Camp Capinpin, Tanay – Saying there effectively no longer is an accuser against them, 28 military officers accused of plotting to unseat President Gloria Macapagal-Arroyo in February last year will ask the Supreme Court to junk the case against them.

“The most important point that we raised this morning is the fact that the charge sheet was signed by a certain Captain Armando Paredez who had, by the admission of the Judge Advocate [General’s] Office, already reverted to civilian status…in other words you have a charge sheet that can no longer be sustained because there is no accuser, the accuser has become a civilian and, therefore, already outside military jurisdiction,” said Francisco Chavez, legal counsel for Major General Renato Miranda, the highest-ranked accused.

“You have a case here where you have 30 accused but there is no accuser, and we pointed this out to the court this morning, but our motion to have the cases dismissed on this basis was denied. We are accordingly elevating the matter to the Supreme Court,” said Chavez.

Chavez also said their option to exercise peremptory challenges remains.

Earlier, Southern Luzon command chief Lieutenant General Alexander Yano, who presided over the military court for seven months and seven hearings, had to bow out after Miranda exercised his right to peremptorily challenge his presence in the panel.

This time, it was the turn of Marine Colonel Ariel Querubin to challenge General Cardozo Luna, who replaced Yano, his wife, Maria Flor, said.

Maria Flor said in a phone interview that her husband was forced to issue the peremptory challenge against Luna to “spare him from the mockery of this sham proceeding.”

The Marine and Scout Ranger officers are charged with mutiny and four other alleged violations of the Articles of War.

I am actually amazed at how the people of the Philippines could allow a bunch of crooks to decide things for them, and practically deprive them of literally participating in the running of their government with laws that these idiots promulgate and pass for them not to really make life easier for them but to deceive and oppress them.

    I am not actually saying that we are free from this kind of graft and corruption the Philippines is ridden of especially with a criminal there acting like she owns the Philippines and being a queen who can make threats like the Queen of Hearts in Alice in Wonderland who can order anyone’s head to be cut off, but what makes our system, laws, and everything better in Japan is that we, the people, have a say in what is happening in our country, and no one can be free of any responsibility even of the decisions the PM make for the people. Over there, we understand very well what the democratic principle is all about, a government FOR、OF and BY the people. It is not a government for, of and by one criminal and her cahoots.

    Thus, I don’t see why the court of the Philippines can even be under the control of the criminal at the palace by the murky river regardless of whether or not she is really under the control of AFP. Nakakulo talaga ng dugo if these gallant men are deprived of justice that they deserve to have. Dapat diyan mag-coup d’etat na sila.

The judges of the courts in the Philippines, including the Supreme Court, should be ashamed of themselves for allowing these criminals headed by the election cheat of Gloria Poohtah to make a mockery of the law in the Philippines. They should have a better federation of lawyers in the Philippines. Unfortunately, what they have in majority in the Philippines are lawyers in the category of lawyers that are mentioned in the Bible as the same bunch that will be condemned at the Judgment Day. Kawawa naman ang mga sundalong katulad ni Col. Querubin if they are not spared of these kangaroo courts they are being subjected to. Will surely pray for them.

    While I am hopeful that the SC will junk the case because there is no longer an accuser..I am apprehensive and doubtful that the justices will not.. are they not all appointed by GMA? Their loyalty is not for the accused and this was shown many times in their past decisions. Theirs is blatantly glaring for GMA. Lady Justice is not blindfolded. Lady Justice does not hold equal scales..tragic indeed.

    What happens if the Supreme Court’s ruling ended in a draw? It may be compared to Koko Pimentel’s fate in Maguindanao fraudulent votes at the Supreme Court. Maraming alipores si Gloria sa Korte Suprema. Baka balik uli sa Esperon’s Kangaroo Court.

    Unfortunately, Sec. 67 of the Omnibus Election Code was repealed by Sec. 14 of RA 9006. This section, which in no way has any connection to what RA 9006 was all about, was surreptitiously inserted before the bill was passed by the 12th Congress. This is why even Gloria’s lawyer Romy Macalintal believed this Sec. 14 is unconstituional.
    This is also why I believed this is a chance to do some thing concrete against that LYING CHEATING STEALING Gloria. I’m not a lawyer, I’m an OFW here in far away South Pacific; so is there any lawyer here in this thread who can initiate a challenge before the Supreme Court of the (un)constitutionality of this Sec.14 RA 9006? If this might result to preventing Lapid being a Senator again, then it’s one less Gloria stooge in the Senate. And I believed it’s a service to the nation.

    DKG: Ang ibig mong sabihin if the Supreme Court’s ruling ends in a draw..that is it? they are guilty and jailed for life? Hindi ba ang draw- they can not make a definite decision? puede din silang i release and the case is dropped. And if in Esperon’s Kangaroo Court ay wala na ang accuser..sino ngayon ang maging accuser…si Gloria? and the judge is Esperon? Kung ganoon nga ang mangyari the people will have a good reason to revolt..and the whole world will know the truth..something good could come out…at bakasali matulungan tayo ng buong mundo..am I dreaming an impossible dream? puede din mangyari hindi ba. At the moment though all we can is let’s pray together..

    At the rate the court martial case is going, it may take a while to find a complete panel to try these officers. Correct me if am wrong, but the way I understand this case, by February 2008, if the panel is not yet completed and the court martial has not yet begun, there is no more case. Coincidentally, it will also be Assperon’s retirement from the service then.

    Yes, it is scary for the case to be ruled by an evenly divided Supreme Court. But I am hopeful that our justices will look at the merit of this case based on previous cases of Honasan and the Batasan 5. Allegedly Honasan’s group and the Batasan 5 joined forces with these incarcerated officers to oust the tiyanak last February 2006. Honasan is now enjoying his freedom(although we all know how he did it!) and the Batasan 5 are enjoying their freedom too. So why are these men of honor still incarcerated? It looks to me more like this incarceration is to keep these officers from assperon and tiyanak as long as they can. The fact that the accuser is now a civilian and the fact that there are now only 5 generals who can sit on the panel, this number may include assperon, tolentino, dolorfino and the other higher ranking officers, tells me that the case against these brave officers is getting weaker by the day. It is just prolonging the incarceration so assperon and the tiyanak can do whatever they please in the AFP without the scrutinizing eyes of these few good men!

  12. I’ll write about the court martial trial yesterday tomorrow. But so far, five “presidents” of the court martial panel have already been ejected. Yesterday, it was like a show “The Weakest Link” where Edu manzano would say, “You are out.”

    Things were happening so quick, before we could even familiarize with their faces or even get their names right, they were already ejected.

    So far this is the score:

    Lt. Gen. Alexander Yano ejected by Maj. Gen. Renato Miranda’s challenge.

    Brig. Gen. Raul S. Caballes, ejected by Brig. gen. Danny Lim’s challenge.

    Lt. Gen. Cardozo M. Luna, ejected by Col. Ariel Querubin’s challenge.

    Maj. Gen. Michael Mendoza, ejected by Col. Januario Caringal’s challenge.

    Maj. Gen. Cyrano Austria, ejected by Col. Armando Bañez’ challenge.

    Maj. Gen. Jeffrey Sodusta, ejected by Col. Custodio Parcon’s challenge.

    There are only 11 officers much more senior than Miranda. But except for Yano, all the rest are junior to Miranda.The court martial panel has ruled that “since it can’t be avoided, an officer lower in rank to the most senior accused can sit as president of the copurt martial panel.” A mockery of the military tradition!

    I’m sorry to say that this will not happen because the kangarro court has ruled that officers lower in rank than Miranda can sit as president of the panel since “it can’t be avoided.”

    The law member of the panel (Col. Marian Aleido) said any one of the 6,000 officers in the armed forces can sit as head of the panel. Kahit lieutenant.

    Baka pati corporal pwede pa. Nakakagalit!

    Next hearing is on Aug. 10.

    Those who sat as presidents of the GCM are all PMAers and were challenged by fellow cavaliers. Can’t you see something in here? There are 11 officers much more senior than Gen Miranda but these could be all his MISTAHs. How about sending Generals Miranda, Lim, Cols Querubin, et al to Basilan and lead the offensive against the ASG and rogue MILF. Put to good use their military skills, after all, they are all brilliant military strategist. Instead of playing chess or watching those telenovelas, they should be better off biting the bullets in Basilan. Just a thought.

    Ellen, this is indeed a mockery of the military justice system! Can you just imagine the lower ranked officers handing down a decision to convict these gallant officers(two of them are even Medal of Valor awardees) and putting them in jail for the rest of their lives while the real criminals are sitting pretty in their stolen and prostrituted positions? It must be more than demoralizing for the rest of the 6000 or so officers of the AFP( except of course a dirty dozen of them who are benefitting from their bribed positions like assperon, tolentino, dolorfino, allaga(alias alaga) to see the higher officers they so respect go through the ordeal of dealing with assperon’s Kagaroo court. It is really a shame that we have gotten to the most unprofessional AFP the Philippines ever had. Only in tiyanak’s time have we prostrituted all the government institutions. When will this ever end?

    I hope Anna’s wish will come true that when the Kangaroo court will run out of potential panel members higher than General Miranda in rank, that those who will eventually be installed will be those who respect these incarcerated officers and they will look at the case as a baseless allegation! I am looking forward to that day in court!

    Noypi, a great idea indeed! In previous threads, this scenario of sending these marine officers and army rangers to Basilan was suggested by a few bloggers. It is easier said than done. They have to go through the legal process. Asspweron started the case so he has to end it somehow. Asspweron can not just spring them out of that hell hole he had put them in anytime he pleases. He has to go through the process too. Maybe only the Supreme Court can put an end to this Kangaroo court as it is a Superior court to the military court and it is the highest court of the land. Even if the Supreme Court is evenly divided right now, these incarcerated officers may see more justice from the Supreme Court justices rather than from asspweron’s kangaroo court! I still believe that the Supreme court had been handing down equitable decisions lately and the justices seem to excercise independence from the tiyanak! Our prayers are so much needed by these incarcerated officers and enlisted men( 40 or so of them who were put in the Tanay detention without any pending cases). Asspweron simply put the enlisted men in there!

    The comments of PSB although trying to be positive never-the-less some of his words used are but a reflection of the wobbly thoughts most if not all, people feel about the Supreme Court justices (note: justices means the content not the SC).

    The comments included the phrases
    ‘(Maybe) only the Supreme Court can put an end to this Kangaroo court’
    ‘the Supreme Court is evenly (divided) right now,’
    ‘incarcerated officers (may) see more justice from the Supreme Court justices’
    ‘the justices (seem) to excercise independence from the tiyanak!.
    ‘Our prayers are (so much) needed’
    ‘Only in tiyanak’s time have we prostrituted (all) the government institutions. When will this ever end ?.’

    We should be able to rely on the Supreme Court justices but like ALL the other institutions, they have been prostituted. The comments of PSB are unsure and I believe to be a true reflection of the thoughts of people in the country if not the whole world – they certainly reflect my thoughts
    I sincerely believe that things will get worse before they get better – the ship has to become so unstteady that the allies of this Schizoglo will realise its about to go under and abandon ship. As for Schizoglo she will have no alternative but to sink with it.
    But sink it surely will, as night follows day.

    Mockery of the law it is. Kahit pa siguro mga sobrang pinakamagagaling na counsels ang kunin ng mga marines at rangers, walang mangyayari. With all the motions and resolutions of the defense lawyers, all Assperon’s court martial president have to say is, “noted, Trial Judge Advocate (TJA), proceed”, or simply, “resolution denied, TJA proceed”. Very irrational, I was there in the courtroom and sobrang mainis ka talaga! Super bias, no justice, not a single sign. Nakakahiya ang nangyayari sa justice system ng military dahil sa pambababoy nila. Truly, Gen. Luna’s hands were spared from the mockery of a sham proceedings. Luna should thank Col. Querubin.

    The true colors of the officers asked to be a part of this kangaroo court is certainly coming out. Even the ones who are expected to have a higher standard of conduct are obviously trying to please asspweron to be on his good side. Baka nga naman magiging Cheat of Staff din sila balang araw. These flip floppers are learning fast that in a government where the head has no morals at all, the best way to get to the top is to play their dirty game. From the gravevine I heard how the court martial panel tried to railroad the proceedings through and through without regard for the right procedures. Downright dogs!

Over in Japan, when the court starts advertising their rulings in the media even before a formal trial can be started, the case is more often than not dismissed, and the people in charge of prosecuting the case are likely to be dismissed likewise. So, how can one expect a fair trial in a court filled up with appointees of a criminal fondly called by many as “unano, pandak, tiyanak and lately, the poohtah!” Yuck talaga!

    There is no such thing as draw on the 7-7 votes on the Koko-Zubiri fight. In any civilian or military tribunal the concept of a chairman/president, etc is only a tie breaker. He abstains from voting if one side has already majority vote. Thats the reason its called tribunal for three sides, the proponents, the opponents, and his own side only needed during a draw.

    I really feel sorry for Filipinos, who are saddled with a lot of idiots running their government like hell. I cannot imagine anyone getting elected to a position by cheating for example in Japan.

    Over in the land of one of my ancestors, cheating in elections will mean jail term and being banned from politics and/or getting any position in the government for life, and reason why the die-hards would rather commit suicide than lose face unlike in the Philippines where die-hard cheats like Gloria de Poohtah and Dayana Zubiri can still face TV cameras, and say without blinking an eye, that they are right for the positions they covet and steal even when the people watching them cannot even have a minute to run to the bathroom to puke and spill out viles from their tummies.     At first sign of cold or flu, begin taking at least 8 g (8000 mg) of vitamin C as ascorbic acid every twenty minutes for 3 to 4 hours until bowel tolerance, and then smaller dosages of 2-4 g every 4-6 hours for ten days to prevent recurrence.

    1000mg of Vitamin C for every 10kgs body weight taken daily could prevent any disease [colds to cancer].

    For whatever it’s worth, I recommend the ever dependable calamansi.

    First, an all-out war against the Moro Islamic Liberation Front was announced by Malacañang and the Armed Forces of the Philippines (AFP) leadership, to get the MILF to surrender to them the mutilators of 10 Marines in Tipo-Tipo, Basilan, with a July 23 deadline.

    Then, the deadline was extended and the all-out war against the MILF was changed to “punitive police action” against the Muslim insurgents who beheaded the Marines.

    Now, President Arroyo and her AFP chief of staff, Gen. Hermogenes Esperon Jr., are holding their fire against the MILF, and instead are concentrating their fire on the Abu Sayyaf, on an announced all-out offensive against the bandit group.

    I agree what Esperon and Gloria are hatching, doing in Mindanao is pure theatrics.

    First, Esperon said, “Let’s keep our cool, don’t jeopardize the peace talks, yakatiyakyak, nyanyanyanyanyanya, etc., etc.,” then he says, “I would like to ask our dear MILF folks to PLEASE return the weapons that my troops lost during the ambush, please?”

    Of course, Eid Kabalu laughed in his face and said, “Fxxx you, Hermie Esperon! Sod you, mate, finders keepers! But tell you what, send me a letter and I might consider…”, to which Esperon, still at his cowardly best retorted, “Look, Eid, ok for the weapons, you can keep them but since we’re friends, I’m giving you MILF folks 1 week to surrender the people from your MILF lot who beheaded the Marines just so I can show something to the rabid media in Manila, you know what they’re like? C’mon, even one or two kids from your ranks will do…”

    Obviously, the MILF spokesman not only just sneered but also said, “Come and get ’em if you can, Hermie!”

    Kabalu knew that Esperon, the coward who can’t scratch his crotch and think at the same time wouldn’t and couldn’t do any bloody thing…

  41. So Gloria and Esperon to play up to the media gallery staged the deployment of a couple of hundreds of marines complete with stage props, mortars, guns, grenades, bayonets (ooops, outlawed na pala sa Geneva convention ang bayonets). Then what? The troops land in Mindanao to get a suntan!

    And know why Esperon and Gloria are doing that? Not because the US, Canada or Japan said they’d cut Esperon’s balls, ooops, aid to RP I mean but because Esperon and Gloria want so badly to show their good faith to the MILF by giving MILF commanders and fighters all the time and leeway to prepare themselves, gear their beheading troops for battle, provide them insight into AFP plans of attack and most of all, to allow ’em MILF to take the higher ground so they can slaughter our troops easily (allow MILF to adopt the Gen Giap strategy)…

    The junior officers of the AFP must realize that their enemies are NOT in BASILAN, they are right here in Manila – one in Malacanang and the other in Quezon City.

    The good foot troops of the AFP must know that this pair of traitors, Esperon and Gloria aided and abetted by the rest of the members of the AFP Board of Generals don’t give a hoot, nor give a damn about whether they live or die because in truth, as sure as the sun rises, GLORIA AND ESPERON ARE THEIR ENEMIES, DEADLIER THAN THE MILF IN MINDANAO!

He was then the army chief but he wanted so much to get the Cheat of Staff position so he was the one who handed the heads of Gen Miranda, Gen Lim and Col Querubin and later those of the other officers to the tiyanak. Since asspweron knows the injustices he did to these officers, asspweron is keeping them in jail as long as he can while he is in position as the Cheat of Staff. Senga’s fault? Bakit pa niya tinawag itong si asspweron when the disgruntled officers were at his office. Sa totoo lang, Senga was able to talk to these officers to simply go back to their barracks and they did. Gen Lim actually submitted himself to house arrest thereafter. No one marched on the streets as earlier planned so ano ba talaga ang kasalanan nila? For me, ang kasalanan nila ay bakit hindi nila itinuloy kung ano man ang binabalak nila para sana wala ng salot na katulad ni tiyanak at si asspweron! Ginamit lang ni asspweron yung alignment kuno ng left sa right and the soldiers and the tiyanak used the scenario to justify the proclamation of 1017 which the Supreme Court later junked. The irony of it all is, Honasan is now free (he was supposedly the brains of the rebellion) and the Batasan 6 are free( the brains of the left) and these brave soldiers who stood up for what is right are still in jail! Sila ang naging scapegoats ng siamese twins ng kadiliman(tiyanak at asspweron)!

    Soldiers are called rebels or heroes depends on whether or not the alleged coup or revolt succeeds or fails. If FVR-Enrile led groups failed in 1986 Edsa Revolt, those soldiers who included Honasan would have been charged, convicted and jailed. However, they won so they became heroes. The Magdalo group, without questioning their patriotic stand and sincere motive, would have become heroes if the alleged mutiny succeeded. That’s how the whole event and scenario is all about. Next time, rebel soldiers or those planning similar attempt must make sure that they succeed.

    Goji, was there ever a coup or revolt last February 2006? I doubt so. Disgruntled officers maybe because of the widespread cheating that the tiyanak, asspweron and the other generals orchestrated using the AFP and even the marines which never before had been done. In the past the army was used but not the marines but in the 2004 elections, the marines were used for the election rigging as well. All the responsible higher ranking marine officers could not stomach the election fraud and they approached Senga about that. The marines is now headless. Allaga “alaga” who is now the marine commandant was one of the generals who was also implicated in the election rigging. Yun ang kapalit ng role niya sa pandaraya. They took out Gen Miranda unceremoniously and put “alaga” in as the acting commandant. This caused the Ft Bonifacio stand-off on Feb 26, 2006 when Col Querubin protested the sudden removal of Gen Miranda and the appointment of “alaga”. Kaya ang morale ng marines ay napakababa nagyon. Compounded with the recent deaths of the 14 marines who were in Col Querubin’s brigade. Col Querubin must be grieving the death of his men(seen in the videos crying with him in Marawi) when he was sacked as the Brigade Commander.

    Anna says, Col Querubin looked sick. He is still grieving and if he has his way, he will avenge the death of his men for sure!

    Here’s what we need to clarify with the term “mutiny”, “coup” and “revolt”. These might sound the same thing but upon careful scrutiny, they don’t. But I’m not in authority to distinguish each one from the other. Maybe some readers could share what they think and know. I for one am with the Magdalo group. It’s no different from the RAM during and after the Marcos years. Unfortunately, many of the RAM figures have or are benefiting from the same crooks that they tried to oust. Look at Honsana…Bitbit and so many others who are in the government. Would this Magdalo group become the same as RAM later or in the future when the smoke has vanished? I don’t know. It takes principled individuals to continue the vision that they have been fighting for. And I can see that in Senator Trillanes and the rest. May the Lord continue to guide and help them.

    Good point, Mrivera. “For” and “with” are different. Someone brought up that the killing of the Marines was done by the government to create an anti-terrorist hysteria. I would like to believe this too. Recently, I watched an episode of Hitler.
    The film described how he climbed up to the the leader of the German Nazi using deceit and intimidation. He was even jailed so he could project himself as the champion of the German race. He used political parties to his advantage. He made good use of people and connection. Hitler also used “terrorist” to justify his actions (like Bush and Arroyo). When the time was ripe to gain control of the entire country, he declared a stop to all political activities and suspended press freedom. One by one, his enemies were picked up and eliminated. He even ordered building a concentration camp. The rest was history. Gloria Arroyo seems to be headed for the same route. She’s now behaving like Hitler’s counterpart in this modern day.

    Madali lang naman tapusin yang problema sa Mindanao. Sa dami ng namatay na baboy sa Central Luzon dahil sa hog cholera at swine flu (Flu hindi flew, kasi yung huli ang ibig sabihin, si IpDye, nakasakay sa helikopter!) pwede nang mantikain yung mga taba saka ibuhos nila sa Tipo-tipo. Ewan ko lang kung hindi isurender ng mga tao yung mga pumugot.

    Maraming magagawa kung gusto. Pero kung takot, lalo na kung mauungkat ni Akbar yung Hello Garci, babahag ang buntot ng mga tuta, at lalong kukulot yung buntot ng mga baboy.

    Sa susunod na thread ay ipinoste ko yung parte ng transcripts ng Hello Garci tapes tungkol sa Tipotipo, kay Akbar, kay Rashma Hali, at militar.

    Tamaan sana ng hog cholera yung mga dambuhala na nasa babuyan ng Malacañang!

    to everyone here who posted their sympathy…..my salute!!!thank you for the prayers offered…i know GOD never leaves us…sa mga nariring ko lang na comments regarding esperon ,kahit saan sulok ng camp puro negetive…un lang mere kusinero ng kumbento, who was serving there for decades…basta nalang pinatalsik and pinahiya ng “beloved wife ni esperon”…see? simple and good people creates more karma diba…if hindi man kami ang maningil sa kanya,well there are so many people pa na medyo na agrabyado nila…

    Magno, it will be a while before the kids of these officers will continue with their fathers’ legacy. A lot of these officers have very young children. Mrs Aquino(Jason’s wife) just gave birth to a baby not too long ago. Cordero’s child is not even a grader.
