Supreme Court junks Pimentel’s petition for TRO


The High Court’s decision will pave the way for the canvassing of the manufactured votes of Maguindanao. Zubiri will then become a senator by virtue of the votes manufactured by Lintang Bedol and company.

The Supreme Court en banc has dismissed the petition of the Genuine Opposition to stop the recanvassing of certificates of canvass from Maguindanao.

In a 12-0 decision, the high court said it has dismissed a portion of the petition filed by GO senatorial candidate Aquilino “Koko” Pimentel III.

“After hearing the arguments, the Court decided not to issue the TRO,” said Supreme Court spokesman Jose Midas Marquez. He did not elaborate.

The Commission on Elections, meanwhile, said that without a TRO, there is no reason for the commission to stop the recanvassing of votes from Maguindanao.

“It looks like if there is no TRO, I guess we have every right to proceed,” said COMELEC spokesman James Jimenez.

When reached for comment, Team Unity senatorial bet Juan Miguel Zubiri, Pimentel’s main opponent for the 12th spot in the senatorial race’s “Magic 12,” said his camp is happy that the Supreme Court has decided in their favor.

“I’m just happy and delighted and thank God and this country that democracy will prevail,” he said.

Administration election lawyer Romulo Macalintal, meanwhile, said they have yet to receive a copy of the high court’s decision.

COMELEC Chairman Benjamin Abalos, meanwhile, told ABS-CBN News that the National Board of Canvassers (NBC) has yet to determine who will become the 12th senator.

The Maguindanao recanvassing yielded 195,823 votes for Zubiri and 67,111 for Pimentel.

Pending the Maguindanao votes, the COMELEC en banc, which sits as the NBC, has already tallied 10,861,888 votes for Zubiri. Pimentel, on the other hand, had 10,746,298.

COMELEC said it expects to proclaim the 12th winning senator before the week ends. With reports from Marieton Pacheco, Willard Cheng and ABS-CBN News

    Follow this scenario. Comelec will declare Zubiri as the 12th Senator, and Pimentel will file a protest with the electoral tribunal and the case will eventually end up back to the SC. Then time for re-election again. Meanwhile the Drama among the Comelec officials and all the casts will come to an end and the curtains will fall, and everything will be back to where we started… and everyone will tell us to Move Forward…Onward trala-la-la…

    Natcherly – the onus lies in the COMELEC. SC is wise in keeping its hands off. In effect, SC says, let COMELEC decide making fools of themselves.

    Until we FORCE these corrupt Institutions, ALL of them to be transparent, to tell the truth and give justice to the people they the Institutions will never prosper and for sure we as a country will never move forward, not one step.     once upon a time, when the country was in infancy, all political dissent and protest were allowed even then, but once a particular individual or groups of individual conspires and plan to overthrow the government in illegal ways,or by violent means the Judicial system took action and decide with finality. such was the case of Louis Riel, who took arms to overthrow his own government, he was hanged.

    Then as late as l970 a group of separatist in Quebec, wanted to separate in the same illegal way, then PM Trudeau invoked the War Measures Act and done with the Problem by sending the Army. We did have a “sponsorship scandal” during PM Chretien Tenure, and Yesterday another Criminal involved was sent to jail and it is not done yet. And it cost the once Promising PM Paul Martin his Government. So the Solutions are just as simple as the few I mentioned, dealt each and everyone of them with Finality…

    And this Sunday, July 1, we will be celebrating our 140th Birthday, and I would say, we truly have moved forward… starting from Day One..Happy Canada Day to all…

    Tama ang kaba ko na gusto talagang pahirapan si Koko Pimentel para maging senador. Ngayon ang Supremen Court ay nakikisayaw sa kapritso ni pekeng Arroyo. Kasama yata sila sa moro-moro. Sa pagbilang ng boto sa National Boeard of Canvassers ay dapat mahigpit ang pagtutol ng mga watchers at abugado ni Pimentel sa mga dokumento. Dapat ipakita lalo na yung mga ERs na hawak ng oposisyon para patunayan na mga manufactured yung binilang nila sa PBoC. Tulungan natin ipagtanggol si Senator Koko at ang kasagraduhan ng malinis na botohan! HINDI PWEDE ANG PEKENG SENADOR!

    Koko still leads Zubiri in special poll results

    The National Board of Canvassers tabulated Thursday night the results of the special elections in Basilan, Lanao del Sur, Biñan in Laguna and Taysan in Batangas with Genuine Opposition senatorial candidate Aquilino Pimentel III still leading over rival Juan Miguel Zubiri of the Team Unity.

    After adding the results from the four areas to the national tally, Pimentel garnered a total of 10,906,451 votes or 133,005 lead over Zubiri’s 10,773,446.

    The NBC, however, adjourned its session and would resume Friday at 2 p.m. the canvassing of votes from Shariff Kabunsuan, Bais in Negros Oriental and the controversial Maguindanao.

    The NBC deferred the canvassing of votes from Maguindanao “in due deference to the order of the Supreme Court,” which rejected Pimentel’s temporary restraining order petition.

    The high tribunal said it dismissed the TRO petition because it was based on mere suspicion that the Maguindanao votes were tainted with irregularities.

    During the oral argument, Pimentel failed to present evidence to support his allegation that electoral fraud took place in the province.

    Associate Justice Cancio Garcia pointed out that if the Court will grant the petition, it could mean the disenfranchisement of more than 200,000 Maguinanao voters on the basis of a mere assumption of fraudulent municipal certificates of canvass (MCOCs).

    Commissioner Nicodemo Ferrer said they do not want to look too excited or favoring a certain candidate by immediately counting the hotly contested votes from Maguindanao.

    During the open session, Comelec chairman Benjamin Abalos said they will wait for the arrival of certificate of canvass from Bais, Negros Oriental and the reconvening of the Board of Canvassers of Shariff Kabunsuan. – GMANews.TV

    Delikado nga yan kung si Villar ang lalabas na Senate president. Hindi nakakasiguro ang mamamayan na magkakaroon ng oppositionist Senate. Baka ibenta ni Villar sa pekeng administrasyon ni Gloria ang unti-unti nating nakakamit na tagumpay para sa taong bayan. Lalabas na tama ang sapantaha nila Tito Sotto at Oreta tungkol kina Villar at Pangilinan na kunyaring mga anti-Arroyo na. At ang mga GO senators should vote for Pimetel kung talagang gusto nilang magkaroon ng pagbabago at mapanatili ang indepence ng Senado na lumalaban para sa tama. Kailangan si Pimentel ang maupong Senate Leader tutal wala na naman siyang ambisyon na maging presidente at natural lang na hindi sisipsip sa administrasyon at talagang para sa bayan gagawin!!     The Comelec is ready to proclaim Miguel Zubiri as the duly elected senator of the republic courtesy of Lintang Bedol’s manufactured election returns. The next legal battleground will be at Senate Electoral Tribunal and process will take hundred of years to finish the recounting job. There’s something anomalous in the Maguindanao recounting of votes. How come Zubiri dislodged Chavit Singson in the top post?

Over in Japan, if this kind of thing happens, all the people involved in the cheating will be by now in the custody of the police and the court regardless of whether or not they are serving in the government or holding a high position in the government, for NO ONE IS SUPPOSED TO BE ABOVE THE LAW!

    You bet, we’ll be reading of a lot of people losing face and getting ostracized, thus, forcing them to find absolution by hanging themselves or jumping from tall buildings. Ibig sabihin ay hindi nila papansinin ang mga questions ng mga abugado ng oposisyon kung walang mabigat na ebidensiya. Mukhang gustong gayahin si Mr. Noted.   26. The Tribune under ‘Only in the Philippines’ reported today mayebe right to remind these Senators that the filipino has at last grown up and have memories of an elephant.
    “But what is being ignored by those who ran under the GO but joined forces with the administration is that the Filipino electorate have grown up ? and fast. More to the point, they now appear to have elephant memories and wait to punish those whom they feel betrayed them.
    It was much too clear, in the way the results of the senatorial polls went, that the candidates who switched sides, crossing over to the Gloria team, were punished by the electorate for doing so.
    Tito Sotto, for instance, was ranking high in the surveys when he was identified with the opposition, but suddenly plunged in ranking after he switched to the Gloria team, and failed to make it to the Senate.
    In the case of John Osme񡬠while he did return to the fold of the opposition, the electorate didn?t give him the vote to win, probably because they remembered that he had earlier switched from the opposition to the administration in 2004, when he also lost.
    What other possible message from the electorate is there, in these two cases, save for the fact that they don?t want turncoats?
    I was hoping to change my handle to something more friendly but Nah! it stays at ‘We Will Never Learn’ whilst senators such as Villar, Escudero, Cayetano and their like are so self serving and ready to forget the reason the GO electorate put them in their slot was to support their opposition stance, but believe me they will pay for their selfserving mistake.
    Then too, all those Team Unity candidates closely identified with Gloria lost ? including Juan Miguel Zubiri, whose only chance to get the 12th Senate slot is to bank on the obviously manufactured Maguindanao votes which were canvassed.
    Just what message do these GO bets who have crossed over to the administration side think the electorate gave last May, if not for the opposition to become the majority in the Senate and work together to ensure effective fiscalization?

    No GO Electorate will ever trust the likes of Villar, Escudero, Cayetano again for the way they used them for their own self interest.
    I was hoping to change my handle, but Nah! it stays under ‘We Will Never Learn’ because it says it all!

    I’m back! The Manhattan early summer is unbearable, but not as hot as what’s cooking in Gloria’s kitchen. I couldn’t fight the urge of taking a peep at Ellen’s, only to read this?

    Dang! How do you explain Escudero? or Cayetano? Are you sure this is true? Are they in it for the committee chairmanships? or for some other consideration? What’s their story? Just can’t believe it. Too many heavyweights in the opposition camp probably had egos getting the better of them.

    I’m glad though that the more popular ones are steadfast, like Legarda, Lacson, Noynoy, Trillanes, Mar Roxas, Biazon, Pimentel, and hopefully, Jinggoy, too.

    Don’t worry guys, it’s shocking, really. But we already know how to handle this, don’t we?

    And pretty soon, we’ll have all them prodigals penitently crawling back to where they really belong.

    Sabi ni ‘Mr. Expose’ Maceda sa kanyang column na magkaiba ang naging resulta sa Special Provincial canvass ng boto sa Maguindanao kaysa sa mga resulta nuong una na mai-subbit ni Lintek Bedol sa Nattional Board of Canvassers. Dun sa unang canvass sa NBC ay si Chavit ang nanguna pero dun sa Special Provincial canvass ay si Zubiri ang nanguna. Kung totoo ito ay halatang parehong manufactured ang mga COCs. LOKOHAN NA ITO!!!

    Both election results are garbage. The die is cast to proclaim Zubiri A.S.A.P. Elections chief Benjamin Abalos and the NBC will tabulate the manufactured municipal election returns part II. The Comelec will pass the responsibility to Senate Electoral Tribunal in event of Koko‘s protest. Palagay ko abutin ito ng siyam-siyam. Matagal na tayong niloloko at binababoy ang mga alipores ni Gloriang Tiyanak.

    I’m not a bit worried on the maneuvering in the Senate. All what we have been reading are media hype. It’s because of the multi party that comprised the GO ticket. In fairness, the Senators in the past Congress have shown grit under intense fire and I think they will be have the same posture with the additional new faces, I think once the Senate Presidency is resolved, they will sit down to the real job they are expected to do. The elected GO senators know where they stand and I believe they know the pulse of the people why they were given the mandate. But just in case they really changed their ways by aligning with the administration, to hell with them, as long as there is Sen. Trillanes.

    I would like to quote a few lines from Atty. Rene Saguisag in his column: The youngest one ran on the platform of ousting GMA. 11,000,000 voters approved Sonny Trillanes’ winning line. He ran on the platform of a regime change, and won on that basis. Let the Trillanes Wing take off and soar, within the system.

    While it is disheartening to know that the Supreme Court did not grant the TRO as petitioned by Koko Pimentel, I would like to think the justices acted purely based on the case as presented. It could be gleaned from the fact that Koko admitted they has no proof to show to the Supreme Court the veracity of his written charges. We could notice that there’s no angry protestation from Koko on the decision, He being a brilliant lawyer, I feel Koko will comeback, pursue his case with the National Board of Canvassers and hopefully, the truth will prevail. The fight is not yet over. My feel is that Koko will eventually emerge as the winner with the same justices ruling in his favor as we are aware, the TRO thing is only of one the cases filed.

    Huwag tayong mawalan ng pagasa.

Senators Juan Ponce Enrile and Miriam Santiago are feasting like hungry vultures in the disintegration of the opposition. The Senate committee on finance and foreign affairs are their targets. Divide and rule tactics at work. This is the real politik in the quest for senate presidency. The GO-UNO is a coalition of different political parties.

    Malacanang operatives are exploiting GO-UNO weakness’ point via compromise and horse trading. The opposition should not fall onto Gloria Arroyo’s sinister plan. She wants a tame Senate and feels safe under Manny Villar leadership. There’s a strong possibility that Gloria Arroyo will support Villar’s presidential ambition in 2010. Why? She needs a protector after her stolen term expires. Gloria and her loyal generals are responsible for crime against humanity.

Ramos made a lot of blunders during his presidency. These men need the protection of the current admin so they will do all they can to support whoever is sitting in Malacanang to protect their interests. The tiyanak will do the same thing, she will make sure that she will be in good graces with the next sitting president so all her abuses will not be judged harshly. It is all about politics. Villar is playing his hand at it too! When the article about an opposition winning senator, “sleeping with the enemy”, he was the one who came to my mind. The action of Villar, Alan Cayetano and Chiz Escudero, being softies to the tiyanak will be the second kiss of death for these GO winners. The Filipinos will give them the same treatment as the TUtas and even worse, when they run for office the next time around! If these GO winners are aligning with the tiyanak, they have to be very careful. We are watching every step of the way and we have a SCORE BOARD! Once they become trapos again, this spells THE END of their political carreers!

    Junking the TRO appeal of “Senator” Koko Pimentel by the Supreme Court means only one thing – then the scripted moro-moro of Commission of Election starred by the COMELEC Cheat Benjamin Abalos will proceed as expected and proclaim Tita Migz Zubiri as the 12th “elected”-Senator of the Republic.

    For sure “Senator” Koko Pimentel will not take this sitting down. He will protest to the electoral tribunal but with the experience of Senator Loren Legarda on her claim for the Vice-Presidential revalidation, the snail-paced move by the electroral tribunal (a little over than 2 1/2-yrs) will be seen again.

    These operators and their “sponsors” of electoral fraud must be charged with electoral fraud. Their practice must be stopped once and for all.

    While it is disheartening to know that the Supreme Court did not grant the TRO as petitioned by Koko Pimentel, I would like to think the justices acted purely based on the case as presented.

    A fact lost on many. Legal disputes are fact-intensive.

    It’s a shame some people “think” the Supreme Court is a sham, an embarassment and what-have-you, merely because they’re doing what’s mandated by law and not by what certain groups want.

    The unano is actually trying her dumb (damnest) best to destroy the apparent reconciliation achieved even by the candidacy of our favorite Senator Trillanes, whom I hope Villar will not be too ambitious to try to stop being the kind of hero worth putting on the pedestal by all Filipinos, the epitome of what is really good in the Filipinos.

    This actually reminds me of the interviews of Filipinos who fought in WWII that I am presently translating for a TV program for the commemoration of the end of WWII in August in Japan. Interviewers there in fact reminisced and longed for the return of the Filipinos of old with their strong faith in God, good nature, and most of all, love for what is right and proper unlike the kind of Filipinos represented by the like of the unano, JdV, Zubiri, et al who have destroyed the foundation of the country that heroes of old tried hard to build.

    i am not sure how to react on this senate struggle but i like to give the younger senators (chiz and alan)the benefit of the doubt. on the other hand, if villar actively sought the support of the tu’s he ought not be in the go’s block for one can wonder who is he opposing. the senate presidency is quite a long way to the presidency, even historically speaking. showing his greed at this early stage only place this guy further from his ambition.

    Trillanes is not qualified to run for president and vice president 1n 2010 because because minimum age requirement for those position is 40. He would only be 38.

  53. On the SC Decision junking Pimentel’s petition for TRO – Being a unanimous decision, I tend to believe that, given what was presented to them, the decision is right. This decision, however, must not be seen as a defeat for Koko. He may have lost the initial battle, but the war isn’t over yet.

    I agree with one of the previous posts. Here we are praising the SC for a decision which agrees with our sentiment, only to call it names after handing down a decision contrary to our sentiments next time around. Mali yata. If we are to evaluate our institutions, we must not do it on a per instance basis. We should step back and evaluate it from a wider perspective. On the whole, I still trust that the SC will eventually dispense justice whenever it is asked.

    On Chiz and Allan becoming soft – Again, I would not judge them on a per pronouncement basis. I still believe that their hearts are in the right places. It is Villar’s seeming ambivalence that bothers me.

    We want our leaders to be discerning enough to know what is morally right and fair. Let us give them enough allowance to do just that. We were happy when they won. Let them do what we voted them to do in their own way, in their own time…

    We know how rotten they are, why would we praise them, for instance when they decided against Aling Gloria’s CPR, EO464 and PP1017 to name a few? Indeed, why would they deserve our praise when all they did was to display nothing more than good common sense in deciding against government pronouncements even a grade 3 pupil would obviously see as evil?

    We all voted for Chiz and Allan. Now, when they haven’t even begun doing what we voted them to do, we question their integrity because of trivial pronouncements?

    Personally, I wouldn’t be too quick to praise their good deeds, neither, will I be too quick in criticizing them when their views differ from mine.

    AS to Trillanes’ pronouncements after the oath-taking, I liked it best when he said “The truth cannot be libelous”.

    Zubiri is a witting victim as cheating grinds to its climax for want to save face on the senatorial election defeat. One slot after Honasan and maybe some more may preempt the imminent call of the people for impeachment. But Zubiri can defuse the growing national tension by conceding irrevocably. He must choose defeat now, its the honorable thing he can do but not anymore if he lose on the remaining canvass.

    While it may be saddening to some of us, the non-issuance of the TRO is not at all a defeat of Koko’s case. What he TRO would have achieved only anyway was to prolong the waiting for 30 more days that would have provided an even wider opportunity to fine-tune the forged results. It is a foregone conclusion that Comelec is determined to proclaim Zubiri as the 12th Senator sooner or later, and Koko has that in mind.

    But the main case will still have to be resolved in the SC.

    I believe that this is part of Koko’s strategy, look, he filed a TRO without evidence, he already knew beforehand he’ll not get one but what’s the harm in trying? But he had the Maguindanao Special Board expediting the count, doing away with all the GO lawyers’ objections and all. That made Comelec commit more errors in the process and dug themselves a deeper grave.

    At the very least, he still dictates the tempo and keeps the enemy guessing. Meanwhile, the SC still has to resolve the main complaint, which is that the Comelec disregarded the laws and its own rules, which we all know is very much within Supreme Court territory. He’s not a bar topnotcher for nothing.

    In the meantime, I can relate with your disappointment, but I’m giving the SC the benefit of the doubt. Koko, too.

    Ka Enchong: Maliit pa ako my father who was a lawyer explained to me that Lady Justice is blindfolded kasi Justice when equal scales she holds is blind. Kaya nagtatanong ako ngayon, kasi malabo ang nakikita ko..Erap’s case, Evelio Javier’s case, etc. Iilan nga lang seguro pero ang nakikita ko tilted ang scale na hawak ni Lady Justice sa atin lalo na ngayon. Pero sa paghalal kay Trillanes- there is hope for a better tomorrow. I hope to live long enough to see him elected as President..Re Cayetano-sa tingin ko wala na ang investigation sa bank accounts in Germany…it is close to being closed.

    I second the motion. Erap has stated that he wants to retire from politics although I know for sure that he will continue what he has begun. I know of the many charitable foundations he has. One is being run by a priest I know, and with or without Erap being physically there, the charities go on.

    I, myself, don’t want him reelected or what, but I guess he deserves to finish his term of office for which the Filipinos voted for him in 1998. Kung matanggal si Unano, he deserves to be put there instead and finish the projects that he started.

    I knew one in Palawan that was in fact worked with a friend in California using some US Care money. It was supposed to make the Philippines food sufficient. Nasira ang plano nang pumasok si unano!
