Men of valor fight for decent trial

Brotherhood runs deep among the men-in-uniform.

That bond showed in last Friday’s court martial trial in Camp Capinpin when comrades in the battlefield found themselves on opposite sides of the courtroom.

valor-awardees.JPGWhen Col. Ariel Querubin exercised his right of peremptory challenge on Lt. Gen. Cardozo Luna during the court martial trial last Friday, he asked the general who had barely warmed his seat not to take it as a “personal affront.”

“I want to spare him from the mockery of sham proceedings,” Querubin, one of the only two living Medal of Valor awardees in the Philippine Marines, told the court.

When it was the turn of Lt. Col. Custodio Parcon, the other Marine Medal of Valor awardee, to challenge Maj. Gen. Jeffrey Sodusta, he said, “Though it breaks my heart, I confirm.”

Querubin and Parcon are among the 28 officers led by Maj. Gen. Renato Miranda and Brig. Gen. Danny Lim who are on trial for their alleged involvement in the aborted plan to withdraw support from Gloria Arroyo in February 2006.

Parcon had tried to avoid exercising his single right of peremptory challenge on Sodusta because he wanted to reserve it on Rear Admiral Emilio C. Marayag, who is in the list of officers designated by Esperon to serve in the court martial trial of Miranda et. al.

But Marayag, commander of the Naval Forces in Western Mindanao, had to be in Zamboanga for Arroyo’s visit last Friday.

For a moment, the court granted Parcon’s request. The law member of the court, Col. Marian Aleido, upheld the assertion of Parcon’s lawyer that military rules allow the accused to exercise his right for peremptory challenge at any stage of the trial.

After a five-minute recess, however, the court announced that Aleido was overruled and the accused who does not use his right for peremptory challenge when called is deemed to have waived that right. Thus, Parcon, though his “heart breaks” had to eject Sodusta from the court.

We wondered why Parcon was specially interested on Marayag. We found out that it had something to do with keeping the integrity of the Medal of Valor award.

A Medal of Valor is the highest military award given by the Armed Forces of the Philippines (AFP). To earn this award, AFP personnel or member of the recognized guerrilla forces must have been involved in actual conflict with armed enemies, distinguishing himself conspicuously by gallantry and intrepidity at the risk of life above and beyond the call of duty. To justify an award of the Medal of Valor, one must perform in action a deed of personal bravery or self-sacrifice above and beyond the call of duty as conspicuous as to distinguish him above his comrades.

Querubin earned his Medal of Valor when he commanded a Marine battalion landing team that engaged an estimated 300-strong, fully armed band of Moro Islamic Liberation Front rebels in a 24-hour gun battle in Kauswagan, Lanao del Norte from March 18 to 19, 2000.

Parcon earned his Medal of Valor “for conspicuous gallantry and intrepidity at the risk of life above and beyond the call of duty” during a series of encounters against heavily armed Muslim kidnappers at Bgy. Kapayawan, Isabela, Basilan Province, from 07 to 15 May 1993.

As the commanding officer of the 61st Marine Reconnaissance Company tasked to infiltrate the Abu Sayyaf Camp Al Madinah and rescue victim Anthony Biel III, Parcon, then a captain, “led his men on a hazardous mission, pitting them against extremely fanatic and suicidal armed elements.”

In 2004, Arroyo awarded the medal of Valor to Lt. Col. Noel Buan, a former captive of the New People’s Army supposedly for successfully neutralizing Abu Sayyaf leader Hamsirajih Sali in Basilan.

It was a controversial award because of the questionable circumstances of the military operation that Buan undertook. Military sources allege there was not exactly an encounter because Sali was invited to a dialogue. There were members of the military who believed there was an element of treachery in the so-called encounter and definitely not worthy of a Medal of Valor award.

Marayag was a member of the board that deliberated on the award for Buan. Sources said Parcon appealed to Marayag against giving the highest military medal to Buan to preserve the integrity of the award.

Against the rule that it should be a unanimous decision, the award was given to Buan even when only eight out of 12 members approved.

In last Friday’s hearing, it was not only integrity that Parcon, his fellow officers and their lawyers fought for. Frank Chavez, counsel of Gen. Miranda, protested the blatant railroading by the court when their objections were denied one after another. “Please examine your conscience. Are you doing the decent thing?”

Chavez said “it’s not only the rules of general court martial that are being violated but even the rules of decency.”

Chavez said they would have to go to the Supreme Court to save the lives and careers of the 28 men of honor.

    Atty. Chavez is a good lawyer. But so far, I think his record (winning cases) is not that very impressive. The Fortun law office would have been better. Chavez failed politically and to keep his image alive, he needs to take high profile cases.
    But please don’t get me wrong, he’s good. He was the former Solicitor General. I hope he runs again in 2010. Decent men deserve decent trial and represented by decent lawyers. Chavez is a decent lawyer. Let’s all pray for them and wish them the best of luck.

    I know why they shaved their heads, Ellen. Was it a show of protest? My comment about the two looking like the former bald comedians was meant as a joke. I didn’t mean to offend. I apologize. It also reminds me of a group, a cult, during the Marcos regime who also shaved their heads as they protested on the street in Manila. I forgot the leader of that cult. It starts with letter M. Indeed, shaving one’s head is a sign of protest…or defeat. During the old MICAA days, Coach Tito Eduque and his team shaved their heads after losing. I think Eduque coached the Ysmael team (or was it Yco?). I’m not really that old. I was a little boy then but even that early, I already love basketball.

    I believed that these men in uniform who are persecuted by arroyo government will be vindicated when gloria and her pigs will be out of power. Power won’t last long.

    For the meantime, just fight the good fight soldiers. Never surrender. The country needs your courage and honor to fight the ideals of a true soldier. A stinking name gloria and esperon should not ruin your spirit, your honor and your dignity.

    Jalendou, it may be true that these men will one day find their places in higher government positions, that is if they survive the legal assaults hurled against them. There are just a few good men in the AFP now and they are mostly in detention. Only a few more are left in the active service and they are outnumbered by the rotten ones. Medal of Valor awards are won because the gallant awardees won the battle inspite of being outnumbered and with less fire power. These two medal of Valor awardees will hopefully conquer the enemies, this time not with actual firefighting weapons but with the legal armory they both have to defend themselves from tiyanak and asspweron. The “honorable”? men on the court panel have their own “carrots”(dog food, money, promotion, a house and lot or even a promise of being another Cheat of Staff if they would nail these incarcerated officers!) dangled by these two wicked bogus leaders(tiyanak for masterminding the oust of Erap by conniving with the left-did you see Satur etc in one of her famous photos? and the right-Angie Reyes leading and then by using the comelec and the military to cheat for her in 2004 and asspweron for manning the military cheating operations for the tiyanak in the 2004 and putting Gen Miranda, Gen Lim, Col Querubin etc in detention).

    The battle is long and uncertain but these two Medal of Valor awardees should know that they are continuing to fight for what is right and defending what they believe in that the citizens come first before themselves unlike the two bogus tiyanak and asspweron who only have to continously protect their stolen thrones at the expense of the country.

    May I quote a portion of columnist Herman Laurel’s most recent column. So, Angelo Reyes and the other Generals also committed treason. Why aren’t they punished and even rewarded?

    Like all institutions and symbols that stood for the excellence, righteousness, gallantry, fairness, and many other positive virtues of this once-great Filipino race, Gloria singlehandedly, and without much effort, destroyed their significance integrity-wise like she invented the word “circumvent”. In many respects, she even completely disregards rules and the laws to best suit her interests.

    The Medal of Valor Award was not spared. Her first ordained valor medalist, yantok-swinging Vidal Querol, who was deadly against unarmed rallyists and took credit for being Gloria’s hero when the “masa” stormed Malacañang by ordering his snipers and blocking forces to fire against the teenagers who were “armed” with debris from a construction site. Which was the part that’s either “heroic” or “sacrifice beyond the call of duty” in this instance?

    Under this bogus regime, symbols we once held important have become mere tokens for patronage, or worse, bribes.

    I fully charged the battery of my DVD player and if this is the right CD, Ltc Noel Buan was an Npa captives and he has a shoulder length hair when he was released. Mayroon na palang Medal of Valor ang mga sumusurender sa laban at naging war prisoners. To be awarded a Medal of Valor the recipient needs a recommendation from the Medal Valor board. The board will deliberate on his qualification. Hindi basta-basta ibinibigay sa sundalo iyan. Lintik pala itong si Arroyo, her childhood girl-scout experience as a cheering committee in selling “bukayo” qualify her to master the military rules, laws and procedures. Dinaig pa si Mc Arthur.

    The name Buan sounds familiar to me. I wonder if he’s related to a former Gen. Buan (first name maybe Manuel) who once headed the Highway Patrol Group. For many years, people branded the late Gen. Fabian Ver as the worst Chief of Staff.
    Now that there’s Esperon, I wonder if people would pass that title to this Arroyo boy.

    Ltc Parcon want to exercised his peremptory right to Marayag because he knew that the admiral has a tainted reputation of being bias and a rubber stamp. His peremptory challenge went to Sodusta instead, and it is really a heart breakening. His peremptorily challenge is not only to eliminate extremes or impartiality on both sides and who knows maybe, Sodusta is on their side and what a waste of one vote. His peremptory also assures the parties that the jurors before whom they try the case will decide on the basis of evidence presented before them.

    Thanks for good close up pix,really I was amazed.I’m weaponry tech specialist on aircraft&land vehicle,I didn’t see these type of armored personel carrier on war museum. That’s not US equipments,are these designed by 4FT.HUMANOID, for curiousity,how much it is?only one liter of flammable liquid,you’ll be roasted.How they can defend the country if war hardwares are like this or substandard,not even 2 hours the entire country will be in the hands of the invaders.

    Whoever got the idea of sending the tank out and be pictured in all its majestic bearing should be given commendation if not the medal of valor. Just imagine his bravery and gallantry for parading the sophisticated tank of the AFP from its vast arsenal, part of the modernization program by Gloria Arroyo. It could annihilate the enemies of the nation without firing a shot. With that picture alone, the MILF, MNLF, ABUS, NPA will die….laughing.

  30. By the way, another brave and principled officer who was nominated in 2003 for Medal of Valor award was Cpt. Gary Alejano of the Marines.

    But Alejano is a Magdalo member and one of the core leaders of the “Oakwood mutiny”. He didn’t get the award. He is now in detention with now Sen. Antonio Trillanes.

    I eagerly await the reaction of Ellenville to the news that U.S. Congress restored the$30 million military aid for the Philippines for 2008 that was earlier slashed by the State Dept. The aid comes again with strings attached. I’m eager to know if the aid should be rejected, first because it is desired by Ate Glue and Esperon, and second, because it comes with strings attached.
    The string? A matter about meddling with our sovereignty – U.S. concern about extra judicial killings here.

  42. The first war tank I saw was the one left by the US soldiers in a street in front of Manila when I was growing up a year or two after the US granted the Philippines its independence. I remember that war tanks then did not have rubber tires. No wonder these humvees more often than not rendered useless during battles as what is now happening on the humvees of US soldiers in Iraq.

    A member of our church in fact was run over by it in Iraq while taking a nap. Kundi ba naman isa pang inutil itong si Esperon! Bakit niya pinalabas iyong humvee?

    Displaying such military surplus during the trial of gallant soldiers incarcerated for defying a stupid order by a criminal is no doubt stupidity of the worst degree! Yuck!

Anyway, I hired a truck to carry it to the garden of my house in the mountains to prevent people from passing in my otherwise open plan path leading to one of the slopes… Hahah! The children loved it. They used to play IN it (di pwedeng pagulungin dahil masisira ang fields and the roads, heheh!) Every year, kiddies and I would paint it different color.

    In the end, it looked like a technicolor barbie doll tank… and guess what my daughter called it? Daisy! Hahahahaha!

    That little Army armoured vehicle in the pic reminds me of my own tank.

Quality is often sacrificed to make up for the “extra expense.”
    The prize deals, however, are obviously those involving big-ticket items such as armed personnel carriers, aircraft and patrol vessels.
    According to military insiders and contractors alike, contracts entered into by the AFP involving such items have, at the very least, been suspicious.
    Among these deals are those inked by the Aquino administration before it exited in 1992. One of these contracts was for 150 Simba armoured vehicles from GKN of the United Kingdom. Another was for 18 S-211 basic trainer jets from Augusta of Italy.
    The Philippines now has the distinction of being the sole nation using the Simba, which even the United Kingdom, the manufacturer’s home country, does not use.
    The local partner of the Simba deal, Asian Armoured Vehicle Technologies Corp., had a board dominated by retired military officers, including General Juanito Dator, and Col. Cesar Pio Roda. It was organized only in September 1989, or close to the award of the contract.
    A “revolving door” phenomenon has emerged: a number of military officers assigned to technical and logistics units, upon retirement from the service, have signed up as consultants or executives of certain defense suppliers they had favored earlier.
    Like the deal signed just a few months ago by Reyes and Defensor, the Simba deal had an in-country component—the production of tractors and heavy equipment.
    No such thing happened, and no transfer of technology took place. Only an assembly line of knocked-down parts was set up at the firm’s offices in Subic.
