The problem with lying

Documents speak for themselves

The problem with lying is that once you start, it’s difficult to stop because you have to commit more lies to cover up the original lie.

And in the process of endless cover up, truth manages to come out.

That’s what happened to the unconfirmed Brig. Gen. Jonathan Martir (his appointment to brigadier general is “ad interim”).

Martir’s promotion is being deliberated by the Commission on Appointments. Since there are two oppositors, Francisco Catibayan and Maria Flor Querubin, wife of Marine Col. Ariel Querubin, the CA decided to defer discussion and decision on it to January.

Catibayan and Querubin’s opposition to Martir’s promotion centers on his having been absent without leave for 750 days (more than two years).

In an affidavit he submitted to the CA, Martir did not exactly deny his having gone AWOL. In fact, he offered a solution: Deduct the unauthorized leave from his available leave balance.

Here are excerpts from Martir’s affidavit:

“Based on the anonymous letter dated 18 September 2006 to Hon. Avelino J. Cruz Jr., then the DND Secretary I, the undersigned, allegedly violated AW 62 (AWOL) for accumulating more than 945 days of absence. According to the complaint, I was only given 195 days of authorized leave which gives a discrepancy of more than 750 days of unauthorized absence, and that my available leave balance of 574.84 days could not offset this discrepancy.

“That based on my three passports issued between 1993 to present namely: number N042406 issued on 21 June 1993 and expired on 21 June 1998 number DD386079 issued on 18 May 1998 and expired on 18 May 2003 and number LL013454 issued on 13 March 2003 and expired on 13 March 2007, I have traveled outside the country on eleven different occasions. However, I would like to clarify that all of my travels from 1993 to 1998 and again from 2001 to 2003 are all official and with authority from the Armed Forces of the Philippines, contrary to the complaint that I was only allowed 195 days of authorized leave. Further my travels abroad were either for military schooling or official visits as participation in Military Defense Exhibits and hence not charged to my official leave balance.”

This is the interesting part:

“That I would like also to clarify that during my travel to the United States on 16 July 1998 to 04 January 2000, I asked a favor from Col Julna Jerry C. Carrillo PN (M) (GSC) to file an extended official leave of absence on my behalf for I will be spending a long vacation with my family in the States, knowing that I have accumulated enough leave balance to be spent there. Upon arrival in the country on 01 January 2000, I learned that Col. Carillo did not file my request for an extended leave of absence because he forgot to do so. The number of days that I stayed in the States totaled 535 days. Considering that this period will be charged against my accumulated leave balance, only 385 days will be deducted, less weekends and official holidays, which totals 150 days. These 385 days of absence can be deducted from my available leave absence of 574.84 days. I will still have an available leave balance of 189.84 days after the deduction.”

Martir said in the affidavit “I have hereunto affixed my signature this 06th day of August 2006 at Taguig City.”

The affidavit was subscribed and sworn to before Col. Pedro G. Herrera-Davila, Judge Advocate General Service on Oct. 8, 2007. That means one year after the affidavit was supposed to have been prepared. If it’s true that it was prepared in August 2006.

Another affidavit, of course was executed by Col. Julna Jerry C. Carrillo who attested that Martir “is an honest and honorable marine officer and that I know him since we were cadets at the Philippine Military Academy.”

He admitted that Martir “asked favor from me to file an extension of his official leave of absence when he visited his family in the States. However, I was not able to file his leave of absence because I overlooked the situation and I thought that I already filed it.”

Carillo said, “I have hereunto affixed my signature this 01 day of August 2007 at Taguig City.”

Davila again signed, “Subscribed and sworn to before me this 18th day of March 2006 at the headquarters Philippine Marine Corps, Marine Barracks, Manila.

Actually the typewritten year was “2007” but Davila changed it in his own handwriting to “2006”. So it was subscribed and sworn to one year and five months before the affidavit was executed!

Someone was lying again. To support that lie, someone falsified documents.

Siguro palusot niya aksidenteng natapakan lang niya siya. That reminds me of after Erap was ousted. Rumor had it that when then PNP Chief Ping Lacson was in the elevator, another military officer who was anti-Erap punched Lacson. Ewan ko lang kung tutoo. Gantihan lang naman. Etong sina Esperon, Barias at iba pa…kawawa iyan kapag bumagsak si GMA. But then, they may be already abroad enjoying their new life when that time comes.

    sir julna carrillo is now based in the US. The last time i talked to him and saw him was sometime in may or june of 2006. he was a week away from leaving for the US then. I am not sure if he went back this year (aug 2007) just to sign that affidavit of JOHN RAT in Taguig city. i’m pretty sure i will come to know about it if he came back this year. but i believe that he doesn’t love JOHN RAT that much to spend hard earned money just to sign that affidavit in taguig city. i wish i would be able to verify that signature of sir julna carrillo on JOHN RAT’S affidavit. pero, kaya mo naman i-find out yan ate ellen. hehehhehehe

    Salamat. Maraming-maraming salamat. The carelessness of Davila gave them away. I think.

    Both affidavits, by Martir and Carrillo, as it appears to me, were prepared and later submitted to JAGS’ Davila at the same time. Davila mistook one for the other, hence, the handwritten correction of the year got mixed up.

    The plan was obviously to antedate Davila’s signature in Martir’s affidavit and simply sign that of Carrillo’s. Not the other way around, as what actually happened.

  19. Sorry, but even if Davila just simply signed that of Carrillo (subscribed August 1, 2007), the typed date of March 18, 2007 is still much earlier than the date of subscription.

    By the way, even if Martir is entitled to leave credits — which still have to be determined — the same will not excuse his leaving the country without a valid travel order or authority required by the civil service. This also means that upon leaving the country, when Philippine immigrations asks him if he is a government employee (which is the question that preceeds the request for production of travel authority or travel order), he LIED. Again.

    1. using “ALL RIGHT, SIR” as answer and granting that he still has that spirit of the Honor Code left in him…DID YOU OR DID YOU NOT GO ON AWOL, JOHN RAT?

    I would not wait for his answer because obviously he doesn’t have the balls to admit it.

    For the information of our bloggers here, these are some of the basic requisites before an officer of the Armed Forces can leave the country for whatever purpose it might be (schooling, training, leaves, etc). I leave it to you to pass judgement on the “forgetfulness of JOHN RAT

    1. During the time that JOHN RAT left for the US, the approving authority for him to be able to do so is the Office of the Presdient. If i’m not mistaken, recently it was downgraded to SND’s approval only.

    2. The question to JOHN RAT is, did he secure that approval before he left the country?

    3. Granting that he did, what type of leave did he apply for and and for how many days? (Leaves of the kind JOHN RAT supposedly applied for has a maximum duration of 30 days. If he wants to have an extended leave while out of the country, he has to apply for it personally every month with the DAFA or Defense Armed Forces Attache to the US)

    4. That alone would show that “forgetfulness is not a reason for him to skip liability. Asking another officer in the person of sir julna carrillo to apply for extended in his behalf is the height of idiocy and administrative ignorance especially from someone who considers himself a “GENERAL” material. Imagine a request for leave done by another person to reach the Office of the President? I wouldn’t be surprised actually because as i know JOHN RAT, he has no respect for institutions.

    Marami pang tanong, but I’ll leave it at that muna and wait for his sycophants to answer for him.

    Lying:This Bgen is lying his teeth…to include Col Carillo. Martir said he asked Col Carillo to file and extend his leave so he can spend a long vacation with his family in the Continental U.S. He spent 535 days of leave in the States and yet he never asked back or follow up with Col Carillo if his request for an extended leave was filed and/or approved by his higher authority. You cannot just assume your request has been approved. You have to follow it up and asked for a copy of orders. Martir is a senior officer an is expected to lead by example and knows his regulations.

    Martir and Carillo are lying! With this number of days on supposed leave,higher headquarters must come out with official orders stating thereto that such and such officers, enlisted, and even civilian working with government especially the AFP must have with them a copy of this Special or General Orders duly signed by their respective Adjutant Generals. Hindi po pwede yung telepono lang. Martir is definitely AWOL (absent without leave) and must be charged accordingly. You cannot just tell everyone that you have enough accumulated leave to offset whatever leave you might have had incurred as a consequence of your absence from the service in connection with your official orders on schooling, seminar, excersises, etc. If you are absent without leave—YOU ARE ABSENT WITHOUT LEAVE period!!! Let him produce those orders from the HQs file (Adjutant General’s Office) and not those affidavids… CARILLO must also be charged for negligence…hindi pwede yung “nakalimutan ko” alibi!! Remember these are Officers of the AFP.

    Stealing:This Bgen is stealing from the coffers of the government as well as from the taxpayers money! Imagine “kung makakalusot siya at hindi ma-charge ng violation of Article 62, AWOL, malaking pera pa ang mapapasa-kanya. Alalahanin mo Ellen na maraming racket sa AFP tungkol sa “accumulated leave”! You can encash those accumulated leave when your retirement comes and/or anytime when budget is made available to pay those accumulated leaves. Imagine Martir’s leave of 535 days in the states, at hindi nai-deduct from his accumulated leave—pera pa ulit yoon at mai-encash nya ulit. Nag leave na—-nagkapera pa dahil naipera pa and leave nya!!! Di ba Pagnanakaw yan! Marami pong ganyan sa AFP (all Services for that matter). One reason why there must have leave form request to be filed by both uniformed and civilian members of the AFP when they file their leave is for accountability both in monetory and personnel matters. My guess is that a person is entitled to 30 days accumulated leave per year with full pay/allowances! Hindi kaba nagtataka kung bakit napakalaki ang accumulate leave ni MARTIR? Hindi ba siya nag-leave since his Ensign days?? …at nakapagipon siya ng ganoong karaming leave??? Hehehe! Meron pa yatang regulations na nagreregulate para hindi ka makaipon ng ganitong karaming leave—The military leadership is mandated to encourage their personnel to go on leave for as long as they meet their respective operational requirements. Sa dami ng daming Pasko at Bagong Taon na nakalipas hindi ba nag-leave itong Martir na ito simula noong Teniente pa sya at nakalikom siya ng 574.84 days accumulated leave?

    Cheating: Martir mentioned he traveled 13 different times outside of the country. Wow!!! Did he ever do his sworn duty to served his country or “malakas talaga sa taas”. GEN YANO of the Philippine Army is a sterling example of Duty, Honor, Country! I doubt if he traveled 13 times outside of the country. On those 13 times MARTIR traveled, (show us your orders) how many times you asked for leave in consequence with your official travel. “Ibig ba nyang sabihin hindi ginawa yung ginawa noong nakaran na nag-leave siya for 535days?? Ang problema eh Hindi yata nakita nina Mr. Catibayan at Mrs. Querubin ang iba pa? They should ask for copy of orders of his leave, orders of his official leave, and others purporting his alleged leave in conjuction to his official travels! This Martir is plain and not just a simple dheat .But a CHEAT in the highest order!

    Dapat lang na hindi eto i-confirm ng makapangyarihang CA. If I was one of those CA, I’d like to ask Martir.”What the heck the government sent you to go on official travel/school/seminar/…etc. and then spend 535 days abroad instead of getting back to work and get your hands dirty and apply whatever you learned in school abroad so we, the Filipino People, can get back our investment in sending you outside of the country!!! But on the one hand, I might just be hallucinating.

    Trillanes has and is making a lot of sacrifice for this country. First, he put his Military career on the line. Now, he has also put his Political career on the line. He is fighting for something that is morally right and has the guts to do so. I believe most military knows Trillanes is right, 11Million Filipinos voted for him. But sadder are those people who seemed to know more of the story behind the issues and yet crippled (by fear perhaps) to go out and testify in court against the accused. If nobody is bringing the issue in court, these people who seemed to know more about the corruption may file a case in court, instead of redressing their rage against the issue (more accurate, against the person)in this blog.

Brigadier General Francisco Gudani, former chief of the 1st Marine Brigade based in Mindanao claimed that he was able to witness and observed all kinds of cheating in Lanao from start to finish. Where was Mr. Esperon during the fraudulent 2004 presidential election?

    I don’t understand the need of a lobbyist to ask more money from the U.S. government to buy weapons to destroy the Filipinos. What we need in the U.S. is to call our U.S. Congress and President Bush to stop aiding the lobbyist of Gloria the thief. I’ll start now.

    For a moment i thought i could still the restlessness in my heart. I thought the past could no longer haunt me — nor hurt me. How wrong i was!

    For the past, no matter how distant, is as much a part of me as life itself. And you are part of that life. You are so much a part of me — of my dreams, my early hopes, my youth and my ambitions — that in all my tasks i can’t help remembering you. Many little delights and things remind me of you.

    Yes, i came. And would my pride mock my real feelings? Would the love song, the sweet and lovely smile on your face, be lost among the deepening shadows?

    I have wanted to be alone.
    I thought i could make myself forget you in silence and in song… And yet i remembered. For who could forget the memory of the once lovely, the once happy world such as ours?
