Detention takes its toll

In the last hearing of the court martial panel trying 28 military officers for their alleged plan to withdraw support from the bogus presidency of Gloria Arroyo in February last year, notably absent were Col. Januario Caringal and Lt. Col. Custodio Parcon, both of the Philippine Marines.

The two officers were sick. Caringal , former deputy commander of the 2nd Marine Brigade, has been at the AFP Philippines Medical Center (former V. Luna Hospital) in Quezon City from his detention quarters in Fort San Felipe in Cavite since November . He was suffering from acute hepatitis B and hypertension.

nov1316.JPGParcon, a medal of valor awardee, is detained at Fort San Felipe in Cavite. In the Jan. 18 hearing, he was represented by his counsel, Alex Lacson, who was his classmate at the Philippine Military Academy.

Col. Ariel Querubin, another medal of valor awardee, almost didn’t make it to the hearing in Camp Capinpin in Tanay too. A few days before last Christmas, Querubin was confined at the Cavite Naval Hospital due to high cholesterol, high blood pressure, fluctuating sugar levels, and high uric acid.

He made it to the hearing in Tanay but he was brought back to the hospital that same day because his malaria, caught in the jungles of Palawan and Sulu many years ago, recurred.

lim-and-querubin.JPGThese officers are a hardy lot. But soldiery subjects the body to terrible stress. Querubin, for example, had underwent operations on his liver, pancreas, intestines and many other parts of his head and body where he had bullet wounds.

Querubin’s wife, Maria Flor, had written Vice Admiral Rogelio Calunsag, Philippine Navy’s Flag Officer-in-Command three times to do something with the conditions of the officers who have stood for truth and justice.

A portion of Mrs. Querubin’s letter to Calunsag reads,” Although the hospital in Cavite is clean and the doctors, nurses, and staff are concerned, kind and caring, my husband’s condition demands that he be placed under the care of specialists. CNH does not have the specialist for Ariel’s case and complete medical facilities in case of emergency. Blood tests on Ariel were done last Monday and he even had to pay for one test that has to be done outside of CNH Laboratory.

“Our family doctor recommends that my husband has to immediately undergo a series of sessions to completely eradicate malaria from his system and a thorough medical check up under the care of specialists to ascertain that nothing will happen to him while he is enduring the highly stressful conditions of his incarceration at Fort San Felipe.

“In fact, the Navy Surgeon General in her letter to the FOIC dated November 29, 2006, had recommended his (and the other officers’) transfer to the Marine Camp in Fort Bonifacio because of its accessibility to the V Luna Medical Center due to the expected worsening medical conditions of the marine detainees.

“As a Medal of Valor awardee, the law stipulates that he shall be entitled to free medical services and consultations anywhere in the country even from private hospitals and clinics. I am sure the necessary security preparations needed can be worked out by your staff at the soonest time possible.”

Calunsag has never bothered to answer Mrs. Querubin’s letters.

In the Jan. 18 court martial hearing, which centered on the secret pre-trial investigation report that recommended the dismissal of mutiny charges against the accused officers, Lacson, appealed for justice reminding the panel that the accused are “their brothers in uniform.”

“Who will protect them? he asked.

The same question should be directed to Vice Admiral Calunsag.

    Nothing good we can expect from this dark regime of the false president. If something wrong happens to just one of these great military guys, Glueria and Assperon should better hide their fat asses fast!

    My info is that Gen Lim was brought to Makati Med about two weeks ago. He was to undergo an MRI. A bullet shrapnel is still buried in his back which he acquired during a combat encounter long time ago.

    Contrary to the doctor’s advice (he was supposed to be confined), Gen Lim was immediately brought back to Tanay upon orders from GHQ.
    He was never allowed to see a specialist. Gen Lim is still suffering from the old wounds (he got a Gold Cross Medal for this) compounded by the brutality of speron!

    WHY IS IT that nobody seems to be interested in the recent and Previous junkets of the alleged fake president ?

    May I post again some facts on overseas trips of Gloria that I am challenging Malacanang to check its veracity using their website.

    At a glance our alleged fake President seemed to have achieve the distinction of being the most traveled President. In her first year she went out of the country eight times in four months, (WOW two trips per month in those 4 months) visiting a total of 10 countries in 39 days. Her second year travel involved 10 countries (Japan, twice) in 26 days. Her third year covered 15 countries in 41 days. During her fourth year, an election year (busy kasi sa phone with Garci) , Mrs. Arroyo visited only 5 countries all in Asia in 10 days. During her fifth year (panay ang sangga sa impeachment) she visited still fewer countries, five countries in 15 days.

    In 2006 , Mrs. Arroyo visited 12 countries in 33 days. In 2007 (isa pa lang, pero simula na) ), Davos, Switzerland in 5 days. In all her past travels Mrs. Arroyo within a six-year period had visited 28 countries in 169 days. In other words, that is more than five and half months travel (kalahating taon) in a six-year period. She has also made 58 sorties to these 28 countries since she visited 15 countries more than once.

    I myself was hoping for the same as you, but if you remember a few weeks ago YesArms made a bold statement that they had three teams of men who were experienced as jungle experts that were traking Garci to bring him into custody alive! Nothings happened yet just a lot of hot air talk.

  10. All the more reason now that OFWs who have relatives in the Philippines voting this election not to vote for their representatives who are pro-administration. They should be convinced to vote only for the Opposition or anyone against the administration. Pichay, Nograles, Lagman, et al should be removed from the Philippine Congress. The trapos should also be kicked out. Time for a big change in Philippine politics.

    The Filipinos should rally en masse, with or without the support of their churches (ours definitely will not be in any political rallies even when members of our church join the protests because of our church policy of respecting the law on the separation of church and state) against these politicians, and more against the political appointees in the court, police and military. By all means, they should demand the removal of the creep acting as Secretary of In-Justiis, and the crony acting as Ombudswoman. With these creeps, justice cannot work and truth cannot prevail. They should be kicked out.

    Will submit the names of the two gallant officers to our temple when it opens, and pray for them there so they can stay fighting there for their pride, honor and dignity. Meanwhile, Congressmen and Senators still with some sense of “hiya” to please demand for better treatment of these soldiers.

    May God give them the spirit to have courage and fight all these oppressions, too. Sipain na si Esperon at ang mga katulad niyang animal sa AFP, pati na ang patron nilang mga baboy sa Malacanang!

    I advise the wives of these officers to write Amnesty International and the UNCHR for the gross inhumanities their husbands suffer from these crooks heading the Philippine military.

    Ano nga ba ang ginagawa ng mga sundalong mayayari pa ng mga ungas na ito? PATALSIKIN NA, NOW NA! ANG HINA NAMAN!

They have to make sure, too, that the medical doctors even in private hospitals are not under threat for not following Malacanang order to inject medicines into the bodies of these soldiers to make them more submissive to the wiles and whims of the ambitious crook EDSA 2 placed at the palace by the murky river.

    I was never a supporter of these EDSAs as a matter of fact. I’d rather Filipinos learn to vote more wisely and maturely. Hindi na puede ang boto for popularity but for platforms that should be well scrutinized.

    At least, I know Akbayan and Bayan Muna voters are wiser. Kaya nga sila pinapapatay or their representatives charged with this and that false accusations. I know for a fact that none of the reps of the Bayan Muna and other partylists connected with them have enriched themselves.

    I would support the lawyers of these soldiers if I were you in order to help them be more aggressive in pursuing their cases against this oppressive government and/or oppressive AFP heirarchy that should be toppled down as a matter of fact.

    I don’t think this is a time to follow any military protocol. What should be done is a passage of a law to consider this present AFP as illegitimate, null and void, and therefore, should be replaced with one that is independent and free from the dictates of the bogus president who has actually awarded Esperon for cheating for her in the last election. This piece of information should in fact be investigated and when found to be true, all those involved be prosecuted and put to jail.

    Is that difficult to understand and do?

I doubt that Esperon and his cohorts will achieve the purpose of the tactics that they are applying on these soldiers whose courage and bravery have been well tested in the battlefront unlike him who is definitely just clinging to the apron of the criminal calling herself “president.” He may succeed in sending these gentlemen of the AFP to their early grave but their spirits will not die, nor the ideals and principles that they have fought for. Pag namatay ang mga iyan ay baka iyan na ang mitsa ng pag-aaklas ng mga pilipino laban sa mga burot na ito. Huwag naman sana, for I’d rather see Querubin, Lim, et al, leading the Filipinos to victory against these oppressors.

    BTW, baka matauhan na ang mga pilipino gaya ng nangyayari sa Amerika ngayon. Even traditional Republicans are now abandoning Bush. At least, there are still Americans who will not compromise their “My country, right or wrong” for the mad man at the White House, who BTW a lot many people believe also cheated to get to the White House and making a lot many Americans wanting to bang their heads on the wall!

  13. Once they are found guilty at Court Martial (and I do believe there is no possibility they will be found innocent and acquitted at that stage) then Col. Angel Querubin, Danilo Lim, and the Oakwood Mutineers will be in the same exact legal status as Lance Corporal Daniel Smith. They will have been convicted by the “court of first instance”, the equivalent of the Makati RTC, of the heinous crime of rebellion with conspiracy and violations of the Articles of War. But I claim they, like Smith, will not YET have lost the presumption of innocence.

    If we as Filipinos cannot be blind to a person’s possible guilt UNTIL, as the Law requires, it is proven beyond a reasonable doubt to the Judiciary (the entire Judiciary!), then how indeed can we expect Justice herself to be blind??

    The same applies to Ellen, if or when, she is convicted of criminal libel.

  14. Was Angelo Reyes’ “withdrawal of support” mutinous treason? Yes it was. Any withdrawal of support for the Presidency is mutinous treason, if the person does it without first resigning his military commission. If that is what these guys were gonna do, then, I’m sorry, I may sympathize with their objectives, but their means, like that of Angie Reyes and Davide and GMA, were immoral and wrong. They are guilty of mutiny and rebellion. They are entitled to a defense and the presumption of innocence as I have been insisting, but it doesn’t look good. We can’t have our cake and eat it too. We cannot wear the robes of sovereignty with dignity, unless we apply impartial justice to all.

    These officers are simply “whiners”. In simple terms, they are not sick! What they have are sick “brains”!!! What they need is simple exercises everyday and they have to watch their diet. They need to sweat and stretch their muscles. Better yet, read the Holy Bible for enlightenment. Send them psychiatrists/guidance counselors and spiritual persons/priests!!! But the ultimate best you can give to these whining officers is SEX…hahaha! (Not necessarily with their wives).

  18. I agree Cocoy. There is no need to degrade their valor or their sacrifices because of what they were perhaps forced by conscience and circumstance to embark upon. If anyone is whining, it may be their supporters or the Media or the Opposition off on another victimological tangent. These boys are soldiers, but now they are in a legal and political fight in which they are almost defenseless unless they learn new ideas and eternal principles.

    Neither can those who support them save them with “people power” which is not democracy but Mob Rule. We must re-establish our fealty to the Constitution, which was destroyed at Edsa Dos and buried alive in 2004 by the smartest manipulator and beneficiary of “people power”.

  21. This administration their military and their Judiciary bend the rules otherwise their case wouldn’t hold water with their evidence of dubious confessions. So don’t be surprised that we ordinary people want to resort to bending the rules also, to do anything to stop this discusting situation.
    Everybody here in this blog knows that left to this corrupt AFP leadership and their kangaroo court these brave, and remember brave officers that have more than proved their worth to the country, will be found guilty at this micky mouse Court Martial where no evidence has been produced yet (does that give you some indication of how micky mouse these AFP leaders are). Everything with this administration and their institutions are being railroaded and the reason for all of it is to keep this evil wonder woman in power all the way to the German banks.

This is a matter of life and death.     WWNL, you are right! These brave soldiers could not stomach the filth in this administration! Now they have to be incarcerated. Contrary to what Black Knight(suits him well because his soul is sooo black!)says that these soldiers are just feigning their sickness, they are probably sicker than sick seeing how Tiyanak and her goons ( Assperon, Ebdame, Reyes, Palparan, Mayuga and the like)continue with the rape and murder of the Filipinos.These asses are enjoying the perks of the midget while their comrades are in jail even without the due process of the law! It is even sickening that up to now, these soldiers have not received a copy of the pretrial report that supposedly was Assperon’s basis for his convening the Kangaroo court.
    It is very obvious that this administration do not really want justice for these soldiers! Just like any other threat to them who were/are put away conveniently by execution or incarceration, they have to be jailed so the thieves can continue with their dirty operations. Remember, the 2004 election cheating was the root of it all. These soldiers were used to cheat in the elections. If you are a responsible officer, would you have just closed your eyes to this deceitful crime? Now all the generals who aided in the tiyanak’s “stolen victory” are all in top ranking positions. Thank you to Mayuga, who whitewashed the reports clearing all these generals from the election cheating . Even the Cheat Justice Davide has his big share of the bounty, by being appointed as an acting permanent ambassador to the UN (as if this makes any sense at all). Now Black Knight you are saying that these soldiers violated something? Who had violated more laws and rights, these soldiers who have conscience or the Tiyanak and her cohorts(including you) who continue to violate the constitution and the will of the people?

    Speaking of another BULOK soldier, Ebdane, according to a report on its website, ABS CBN News reported that Ebdande will be sworn in as the next DND Chief on Wednesday. The report says that “The selection of Ebdane, if confirmed, goes against one of the recommendations of the special commission formed after the 2003 Oakwood mutiny..The commission headed by retired Justice Florentino Feliciano warned against the appointment of retired military or police officers to the top post in the defense department.
    Ebdane’s selection also goes against the recommendation of Cruz, who has been widely credited for implementing key proposals in the Philippine Defense Reform Program in his two years as defense chief.”

    Dirty Mama G is at it again-paying back those who helped in her victory-kuno in ’04. Ebdane is one of them. He even is part of the “Hello..Garci” scandal. Maybe the only chance we have at this point is to write or e-mail Senators who are members of the the Commisssion on Appoitnments (?) & convince them why Ebdane should NOT be confirmed as DND Chief. Let him, like the other appointments of Gloria (siRAULo Gonzalez, etc.) be “unconfirmed” officials ! Let’s at least try & give ’em hell !

    We’ve heard of what he and FVR did to the evidences the Manila police found in 1995 that could have saved the WTC from being destroyed if Bush was not waiting for the opportunity for the Islamic Fundamentalists to move as they have planned.

    According to interviews of witnesses done by a US TV network, FVR and Ebdane were paid by the FBI more than the asking price of 30,000 dollars for the information. Nothing was given to the finders of the evidences found at the Josefa Apartment where the Islamic Fundamentalists stayed and planned the assassination of the late Catholic Pope who visited the Philippines then.

    Puro magnanakaw! Pwe! Palibhasa si Madame Bovary of the Philippines, a.k.a. Burot, wala nang makuhang matino kaya hanggang mga bugok na lang siya. Point is why are these bulok na bugok pa officers are being confirmed by the CA if the people manning that agency are themselves clean, sane and proper?!

  33. Mrs. Querubin should insist for an answer. In a democracy, whether she is a military personnel or a civilian, she is enttitled to an answer. Otherwise, palpak talaga ang bogus na pamahalaang iyan!

    It is a great insult to call these officers as ”whiners.” They served well in the field. They risked their lives. Most of them were wounded in combat. Most of them are well-decorated. They never bragged about their accomplishments. None of them were ever involved in any irregularities and scandals.

Most of them spent their combat duties inside the comfort of their Bn at Bde hqs. Most of them unnecessarily risked the lives of their soldiers for personal gratification.     Now, who are the real ”whiners?”

    However, given the fact that we have no military report, i.e., pre-trial investigation, Mayuga report to base our conclusions on, we can only rely on newspaper reports.

    I’ve maintained – and you and I have kilometers and kilometers of exchanges of ideas on the matter last year right in your blog based on the reports that we’ve read – that the crimes of mutiny and rebellion against Lim, Querubin and their officers COULD NOT be realistic.

    1) If indeed there was a mutiny committed by Lim, why did then CSAFP Senga simply send him back to his quarters. Remember a mutiny cannot be committed by only ONE MAN! There’s got to be 4 officers/men threatening SENGA with violence for mutiny to stick.

    2) As to Querubin’s alleged rebellion? What rebellion? Did they march to Edsa that day and threatened to fight this bogus government with violence, arms? Didn’t they go back to their barracks? Based on what we’ve read and first hand reports then, the only military offence that Querubin and his officers committed WAS INSUBORDINATION.

    Senga and Esperon never came forward to reveal anything except for a bit of their usual grunt grunt here and there.

    Where is the military pre-trial investigation file that both parties , the accused and the accusers need to start a military trial in a court martial?

    Where is the MAYUGA report. I do not believe that the report ocntained information that would endanger the security of the nation – heck, the nation’s security has always been in danger forcing Gloria to come forward systematically and even play bedmate with George Dubya Bush and his troops…

    As you like to say Dean, we might as well have 9 not guilty verdict out of 10 than pronounce all of them guilty without trial.

    I am 101% against the designation of Secretary Ebdane as the next Secretary of National Defense. Reading the editorial of the Philippine Daily Inquirer says it all. I predict Ebdane will have a rough sailing with the DND and AFP. Everybody should rejoice that the senior and junior officers of the AFP have a reason again to “break” the chain of command and ultimately bring down the present administration.     Detention is not good for them – if the conditions of detention are poor, they will inevitably suffer from lack of adequate physical exercices and worse, boredom which are bound tp have an effect on their physiques and minds. (Have posted something similar earlier on in another thread.)

    The sick officers must have appropriate medical attention – part and parcel of their fundamental human (& military) rights. No ifs, no buts.

    A member of the military is unusually harsh or harsher on his own people because a soldier is expected to be really tough.

    Of course, the civilian in us feels horrified when a member of the armed forces calls another a whiner. But lemme tell you that between them, it’s an ordinary thinggy to call another a “whiner” when said fellow trooper remotely “complains” about his physical condition. You should hear the troopers of the British Army call a fellow trooper when he or she complains of being sick.

    I think it was Dadong Macapagal who established the dirty Kitchen outside the legal kitchen of Philippine bureaucracy, until the legal kitchen has been fully supplanted by the dirty one by the ascendancy of Cory, Ramos, then Erap. It was Gloria who shamelessly, even criminally abolished the legal kitchen. What operates now in the Philippine bureaucracy is a dirty, stinking kitchen that whosoever is called to work in that kitchen cannot escape being soiled by blatant corruption.

    Gloria being the cheat chef, is blindly aided by handsomely paid cabinet cooks, kitchen security officers, procurement officers, food handlers, janitors, etc. The dirty kitchen (buong gobierno po yan) is devoted to cooking stuff design to enrich the officers and workers in the kitchen and to slowly and eventually poison the people who eat the cooked food (smuggled po yan, etc) from the kitchen.

    Since Dadong’s time, nothing happens in the kitchen without corruption and bribes (remember Harry Stonehill?). Even lowly kitchen cleaners must be bribed to do their jobs. Too many cabinet cooks have enriched themselves and their families through their work in the kitchen.

    Very well put Jay. My father was one of those in the late Macapagal’s dirty kitchen but he died a very poor man. There are people who survive the so called dirty kitchen and are very glad they never got contaminated by it. This is why personally, I do not respect anyone who work for the government who flashes their loot by sporting fancy cars, humongus homes, able to send their children to expensive schools like Harvard and Yale and act like they own the Philippines.     What really concerns me is that when you compare the AFP as an organisation with say the information on the website of the British Army and it then becomes very obvious to all of us that the AFP leadership is 3rd class.     Until we get a government administration that sees the long term problems for what they are, then we can never expect to reach above 3rd class.
    The AFP for one will be relying on American Aid (second hand junk helicopters) forever & forever.
    The AFP can start by installing a Chief-of-Staff with the proper qualifications to command respect, they can find a way only if they have the will to do it. You got this joker Assperon holding onto the skirt of the wonderwoman he’s just pretenting he’s in command when you’ve got Danny Lim, with a proven military record to command, banged up in jail on trumped up charges on the say so of Assperon.     Mrs. Querubin should address all her letters to the Presiding Officer/President of the Court Martial and not to the commanders. The President of the Court martial will have to decide on the merits of the appeal. The commanders, including the Chief of Staff, should provide for whatever the President of the Court says. Its a contemptuous act not to follow…. If Admiral Calunsag neglects to inform the Court that he had received a request from Mrs Q., and that COL querubin continously cannot stand trial due to unattended medical needs, the court can pronounce contempt.

    The way I picked it up from the news, the court martial panel is not even sworn in yet and neither have the accused been arrainged yet so the Kangaroo Court has not been up and going. Col Querubin filed a case with the court of appeals to issue a TRO( temporary restraining order) against this Kangaroo Court( Essperon appointed the panel, he will be a witness and he will be the ultimate decision maker). Col Querubin is still awaiting for the reply from the Court of Appeals. Besides, all the lawyers of the accused are still waiting for a copy of the Pre-trial investigation report which supposedly absolved all the accused from the rebellion and mutiny charges leaving just a few to face the lesser of the charges-Conduct Unbecoming of an Officer( a copy of that pre-trial report was published in this blog-217 ppgs in all). The letters of Mrs Querubin should have been forwarded to the right party if the officers who received them were not the decision makers-plain and simple! But to our AFP leadership, this is a tough decision to make because tiyanak has all the strings tied to her fingers and no one does anything unless she makes the move. Never mind if these soldiers are suffering as long as the crooks are in power! Nothing else matters-not even a life of an officer like Col Querubin who has a Medal of Valor Award (someone who did not think of himself and his family when he was fighting the enemies for his motherland).

    it was also my experience during my assignment with the 10th infantry battalion in pata island, the place of the infamous pata massace sometime in 1981 or 1982 and also during my stay with the 24th infantry battalion. it was up to one’s initiative and self concern to protect himself.
