council, was named to the IRB in October 2000 and renewed in 2002, two years before rules were changed to “professionalize” the board and eliminate patronage appointments of people poorly qualified for the job.

    Refugee lawyers who have dealt with him describe him as professional and knowledgeable, though a “maverick” at times.
    “He’s less formal in his manner than other members and … he’s said he’s been in private practice before and he doesn’t wave the rule book at you,” said one.

    Acceptance rates for South Korean refugee claimants are low — about 11 per cent compared with an overall 40 per cent of the 20,000 annual claims.

    Kim, 25, came to Canada in 2004, claiming she’d been a victim of domestic violence, the grounds most commonly used by South Koreans, said Soh Young Jeong, a reporter with the Korea Times, a Toronto-based community paper.

    lets take it easy for a while. don’t worry ellen will be acquitted. just a quick comment on what appears as the Philippines being the only place where bribing happens.

    Injustice (as perpetuated by the ruling power) knows no race, gender, nationality, religion. It is present anywhere. It is disputable that corruption in Europe and Japan is almost nil (using Phil standards). Why is the Japanese underground still existing?

    The Philippines is the only remaining country in the world that has yet to decriminalize libel.

    So hold your hasty generalizations for the meantime. If Ellen is convicted, then that’s the time you resume your spiel on injustice blah blah etc etc

Kaya nga iyong mga tuta ni Ayup na babae, ang tapang magsalita na hindi matatanggal si Ayup na babae at mga ayup na kasama niya pati na iyong civiliang Fatso.

    Ellen, sabi ng kaibigan kong kanong lawyer dito sa Tokyo, double jeopardy daw dapat, off the hook ka na!!! Bobo din ang nag-issue ng warrant of arrest mo, ‘no? Dapat bumalik iyan sa law school.

    How about a petition for Ellen condemning the incompetent court that does not seem to realize that hers is a case of double jeopardy, and that the Fatso has no right to act like a king?! Ipapakalat namin dito tapos sabay sampa sa UNHRC, EU, at mga organization ng mga periodista around the world.

    The British media won the freedom to publish allegations about public figures free from the threat of libel laws in a landmark House of Lords ruling today.

    In a ground-breaking unanimous judgment, the law lords ruled in favour of a public interest defence that brings English law more into line with the freedom enjoyed by the US media.

    In future, journalists will be free to publish material if they act responsibly and in the public interest and they will not be at risk of libel damages even if relevant allegations later prove to be untrue.

    The law lords, Britain’s top judges, said that the media was entitled to publish defamatory allegations as part of its duty of neutral reporting of news, or if it believed them to be of substance and they raised matters of public interest.

    The ruling came in an appeal by the Wall Street Journal Europe against a High Court decision, backed by the Court of Appeal, that it should pay £40,000 damages to a billionaire Saudi car dealer, Mohammed Jameel, whose family owns Harwell Motors in Oxford.

    The story, published in February 2002, said that bank accounts associated with a number of prominent Saudi citizens, including Mr Jameel’s family and its businesses, had been monitored by Saudi authorities at the request of US authorities to ensure no money was provided intentionally or knowingly to support terrorists.

    Lord Hoffman, giving the lead judgment, said that the article was a perfect example of journalism for which the public interest defence should be available.

    It was for judges to apply the public interest test but that publication easily passed that test, he said. Its thrust was to inform the public that the Saudis were cooperating with the US Treasury and monitoring accounts. “It was a serious contribution in measured tone to a subject of very considerable importance.”

    It could not be proved true because the existence of covert surveillance would be impossible to prove by evidence in open court. But that did not mean it did not happen.

    The newspaper was entitled to report even serious defamations against individuals, so long as they “made a real contribution to the public interest element in the article”.

    The ruling also said that judges, with “leisure and hindsight” should not second-guess editorial decisions made in busy newsrooms.

    The key test was whether a media organisation or newspaper acted fairly and responsibly in gathering and publishing the information, the judges said.

    If the reporter and editor did so, and the information was of public importance, then the fact that it contained relevant but defamatory allegations against prominent people would not permit them to recover libel damages.

    Baroness Hale of Richmond in her judgment said: “We need more such serious journalism in this country and our defamation law should encourage rather than discourage it.”

    (1) had been arraigned, and
    (2) his case had been dismissed, either by settlement or by acquittal
    (3) and the accused is sued again for the same act that was the subject of the dismissed case

    i don’t know if there are other details in ellen’s case. but she won’t lack in defense lawyers willing to volunteer for free. if double jeopardy has attached, her lawyers will discover it

    Yuko, your friend may have not all the info about the case. Ellen case was dropped by the prosecutor and re-instated on the insistence of Mike Arroyo the Complainant. Double Jeopardy is, you can not be prosecuted for the crime that you have been already acquited by the Court after a trial. That simply means that even if OJ Simpson will confess that he murdered his wife and her friend, he could no longer be charged for that crime. Maybe he could go to hell for his sins, but not to jail..

    talagang ma-a-acquit si ellen dahil wala namang basis para mag-prosper ang kaso. isa pa tanga lang ang judge (o nabayaran at tinakot) para i-revive o i-reinstate ang kaso. siguro laging absent si tabang baboy sa klase at binayaran lang ang diploma kaya naka-graduate sa (ka)law (kohan) school.

  35. Let face it, Philippines has a culture of corruption in their government. When someone obtains ultimate power, where there is no checks and balances, they can do whatever the want. We can only bitch about it, and still we won’t find ways of stopping it. And now, Mike, the most powerful person in the Philippines next to no one, tries to kill all criticism of him. This is another nail in our coffin.
    Journalists, such as Ellen, not only have right, but the duty to say what we all are thinking about this man. And hopefully sometime, we can wake up and stop this corrupt culture because of what they wrote.

When there is this kind of libel suit and the one accused is one of the calibre of Ellen, surely the press club will come to her rescue, and you will see a dozen of lawyers tailing them to protect her right to expose the crooks. No one can be forced over here likewise to reveal his/her source as guaranteed by some international rule applicable to journalists.

    And they call the Philippines a democracy. Puwit ni Bansot at ng asawa niyang hambug. Ang bobo naman ng mga ayup na ‘yan!

    Sorry to hear the bad news. It’s my hope that nothing will come out of it, but just a waste of your precious time. Only in the Philippines when the abuse of power has become the tools to harass good citizens of the Philippines, like you Ellen. You’ve nothing to be ashamed of, you’re just exercising your right as a professional journalist. Just keep in mind, your battle cry when you enter the kangaroo court of abusive Mickey Arroyo. Keep your head high, and don’t let him get the best of you, you’re three times better than abusive Mike will ever be, including the illegitimate wife combined together. Never let your guard down, the law is in your side, a lots of people will be praying for you, I for one.

    You’ve become a name recognition among all of us and I’ll never forget such phrase that you instill on us, “making life worth living”.

    Remember what you told me, “justice will prevail”.

    Over here, when the case is presented in court and the case is dropped, it is as good as being acquitted. So by our standard, it is double jeopardy. In another loop, I have actually explained how cases here are indicted in court. Civil cases are treated differently, and the libel suit of the Fatso is more or less in a nature of a civil suit since there is no crime committed, but that the Fatso simply finds the things written about him annoying, especially when his secrets are revealed like the philanderings, etc. that their propagandists even wrote caused shock to the daughter even when we know for a fact that it is impossible that she would not know about the other children by the kabit even before the revelation in media there!!!

    Over here in fact, the spouses do not have power. They are not allowed to meddle in politics or they become the subject of investigative journalism that may lead to their downfall together with the politician spouses. Iyong mga private parties sa Malacanang, kung sa Japan iyan, matagal nang nasibak ang mga squatters diyan.

    Walang patawad ang press dito kapag tumira ng mga kurakot sa gobyerno. Kaya ingat si Pandak na gumawa ng kalokohan dito with her lobby group. Hindi iyan papasa dito.

    Ellen’s lawyer should know what to do even based on some journalistic code. Sampahan na ng kaso ang mga walanghiyang iyan! Sobrang abusado! PATALSIKIN NA, NOW NA!

    This is part of the strategy of a regime gone mad. Obssessed with power, it wants some more, and MORE, and MORE. “Power corrupts, and absolute power corrupts absolutely,” acording to someone. Wannabe dictators always find ways to entrench themselves in power. They demolish everything in their way to achieve that goal. Silencing media and other critics, aligning the judiciary to the thinking of the executive, corrupting the military, dividing men/women of goodwill (e.g.,bribing bishops), tampering with the constitution, etc. are all part of a PATTERN. That is, to destroy all democratic institutions. Glue and her fatsoman are clearly doing that, and they have already succeeded in many ways.

    You are right, Josephs. Culture of corruption is its distinct face (all dictatorial regimes are corrupt). Soon, it will also show up, or mutate, in uglier faces – culture of impunity, and DAMAGED CULTURE.

    Para ano pa yung law firm nila kung hindi magagamit yung mga abogadong “de kampanilya”. Mike is maximizing the services of his lawyers kaya kabila-kabila kung magdemanda -sayang yung binabayad kung walang ginagawa. That’s only one of the Firm’s uses. Pinag-aaralan din nila kung papaano lulusot sa mga kaso nila sa gobyerno, kung anong gagawin nila kapag wala na sila sa puwesto, kung saang govt. depts. maraming pera na makukurakot, atbp.     I wish the case in UK you posted would hold true to form in RP. But UK judges are rational, and over there the judiciary is unmistakably independent. I doubt if it will happen in the Philippines now, knowing that some judges could be brazen because of their dogged loyalty.

    I still think it would be a good idea to turn the table on abusive Mike to keep his time occupy in courts. All, as in unanimous, those being sued by abusive Mike Arroyo should combine their effort and bring on-board the best lawyer(s) available and counter-sue abusive Mike for harassment and intimidation. Also for denying them of their rights as journalists the freedom of the free press. At least, it will give abusive Mike something to think about. That, we no longer be taking shit from you abusive Mickey. Get him busy with libel that he doesn’t the time to enjoy anything, even visiting his San Francisco Mansion or German Strong Vaults.

    Abusive Mickey is not the only one knows how to play the game, the journalists can get in the game.

All establishments in the Waikiki area are closed. But the epicenter of the quake is in another island, have yet to listen to the news about it. It is now 3:39am in Honolulu.

Media doesn’t need Mike and Gloria Arroyo. It’s more like the other way around-Mike and Gloria Arroyo need media. What if these journalists decide to stop writing about the couple-good or bad-who will suffer? Media? Nah, there are more interesting topics to write about other than them, after all Gloria’s recent approval rating is a mere -11.     Generally, it was ok. People got hurt all right, but nobody paid his/her life for it. The epicenter was tracked down on the Big Island (also called “Hawaii”), and reverberated in those islands next to it, including Maui and Oahu (Honolulu is here). It registered 6.7 on a Richter scale (upgraded from 6.6 as reported earlier). The last time Hawaii had a quake of this magnitude was in 1983.

    In the Waikiki area, we felt the tremblor a little past 7:00am yesterday, Oct 15. I guess it was about 4 or 5 on the R-scale. Not much damage, but a few old houses reportedly came close to collapsing. My apartment shook in all directions, a couple of plates flew like projectiles. We had no electricity for 15 hours, and many missed their dinner as all restaurants closed. Ala Moana Center, the largest mall in USA before Bloomington’s Mall of America took the crown, was practically empty. As expected, no tourists could be seen moving around, partly due to the rain, and to their residing in high-rise hotels with no functional elevators.

    No damage inflicted to me and thousand others, except a forcible “puasa” (fasting) last night. And, oh, it also stopped my blogging here yesterday.

    ellen did you receive a copy of the resolution of the prosecutor dropping your name? i was wondering because you were telling us about a court petition of arroyo seeking reinstatement of your name in the charge sheet and yet it seems you were not aware about that petition until you learn of the warrant already issued. if there was a petition, you should have been provided a copy for that to be able to give your comments or opposition -this is very basic requirement of due process.

    anyway, since your position as chief of reporters is more of a nominal position and does not involve any policy decision making process about what should and should not see print in the paper. this could have been highlighted in your counter-affidavit as proof of absence of probable cause to hold you for trial of the crime as charged. but you really have a hundred per cent chance of getting acquittal as i see it.

    on persons liable for libel, the law talks only of the reporter, the editor and publisher because they have a direct hand in the printing, publishing and circulation of the paper where libelous article was printed.

    ellen, some are hinting on double jeopardy. i don’t want you to dwell on that area because you cannot utilize it in your case in anyway. anthony scalia (namesake of a US supreme court justice) has already enumerated the elements in order for double jeopardy to attach. your case does not fall under it. the more substantial elements your lawyer should pound, emphasize and prove is the absence of malice or the total absence of the crime charged against you. then when you have established these and you win your acquittal, get back at mike and give him a dose of his own medicine by slapping him with a multi-million damage suit (malicious prosecution which i lengthily discussed in previous posting).

    get a good sleep and we pray you get over with this very soon.

  78. Fencesiter, the reason I don’t know all the details of this case because it’s the office and the lawyers who are handling this. I didn’t give this too much attention.

    They (Malaya) have the copy of the resolution. They informed me about my having dropped from the case by the fiscal but they also told me “but you are not out of the woods yet because Mike Arroyo petitioned for your and tatad’s reinstatement.”

    I don’t bother kasi with these things. Now maybe i should give it more attention.

    I don’t think the lawyer is invoking “double strategy”. I have not talked with malaya lawyer yet. Arraignment will be on the 25th. I will know by then the details of our legal strategy.

    ellen plus the fact that the alleged libelous news report was published during election time. the court could take judicial notice that politicians during election time have all the fun throwing muds and brimstone against each other. all is fair actually. one should not throw stone if he lives in a glass house or if one does not like to get burn, he should stay out of the kitchen. i have heard and read far worst articles written against contending politicians during election time, but i am not aware anyone of them filing libel suit because of it. the whole country have seen and knows fully well that mike arroyo was very active and highly visible in the campaign during that time. so the allegations against him was only fair. that accussations could not have been made if he stayed behind and be contented to remain in the background. so mike arroyo move one step a little farther with these libel suits because of that newsreport related to his conduct of election campaign for his wife.

    make it sure you have all the papers, resolutions and orders coming from the court on this case. you can share it with me so i can help you with the analysis, research work and some suggestions. i have a very limited law practice and i cannot claim to be good in criminal law but certainly i can give you some suggestions every now and then so you can discuss with relative ease every aspect of your case to your counsel handling the trial in court.

    i wish you all the luck because i know you are in the right side of this legal controversy.

    a little off topic but reloated in some way maybe – the court has junked the libel case and rehab of pacific plan inc…we can alway hope that there will be a judge who will have his conscience back and be afraid for his own judgement day…and will not be influenced by the ugly fatguy
