Ninoy Aquino,Jason Aquino

Frank Chavez opened the petition he filed before the Supreme Court last Friday, on behalf of his client, Army Major Jason Laureano Aquino,with a quote from Benigno Aquino Jr.,made before Military Commission No. 2 on August 2, 1973.

Ninoy Aquino’s words: “There is something that transcends all other considerations, something that is unique in the case against me. Two years ago, on August 24, 1971 – three days after the horrible massacre in Plaza Miranda – I was accused and pronounced guilty of the same charges by the President himself, the commander-in-chief of the Armed Forces…With due respect to all of you, how can this Military Commission reverse the President? Even if you want to because of your sense of justice, nonetheless, under Presidential Decree No. 39, the President has the power to change or reverse your decision.

“Sirs, I know you to be honorable men. But the one unalterable fact is that you are subordinates of the President. You may decide to preserve my life, but he can choose to send me to death…

“I have therefore decided not to participate in these proceedings: first, because this ritual is an unconscionable mockery…”

jason-aquino-1.JPGChavez said, “Thirty-four years after the impassioned oration of the well-known martyr before a court martial, the county is again forced to witness a vicious spectacle of an innocent individual being hailed before a court martial that has been created and constituted by the very person who had already pronounced him and several of his co-accused guilty of the crimes charged and who retains the power to affirm or reverse the judgment against them.”

Ninoy Aquino and Jason Aquino are not blood relatives, but as Chavez noted, “the circumstances of the then and now are eerily identical. The surnames are even the same.”

Maj. Aquino stands accused, together with 27 Army and Marine officers headed by Maj. Gen. Renato Miranda, for attempting to create mutiny and conduct unbecoming of an officer and a gentleman before a special general court martial No. 2 (SGCM2) created by AFP Chief of Staff Hermogenes Esperon. They were originally 38 but cases against 10 were dismissed. The case is in connection with the alleged planned withdrawal of support from Gloria Arroyo in February 2006.

Chavez avers that the SGCM2 was illegally constituted by respondent, Esperon, who is the accuser/prosecutor of and witness against the persons charged and reviewer of the conclusions of the panel hearing the case.

Chavez said the continued prosecution of Maj. Aquino and his co-accused for violation of Article 67 of the Articles of War (attempting to create mutiny) cannot take place since its very basis, the Pre-trial Investigation Report, contrarily exonerated the accused officers.

Esperon overturned the recommendation of the PTI panel headed by Col. Al Perreras. Chavez said the Manual for Court Martial does not provide any specific power for the appointing authority to countermand the findings of investigators particularly in regard to the dismissal of charges.

Chavez underscored the injustice that Maj. Aquino had been subjected to as a result of the unjust and illegal proceedings conducted by the SGCM2. Aquino, he said, “has been incarcerated with neither warrant nor bail for his temporary liberty for more than a year now. For several weeks, he had been subjected to solitary confinement before being transferred to the detention facilities at Camp Capinpin in Tanay, Rizal where he is still detained.

“Despite the fact that the proceedings before the SGCM2 and petitioner’s continued prosecution for alleged violation of Article 67 of the Articles of War are illegal, unjust and unconstitutional,” Chavez said, Maj. Aquino “is still suffering the unbearable torment of being torn away from his family and deprived of liberty.”

Jason’s wife, Maria Fe, is on the family way and is due to deliver next month.

Before Aquino’s petition, General Miranda, Brig. Gen. Danny Lim, Col. Armando Bañez, Lt. Col. Custodio Parcon, Maj. Jose Leomar Doctolero, and Capt. William Upano had also filed a similar petition three weeks ago. Col. Ariel Querubin had also filed for a TRO before the Court of Appeals in December 2006 which remains unacted on.

Chavez filed a supplementary urgent motion for special raffle and urgent plea for court action because SGM2 proceedings are scheduled to resume on Thursday, April 27. That’s three days from today.

Chavez said that for Ninoy Aquino only history was able to absolve him. In the case of Maj. Jason Aquino, however, Chavez said, “It is not yet late for the courts of law to step in and render justice.”

Chavez pleaded: “Maj. Aquino seeks justice NOW, not vindication tomorrow, when this darkest chapter of the nation’s history would have already been written. Otherwise, not even God may spare this generation and its children from the dreadful curse of infamy.”

  1. Conduct unbecoming of an officer and a gentleman? What these officers did is the mandated by the oath they took. They tried to defend the constitution and protect the people against a terrorist regime.

    This is a classic example of what a kangaroo court is. 3 in 1, prosecutor, witness and judge. Esperon sure has a twisted view of what a gentleman is. A gentleman fights fair, he is just and is sensitive of the people’s sentiments. All these Esperon is not.

    Well, what do we expect from a glorified security guard like Esperon?

    The Pretrial investigation report exonerated all accused officers of mutiny charges. However, they are individually charged of ”conduct unbecoming of an officer and a gentleman”
    Any soldier charged of mutiny is necessarily put inside a detention while undergoing court martial trial. An officer charged of ”conduct unbecoming” CANNOT be detained while on trial but he faces possible dismissal from the service if found guilty.
    Esperon only wants to continuously detain these officers even after his retirement for fear of their wrath. He knows he gravely abused the rights of the accused officers.

    Officers facing ‘conduct unbecoming’ charges are usually tried in the AFP Efficiency and Separation Board (ESB). ESB will determine if the accused officers are still fit and worthy to continue the military career. Service reputation is the primary consideration. The accused officers are the cream of the crop. They performed excellently in combat, in academics and mostly are bemedalled officers. Two of them are even Medal of Valor awardees! They were never involved in any corruption and irregularities. Surely, they will all be exonerated.

    Esperon would not also allow this to happen. His only scheme is to insist and push the charge of mutiny (which he did) thereby justifying the continuous detention of the accused officers.

    Reading the thread, a quick analysis of the case of Ninoy and Jason, surnamed Aquinos, would suggest (to me only) that we are at present under some sort of a unique situation wherein the Marcos’ martial law will pale in comparison.

    Sa kaso ni Ninoy Aquino. He was an arch political enemy of Marcos. Magkaaway sila. We can call their rivalry as the battle of the titans. Martial law was in effect, Marcos’ PDs are laws, Ninoy was jailed. Although the Military Commission was legally constituted under, Ninoy refused to face the Commision because whatever was the result of the case, it’s Marcos who will decide to free or put him to death Ninoy. History tells us that Ninoy was found guilty and sentence to die but he was first given medical attention at the Philippine Heart Center and later on, allowed to leave for the US. Tama ba ako dyan?

    Sa kaso ni Jason Aquino. He is prsently under court martial. He’s not even one of the perceived peronalities who was openly coveting the presidency. And according to Frank Chavez, said court martial that has been created and constituted by the very person who had already pronounced him and several of his co-accused guilty of the crimes charged and who retains the power to affirm or reverse the judgment against them. And if we are to believe Atty. Chavez, said court martial is self-serving and therefore, illegally constituted. Btw, that person is no other than Gen. Esperon whose only other event that made him widely known was in being prominently mentioned in the Hello Garci! tapes.

    And where did Esperon got his unusual bravado to act as the prosecutor, judge and executioner? Dito pumapasok ang imahe ng kanyang kumander in tsip. But the little lady is not even saying a word on this matter. Is something sinister already in place and is being followed to the letter by the AFP hierarchy? There’s no actual declaration of martial law altho we are aware they’re debating on it already, but what is it?

    The answer my friend is blowing in the wind. Parang kanta. I hope I’m wrong in what I’m thinking.

    Yes. Colonels. Ariel Querubin and Custodio Parcon are medal of valor awardees. Army Capt. Ruben Guinolbay is a Gold Cross awardee.

    Until his relief and detention, Maj. Aquino was operations chief of the elite First Scout Rangers Regiment-Airborne. He was elected baron or first captain by his classmates at the Philippine Military Academy (PMA) class of 1991.

    You’ve been providing Ellenville a lot of info about military rules/procedures/stuff which ordinary civilians, like myself, do not know.

    That “the accused officers are the cream of the crop” only shows how insecure and threatened coward Assperon must be. I pray that members of the Supreme Court will slap the commander-in-cheat and her Super Sekyu Assperon the right ruling about this case as soon as possible.

    These officers and gentlemen must be released from illegal detention so that we will feel safe again!

  9. Point is why the COMELEC has not filed any case against criminal suspect Gloria M. Arroyo for violating the Election Code, and the court has not initiated any case against her likewise for plunder especially the use of OWWA fund, fertilizer fund, etc. for her election campaign and vote buying, abuse of power and worst, the trampling of the Constitution of the land?

    These officers have all the right under the law to defy a government headed by a criminal. All officers and soldiers of the AFP should have walked out on these crooks who are running likewise the AFP like a Mafia organization. They could all have refused enmasse to follow orders from an ass-licker like Esperon, Mrs. Pidal’s Cheat of Staff.

    Ang dali-dali namang gawin bakit hindi kumikilos as one even the bar associations in the Philippines and start cleaning up the judicial system there. Anong problema ba nila?

    This reminds me of a Congressional session I witnessed when I was in high school. I attended a session with my eldest sister, who was making a term paper on the Philippine Congress. There was a Congressman there who was being berated by his fellow Congressmen for his philandering, and he blurted, “P…ina ninyo! kapag bumaba ako, baka mawalan ng tao ang Kongreso kasi I will demand that those having one or more queridas to step down, too.”

It’s understandable why men of honor like Gudani, Lim, et al would want to defy the power-grabber, who should have been sent to jail herself together with her fellow lawbreakwers who think that just because they are now in positions undeserved, they can now be the law themselves, interpreting the law the way they want to for their own self aggrandizement and satisfaction.

    The truth is, the incarcerated officers may have wanted a court martial to clear themselves of the allegations that the tiyanak and Assperon had on them. They know the anomalies of the elections in 2004. They and their men were used to rig the elections. Mayuga failed to interview these men in uniform who knew first hand what went on with the elections but these detained officers know the people involved in the operations. But because they know that with tiyanak and Assperon spearheading this court martial, they will suffer the same fate as the Mayuga report…hid under and forgotten. This is why they have to fight and get themselves out of the bogus court that Assperon is attempting to create( the panel has not been created yet because the able lawyers successfully blocked its creation in the past court appearances).

    Spy is right, Assperon has to put these officers away so he can secure himself during and after his term. What he had done and continue to do to these officers has a reverberating effect not only on themselves but their families as well. Most of these officers have very young families. Some wives are even pregnant, like Aquino’s wife. Some have newborm babies and some toddlers. For the families to be deprived of a parent because of sheer “act to please a benefactor(the tiyanak) and to further his career(he was eyeing at the Chief of Staff position then)”, Assperon had erred and BIG to these men of honor!

    I doubt that a court consisting of the tiyanak’s appointees(the Supreme Court Chief and Nachura were just recently appointed in preparation for the charter change tiyanak did not succeed in pushing last Christmas and will continue to push after she succesfully cheats again in the May elections-God forbids this to happen!) will favorably rule in favor of these honorable men.

    I can foresee that just like the court of appeals where an earlier case was filed by Col Querubin(where the justices are either waiting for a big bribe which these officers do not have or a promise of a juicy position in the Supreme Court) the supreme court justices will just sit on their case and make the tiyanak and assperon happy. It will take a miracle and a divine intervention for these justices to rule in favor of these incarcerated officers.

    Our prayers are much needed by these officers until their struggles are over. The irony of this regime is that the rotten ones are running the government and the good ones are either dead or incarcerated. This is the worst regime my grandparents, parents( I have one who is now in her mid 80s) and I had gone through! At least in the time of Marcos, our country had not been threatened to be sold. But now, with tiyanak, her charter change, if successful, will sell every inch of our patrimony to the highest bidder. Since Filipinos do not have the money to do so, foreighers will FEAST AT OWNING US! WAKE UP FILIPINOS!!!!

So, I have to go online once again reading off different columns and voila! It was the column written by Alejandro Lichauco at Daily Tribune. Ganito ang kanyang sinabi sa first two paragraphs:

Kontra Daya in fact has warned everyone of the 100 percent possibility of Mrs. Pidal using the AFP again especially under vote-rigger, Assperon, to help the Tutas win the mid-term election despite the numerous surveys proving her present unpopularity and evident failure of her very expensive and padded publicity stunts of late.

    It’s the main reason in fact why Assperon was promoted ad is now in control of the AFP, and acting like the mini-president–to thwart of the will of the people in this coming mid-term election. Filipinos, therefore, should not allow this Assperon to do so.

    Go to the polls and vote. Don’t allow the COMELEC to take advantage and steal your votes by using your unused votes!!! If everybody votes and COMELEC riggers still add those manufactured votes to the box, then there will naturally be more votes than there need be, and that will be proof enough that the election has again been rigged as in 2004.

    Sleepless. Nope, that was not the article. I went back to find it and I can not find it anymore. The gist of his speech though says that poverty is a form of terrorism. He further says that the policies of our country to follow US’s way of running after the terrorists without coursing it through the UN has taken a toll on the violation of human rights. This is even more manifested in more corrupt(at least he is not in denial) countries like the Philippines. He also said that in implementing the anti terrorism bill, shortcuts on the legal process have to be made and this further undermines our rights. There are unecessary arrests. It was very well put.

    If I find the article again, I will share the article here. If someone had read it earlier and know where to find it, please help me out so you all can read it too.

Filipinos in countries where voting by mail is now allowed should take hid of the warning regarding possible rigging of their votes with the COMELEC reportedlty instructing the Philippine embassies and consulates in the designated 61 countries to open the outer envelopes containing the ballots in an inner envelopes that can be replaced with inner envelopes with rigged ballots manufactured by COMELEC riggers who did the same thing in 2004.

    We urge all OFWs and those monitoring the absentee voting to demand that the envelopes containing the ballots be not opened until counting day so that we can at least be sure that they are not replaced with the lutong makaw ballots on order of the criminal at the palace by the murky river.

    Please write to your embassies and consulates so that they can ask the COMELEC to stop compelling them to defy the will of the overseas absentee voters!!!

  34. I am still shocked by what I read in an earlier thread about a 9-year old girl who was shot in the head because she was suspected to be a communist.

    This country needs a major overhaul – it needs to re-invent itself and if need be, should wipe Gloria’s criminal slate with the blood of her partners in crime. When these honourable officers escape from prison, they should eliminate the gangsters in their midst.

    Chavez did a good job in arguing in the Supreme Court that SGCSM2 created by Esperon is illegal. The military commission appointed by Esperon to hear the case of the accused is not legal, but political.

    His military commission create the impression of Kangaroo courts, not legitimate accountability mechanism for trial, rather it perceive in granting judgment base on politics and not legal form. In kangaroo Court the procedural rules is casting a further shadow over a process so compromise as to be a doubtful value because he handpick the tribunal who will hear the case. It is no doubt that they are to be believe under his pressure. In this particular tribunal Kangaroo Court there are very specific expectation, everyone knows what will happen, Esperon will just carry out all the manufactured evidence and bring it in court and be legally and morally convince his appointed tribunal to convict the accused.
