Malacañang yesterday said it will invoke Executive Order 464 in the Senate probe on the revival of the “Hello Garci” wiretapping controversy.
Executive Secretary Eduardo Ermita said while the Palace feels that the Senate has the right to reopen investigations, its inquiries must be truly in aid of legislation and should go hand in hand with what is provided in the law on the attendance of officials to the hearings.
Ermita said resource persons should be given an invitation plus enough time to prepare. He said Palace and defense officials would meet first to find out about the “circumstances” of the soldiers and officials named by former T/Sgt. Vidal Doble.
“All along, we thought the (issue of the) Garci tape was behind,” he added.
Ermita said Malacañang is not trying to make it difficult for the Senate to conduct an inquiry.
Ermita said EO 464 was not totally declared unconstitutional by the Supreme Court and that only sections 2b and 3 were voided.
The controversial provisions of EO 464, which was issued on Sept. 26, 2005, provide that some officials have to secure the prior consent of the President before appearing in any congressional hearing.
These officials covered under the mantle of executive privilege are from the Cabinet, the Armed Forces, and the PNP, and others who may be determined by the President.
After the Supreme Court ruling on EO 464, Arroyo issued Memorandum Circular 108 on July 27, 2006, which gave specific guidelines on the appearances of department heads and other executive officials before Congress.
Under MC 108, Malacañang imposed restrictions and guidelines on appearance in congressional hearings which involve conversations and correspondence between the President and other persons on matters of privilege; state secrets, including military, diplomatic and other national security matters which in the interest of national security should not be divulged; information between inter-government agencies prior to the conclusion of treaties and executive agreements; discussion in close-door Cabinet meetings, as well as internal deliberations of government officials comprising part of a process by which government decisions are made or policies are formulated; and matters affecting national security and public order.
The Palace also imposed rules on what an official should do if he is invited as resource person in the House of Representatives or Senate.
The rules include asking Congress for the possible needed legislation that prompted the need for the inquiry, the subject matter of the inquiry and the questions that would be asked – all of which would be forwarded to Malacañang for approval by the President through the Executive Secretary.
Ermita said the Arroyo administration would survive the controversy considering that it has gone through several crisis situations.
President Arroyo, during an informal interaction with barangay folk in Quezon City, lashed at her critics.

Armed Forces chief Gen. Hermogenes Esperon Jr. said: “I have yet to look at the statement that was made about the Doble matter. Until then, I will not make any comment.”
But he did say that Doble was wrong in saying the military kept his family at the basement of the quarters of then AFP chief Efren Abu. “I am now occupying the quarters of General Abu … and I must tell you that there is no basement.”
Esperon was among the four military generals named by Garcillano in the wiretapped recordings. Esperon was then the AFP deputy chief of staff for operations and the concurrent deputy chief of the military’s Task Force Honest, Orderly and Peaceful Elections.
It was implied in the recordings that Esperon, then Southern Command chief Lt. Gen. Roy Kyamko, and then Joint Task Force Comet chief Maj. Gen. Gabriel Habacon helped in the cheating to ensure the victory of the President.
The fourth general, then 1st Marine Brigade commander Brig. Gen. Francisco Gudani, supposedly supported an opponent of the President. He has appeared in the Senate to testify poll fraud committed in the Lanao del Sur.
The Commission on Elections welcomed Doble’s re-surfacing but said it is adopting a wait-and-see attitude.
“Let’s see first what he (Doble) has to offer, this time in the Senate,” said Comelec spokesman James Jimenez.
“Wait-and-see kami as of now talaga. Kung may maputanayan sa investigation, that is the time the en banc will do what they deem as proper actions to it. Sa ngayon kasi wala pa namang inilalapit sa amin,” he added.
The militant group Bagong Alyansang Makabayan said Doble’s statement about the military’s wiretapping activities were important not only to electoral fraud allegations but also because of the “dangers of surveillance” under the Human Security Act. (Malaya by Regina Bengco)
