Biazon barred from holding committee hearing in Trillanes’ cell

Update: Esperon thinks a Senate hearing on civil service is political

Custodians of Sen. Antonio Trillanes IV on Thursday prevented Sen. Rodolfo Biazon and some 34 other people from entering Trillanes’ detention cell inside the Marine headquarters to conduct a Senate hearing.

Marine commandant Maj. Gen. Ben Dolorfino said the Marine soldiers denied entry to Biazon, erstwhile Marine commandant and chief of staff of the AFP, and his companions, due to the ruling of the Makati City regional trial court barring the holding of Senate hearings for Trillanes’ sake at the brig.

Dolorfino said Biazon’s group arrived at the Marine headquarters at around 8 a.m. for a hearing of the Senate committee on civil service. He said the Marines allowed Biazon’s group to enter the camp but barred them from Trillanes’ cell, saying they were just enforcing the court order.

Trillanes is being held at the Marine brig pending the completion of his court martial for his role in the 2003 Oakwood mutiny while a Navy lieutenant. He is also facing a charge of coup d’etat before the civilian court of Makati with 30 other cohorts, 28 of them officers.

“We are just following the decision of the court preventing Senate activities here at the brig. His motion before the Makati City RTC to conduct hearings inside the brig has been denied. Last week his motion for reconsideration was denied,” Dolorfino explained.

Dolorfino said the Senate staff which arranged the hearing at the brig on Wednesday should go to Makati RTC Judge Oscar Pimentel for relief. “I am just the custodian. They are dealing with the wrong person,” he said.

  1. Based on what I’ve just read, perhaps, Dolorfino is right.

    But again, we come to the crux of the matter. There is no rule of law in Pinas so, Judge Pimentel who issued that ruling is suspect. Dolorfino who is also wearing the military skirt of Gloria is simply being a toy soldier – can’t blame the asshole.

    Biazon and his fellow senators should move in to do something about this particular stupid law. The whole bunch of them – 23 or 24 senators, supposed to have the mandate of the Filipino people cannot enforce their mandate? OK, if so, they should bloody do something about the law.

    Ano ba sila? Pipitsuging senators? They were not impressive yesterday… they’re even being less impressive today.

    Nabili na rin ni Gloria ang mga yagbols ni Makati RTC Judge Oscar Pimentel. Ano ba namang mga court judges ito at 4’9 lang si Gloria ay hawak sila lahat sa mga yagbols!

    Nakakaasar dahil habang ang mga galamay ni Gloria ay naghahasik ng lagim sa Pinas, si Gloria kasama ang pamilya at minions ay ayun sa New York at nagpapasarap. Wala man lang mag-Thaksin sa tangnang ‘yan!

    Tama nga naman, there will be a denial of equal treatment if Trillanes’ motion is granted.

    But if I remember right, equal treatment is only due if people are similarly situated. You do not give 100% to the genius and the bobo – they are not similarly situated.

    So, the question is, similarly situated ba ang ibang inmates kay Trillanes? Do they have the mandate of 11 million voters? Pilipit at katawa-tawa ang logic ni Judge Pimentel. Maybe we should address him as Your Humor.

    Correction system baga? Ano ang “correctional activities” sa kulungan? Basket weaving, development of skills for livelihood para ma-reform ang inmate?

    Isn’t the participation in the legislature the highest form of reform for an alleged coup plotter like Trillanes? Hindi ba sa pagtakbo at pagsama sa legislation, he is affirming his desire to work within the folds of the law? Shall we put this activity below basket weaving as a way to correct this “misguided soldier”?

What the heck AFP chief General Esperon is trying to prove? The essence of republican democracy is where sovereignty resides in the people and through its elected representatives or leaders. Civilian authority is, at all times, supreme over the military. Anyways, he just follows orders from his bogus President Gloria Arroyo. Maj. General Dolorfino’s stand is understandable for being is a rotten toy soldier of Gloria. Let’s see if these Gloria’s toy soldiers can stand Senate’s grilling on Tipo-Tipo fiasco. Sen.     At my younger age, I held someone at bay but with my concience in a dilemma I let him go. A few days later, the end of the gun was pointed at me with that guy holding it.
    Good thing he was off his target. Our feud is alive to this day. A sympathetic guy told me that once you point a gun at someone, pull the trigger. Thats the chain of command, no less.

    Senator Trillanes should have pulled the trigger then so we dont have this kind of trouble now. He had all the backings then.

    Re: Motion to Quash for Trillanes. There seems to be one mistake in the proposed motion. Capts. Gary Alejano and Nicanor Faeldon are Marine Captains. They are not equivalent to the rank of a Naval captain which in turn is equivalent to the rank of Army or Air Force colonel. A Marine Capt. is equivalent in rank to an Army Capt. They would not therefore, fall under the jurisdication of the Sandiganbayan. Which is too bad because we would love to set these men free, together with Sen. Trillanes.

    Tama si klingon. Marine captains have army rank, not naval rank, if we follow US ranking. Presumably, Philippine Marines follow the same ranking.

    Ellen, according to Atty. Rey Robles, one of Judge Pimentel’s arguments against allowing AT4 in the Senate is that he is being allowed to perform his duties while in detention. He noted his staff were allowed to communicate with him, Senators were allowed to see him, etc.

    Now, that Esperon has ended it, AT4 should seek relief from the court.

    The detained senator was supposed to conduct a hearing yesterday that aims to raise salaries of teachers from P9,000 to P16,000. Ditto for soldiers, cops and the rest of the bureaucracy. He believes this will be the first step in curbing corruption in government. (Brainless Esperon may have taken it as a personal affront.)

    All government employees should start cracking! Start with Esperon’s ass!

    Here’s how it goes:

    Navy captains PN rank equivalent to air force, army and Philippine Marines colonel.

    Navy lieutenant commander rank is equivalent to major in air force, army and marines

    Navy commander rank is equivalent to lieutenant colonel in in air force, army and marines

    Trillanes is supposed to be navy lieutenant (but senior grade) so his rank is equivalent to captain for the rest of the major services including Philippine Marines.

    Navy lieutenant (junior grade) is 1st lieutenant in other major services while ensign rank is 2nd lieutenant in other major sevices

    I don’t know – I don’t know if it’s possible or not.

    All I know is that for the moment the economy is consumer driven, backed by the almost 13 billion dollars in contributions of the OFWs and is the basis of that consumerism in the Philippines today.

    I do believe that there’s great disparity in the economic situations in Pinas between those who are at the trickle down receiving end and the people who have the capital and taking advantage of the great economic growth announced by Gloria, i.e., big business getting bigger.

    you cannot engage me in that line of argument for the simple reason that there is a greater evil today – one that is not trillanes.

    trillanes has been mandated by the Filipinos to represent them and to be in their service in the Senate, in other words, for all intents and purposes, agreeing or disagreeing today as to whether he was right or not at the time has become irrelevant. People have spoken.

    the best level playing field is to release him and to allow him to do his work – if he doesn’t deliver, then chuck him in the bin during the next electiosn.

    and if we are to argue about the man, I don’t know enough about him and don’t know him personally to say whether he is sincere or not but I give him the benefit of the doubt. When you have young officers who challenge the establishment, their motives are most often valorous, their methods perhaps questionable but against Gloria, what can you expect?

    Gloria has used every trick in the bad book, i.e., most questionable methods to get hold of power, so what right has she to say that those who disapprove of her cannot use the same?

    Therefore, along those lines, I will side with Trillanes against Gloria anytime.

    Don’t know about that. If we are to look back in history, it’s true that people (the masa) will support a leader who can lead. The masa have never led a revolt… someone’s got to lead.

    What you don’t know is given a leader (who just may spring up from somewhere one of these days,) the people who are dispappointed today will move. There is no real LEADER today in the strictest sense of the word – hence your feeling that there’s apathy.

    Trust in the people to know when to recognize that leader. As atty said, history has the luxury of time. Perhaps, it’s not Trillanes, might be another one. But when he/she arrives or gets there, people will spot him or her and will follow him/her.

    The problem with taking him to the ICJ direct is that it can’t be done.

    The rule is that all recourse to indict him must have been exhausted in Pinas first. And there must be absolute proof that the mechanisms to charge him have failed in Pinas. (There are so many criteria: war crimes, human rights abuse, crimes against humanity, etc.) But the charges must be backed by proofs that the Philippines has not acted on the complaints before you can bring a case to the ICJ. The complaints must also be made by a group of people and not by an individual only.

    1. Among the accused are Gary Alejano and Nicanor Faeldon;
    2. Both are Marine Captains;
    3. The Marine Corps is a service of the Philippine Navy, patterned after the US Marines;
    4. The jurisdiction of the Sandiganbayan is defined by PD 1606 as amended by RA 8249;
    If the facts above are true, and there are no amendments to PD 1606 after RA 8249, then I think the motion below will present a good fight.
    I am posting this purely for the intellectual exercise. If somebody finds it useful, then I shall have been doubly rewarded.The jurisdiction to try this case, we submit, lies in the Sandiganbayan, not this Honorable Court. Said Court’s jurisdiction, is provided as follows:

    There is another contention though: the apparent ‘commission’ shared between him and Dichaves (the owner in name of the Velarde account) gained from the sale of the Belle Corporation sales. That’s GSIS money.

    I’m not clear on this particular issue – anyway, I do believe that Estrada was not a hands on president, I am positive he adopted the armchair presidency method and the worst is that he took things for granted and so was careless. At that level, impossible to take things for granted.

    My beef is that he was toppled unconstitutionally – when people start toying with the constitution to grab power, the man, Erap in this case, is almost irrelevant, it’s his office, the one created for him by millions of people who voted for him – to me it’s their right that’s been breached, it’s those millions, in effect, who were disenfranchised most illegally.

    In that sense, one may call me pro-Estrada not because I like him (I don’t like the man and the politician at all) but because he was constitutionally mandated to be the president of the republic – all accusations against him should have been tested in the only court that was prescribed by the constitution – in an impeachment trial in Congress (lower house & senate). Therefore in theory, no illegal force on earth should take that right away from him, the right to be tried constitutionally and not toppled down by a bunch of hooligans.

    It is all a question of moral and legal principles!

    Yap, Marcos and Erap – Two people who FVR dislikes. FVR dislikes Marcos because he was by-passed ba Gen. Ver, and he dislikes Erap too, because Erap is about to file cases against his corruption during his term. That is why FVR and his men are the in the shadow of Gloria’s fake government. But most of all, FVR wants again to rule the country because he wants to get…the Marcos’ hidden wealth!

    Agree “Commissions in sales of shares of stocks are COMMON practice.” what I’m not clear on is whether Erap was paid a share of the commission. If that’s true, then that is wrong. But as I’ve said, not sure so…

    The GSIS/SSS commission was handed personally ny Willy Ocier to Jaime Dichavez, was it proven that Dichavez delivered the check to Erap? No.

    Jaime Dichavez owns a big chunk of Tagaytay Highlands, a Belle project. A very large portion of the lands in that area are owned by Doña Mary Ejercito and husband, ONE MILLION HECTARES, the title says. But this was not presented by the prosecution. Absolutely no connection between Erap and the check for the commission except for the Jose Velarde account which was Dichavez’ as supported by bank evidence which the court failed to appreciate.

    Dichavez is still missing but the government is not interested in finding him and bringing him home. Without his testimony, the prosecutors’ Jose Velarde theory cannot be given full credence. Without his testimony, Erap loses his chance to get a corroborating witness to his claim. It was unfair to the defendant and it sure would’ve created enough doubt to acquit him.
