Trillanes: “Tuloy ang laban!”

trillanes-gma7.JPGThis is to clarify recent news reports and headlines pertaining to my PDAF Allocation and yesterday’s court apology.

It had been my campaign promise to waive my PDAF allocation and I remain committed to that. However, I was informed by my Senate staff that since I am entering in the middle of the Fiscal year of 2007, half of the P200M PDAF allocation per senator is already part of the budget and, therefore, cannot be waived anymore. Otherwise, if the said amount would not be programmed, it would be like giving GMA a P100M blank check. Hence, I decided to have my PDAF funds programmed to various public hospitals all over the country as well as for the construction of school buildings. This is not a crime!

However, what had been conveniently excluded in the reports is my letter to the Chairman of the Senate Finance Committee, Sen. Juan Ponce Enrile dated 28 Nov 2007, where I requested that my PDAF allocation for infrastructure projects be removed from next year’s budget which is exactly my campaign commitment.

As regards the court apology, it was very clear in the manifestation filed that the apology was addressed to Judge Oscar Pimentel and the Court since they were never the object of our protest to begin with. We remain firm in our conviction that what we have is a morally bankrupt administration that the Filipinos never deserved. Moreover, standing up against the most corrupt president in history is not something to be ashamed of and definitely not something to be sorry for.

    Esperon’s statement is so disturbing…he is redefining the meaning of deception…the Magdalos should have put the agreement in writing with signature and with notarization…and what under duress he is talking about, I think the threat or intimidation was mutual.

    According to Gen. Lim’s testimony, there was no tension on the part of the officers in Oakwood. There was no intention to shoot and no shots fired. If anyone showed an intention, again, like in the Manila Penn incident, it was the government forces who showed such intents. Remember Gen. Teodosio saying, “We will use a maximum preponderance of firepower against you!” ?

  12. Esperon is claiming that the agreement was subscribed to while under duress. Who was under duress? I cannot understand how a group of 300 junior officers and men can place an entire nation’s armed forces under duress.

    Let Esperon define duress, then.

    In deceiving the junior officers and the negotiators into an agreement that was never meant to be adhered to anyway, isn’t Esperon guilty of Conduct Unbecoming an Officer and a GENTLEMAN?

    Article 133 of the Uniform Code of Military Justice (I don’t know if this is the same as our Articles of War) gives the following examples:

    Examples of offenses. Instances of violation of this article include knowingly making a false official statement; dishonorable failure to pay a debt; cheating on an exam; opening and reading a letter of another without authority; using insulting or defamatory language to another officer in that officer’s presence or about that officer to other military persons; being drunk and disorderly in a public place; public association with known prostitutes; committing or attempting to commit a crime involving moral turpitude; and failing without good cause to support the officer’s family.

    Many have declared that they are against this president; pero ayaw daw ng extra-constitutional means. They will only support peaceful means.     Ngayon may cha-cha na naman to prolong her stay. Of course deny to death, just like that spiel about “I will not run because it will be divisive”. Erap says he will fight any move against cha-cha. The civil society wants nothing of it either.

    “Section 4 of Article VIII is amended by inserting the following as the second and third paragraphs:

    The term of the President and Vice-President elected in 2004 shall terminate on June 30, 2008. Elections for President and Vice-President shall be held on the second Monday of May 2008. The term of the President and Vice President elected in 2008 shall be that stated in the first paragraph of this Section. All subsequent elections shall be held in accordance with the first paragraph herein.

    Barangay elections in 2008 shall be held together with the Presidential and Vice-Presidential elections.”

    Tagalog.

    Ang katungkulan ng Pangulong nahalal noong 2004 ay tinatapos niyaring susog sa ika-30 ng Hunyo 2008. Ang halalan para sa Pangulo at Bise ay isasakatupad sa pangalawang Lunes ng Mayo 2008. Ang panahon ng katungkulan ng Pangulong nahalal sa 2008 ay alinsunod sa unang talata niyaring Seksyon. Lahat ng mga susunod na halalan para sa Pangulo at Bise ay ipapatupad alinsunod sa unang talata niyaring Seksyon.

    Ang halalan para sa mga pinuno ng barangay ay isasagawa sabay sa halalan para sa Pangulo at Bise.

    The above is a constitutional way to kick her out, which will be a direct act of the people. So hindi na kailangan ng mga for sale na legislators. Erap and the civil society can put their money where their mouths are, by working for this amendment.

    Let us see who dances the cha-cha better – the people, or Gloria.

    Tuloy ang Laban! O Tuloy ang laban? I trust that Senator Trillanes will continue to fight this GMA government. However, all along I thought he and his group do not recognize the jurisdiction of the court calling it a Kangaroo Court. They walked out and then now they apologized for what they did. I reserve my judgment as to why they have to apologize. Kahit na humingi sila ng tawad, na-contempt pa rin sila. Kung ako ang tatanungin niyo, kung hindi ako nagsisisi sa ginawa ko ay hindi din ako hihingi ng tawad sa Korte. Anyway, advice siguro ng abogado. May legal reason or implication siguro.

    Tungkol naman sa Pork Barrel na hiningi daw ni Trillanes kuno bago Manila Pen incident, kalokohan iyan. Why would Trillanes ask for it when he and Senator Lacson have given up their Pork Barrel? Among the senators, they’re the only two who refuse to avail of their Pork Barrel. Apostol’s mind is bad as his tongue. I hate listening to him. Recently on TV, he said “Ribilyon” instead of “Rebelyon”. Hayaan na natin itong Apostol ni Satanas…

    Isang malaking katanungan ngayon kung alam ng mainstream opposition particularly from Erap’s group that Trillanes and company would walk out from the court and stage that failed ouster move against GMA in Manila Pen. Supposed to be the opposition groups would gather and do it a day after, November 30. Bakit sinolo nina Trillanes? Gusto ba nilang solohin ang military junta at new government? Trillanes must realize that without Erap and Erap’s group which is composed mostly of poor masses, it is difficult to succeed.

    The Pen incident took place Nov. 29 while the opposition groups would gather on Nov. 30.

    I guess that Nov. 29 was the only opportunity for Sen. Trillanes and Co. to walk out of the courtroom as it was the designated day for the hearing of the Magdalo case. They ‘seized’ the moments, ika nga.

    Sen. Trillanes, Gen. Lim and Co. gustong solohin ang bagong gobyerno? I don’t buy it, wala nga silang weapons at ang guard nila ay naka-wig pa!

    Besides, Gen. Lim is a soldier par excellence, ‘yan ba ang sasama sa military junta?!

    Ganyan din ang sabi noon kay Macoy. But the people guarded the ballot with their lives.

    There are two rallying grounds now – Erap and cory (civil society). After Gloria is booted out, well, kanya kanya na, in campaigning for the candidates.

    We only need twelve percent of the electorate. Yung OFWs, well, they can register as absentee voters. Since there are hundreds of thousands overseas, that would help to achieve the 12 percent.

    This is the only way to constitutionally oust her.

    What is the alternative? Coups? People Power? Wait for two years, while they hatch their own amendment to stay in power?

    Alternative? Realistically or strategically speaking, the only alternatives to my mind is a successful coup d’état is the only way to oust Gloria and to make sure she doesn’t come back.

    However, a coup d’état is no guarantee at all, but not at all, that Pinas and its citizens will end up the winners in a coup d’état exercise.

    People power? I don’t believe poeple power in the Philippines is a viable solution any longer. The country’s elites and civil society have subverted people power. The exercise will leave a lot of legal questions unanswered, eg., Gloria and her husband forever to my mind subverted the operation and they can do it again with bayong and bayongs of money.

    The other viable alternative would be to hold a referendum — if that is at all provided in the Constitution — to ask the citizenry whether they’d approve of a snap election. A referendum containing a yes or no answer would be the best.

    But again, is that Constitutiona and if so, will Gloria submit herself to a national referendum?

    A national referendum to me is the best democratic exercise when a country is politically divided.

    That is exactly what I am proposing. The referendum will ask if the people approve of the above amendment or not.

    Will Gloria submit to one? She can be forced to one, by way of people’s initiative if people can gather signatures of 12 percent of the electorate.

    That is what happened in the failed cha-cha in her favor, but the Supreme Court (Carpio writing) said the signatures were bogus.

    On Esperon’s declaration on why they reneged on the agreement concerning terms of surrender at Oakwood. Here’s my humble opinion:

    Reneging on the agreement made to end the Oakwood mutiny will have repercussions for the future.

    The agreement on surrender terms may now seem favourable for the majority of the mutineers, but at the time they were the best the government could achieve. I find it a bit weak of a government and the military to believe this was duress; there was no need to accept these terms, they could have been harsher (although that might have taken more courage).

    I think that breaking such an agreement indicates a grave lack of faith in ones own word.

    The Philippines has a history of this sort of incident and normally they are resolved without too much problem. The next time resolution will be considerably harder. The rebels will remember that the government cannot be trusted to keep their word and will be harder to appease.

    Breaking the agreement to end the Oakwood mutiny may give solace today to a few who feel they were not harsh enough, but it resurrects the idea of mutiny in the minds of the angry young officers, it brings ideas of injustice to the forefront of young minds, these two will forment the idea of another mutiny and this time there is much more likely to be bloodshed. The next generation of mutineers will have no trust in the word of the government, no respect for the negotiators and will be more prepared to commit acts of violence.

    It is never good to go back on ones word. That way lies anarchy.

    According to Article 7, Section 10 of the Constitution, a snap election (or “special election”) can only be held if there is a vacancy in the Office of the President and Vice-President.

    So, Gloria and Noli must both step down in order to have snap elections, since a vacancy can only be effected by death, disability or resignation.

  59. Frankly, I am gobsmacked that General Esperon, chief of staff of the nation’s armed forces could so whimsically declare that the government was “under duress” at the time of the agreement and therefore was right to renege on the terms of surrender.

    I am absolutely appalled that Gloria Macapagal’s favourite bodyguard turned 4-star general should even consider reneging on the terms of agreement with his fellow military officers is the right thing to do!

    Ang legislation, nakatali ka sa Constitution. You cannot legislate anything contrary to the Constitution, on the philosophy that the representative (legislator) cannot contravene the master (the people).

    But in proposing amendments, anything goes, because it is the sovereign people themselves acting.

    They revealed their hand in the failed cha-cha. Ayaw nilang ma-lengthen ang term ni Glo. She got a stinging rebuke from Carpio (former ally).

    Will they agree to a shortening? The people, via a referendum can force the Court.

    Of course, before we get to a referendum, there will be all sorts of challenges, asking the Supreme Court to prohibit the COMELEC from conducting the referendum – the same challenge mounted by civil society against Raul Lambino.

    How will the Supreme Court rule? Why don’t we find out.

    This is a better alternative than that hare-brained idea of asking Glo and Noli to step down. That is like asking a man in bed with a beautiful woman to get off the bed; he will not

    unless she wants to do it on the floor.

They want to maintain the status quo that gives them ample opportunities to control government and of course! The pork barrel, they have successfully implanted fear into the public consciousness. They especially like to talk about the ghost projects funded by there pork barrel that able to overturn country’s economic progress, destroy our democracy, and rob us of our civil liberties and freedoms.
    What a poor masses can do?Senate become a fraternity club of affluent and millionaires, Congress are infested with mostly corrupt elites, they are all illustrados from a prominent families from their district.     It seems that all these talks, complaints, crappy bs only shows that we are not ready for a change. No one is stepping up, saying, “I am tired of all this bullshit and I’m putting a stop to it!” For now, and I am not saying it won’t happen, it is all baka, sana, papaano.

    GMA may get to finish her term on 2010, if not longer if she can cha chaching the opposition again. And if she and her cohorts get to finish on 2010, you can bet that she is going to be a celebrity, just like Imelda!

The 1898 Philippine Revolution wouldn’t come about, if Rizal and the other propagandists kept silent and acquiesced to the colonizers. Or, if there were no inspiring messages for freedom from our pasyon. Bonifacio would have kept his bolo forever, without shouting a voice, if he lacked the inspiration.

    A real revolution is a mix of several things. One can’t wage it sucessfuly by the gun alone.

    Your proposal to limit charter change to the removal/term-shortening of Gloria and Noli is a good one, and well within the boundaries of law. With that, we will see who is really anti-Gloria or nag-aantay lang makatapos si Gloria. Many lip-servers who openly declare their opposition to the cheating liar are actually pro-Gloria who use the constitutionalist excuse to evade revealing their scales underneath faux skin.

    But I have my misgivings. The cheating machinery is well entrenched in many towns and cities, especially in ARMM. The people there cannot muster enough courage to swim against the current, flowing generously from Gloria’s purse of stolen funds to her warlords’ pockets. I doubt if such towns, even provinces like Maguindanao, will produce the required 3% vote to get the Concon started. Noli de Castro is married to an Ampatuan. The Ampatuans control politics in that province and have won all elections although none were even held!

    Then you also have Lanao del Norte, Lanao del Sur, Sultan Kudarat, Basilan (‘tho Akbar is resting in pieces) and many others whose town are inhabited by a single clan and will vote wholesale for the highest bidder.

    Pagdating sa actual referendum, well, as long as you have Manila, Cebu, and the big population centers, panalo yan. Put Erap and Cory together, panalo yan.

    Ang danger lang, ay yung pagkuha ng three percent signatories. Diyan papasok ang military brethren ni Trillanes to guard those collecting the signatures.

    Atty, the reliance on a vigilant people may be difficult to muster. These last elections, only the exceptions stood out, Fr. Ed and Grace Padaca. Otherwise, the same dynasties and tired old faces were elected. What we need is inspiration that we can do 1986 again. I’m not saying that we should try people power (which, by the way the SC has already ruled as a legitimate means of removing a leader) again. But the bloggers here are right.     Yes. Thats what I do, I have retainers to handle legal arguments for me, I call this firm in Pacific Tower. But lately, I find it more expedient (and less expensive) if I just sit down with the person/s concerned, hear their side, explain my company’s side, and eventually look for a middle ground somewhere and strike a deal. That way I avoid burning bridges, the way things usually result to when you call in the lawyers. But when it comes to issues with a government office asking for money (or more money), I let the lawyers handle it…

    Public office is a public trust. (section 1, Art XI). It is not a right. It cannot be vested. Trust may be lost or revoked by the sovereign will of the people.

    I faced a friend in a land squabble in Cagayan de Oro. We had beers at the Trellis before we flew to the south to litigate. And yes I had the inside track to his arguments.

    An officemate was engaged to a Makati lawyer; another to a SolGen lawyer, we knew each other’s arguments before pleadings were filed. Nag-aargue pa kami sa Trellis before we faced each other in Court.

    People know each other in the profession, and they get deployed to various offices. Ganyan din si juggernaut, he knows men in uniform from both camps.

    Nothing wrong there; legal arguments lang naman, there was no sharing of client info. Sharing of beer, yes; lots of it.

    for sure, today, para masabing di tuta ang COMELEC, it will approve the referendum of your proposed initiative – in which case, a private citizen can challenge the proposed amendment sa Supreme Court, with the OSG defending the COMELEC approval! thats where the ‘main argument’ will come in! kakampi nyo pa si Devanadera or whoever is SolGen at that time!
