At last, rebel officers to get copies of PTI report

Here’s Inquirer report on what happened in the courtmartial hearing of 28 officers involved in the alleged February 2006 coup plot.

A military court on Tuesday acceded to demands of 28 Army Scout Ranger and Marine officers facing mutiny charges that they be furnished copies of the pre-trial investigation (PTI) report, which was the basis used by the Armed Forces chief of staff to order them tried.

“This court, in the interest of justice, grants the petition of the accused to be furnished copies of the PTI report,” said court president Lieutenant General Alexander Yano, during a hearing in Camp Capinpin here.

The accused and their families applauded and cheered Yano’s decision.

The accused officers had refused to be arraigned until they are furnished copies of the PTI report, which was submitted to Armed Forces chief General Hermogenes Esperon Jr. in October.

“The [PTI] has not finished until we get a copy of the report. It is premature for us to proceed,” defense counsel Vicente Verdadero told the court.

Verdadero represents Army Brigadier General Danilo Lim, former commander of the First Scout Ranger Regiment, who with Marine Colonel Ariel Querubin, is accused of planning to lead a mass withdrawal of support from President Gloria Macapagal-Arroyo on February 24, 2006.

Lawyer Francisco Chavez, who represents former Marines commandant Major General Renato Miranda, the highest-ranked accused, described the court’s ruling as a “petty” victory for the 19 Scout Ranger and nine Marine officers, who were rounded up in a single detention cell in this Army camp east of Manila after the proceedings on Tuesday.

“Finally, they [court] capitulated. We do not crow over this petty development,” Chavez told reporters.

Stressing his client’s right to a copy of the PTI report during the hearing, Chavez told the court: “We are not asking favors from your General Esperon.”

Yano deferred the arraignment, gave the accused 15 days upon receipt of the PTI report to submit their written response, and set the next hearing date on March 16.

The defense panel has been demanding a copy of the pre-trial investigation report since November when the military court held its first hearing. The defense repeated the demand in the second hearing in December but the court ignored the motion.

When Lt. Gen. Alexander Yano, Southern Luzon Command chief and military tribunal head, asked the prosecution to proceed with the oath-taking of the court’s members, Miranda’s counsel, Francisco Chavez, reiterated their appeal for copies of the PTI report which he said they need in defending their clients.

“They are being deprived of their right not only as soldiers but also as an accused because up to this time, they have yet to be furnished with the PTI report…This is a basic right of the accused,” said Chavez.

Lim’s lawyer, Vicente Verdadero, said the court cannot proceed with the trial of the accused because the pretrial investigation process has yet to be completed, particularly the furnishing of the PTI report to the accused and, if necessary, filing of motion for reconsideration 15 days after the receipt of the report.

“Under the rules of court, we have the right to have a copy of the PTI report and file our motion for recommendation…The process is not completed until we get a copy of the PTI report,” said Verdadero, who was backed by other defense lawyers.

Chavez went as far as asking the court to issue subpoena to Esperon to tell the court why he is keeping the PTI report secret.

Dishonesty

Military prosecutor Col. Ukol Paglala opposed the motion. He cited jurisprudence which says court martial proceedings can push through even if the accused are not furnished with the PTI report.

This was disputed by lawyer Trixie Angeles, counsel for Capt. Ruben Guinolbay, who accused Paglala of “dishonesty” and this could be ground for his disbarment.

She said the accused in the jurisprudence cited by Paglala did not actually participate in the pretrial investigation unlike the present case.

Chavez raised the issue on the constitution of the military tribunal, which he said was illegal. He said it was constituted by Esperon who he said is the court’s convening authority, the witness and the reviewing authority.

Homobono Adaza, Querubin’s counsel, said President Arroyo, the AFP’s commander-in-chief, is the proper authority to convene the court in view of Esperon’s actuations.

After a recess, Yano said the court was denying motions by the defense to declare itself illegally constituted. He said the court will continue the hearings unless there is an order coming from higher courts.

On the motion that the defense and the accused be furnished the PTI report, Yano said the court was granting the petition “in the interest of fairness.”

He directed Paglala to furnish the defense with the report.

Off court, Verdadero said the copy of the PTI report could be made available to the defense and the accused next week because the copying machine at the AFP’s Judge Advocate General is not functioning.

    why just now? The PTI report was done sometime in October. Gen yano, the president of the court martial, must have finally realized that its an injustice to the accused who were deprived of that PTI report.

    At first glance (I will re-read and examine PTI), it seemed that whatever plot there was, if ever there was one, was stopped by Senga.

    At first glance, technically there was no coup d’état plot because all troops were accounted for since it is the command leadership’s duty to check that all troops are accounted for.

    On face value of the report, one may charge an INTENT to commit mutiny but again, as in any armed group, military or not, there always is a possibility of INTENT, i.e., gun can always be pointed at someone to threaten, etc. but the OTJAG will be hard put to PROVE THAT INTENT.

    Gen Lim’s own request to CSAFP Senga to put him under his custody is already proof that he FOLLOWED AND WAS HELL BENT ON FOLLOWING CHAIN OF COMMAND.

    So where the f***********k is mutiny there or coup d’état attempt there?

    Anyway, I will translate some of the Pinoy words and will discuss the matter with friends from NATO JAGO here.

    Military laws in Westernized countries (well, like Pinas) are almost universal, unless of course, AFP follows the FIRST PIG and TIYANAK self-made military laws.

    In military law, technically, what Homobono Adaza, Querubin’s counsel, said that “President Arroyo, the AFP’s commander-in-chief, is the proper authority to convene the court” is true.

    What is gobsmacking is that when when CSAFP Senga was still chief of staff, why didn’t he recommend for a court martial to be convened?

    If it can be proven that CSAFP Senga DID NOT recommend for a court martial to be convened, by order of presedence alone, Esperon is bullshitting the AFP and is making a mockery of military laws.

    If Senga failed to recommend to commander in chief that a court martial be convened to try Lim, Querubin and other officers, but Esperon, say FOUND and COULD prove that there were grounds to try these officers of criminal charges against the Republic, SENGA is also LIABLE…

Asked SC chief Justice Beverly McLachlin writing for the whole court declaring the Secret Evidence under the Security Certificates to detain and deport non-citizens for suspicions of terrorism or connections to terrorists in violation of the Fundamental Justice to Fair Hearing and therby Unconstitutional..

    And it the same vein, how could the “rebel officers” meet their case by not disclosing all the evidence against them? Would the prosecutor be guilty of violating the fundamental rights of the accused or under which law did he base his refusal to disclose the PTI reports which are part of the evidence in the case? Now shall I say, they so-called prosecutor of the Military court can not even follow the court process to a fair hearing. Or does anyone for that matter really know how to conduct a proper court proceedings?

    He has to please Esperon, lest he gets floated.

    I have a suspicion, the presiding judge is doing things on a day to day basis – sort of we’ll see tomorrow.

    That kind of attitude seems to describe best the state of affairs in the military.

    Since when did W/rawal of Support rhyme w/ Coup D’etat ?! You mean to tell me, it is a crime if a soldier not to like Gloria, or is against any of her policies, or chooses to protect the Constitution ? Last time I checked, the Philippines was a democracy !

    Why didn’t anyone then make an issue when Angie Reyes & the rest of Gloria’s Military Dogs w/drew their support for ERAP ? Oh, I get it ! Double-standard pala !     In a show, 60-Minutes, the other day, about 10 active soldiers in civilian clothes openly criticised the Iraq policy of Dubya (Pres. Bush). These soldiers were not court martialed for giving their views w/c was contrary to the gov’t policy. Sadly, this cannot happen w/ the People’s Military (i.e. Querubin, Lim et al). They have suffered the consequences of sticking by the truth.

    The problem w/ this pygmy is that she made her base the military. When this base of hers shakes, she becomes insecure & panicks. Look at the way the pygmy reacted w/ the Melo Report & Prof. Alston’s findings !

    If Gloria continues to do this to the People’s Military, she will be made to understand the words, “isang bala ka lang” !

  10. The PTI report clearly doesn’t point to a plot to commit a coup d’état.

    There perhaps was an INTENT to commit mutiny but even that was quelled when the CS AFP ordered “back to barracks”.

    It was clear that BGen D Lim DID NOT COMMIT mutiny. There was no act of insubordination either so, this whole shebang – incarcerating good officers – is only to ally Esperon’s fear, nothing more, nothing less. Based on what the PTI revealed, TECHNICALLY the officers only fault was to have talked to CS AFP Senga about disenchantment in the AFP among the junior officers’ rank.

    If at all, it seems Senga did the right thing by ordering an accounting of the troops.

    A coup d’état entails stealth by a faction of the military – logistics to achieve that must be in place, designation of battle orbits and movement of troops towards those battle orbits.

    Gloria OVER-REACTED, she who plotted for more than a year the overthrow of a rightful commander in chief, legally and constitutionally elected by the people, she who instigated the revolt and mutiny of generals at the highest echelons was overtaken by fear.

    And I can’t blame her – she started it all! She didn’t want to see her head at the end of a spike for the whole Pinoy nation to gloat over.

They held the PTI for months and now the stupid excuses in which they want the defense to buy. Copying machine not functioning in Judge Advocate General? Not just a peon, a General yet.     If illegitmate mutineer Gloria has a lot to do with the trial, we can be sure none of the accused will get a fair treatment. What else can be expected with this pigs, but a Kangaroo court. Those accused has already been found guilty and sentence to jail before they even got a chance to walk in to the court. It’s the way illegitimate Gloria’s systen has worked in the past and I don’t see any changes now. We don’t have to look far, she has done it with President Joseph Estrada the only legitimate President of the Philippines still being held against every judicial laws of the land, only because illegitimate Gloria wants her way. For as long as illegitimate Gloria remain in power, there would no fair justice.

    Lets us be realistic, the accused are clear threat to the very existence of illegitimate Gloria, as I see it. Mutineer Gloria will do anything to prevent those accused to do any further harm while she’s illegaly occupying the House of the People. The way illegitimate Gloria’s and her pigs sees it, either them or us, and you know who’s going to win. Therefore, it stand to reason, without any doubt, as the past testimony to the facts, those accused of the mutiny will remain incarcerated. The charges will stick and the trial will not end, only when President Estrada finally see the light of the day as truly a freeman. But it won’t never happen because it will meant for illegitimate Gloria to answer for all her crimes, and that’s the bottom.

    Of course, lets not forget the precedent treason Angelo Reyes set (or Ramos and Enrile) when as chief of Armed Forces withdrew his loyalty to the constitution and to the legitimate President of the Philippines, instead sold his soul to the devil herself, none other but mutineer Gloria Arroyo, fake as a three dollar bill. It seemed treason is the way to go, at the right and proper time. Since, nobody ever got hung or shot for treason in the Philippines. It’s because Philippines has a Kenkoy Armed Forces, can’t be taken seriously.

    If the accused will be guilty, then Enrile, Angie Reyes and others should be also declared guilty!

    So now that Assperon is releasing the PTI report, it would be very interesting to see how the new report compares with the one Ellen published. It would be difficult to white wash this report. Had Ellen not have gotten a copy of the unsigned PTI report, who knows if the report would have been another Mayuga report.

    Anything to delay justice for these few good soldiers would be a victory to the evil tiyanak and her bodyguards! Assperon can not even buy a working xerox machine after he was given 10 billion for modernization! I wonder where these billions are? Check if they are invested in real estate properties in the US, Europe and even Australia (this country is a favorite destination of these corrupt generals) using dummy investors.   21. Not getting copies of the indictment, etc. is not justice as a matter of fact. It’s suppression of freedom, and it is illegal by international and local standards as a matter of fact. Unfortunately, Filipinos have gotten used to these acts of injustice and think it normal.

    They are not even aware of their basic rights and privileges under the law that are being trampled upon by the creep calling herself president, her escort and lackeys, including their Constitution that she wants discarded with a ChaCha she wants done with the help of the vegetables she has been “watering” with money from the national treasury.     I’m with you, “demokrasya ay hindi absolute”. However, in Philippines, it’s a useful tool to have for conveniency when it’s needed. The real problem is not really the institution itself or democracy, but the illegitimate Gloria as an illegal, the blood sucking leeches that she is, from the family of leeches which included the arrogant husband. He think he’s above the law, this bastard has no respect for the law, and would rather do his business outside the court, so he told the defense lawyer in court. Yet, scary pant judge of the court without credibility, let the bastard get away, and did as he pleases, didn’t even cite him with contempt. This is how bad our judicial system and those wearing black robe.

    The delay in giving the copy of the PTI to the defense panel/accused is one of the “tricks” of the prosecutors. Relatedly, the defense could also use some “tricks” to delay the resolution of the case. The next move will be for the defense to “challenge” the composition of the General Court Martial. So, if the accused/respondent doesn’t like the face of General Yano, he can be replaced outrightly, thereby delaying the course of justice for the accused.

    what happend yesterday was quite a one step victory for us. before the hearing started, one of JAGO officer led the prayer…prayer that goes like asking GOD to touch everyones heart, to give justice and set the truth…my eyes was leaking then because his prayer is the same with mine…so glad then gen yano eventually give in ending up a peaceful hearing contrary to what i was expecting(gen esperon is getting into thier nerves and will make him pay for the misery that he brought to us,they(we) will make him pay every penny that we have spent for this, every tears that not even general esperons life is enough). there is one person that i wanted you guys to watch out…the key of PTI contoversy – col perreras. his yes/no answer will set the truth …. 15days? ang daming pweding mangyari:) lets pray for his safety. people like gen esperon bluntly speaking is capable of goddam neutralizing people that will go against his plan(and you know what i mean), remember he is evil in the first place!!!!we all know that!! lets keep our eye to col perreras…of course he will do anything to be on top…nung dec pa lang napapraning na sila eh, to the point that 1 of the wife sinusundan ng isang van and they found out na the van belongs to a certain general(hmmm, bakit kaya?) and isang bahay ng officer pinasok kinuha ang laptop peru hindi naman kinuha ang jewelries(so it means hindi pagnanakaw ang intention diba), all our landline and cellphones are being tapped until now( though wala naman sila makukuha kaya wala kami kinakatakutan peru nakakapikon kasi you cannot hear the other end clearly kasi parang radio sya..i mean to say na they are capable of harming us, the family and people who will get into his way!!!

    when the hearing yesterday started gen yano gave an order to col paglala(head of JAGO) to start the arraignent and furnish copy of PTI later….if you will read between the lines, meaning naka ready na dapat ang PTI report that will be given to the lawyers with a snappy line of thinking na sa dami ng respondents and lawyers they should have prepared those copies before hand pa kasi nga sinabi na ibibigay after the court becomes legal eh…peru after ma gipit ang prosecution panel headed by gen yano that ended up giving in to our demand, wala silang maibigay na copies…meaning niloloko nila kami,that they dont have intention talaga to furnish us copies of the said PTI. good thing we have a very good defense panel na hindi nasisindak sa kanila, thanks to the lawyers and to the people who support and prayed for us. and thank you LORD for your guidance and protection:)

    BK, there will be no justice for these men in uniform in this Kangaroo Court. Assperon is the law and whatever the tiyanak wants, this Assperon does. This is called “chain of command”. In other words, be like a robot!

    You should thank Ellen for for printing the unsigned PTI. It was God’s way of protecting these soldiers. Can you just imagine if Ellen did not have a copy of the PTI? The rest would be history. Assperon will just make his own report and hide the real PTI like they did with the Mayuga report. So, your angels are still actively protecting you.

    Col Perreras did his job well by being as fair as he can be.
    Although his life may be in danger after that. He will be perceived as one of the brave soldiers.

    The truth of it all is, Assperon wants these brave men locked up while his master is enjoying her stolen presidency. These soldiers know the truth about the rigged election in 2004. Do you think Assperon will be stupid to let these men out before the May 2007 election? Assperon, Ebdane, Abalos and all their cliques are busy figuring out how to score for their bogus president again. These brave soldiers can not be on their way of massive operations. Why do you think Col Querubin’s brigade was moved down South. This is in preparation for more cheating. The officers in the field know too well how the cheating operations were conducted.

    These brave soldiers may be physically imprisoned but their spirits live on.

    I hope that the Filipino voters will reciprocate the sacrifices of these men and their families by voting for the best candidates in the May election. Anyone who has a questionable agenda and have had corruption history, DO NOT VOTE FOR THEM! Otherwise, the trapos will will live on and rule! VOTE WISELY! It is very critical!

    If Esperon doesn’t stick his dirty fingers in the proceedings, everything will be fine.

    Justice will not be delayed because these officers are NOT guilty of any crime that’s attributed to them.

    ”The defense wants to delay the proceedings” is a stupid contention. The accused officers are detained for a year now. They definitely want a speedy trial. It it esperon who intentionally delayed the proceedings by deliberately witholding the PTI report for four months.

    So now after Assperon releases the PTI there is a PTA. These reports should have been given to the incarcerated officers long time ago. No excuses! This is gross inefficiency and harassment! Assperon and Mayuga got away with hiding the Mayuga report and tiyanak and her cohorts were trying so hard to hide the Melo report. Hiding the truth is a signature move by this corrupt, abusive and murderous regime.

    Military wife, you and all the other wives and husband of the incarcerated officers should altogether go to an International body for help. It looks like all authorities in our country are afraid of the tiyanak(because she is extremely vicious and dangerous!). It is about time you seek this international intervention before Assperon completely destroy your lives! Now that you have a copy of the PTI, run and do something! Crying, complaining and ranting wont solve anything. You have to aggressively defend your rights, afterall, your better halves are more human that tiyanak and Assperon!

    Military wife,I feel so bad for the conditions in the detention cell, per your description. If the walls are open, then the heat must be scourging and what if it rains? How about the insects? Although I know that Tanay has good weather still it is inhumane to have all these soldiers live in an open barracks for a long time. It is acceptable if it were only for days but not for months and even years for that matter. I bet Joc Joc Bolante has much much better accomodation than these poor soldiers! How sad. My prayers are with you. God is the final judge! Miracles do happen. I hope it will be soon!
