Just got a text from Joey Salgado, with Makati Mayor Jejomar Binay’s media office:

Sandiganbayan third division junked graft case against Mayor Binay for lack of probable cause.

Case filed by Bobby Brillante was in connection with the purchase of office furniture and partitions.

    Binay should not be sure, though. Evil people will still devise some evil ways to harm him. He should be on guard all the time. There are only few bona fide opposition leaders like Binay today. We need people like him very badly. So, let’s make sure we keep them healthy and alive.

    The then Filipino President Corazon Aquino appointed Jejomar Cabauatan Binay officer-in-charge of the then Municipality of Makati on 27 February 1986. He was the first local official to be appointed after the 1986 EDSA Revolution ended the Marcos dictatorship. He has been re-elected several times by his constituents, and continues to introduce innovations in local government in the Philippines.

    Jojo Binay was born on 11 November 1942. He was orphaned at an early age and had to take on odd jobs to support his schooling. Despite financial constraints, he gained a BSc in political science and was later awarded a bachelor’s degree in law at the University of the Philippines (UP).

    He passed his bar exams in 1960, but chose instead to teach and to provide free legal assistance to the poor. For his political convictions, Mr Binay was jailed for several months by the martial law regime of the time. After his release, he continued his work both as a human rights lawyer and as an active participant in the pro-democracy movement.

    Jojo Binay was named officer-in-charge of the municipality of Makati immediately after the February 1986 Revolution. He found a bankrupt municipal government and quickly took drastic yet sensible steps to put Makati’s financial house in order. As a result, his administration posted savings at the end of 1986. The local government has not had a deficit since then.

    Nothing happened about those charges against Davide. According to a former staff of mine who got another job at SC when she passed the Bar Exam, under Davide…their lips were totally sealed. Davide was beyond charges, kapit-tuko kay Glue or the other way around?

    Davide also had lavishly furnished mansion house in Baguio, the consulgeneral in New York had $10,000/mo condo, and same thing with the congen in Los Angeles. Compared to these extravaganzas, Binay’s furnitures are mere straws in the wind. So where is the logic in the case against Binay?

  13. I will not rule out that there could be overpricing in the construction of the Makati City Hall. But I was impressed with the building. It really represents Makati as a financial center. It’s not your usual Filipino idea of a city hall.

    It’s 22 (or 23?) floors. There are I think 6 or 7 elevators. The ground lobby is marbled. All the furniture match the modernity of the building. No monobloc chairs or tables. The furniture I saw in the board room are tastefully designed.

    And it’s very well maintained. When we went there durng the standoff in Makati, the comfort rooms are kept clean and shiny despite the fact that there were thousands of visitors going in and out of the premises.

    No doubt the building project cost a lot of money. With P8 billion in yearly revenue, I think the people of Makati deserves it.

    Now, on the alleged overpricing part, that’s up for Brillante to prove.

    This is how it should be done. When you have an accusation, you go to the courts. If you can prove it, then the accused should be punished. If the accuser is proven wrong, he should be the one that should be punished (cost of litigation?, what else?).

    I believe it should be the same with libel cases. When the accusser (abuser) is proven wrong, he/she should be punished too!

    In the case of the libel suits filed by the Fatso against journalists, most likely the Fatso will end up as the sorry lot especially with this rumor of falling out, and the “labanan ng mga tuso.” Who knows? The evil couple must be fidgetting in China by now, and wish it would be over so that they can fly straight SFO or remain in Beijing that must be the reason why the Bansot was desperate to impress the Chinese that her husband is a Chinese descendant.

    Parang iyong mga Nikkeijin na nagdadagsaan ngayon sa Japan even when the kind of jobs offered to them were jobs that I would not even want to take when I first came here. I just felt that I should “return” to the land of my ancestors.

    I didn’t even need to make emphasis then that I was a Nikkeijin unlike the Bansot who tried so hard to impress her Chinese hosts that they should welcome “one of China’s great son like the Philippine national hero, Rizal!” Ang tindi ng tupak sa ulo sa totoo lang.

    (this is my reply to another post in another thread. i think its worth reproducing it here, as my reply to your post)

    Some thoughts on Binay:

    If GMA is Ate Glue, Binay is Kuya Glue. He’s no different from the original kapit-sa-puwesto. Wait, he should be the original kapit-sa-puwesto pala. He’s been there 20 years, not wanting to let go. Talo pa niya si Marcos.

    He’s been ruling Makati since 1986 (his wife’s term is counted). What happened to Makati since then? Still full of squatters! The squatters of 1986 are still squatters now!

    His supporters are content with the dole-outs he’s giving! Free education? Free healthcare at Makati Med? Free movies for seniors? With the revenue Makati is earning, all of these are expected! They are not “over and above” but mere average performace. Binay can’t brag over his “dole-outs.” If a fourth-class municipality was able to duplicate Binay’s dole-outs, then that’s commendable! Because only Makati can afford the dole-outs Binay is giving! WALA TALAGA SIYANG IPAGMAMALAKI.

    I’m reminded of the anti-Cha Cha rally of Cory vs. FVR’s attempt to extend his term. Cory said to FVR – “You said you improved the economy? Fine. You’re just doing your job”

    Whatever progress you see in the business district and the mall areas – Glorietta/SM and Rockwell – are due to the efforts of private individuals. Binay has nothing to do with it.

    He is no different from the other politicians – he keeps his supporters poor, making them dependent on him, not really empowering them. These poor squatters do not know their real situation – Binay is preventing them from reaching their full potential, from becoming middle-class!

    If Binay is really a servant of the poor, then Makati should have been squatter-free now. He’s already 20 years in power! 20 years not enough for a city? What then can we expect from a President’s 6 years?

    How come Marikina, not Makati, is deemed the mini-Singapore? Kaya galit si Binay kay Bayani Fernando. Without the revenues of a Makati, Fernando has transformed Marikina into a model city.

    Siyempre, kayang kaya niyang bilhin ang loyalty ng mga CIty Hall employees. Kung wala na si Binay, wala na rin ang ganansya nila. Kaya ganun na lang ang pagsuporta ng mga taga-City Hall kay Binay. Sabagay, kung maambunan ka nga naman, sa hirap ng buhay ngayon.

    My use of “expected” pertains to the dole-outs. Kung baga sa golf, par lang yun.

    I’m not a Makati voter. But he has to go. Any mayor can give the dole-outs. But Makati needs a mayor that really emancipates the squatters, making them middle-class. That really brings Makati to the next level. Sadly, in 20 years, Binay miserably failed to do that.

    What? The business and shopping districts expanded? Thanks to the Zobels, Ayalas, Sys, Lopezes et al. Binay does not deserve credit for those.

    Binay is afraid because if he empowers the squatters, making them middle-class, he won’t be voted into office. That’s why it is in his best interest to keep them squatters, dependent on him.

    Binay is a Robin Hood. But Robin Hood cannot usher in progress and development. Only dependency. Its counter-productive. (This Robin Hood description is already a generous description of Binay)

    Natatandaan ko nang umalis kami sa Pilipinas, isa sa proyekto ni Marcos at Imelda ay pagandahin ang Maynila. Gusto nilang paalisin ang mga squatters sa Bangkusay. Nagpatayo ng murang tenement sa Sta. Ana. Forgot the name. Aba ang mga loko nagreklamo pa kasi ayaw nilang magbayad ng upa. Kung sabagay dapat tinutulungan nga naman nilang magkaroon ng mga trabaho para makabayad ng upa. Otherwise, magbigay sila ng pera para pambayad ng rent gaya ng ginagawa sa America ng Housing Authority doon. Dito naman sa Japan, medyo may hiya ang mga hapon. Hindi sanay sa panay libre di tulad ng mga pilipino! May trabaho pero ayaw pa rin magbayad ng obligasyon! Hay!

    Ang squatting problem ay napakalaking problema sa Metro Manila na kailangang gamutin. Pero hindi pwedeng isisi ito sa iisang Mayor kagaya ng ginagawa ni Anthony Scalia.

    Whoever keeps squatters in their state, and prevents them from becoming middle class, ay dapat nang paalisin. Yan ang problema kina Binay et al. Ginagamit lang talaga nila ang mga squatters. Ayaw nilang magkalaman ang mga tiyan at baka magkaroon pa ng pagkakataong mag-isip at maging kritikal.

    Ang problema, hindi ako mayor eh. Since you asked, here it is – I’d give low-cost mass housing to all squatters in Makati, in cooperation with Gawad Kalinga. Complete with livelihood means. In cooperation with other NGOs, I’d help set up cooperatives for the squatters. In cooperation with PAG-IBIG baka puwedeng mag-develop ng low-cost subdivisions. I’d give scholarships for those wanting to study law, medicine or dentistry. I’d give tax rebates to Makati businesses hiring workers coming from squatters.

    The goal here – elevate the squatters to be middle class people. I will have succeeded if the number of people dependent on yellow cards decreased significantly, because most can afford to have medical attention on their own (kahit through HMO lang like Medicard)

    I’d risk not being reelected. Nagkalaman na ang tiyan nila, maaari na silang mag-isip critically. Nasa kanila na yun kung gusto pa nila akong iboto uli, despite what I’ve done.

    Belmonte assumed power in 2001. So far he served 6 years. My goodness, Binay has been there 20 years! Baka yung 6 years ni Belmonte puwede pang matanggap, at bigyan pa siya ng isa pang term. Pero si Binay? 6 years compared to 20 years?

    Saka ang pinag-uusapan natin dito ay si Binay, hindi si Belmonte. Kung igigiit mo pa si Belmonte, e lalong madidiin si Binay, dahil may nagawa naman si Belmonte in 6 years. Give Belmonte 20 years and for sure he’d surpass the accomplishments of Binay. (baka nga yung 6 years ni Belmonte ay may mas nagawa pa siya kaysa 20 years ni Binay)

    Si Lee Kuan Yew, in 20 years, nagawang almost nil ang poverty sa Singapore. Eh sa Makati?

    Kung meron dapat “patalsikin na now na” ay si Binay, dahil he is keeping the squatters poor! The squatters don’t know any better, masaya na sila sa mga crumbs na binibigay ni Binay.

    Valenzuela

    Sino ba sa kanila ang mga balik-mayor (after three straight terms, let a family member be mayor, then returned for another term/s? In short, sino ba sa kanila have been mayor for at least 9 years?

    Remember, I’d like to give a chance to the third-termers to solve the problem. Pero si Binay, 20 years?!? Mantakin mo, 20 years?!

    Si Binay, sa kanyang 20 years – “subok ng subok, squatters pa rin!”

    Ang point ko ay simple lang – 20 years ay napakatagal nang panahon para ma-solve ang squatters sa isang maliit na siyudad. Pero napaka-inutil naman kung 20 years na, di pa rin ma-solve!

    I disagree. They just promote dependency. You’re an example of an empowered ex-squatter resident. No longer dependent on dole-outs. If all Makati squatters become like you – empowered, self-reliant – then Makati will really become the showcase city of the Philippines!

    (Before I am misinterpreted, dole-outs have their place. But its different if they are used to enhance dependence)

    You are correct to say that “Binay is a Robin Hood.” He was merely a product of what the likes of “Zobels, Ayalas, Sys, Lopezes et al” were not able to do for the poor of Makati. I beg to disagree with your comment that “Binay does not deserve credit…” He does deserve credit for making the lives of the poor better. Whether he is empowering “the squatters, making them middle-class…” He showed results. What did GLORIA and her Legions do aside from CHEATING, LYING and STEALING?

    Masyado nang api ang mga squatters, inaapi pa ng mga linyang ito! Pinalalabas mo ba na walang sariling pag-iisip ang mga magulang sa Makati? Just asking. A lot of “smokes and screens” use for who and what.

    From this comment of yours AS, mukhang expert ka sa local politics and tradpol (or nasa likod ng tradpol).

    Walang magagawa ang mga squatters (of course ang iba sa kanila ay mga nagsasamantala lang), pero ang mga talagang walang-wala ay hindi masisisi kung tumanggap ng mga regalo galing kaninuman. Economics of empty stomachs. Please, have a little compassion for these people, huwag mo silang gamitin just to prove your point na hindi ko rin nakita ang konek.

    Because of poverty,people flock to urban areas to find jobs. They don’t have money for decent housing, so they squat.

    Why is there massive poverty? We go back to government mismanagement and corruption. On top of that, there is no consistent population program.

    To solve the problem of squatting in Metro Manila, the government has to take it in a national, wholistic perspective.

    Squatting has actually become worse thru the years largely because of the influx of people from the provinces that’s why we have the news a few days ago where people are now leaving in the cemeteries!

    These people (just like me before) would go to a better place if there’s something available that could only afford. It doesn’t matter what city it is.

    Anthony’s ideas to solve the problem are very good ideas but as he himself said, they remain as ideas. Implementation of these ideas (and other ideas being implemented now) is a totally different issue altogether. That’s where Ellen is so right, it needs to be solved in a national perspective. You can remember the government’s “Balik Probinsiya” program which I think is good, but look what’s happening to it now. Those who got some money to go back to the provinces may have been back to Manila again! The other program I can remember was the devolution of government agencies and moving some departments to othe cities outside of Metro Manila, what happened to it?

    In conclusion, Anthony Scalia’s idea of blaming Binay because he’s been there for 20 years and squatting is still a problem, is all bull! Pati ang kanyang conclusion na the mayor is holding back his constituents is harebrained!

  48. You bet, Jon, hindi na ma-solve ang squatting problem na iyan dahil wala namang ginagawa para kumita ng tama ng mga pilipino na nasasanay naman sa panay na lang awa at libre. May mga pilipinong nahuhuli dito lalo na tuwing summer na natutulog sa mga park. Pero salamat na lang may Winter dito kaya napipilitan silang humanap na mainit na lugar na matutulugan pero may mga tao talagang makapal.

    May isang pilipino nga ngayon na humihingi ng tulong sa akin kung puede doon muna siya sa office ko makituloy. Sabi ko, “Sorry, hindi puede” kasi baka mawalan pa ako ng gamit sa office ko. Malaking lalaki at puedeng magnakaw!

    Susmaryosep naman talaga. Iyong mga babae, at least maraming shelter dito pero may limit ang panunuluyan. Mahirap ang utak na ganyan na palaging nagpapalibre at kung makakalusot! Hindi ko iyan maintindihan sa totoo lang!

    Speaking of those who live at the cemetery, talaga naman nawala na ang takot ng mga pilipino. Doon sa libingan na katabi ng sa family plot namin, may mga nakatira na nga. Believe you me, Jon, when my eldest brother died, and I came late to the burial, nakita ko ang ataul ng kuya ko na nakalapag, at iyong kuya ko pinasok sa nitso na walang sapin. Buti na lang hindi nila hinubaran. Sabi sa akin ng sepultorero, “Ma’m amin na lang po ang ataul, Christmas na lang po!” New Year’s Eve kasi namatay ang kuya ko.     Ystakei, those who try hard and find a way out of terrible conditions has a fighting chance to achieve their goals. But the ones you mentioned na nakukontento na lang sa limos o tulong ay talagang halos imposible nang makaangat, maliban na lang siguro kung makatsamba (kung ano man iyon)!

    One sign that the Philippine economy is not really doing well is that there are so many Filipinos who are really trying very hard but there are still no opportunities to succeed. In my personal experience, even when I was already earning “high” compared to the minimum wage, I could only afford a boarding house in the squatters area in one of the Rembo’s of Makati. It was still hand to mouth existence, bawal magkasakit, at makakahawak lang ng malaki-laking pera kapag nakatanggap ng 13th o kung minsa 14th month pay which lasts about 1 month then back to hand to mouth again!

    I’m sure there are many more like me who’s only chance to move a rung higher in society is to work as an OFW. You see, if I move back to Manila and do the same thing I’m doing right now, I would be back to my previous situation! Talaga naman. That’s why nobody should look down on (as Anthony Scalia) is doing those who are living at the squatter areas, as long as they work hard and continue to look for economic emancipation.

    Sana ang All Souls Day ay may espesyal na paggunita sa loob mismo ng Libingan ng mga Bayani.

     

    Noon mga nakaraang taon, pumupunta ako ng sementaryo para sa mga pumanaw na mga kamag-anak ko tuwing A-dos na ng Nobyembre. Oh minsan naman kaya kapag natapat ng linggo(Sunday) bago ang araw ng mga patay. Para sa pag-iwas ng maraming tao.

     
    Naobserbahan ko ito noong 80’s, sa tuwing napapabalitang pumupunta raw si FPJ sa puntod ng tatay nya sa North Cemetery. Hindi sya pumupunta ng mismong a-Uno, … kahit anong araw basta libre sya.

    I said the ideas you mentioned are good. How are you going to implement it though? Sabi mo nga they’re just ideas, and I agree with that because implementation of good ideas and making them work as planned usually do not come together. That is why the achievements of Binay and Bayani Fernando are very outstanding because they’re achieved even with the almost impossible to manage environment that Metro Manila is.

    My point is, if you were mayor of Makati and you tried to implement the good ideas that you presented here, you still have almost nil chances in implementing them! Unless of course you have the political will and strength of a Binay or a Fernando.
