Making life harder for men of honor

While we rejoice over the Supreme Court’s dismissal of the fake People’s Initiative initiated by Malacañang, the honorable men in uniform who are detained at Fort Bonifacio are being subjected to more punishment.

AFP Chief of Staff Hermogenes Esperon ordered the transfer of six of the 13 Marine officers to Sangley in Cavite. The six are Col. Orlando de Leon, Col. Ariel Querubin, Col.Archie Segumalian, Col. Januario Caringal,Lt. Col.Custodio Parcon, and Lt. Col. Armando Bañez.

Sources said the original order of Esperon, one of the “Hello Garci” generals, was to transfer teh six to Tanay, where Brig. Gen. Danny Lim is and where detention conditions are harsher.

But Flag Officer-in-command Mateo Mayuga intervened. The compromise is Sangley.

    I maintain that the basic human rights of the officers in detention are being flagrantly abused.

    The mere fact that there has been no court martial within 90 days after they were formally arrested is a violation of the elementary military regulations anywhere in the world.

    Esperon is absolutely wrong when he says he has right of life and death over the accused or that their sort is in his hands.

    The Articles of War in any civilized nation rules that the these officers are entitled to a formal military hearing.

    I rreally, absolutely despise Esperon for his pathetic ignorance and immense cowardice. He, who should be looking after and defending the welfare of his officers and men should be the first one practising the terrorist approach on his colleagues in uniform is an utterly despicable shame. Never have I met an officer in star rank (even in the Philippines) with such wanton disregard of strict and clear cut rules in the military.

    I knew and worked with a great number of Philippine military officers from PMA class 54 onward, not even those who have been accused of slimy act of thievery today can match the willfull dictatorial arrogance and military ignorance of this bodyguard turned chief of staff AFP!

    Gloria and her Legions are taunting many civilians and military personnel with their arrogance and through their lust for power. This is a dangerous thing. When pushed against the wall, what will be the result? How will her people react? From the way things are today, the chances for an amicable solution to all this political madness is becoming nill; sonner than later, the Philippines may reach a point where a compromise is no longer part of the solution because people have had it. Eventually, we will ALL come to that point when ENOUGH IS ENOUGH. Period.

    Akala ni Bansot nakalansi na siya. Pero mukhang something is cooking up sa military. Ang nakakatakot itong mga papalit na mga halang ang kaluluwa, mga sundalong kanin labas ang tumbong! Matapang lang kasi sila ang nasa itaas ngayon!

    Martial Law na susunod na ba? Military Junta na a! Kitang-kita naman sa totoo lang kaya nga iyong military PM ng Thailand diyan unang namasyal!

  16. Newspapers carried reports that the reason behind Esperon’s order to order six of the 13 officers to Sangley (where it would be difficult for members of their family and lawyers to visit them) was because of intelligence report that there is a plot to srping them, especially Querubin.

    Navy Spokesman Giovanni Carlo Bacordo,”There are some who are planning to spring them out. I cannot reveal the details. The objective of imposing stricter security measure is to prevent the planned springing them out.”

    But Marine Spokesman Lt. Col. Ariel Caculitan said he was not aware of any Marine officer or soldier involved in the planned rescue.

Filipinos should be able to choose one who will not be there to seek for revenge but do what is right and good for ALL Filipinos regardless of who get hurt in the process.

  18. There is no law that says it is illegal to download the Erap movie since the producers themselves have uploaded their own files on the Internet.

    Besides, the censorship is for public viewing not for home viewing! More so overseas. To ban the downloading of this movie that does not violate the rules of movie censorship is nothing but attempt to suppress basic freedoms by one who is threatened by it because she knows she is fake!

    1. The Risk Averse

    He is the “for compliance type” officer. He doesn’t care about anything happening around him as long as he’s enjoying. He offers no ideas nor action. He is comfort oriented. He is afraid of responsibility. He prefers the status quo. His interesting trait is that he is simply afraid to think and do something.

    Risk averse officers compose about 60% of the officer corps. Its number is growing.

    2. The Impressionist

    He is the ‘all-knowing type’ officer. He is full of ideas. He talks, writes, lies, speculates and gossips a lot. He often complains, murmurs and gripes about almost everything. He is good at discussions but he will never initiate action. He easily succumbs to corruption. Like the Risk Averse, he is irresponsible. He can’t be trusted.

    The impressionists compose about 15% but their number is dwindling because of fear to be branded as “critical”. Some slowly shifted to Risk Averse and some to Expressionist.

    3. The Expressionist

    He is the “YES” man type. He is a blind-deaf-mute loyal dog. He is dangerous because he defies rationality for blind obedience. His motivation is power and money.

    The expressionists compose about 25% but their number is steadily increasing in an alarming rate.

    4. The Patriot

    He thinks and makes things happen. He is both physically and morally courageous. He believes that service to country is the ultimate moral duty of every soldier. His principles cannot be bought nor can be influenced by his superiors. His word is true. He doesn’t speculate and gossip. He makes decisions based on facts. He doesn’t run away from responsibility. He is incorruptible. He protects the helpless and fights for the truth. He is the REAL OFFICER. He is the Officer of the Filipino people.

    They compose about 1% of the officer corps. Their number is quiet undisturbed.

    The AFP leadership tolerates the Risk Averse.

    The AFP leadership consents the Impressionist.

    The AFP leadership loves the Expressionist and desires all officers to become one.

    The AFP leadership disdains the Patriot and campaigns to purge them all.

    There is no bad military organization. Only bad commanders and officers.

    AFP probers seek court martial of coup plotters

    Military investigators have called for the trial before a general court martial of officers linked to the failed plot to overthrow the Arroyo administration in February, a military spokesman yesterday said.

    Armed Forces of the Philippines (AFP)-Public Information Office chief Lt. Col. Bartolome Bacarro, during a press briefing, said the recommendation was contained in a document prepared and submitted by a pre-trial investigation panel, headed by Judge Advocate General Office (Jago) deputy chief Col. Al Perreras, to AFP Chief of Staff Gen. Hermogenes Esperon Jr.

    Quoting from the pre-trial trial investigation report, Bacarro stressed the panel has established strong evidence to indict the renegade officers before a military tribunal.

    “The pre-trial investigation panel concluded that there exist probable cause and recommended trial by general court martial,” he added.

    Thirty-eight Marine and Army officers have been investigated by the panel for violating several provisions of the Articles of War, including attempting to start or create a mutiny; conduct unbe-coming of an officer and a gentleman; and conduct prejudicial to good order and military discipline.

    The officers implicated in the failed coup plot include former Marine commandant Maj. Gen. Renato Miranda, former First Scout Ranger Regiment commander Gen. Danilo Lim, Col. Ariel Querubin and Lt. Col. Custodio Parcon, both recipients of the Medal for Valor.

    “The report is over 200 pages long and the documents submitted for evaluation exceed 1,000 pages. Hence, the report and its recommendations must be carefully and thoroughly studied in the interest of justice and fairness,” he added.

    The AFP official said Esperon has asked his staff judge advocate to immediately give his pre-trial advise in consonance with military regulations.

    Bacarro stressed the AFP chief is bent on resolving the case with dispatch, without compromising fair play.

    “The chief of staff is committed to a speedy disposition of this case,” he added.

    “At the same time, he (Esperon) will ensure that there is no compromise on fairness. General Esperon directed that the pre-trial advise must be submitted without delay. Further developments will be reported promptly,” Bacarro said.

    He, however, did not say how many of the 38 detained officers had been targeted for a court martial.

    The AFP official also declined to confirm if Lim, Miranda and Querubin, key players in the plot, were among the officers proposed to be indicted.

    “We (military) are not going to name the officers right now. We will not even give you numbers because this is still subject to evaluation of the staff judge advocate of the chief of staff,” Bacarro said.

    The Philippine Navy, for its part, also yesterday abandoned earlier plans to transfer the place of the confinement of six senior Marine officers implicated in the failed coup last February from Fort Bonifacio to a detention facility in Cavite.

    The six officers — headed by Querubin and Parcon — were instead moved on Wednesday night to the custodial center of the Philippine Marines Corps inside the Marine headquarters.

    Navy officials refused to elaborate why they changed their mind to transfer the six officers that also include Colonels Januario Caringal and Orlando de Leon and Lt. Colonels Armando Bañez and Acqilles Segumallian — to a jail facility in Fort San Felipe in Cavite City.

    On Wednesday, military officials said that the six officers would be moved from their current detention at the Bonifacio Naval Station (BNS), also inside the Marine headquarters, anytime that day due to a plot to spring them out.

    When asked why the Navy is permanently leaving its plan to transfer the six to Fort San Felipe, Navy spokesman Lt. Cmdr. Giovanni Carlo Bacordo said: “Right now, everything is volatile, nothing is permanent. It’s up to the chief of staff or the Flag-Officer-in-Command.”

    He added the jail facility where the six officers are detained is secured compared to the facility at the BNS which, he said, is designed as a staff house and merely surrounded by an eight-feet fence compared to the Philippine Marines custodial center which “is designed as a detention center, it has a 15 feet perimeter fence and it has a perimeter tower. It is a highly secured facility.”

    Meanwhile, a junior officer from the Philippine Air Force (PAF) also yesterday surrendered to face court martial proceedings against him arising from his going absent without official leave (Awol) and working as a pilot in a commercial airline, although he is still in the active service.

    Capt. Hilario Pine yielded on Wednesday to the commanding officer of the 520th Air Base Wing at the Air Force headquarters in Villamor Air Base, Pasay City, Air Force spokesman Maj. Augusto dela Peña told reporters.

    “He voluntarily submitted himself to military control yesterday,” he said.

    Pine is accused of violating Articles of War 62 (Awol) and 97 (conduct prejudicial to good order and military discipline). He is currently under the custody of the 520th Air Base Wing.

    Pine surrendered shortly after a pre-trial investigation panel recommended his trial before a general court martial, the Air Force spokesman said, adding Pine has gone Awol since September last year. Gina Peralta-Elorde, Conrado Ching, PNA and AFP

    having no basis and clear reason to transfer the alleged coup plotters stopped the navy hierarchy the push through with its exaggerated plan. however, the agony of these gallant officers isn’t over yet since the AFP’s plan to let some face the court martial proceeding without naming those who have to. but still, the question is – was there ever a plotted coup? against who? the ghost president and its evil administration? takot nga sa sariling anino at multo ang multo. may budhi pa ba at takot ang multo?

    This is from an e-mail of a Scout Ranger, abridged to fit the column:

    Jason Laureano Y Aquino was born Jan. 2, 1969 in Maasin, Southern Leyte, the only son of Jaime Aquino a master sergeant of the defunct Philippine Constabulary (PC) and Elena, a midwife.

    M/Sgt. Aquino took optional retirement in 1976 when he was forced by a superior to withdraw a criminal case against one of the cronies of a local politician.

    In April 1987, Jason entered the Philippine Military Academy. Jason was consistently in the Dean’s and Commandant’s Lists. In his senior year, he was brigade commander and class baron.

    In 1991, Aquino graduated from PMA cum laude and received the AFP Chief of Staff Saber Award for leadership.

    Upon graduation from PMA, 2Lt Aquino joined the newly reactivated First Scout Ranger Regiment (FSRR).

    In 1992, 2Lt Aquino was a platoon leader of the 8SRC and served his tour in Samar, Negros, Bicol, Ilocos, Abra, Bulacan, Aurora, and the southern Philippine provinces.

    As platoon leader, 2Lt Aquino observed one enlisted man who received, as his monthly pay, a measly 300 pesos. This was because his debts owed to loan sharks at headquarters were deducted from his pay by the paymaster. When Aquino asked how the soldier and his family could live on so little, the EM replied: “Para sa Bayan na lang, sir.”

    From that moment, Aquino adopted this as his slogan: “Para sa Bayan.” He understood that the plight of an AFP soldier reflected the plight of a typical Filipino citizen. He realized the plight of ordinary soldier did not end with the individual but cascades into his family and the community where he lives. Thus, the sacrifices of the people who built our nation would be for nothing if our leadership did not embrace the same patriotic fervor as our lowly enlisted men.

    When 1Lt Aquino assumed command of the of 7SR Company , his first order was to establish the ultimate mantra of the academy. He imposed on his unit the Honor Code. During this period, 1Lt Aquino served with distinction as a combat officer. The 7SRC had numerous successful combat operations against the NPA, Abu Sayyaf and MILF. He received numerous awards both from the military and civilian sectors, campaign medals and various commendations.

    1Lt Aquino kept contact with the families of his soldiers. He wrote letters assuring them that their sons and husbands were doing well. The families would also write back. This continued flow of correspondence endeared him to his soldiers. In more than twenty encounters in combat when he was the company commander, 7SRC suffered only six casualties. No one was killed.

    In 1996, 1Lt Aquino bagged the Best Company of the year award.

    In 1998, he was promoted to captain. Also in 1998, he was transferred to the Defense Intelligence and Security Group under the Department of National Defense.

    Capt. Aquino returned to the FSRR in 2002 where he served as task group commander of the Task Group Panther (an FSRR ad hoc light battalion) in Jolo. He was promoted to the rank of major in 2003. He came back to Camp Tecson where he assumed the post of Regimental Comptroller for the FSRR. As comptroller, his first order of business was to put a stop to all automatic payments to loan sharks by the regiment’s paymasters.

    On July 24 2003, Maj. Aquino convened an officer’s conference and discussed the reported illegal movement by some members of the regiment that led to the Oakwood incident. Maj. Aquino personally dissuaded junior officers from joining the mutineers. Oakwood occurred without most of those who attended the conference.

    In 2004, Maj. Aquino became the Chief of Operations (G3) of the FSRR. He sought out field assigned battalions to make sure reforms were carried out. He made it possible to standardize SR uniforms. In the whole AFP, it is only in FSRR that the regiment commander down to the last private wear the same patches, unit seal, head gear (even in combat).

    The “Para sa Bayan” slogan caught on in a massive scale within the AFP, especially within the Philippine Army. At this point, it was widely accepted that Maj. Aquino caught the ire of the senior officers. Intelligence officers would report that in some units, personnel would start and finish conversations by greeting each other “Para sa bayan.” Detailed dossiers and background checks were made on Maj. Aquino and his fellow ranger officers.

    Maj. Aquino and fellow officers hid nothing. He would simply shrug off warnings and tell his fellow officers: ‘A thinking subordinate is the natural enemy of an unscrupulous superior. At least we are thinking what’s best for the people. They should be happy about it.”

    In July 2005 during the height of the Garci tape scandal, Maj. Aquino was unceremoniously relieved from his post for “entertaining political thoughts”. He was implicated for distributing unauthorized material within the AFP.

    When the Marine near-mutiny of February 26 2006 unfolded, Major Aquino was declared AWOL while attending to his sick daughter in a hospital. He reported to HPA the following day and was invited to the Intelligence and Security Group (ISG) for a debriefing. He was led directly to a maximum security cell.

    Maj. Aquino was detained and held incommunicado inside the ‘bartolina’ without official charges. He was in isolation with no blanket, no extra clothes, no toiletries, no slippers. His family was not informed and even the army spokesman denied his whereabouts. His family came to know about his situation by word of mouth. They were only allowed regular visits after a month – for only one hour every weekend after securing clearance from the commanding general for each visit. Maj. Aquino was not allowed to see a lawyer or get legal assistance. He was always blindfolded and handcuffed every time his family visited him.

    On July 11, 2006 after four months in bartolina, Maj. Aquino was finally transferred to Camp Capinpin Army Maximum Security Stockade along with his former commander, Brig. Gen. Danilo Lim. General Lim’s transfer was announced to the press but Maj. Aquino’s transfer was done in great secrecy. This is how the military treats those who would try to institute reforms in the Armed Services.

    Is Mr Paredes sure about this? This is highly irregular.

    If this is true, the officers who are responsible for this sort of treatment on the person of another officer are guilty of human rights abuse.

    There is nothing in the Articles of War that mandate a military command to treat its officers in that way particularly if there have been no formal charges lodged against them. If a formal charge has been lodged, the accused is entitled to the counsel of a lawyer; moreover, to ensure fair justice, higher command should recommend court martial proceedings to give the accused and the accusers their day in court.

    The military has very strict rules and regulations, they are usually clear and with the best will in the world, there should be no room for misinterpretation. A court martial proceeding is not exactly negative – it is a venue much like a civilian court for the protagonists to air their sides.

    In the past, I suggested that the Articles of War should be posted in every military barrack, command posts and on naval vessels for all members of the military to be aware of.

    In the UK, they are posted on Her Majesty’s Royal Navy vessels. Up until a few years ago, the Articles of War were read by the vessel commander before leaving port on a mission.

    There will always be misfits in the military but there are rules and regulations governing the treatment of misfits – military law is harsh but that law does not give the current commanders of the AFP the right to mistreat their “perceived enemies” from within their ranks.

    I can only say that if this story is true, AI should come in.
    Unlike you,I am not an expert on military issues (mine is labor), but this story really bothers me. Perhaps, after many years of living in Denmark, shocked to death ako sa balitang ito.

I do not know much about military procedures in the Philippines because the truth is our military in Japan does not follow any military procedure that is not in accordance with the civil and criminal laws of Japan considering the fact that in principle, Japan is not supposed to have a military organization, but military or not, common sense dictates that these incarcerations of soldiers in the Philippines is a breach of law.

    Clearly these are violations of international rules of law and conventions on human rights as this blindfolding this soldier when his family visits him. It is illegal as prescribed by some international rules of law that all countries signatories to such conventions should mandatorily abide by.

    These abuses should be properly documented and reported to the UNCHR by all means, and Filipinos should ask for a fact finding mission to the Philippines to investigate on these reports so that proper interrnational sanctions can be imposed if the bogus president will continue to defy the rule of law by being the law herself.

    The bogus president may think that she has nothing to worry about especially when she succeeds in replacing these soldiers that she has been ordering removed or incarcerated with the planned new recruits that I have been told by someone in position in the government hoping that I can help expose it, but she actually should not be too sure.

    The GREENBASE Expose:

    On the early morning of July 27, 2003, a group of soldiers occupied the Oakwood Hotel in Makati to conduct protest actions against the Gloria Macapagal Arroyo Administration. Among the grievances they voiced out was GMA’s alleged responsibility for the Davao bombing incidents. In the investigations that followed, the soldiers admitted that the ultimate sources of their information are the so-called Greenbase Documents. How true are these documents? What exactly is OPLAN GREENBASE all about? Indeed, what did these documents contain that were serious enough to drive these soldiers to rise against their very own Commander-in-Chief? Unfortunately, the answers to these questions never came as the investigations focused more on the peripheral issues such as armbands and on whether the soldiers’ actions were spontaneous or not. Eventually, the Greenbase issue was buried and forgotten. The Greenbase Documents validate the fear that state-sponsored terrorism had become a policy option in the GMA Administration. The Davao bombings and other bombings in Mindanao, which left hundreds of innocent civilians dead, are mass murders and works of evil minds and heartless individuals. At the very least, these horrible incidents shattered all the pretensions of democracy under the GMA Administration and effectively removed its very reason for existence.

    • There will be an independent investigation on the extent of corruption in the AFP.

    anna, that was our guiding principle that won the trust of rebel commanders and their followers during my assignment with the first infantry division. before we left jolo, sulu in june 1986 for re-deployment to lanao del sur and lanao del norte, there had been a good relationship between the men-in-uniform and the civilian populace in the area. as i have said in another thread, as long as you respect their culture, beliefs and tradition, the natives will be the one to protect you from anyone who would wish to do you any harm. we always conduct dialogues with the community leaders for them to disseminate whatever program the army command wish to implement in their respective areas to include civic action, information drive and peace campaign. these i think are not observed and implemented now-a-days.

    Arthur Wellesley who later became Duke of Wellington made it the doctrine of his army in India that they should respect culture and traditions while he was in command there. It was during his tenure in India when Britain had its most successful period.

    The writings of Wellesley on an army’s duty to respect the culture and traditions of a colony still exist. In a post somewhere, I mentioned this strategy that worked. Bushs’ troops in Iraq don’t know this seemingly and therefore fail in colossal fashion.

    Wellesley, the victor in the Battle of Waterloo, was also a general who considered war as the ultimate resort, that is when diplomatic or economic means failed. He always thought that the lives of his troops mattered as much as his life and didn’t go around sending his troops in a war if he believed that the means to settle had not been exhausted. Foremost, he prepared the logistics for war like no other general, not leaving anything to chance as well as preparations for peace after the war would have been prepared as meticulously as he had prepared his troops and their logistics – that’s why he was an extremely successful general and one of the most effective prime minister Great Britain ever had.

    One of the current warriors today who comes close to the way the Duke of Wellington did things is General James Jones, SACEUR (Commander, Supreme Allied Europe) who is brilliant at what he is doing in Afghanistan.

    It is good to know that we have some officers of their caliber in the AFP.

  45. Alam mo, Anna, our armed forces here is called “Japan Self Defense Force,” but the “self-defense” means self-defense from outside aggression, not to kill fellow Japanese.

    In principle, even that is not permitted by our Constitution that states that Japan should never rearm, the main reason in fact why the US was allowed to put military installations here especially with the Korean War when Japan was under US occupation in the late 40’s and early 50’s!

    But then, of course, owning guns in Japan is strictly prohibited. It is a criminal offense to own one, not even for hunting purposes!!!
