SC eyes ‘right to truth’ writ

To further address the “chilling” rise in the incidents of extrajudicial killings and involuntary disappearances, the Supreme Court yesterday said it is studying the issuances of the writ of habeas data to uphold the people’s “right to truth.”

Chief Justice Reynato Puno said the writ of habeas data will be effective alongside the enforcement of the still to be implemented writ of amparo, which will deny authorities the defense of simple denial when they are sued to produce before the courts the bodies of victims of involuntary disappearances (writ of habeas corpus).

The use of the writ of habeas data, he said, has been proven effective in solving problems of enforced disappearances in Latin American countries like Brazil, Colombia, Paraguay, Peru, Argentina and Ecuador.

The writ can also be used by any citizen against any governmental agency to find out what information is being held about his or her person.

“This is the right to know what types of data about an individual are stored on manual and automatic databases, and it demands that there must be transparency on the gathering and processing of such data,” Puno said.

“The exercise of the right to truth will expose all the falsehoods, all the fabrications that public authorities and private persons usually put up to evade responsibility in cases of extralegal killings and involuntary disappearances,” Puno said in a speech at the Siliman University in Dumaguete City.

Last July, the tribunal held a two-day National Consultative Summit on Extrajudicial Killings and Enforced Disappearances where various recommendations were made to address the problem.

Among the recommendations was the adoption of writ of amparo, which is now being implemented in Latin American countries, to protect the constitutional rights of the people from abuses.

At present, relatives of victims of forced disappearances can avail only of the writ of habeas corpus as a legal remedy to compel authorities to present before the court the victims. – Evangeline de Vera

    Masyado ng matagal ang paghihintay ng mga pamilya ng mga biktima na magkaroon ng hustisya ang pagkawala ng kanilang mga mahal sa buhay.

    What ordinary laymen do not know in fact is that there are written and unwritten laws that can be the basis of whatever a judge of a court may offer and pass judgment on issues not clearly defined by law. Any good lawyer is aware of this regardless of country of origin.

    Now, this is not the case in the Philippines because of the lack of the rule of law since the lawbreaker and her cahoots took the reins of government, and run the country like hell.

    Tama ka, dahil sa mga Pidal, lalong naging backward ang Pilipinas. Ang pinakahibang in fact are the recent claims of this clan that they own the whole Philippines like the case submitted to the court by Homobono Adaza about some family related to the Pidals claiming that the Americans borrowed money from them when they bought the Philippines from Spain but never got reimbursed, thus, they own the whole Philippines.

    Ang tapang ng apog di ba? Bakit ngayon lang nagke-claim. Bakit hindi noong ibigay ng Tate ang independence ng Pilipinas. Dapat diyan ibasura ng korteng sinasampahan ng kasong ito na you bet is nothing but the usual landgrabbing. Iyan ang trabaho nila as in granting ancestral domain to the MILF! Stupid is as stupid does.

    I’d really like these rights to truth be implemented ASAP for the sakes of the innocents who were kidnapped by the usual suspects.

    Meron akong kalaro noong araw na ang tagal ko nang hindi nakikita. When I visited Pinas the last time, I asked her parents about my playmate’s whereabouts. Matagal na raw “nawala” habang tahimik na nagtatrabaho sa pabrika sa Limay, Bataan. Tinukoy ng mga saksi na militar ang kumuha, hanggang doon na lang at dahil “isang kahig, isang tuka” ang pamilya ay tinanggap na lang na ang kanilang anak ay patay na.

    Kaya ang safehouse sa Limay ay dapat ipa-raid ng SC. Ang dami diyang itinatago! Siguro ay dapat tuunan ng pansin ni Aling Edith ang lugar na iyan. Ang Abucay ay “libingan”, ang Limay ay “taguan”!

    So far, okay naman ang pamamalakad ni Chief Justice Puno kung ikumpara sa dating Davide. Ngayon ay Punong-Puno ng pag-asa ang Pinakamataas na Hukuman ng bansa. Sa mga pahayag ni Puno sa media at public speech niya, halata natin na medyo may prinsipyo at konsiyensia si Puno. Nasaan na ba si Davide? Hindi pa nga na confirm ang appointment niya nagtratrabaho na sa UN. Si Davide ang siyang pinakawalanghiyang Chief Justice ng SC sa kasaysayan ng Pilipinas.

    Ang dami ko ring first hand info on these extra-judicial killings and kidnappings. Meron akong compilation ng mga documents na ginawa ng mga NGO dito na nagtitiyagang pumunta sa Pilipinas to get the bare facts na isina-submit namin sa Diet, etc.

    I serve as a translator lalo na ng mga documents na nakasulat sa Tagalog, etc. dahil believe you me, may mga polyetong panakot na ginagawa ang military na ipinapaalam pa kung sino ang susunod na dudukutin nila to Kingdom Come. Ang problema, iyong kikidnapin at isa-salvage (sa kanila ko nga unang narinig ito to mean the opposite of what it originally meant in English) ay mga walang pera para makapunta sa malayo para magtago!

    Isa sa mga kasama ko in fact nasaksihan ang pagdukot doon sa isang activist sa Pangasinan who led the movement against the construction of a dam there with the use of Japanese ODA. Sa pagtakas nila, natibo siya at na-infection ang kaniyang paa. Gangrene ang labas, pero buti na lang nakauwi agad sa Japan, at dito na ipina-opera ang paa. Muntik nang ma-amputate pero buti na lang dito naman ay hindi mahilig mamutol ng paa, etc.

    Buti naman kung talagang serious si SC Judge Puno sa paghanap ng katotohanan tungkol sa mga patayang ito at pagbibigay ng hustisya sa mga biktima na sabi nga, “And the Lord said: What hast thou done? The voice of thy brother’s blood cries unto me from the ground.” (Gen. 4: 10; Moses 5: 35)

    Yuko: I attended a conference last March at the UN as a rep of the Third World Movement Against the Exploitation of Women, and the Phil. attendees were sked to meet with him as the new Ambassador..hindi ako pumunta at ang sabi ko masakit ang ulo ko. allergic kasi ako sa mga tauhan ng adm. The other time Willie Gaa dropped by at our meeting of the Iloilo Society but had to leave before he came. Kasi magkodakay kuno..I attend some events sponsored by the Consulate and I have had the chance of meeting the Con Gen. Posh nga daw ang apt. niya. Ang pagkakila nila sa akin ay ang married name ko..(but now that my husband had died) I more often use my maiden name..at pihado ko na tatanungin ako na “how are you related to..” I am proud of my cousin.Malaki talaga ang gastos ng gobierno sa mga garbo nila..

  19. Yup, iyan din ang tanong ko, Rose? As far as I am concerned, I am with the AI in Japan lobbying for Japanese politician’s support against the extrajudicial killings in the Philippines. The other one or two Filipinos we were able tag along do not belong to the UPAA in Japan.

    I moderate an egroup for our UPAA in Japan, and have been posting notes on this issue, but no respond. One or two has also joined our movement for the preservation of Philippine patrimonies in Japan, and save them from being squandered by the greedy couple.

    I read that article of Maceda in Tribune. He mentioned that the greedy woman was an alumni of UP just because she got a doctorate in Economics from there, but even that was faked I am told.

    Everybody there knows that some UP president granted her a doctorate that is more like honoris causa in exchange for something. In short, peke din ang diploma!!! 😛 Wala na bang totoong ginawa ang kumag?

    Depressing nga when one hears of these sonabagan UP alumni messing up the affairs of the Philippines. Buti na lang nagkaroon ako ng isa pang alumni association membership. May legitimate ID pa. But wait, meron din isang ungas doon. Si Bill Clinton!

    UP Diliman, once again, is in deep mourning. A graduating College of Public Administration student was killed in a frat hazing. The senior, a neophyte recruit of Sigma Rho Fraternity, whose members include senators Frank Drilon, Ed Angara, and Juan Ponce-Enrile, probably hoped to join the elite roster of proud fraternity brothers who are political biggies. But, look again!

    Me, I’m just one proud babarian.

    Ang alam ko infiltrated ang group ni Joma during the Martial Law. Iyong pag-kidnap sa mga nawawala na hindi na nakita pihadong trabaho ni Tabako and his men na walang kinalaman si Marcos, or biktima din ng labo-labo sa group ni Joma. Ang alam ko nagpatayan pa nga sila sa Mindanao. At least, this is what I heard from a member of their group who has since left the party na based na ngayon sa Japan.

    I get to know them here because I have a friend from the Communist Party of Japan who often requests me to act as interpreter when they have visitors from abroad especially kung pilipino.

    As I have stated previously, I am not a Communist. I consider myself more as a Socialist although I shuffle between supporting the Social Democratic Party (SDP) and the Democratic Party of Japan (Minshuto) comes election time.

    If Chief Justice Puno true to his words that he will apply the writ of Amparo,Kudos Senior! The fight in court will be Amparo vs Arroyo. If Puno is concerned with the protection of individual fundamental rights, the basic difference is that habeas corpus primarily guarantees individual freedom whereas the writ of amparo guarantees all fundamental rights. Both writs are similar in the sense that they protect individuals in their fundamental rights from arbitrary acts of government. habeas corpus and unconstitutionality in concrete cases require a direct interest in order to have standing. This is either by invoking an injury or a threat of an injury to individual rights .An injury occurs in any case in which the law or application of the law imposes an immediate, direct and personal obligation that abrogates or modifies rights legally vested in the person of the complainant the law or application of the law is because these procedures require an arbitrary act, but the unconstitutionality in concrete cases refers to the constitutionality of laws. Therefore it is through the application of a law in which an authority bases its act or decision that an infringement of constitutional right is derived.

    Writ of Amparo, is to protect the rights and freedoms protected by the Constitution.It can be filed by the offended against all disposition, act or resolution of the public administration that violates or tries to violate his rights or freedoms protected by the Constitution. Writ of Habeas Corpus is to protect specifically the right to personal freedom.It can be filed in favor of the offended by any citizen against the responsible authority.

  37. BTW, what is this stupidity about asking US help in prosecuting Joma Sison? Hindi ba naiinsulto ang mga hukom, et al sa Pilipinas that the US ambassador to the Philippines would even make such insinuation that Filipino prosecutors are incompetent that they would be needing US help?

    Joma Sison is a domestic problem of the Philippines. He is not America’s problem since so far, we have not heard of any international terrorism that his group has done. Iyong ngang Japanese Red Army na nagbomba ng airport sa Tel Aviv in the 70’s hindi humingi ng tulong ang Japan sa US but coordinated with the Israeli police and the Interpol to apprehend them. Siguro ang involvement lang nina Joma ay iyong pagbibigay ng Philippine passport sa Japanese Red Army member, and nothing more! Kaya bakit makikialam na naman ang mga kano?

    It’s time Filipinos stop being America’s “white men’s burdens” and even their preys as a matter of fact. Puede ba tumayo na sa sarili ang mga pilipino. Ang yabang-yabang wala naman palang ibubuga!

    I am for prosecution of Joma Sison if he is indeed guilty, but he should be tried and convicted by Filipinos, not Americans since crimes he is being accused of that the Dutch have arrested him for are supposed to be against fellow Filipinos committed on Philippine soil.

    BTW, Philippine lawyers should see the angle of a breach in the manner by which Sison has been arrested. Since the complaints apparently came from the Philippine government, they should check if there had been a Philippine official present when the raid, arrest, etc. were made as per provision of some international convention and protocol. Kundi infringement iyan ng sovereignty ng Pilipinas that I doubt the idiot criminal at the palace by the murky river understands!

    Ang writ of Amparo ay katulad din iyan ng writ of Mandamus or Prohibition, na ang ibig sabihin ay puedi mong idimanda ang korte kung nagkasala ang huwes with negligence in applying the law na nagbunga ng perwesyo sa taong parte sa kaso,pero mahirap mapatunayan na nagkasala ang huwes dahil mayroon silang ethical court proceedings na sinusunod at ibinabasi nila ang desisyon ng hukuman sa mga similar precedence case na ang ibig sabihin ang desisyon ng huwes ay hango sa mga kaparehong naunang kaso, kung ano ang hatol ng korte.Katulad halimbawa ang naunang Supreme court decision on Santiago vs. Comelec, where they ruled against the drafted implementing law on people’s initiative.Kaya iyong mga kontra sa people’s initiative ay puedi nilang gawing basehan ang Santiago vs.Comelec case.

    Honestly, I have a very little idea about these so called writs, and I don’t even know if I am right to say that, if ever the Supreme Court decided to go ahead with its issuance my only wish is for them to put more teeth and cover up all the bases for possible loopholes para walang lusot ang mga criminal sa military at mga pulis.

    I’m not of legal mind. Amparo or Mandamus, basta pagbutihin ng SC at nang may laban naman ang mga tao sa katarantaduhan ni Gloria at mga sekyus n’ya.

    Bibilib lang ako sa korte kung bibigyan nila ng halaga at tamang atensyon ang kaso ni Trillanes (appeal to serve included), Magdalos at nina Col. Querubin at mga kasama. Kasi, diyan makikita kung ang atin ngang korte or SC ay objective at hindi na nasusulsulan pa ni Gluerilla.

    At kung itong mga writs na hangga ngayon ay nasa plano pa lang ay kaagad ipatupad ng SC at bigyan ng ultimatum ang mga usual suspects. Masyado silang malambot sa mga military officials ni Gloria. Pag ayaw sumipot ay palaging pinalulusot.

    mabuti rin nga kung mandamus writ ang masusunod dahil magkakaroon ng linaw ang lahat ng sapilitang pagkawala ng mga pinaghihinalaang bikig sa lalamunan ni gloria arroyo. kung susundin din ng pamunuan ng hukbong sandatahan.

    masaklap kasing nangyayari eh parang ‘yung mga hula ni nostradamus na panay delubyong nakakapanindig balahibo sa kilikili.

    mabuti sana kung sina gloria, esPWEron, ermita, bunyeta, claudio, gagonggonzalez twin at itong mga sipsep na heneral ang biglang mangawala at hindi na muling makita, at least magkakaroon ng katahimikan sa ating bansa.

    that our courts pretending to be pitifully clueless and continue to function without any clear-cut direction, against the backdrop of more than a thousand hapless victims whose families turned mourners, for some, is not only unbelievably stupid, but a great cause of horror and harrow to many!
