Lim shuns military investigation of Pen incident

Update: Upon the order of Makati Judge Elmo Alameda,Brig. Gen. Danny Lim was recommitted under the PNP Custodial Center, PNP effective today, Dec. 28, 2007.

Danilo Lim yesterday faced a military investigator in Camp Aguinaldo but did not participate in the provost marshal’s investigation on the standoff at the Manila Peninsula hotel in Makati City last month, which the military said was an attempt to grab power.

Lim’s lawyer, Vicente Verdadero, said they told Col. Arthur Abadilla, AFP provost marshal general, that they could not take part in the probe because the case is the subject matter of a rebellion charge being heard by Makati RTC Judge Elmo Alameda.

“You cannot investigate the same subject matter which is already pending before the court. That would unduly prejudice General Lim,” he said.

He said Abadilla understood their position. “It is a legal reason not to participate.”

Abadilla said it was Lim’s right not to participate in the investigation. “It does not prevent the provost marshal and the AFP from pursuing the case,” he said.

Abadilla said the investigation against Lim is now deemed submitted for resolution “because we have to build the case.”

Abadilla is looking into Lim’s possible violation under the Articles of War, including beginning or joining a mutiny or sedition, conduct unbecoming an officer and a gentleman, conduct prejudicial to good order and military discipline, breach of arrest and/or escape from confinement, disrespect toward the President, and disrespect toward a superior officer.

Lim, in a striped polo shirt and brown jacket, arrived at Abadilla’s office around 9:30 a.m. from the AFP custodial center in Camp Capinpin in Tanay, Rizal.

He was taken to a detention cell at the Intelligence Service of the AFP inside Camp Aguinaldo after the proceedings.

The military on Wednesday said Lim would be detained temporarily at the Isafp to facilitate the provost marshal’s investigation.

The announcement was made just about three hours after Lim was brought out of the PNP custodial center in Camp Crame and turned over to military authorities in Camp Capinpin where he had been detained since last year for the supposed February 2006 plot, together with 27 other Marines and Army officers.

Lim was placed under detention in Camp Crame on November 29 after the standoff at the Manila Peninsula, to where he, Sen. Antonio Trillanes IV and other leaders of the Oakwood mutiny marched after walking out of the sala of Makati RTC Judge Oscar Pimentel who is hearing the coup d’état case against the mutineers. Lim was at the court as a witness for the mutineers.

Lim, Trillanes, Magdalo officers, and civilians who holed out at the hotel were charged with rebellion.

Lim, along with 27 Army and Marine officers, is already facing a general court martial for the February 2006 plot.

Abadilla said the investigation against the other officers who took part in the Manila Pen incident would start soon.

He said Lim would have to stay at the Isafp detention cell “for expediency.”

Verdadero protested the military’s decision to transfer Lim to Isafp, saying it is a violation of the Makati court’s order that Lim be detained in Camp Capinpin.

“The court order says `stay in Tanay until further orders from me.’ That is what the judge said,” he said.

Verdadero also said there was no reason for Lim to be detained at the Isafp as the provost marshal investigation “has been terminated.”

The military on Wednesday said Abadilla requested that Lim be placed under the “temporary custody” of the Isafp to facilitate the provost marshal investigation.

Maj. Ramon Zagala, deputy chief of the AFP public information office, said it would be “more cost effective” and “more convenient” for Lim to go to the Makati RTC and the provost marshal’s office if he is detained in Camp Aguinaldo than in Camp Capinpin where the court martial has been holding hearings on his case and the 27 other Marines and Army officers detained there. – Victor Reyes

    Yes, Gen. Lim is handcuffed to his escort.

    Those men in uniform are not Magdalo officers. They are his security escorts.

    Gen. Lim’s wife, Aloy,is the lady behind him. Mrs. Lim is one admirable person.

    Sa dami ng military laws allegedly violated by Gen. Lim (AW 96, 97, 70,67, 64, 63) acording to the AFP provost marshal, I won’t be suprised if even the escape of Jalosjos will be charged against him.

    96: conduct unbecoming of an officer and gentleman
    97: neglect prejudicial to good order and discipline
    70: breach of arrest and or escape from confinement
    67: beginning or joining a mutiny or a sedition
    64: disrespect toward a superior officer
    63: disrespect toward a president

    Yeah, they can charge every case they want against these people because they have all the power. But remember, life is like a WHEEL.. You’ll never know when you will be at the top nor at the bottom.

    All the actions that this bogus and incredible government of Ms. Arroyo has is a sign or shall i say.. A HABIT OF PARANOIA..They all want to suppress every Filipino patriot fighting for what is just and right.

    I’m sooo mad at the Unano and Ass trying to humiliate Gen. Lim before the public’s eye! But of course, they will never succeed because they know for a fact that the General has an untarnished image and reputation unlike them.

    Lalo namang napapamahal sa publiko ang butihing Heneral sa ginagawa ni Ass na pagbabandera sa kanya na naka-posas pa! Sus maryosep itong Shit of Staff na ito, wala talagang magawang maayos!

    Ang dami naman ng mga sekyu na ‘yan, as if makakatakas si Gen. Lim. Kakasuyang tingnan!

  5. The more Esperon tries to humiliate Lim, the more that the soldiers sympathize with the much-admired general.The more that he enrages those who stand for the truth and justice.

    Gen. Lim is made of sterner stuff. Esperon does not know how to deal with men of honor. He is surrounded by SOBs.

    I don’t have a copy of the Articles of War with me at the moment, but somebody here could probably identify the pertinent Articles violated by Esperonon the following offenses:
    1. Crying in front of national media.
    2. Accepting two medals (Gold Cross Medal) of dubious origin and citation.
    3. Seeking political patronage for AFP positions.
    4. Partisanship by cheating for gloria in the 2004 elections.
    5. Lying about his participation in the 2004 elections.
    6. Stealing votes for gloria in the 2004 elections.
    7. Using the personnel and other assets of the Armed Forces for cheating in the elections.
    8. Grave abuse of power and discretion in the case of Gen Lim, Gen Miranda et al in the 2006 incident.
    9. Exerting undue influence in the outcome of investigations.
    10. Making partisan political statements.
    11. Showing disrespect to elected senators (Trillanes and Lacson) of the republic.
    12. Making ungentlemanly outbursts in front of the media.
    13. Failure to accomplish his self-imposed target to defeat the CPP/NPA.
    14. Shamelessly making alibis to cover up for his failures.
    15. Absent from his post and caught unaware by the failure of his intelligence during the Pen incident.
    16. Admitting that he knows that the Pen incident will happen but still failed to prevent it.
    17. Lying and lying and continues to lie.

    Ang kaso ni Gen.Lim ay katulad ng ayaw magpakasal.Kinasuhan ni Gloria si Gen.Lim dahil hindi niya napikot kahit tinutukan ng baril ni Esperon ayaw pa ring pakasal ni Gen.Lim sa kanya dahil may mahal ng iba ang magiting na heneral.

    to what extent, if we talk of percentage, are the “silent soldiers” supporting the cause of Trillanes-Lim?

    are they organized? the previous coups staged by RAM failed because of poor planning, disorganization, and false belief that the military and civilians would blindly follow their command. certainly, the Magdalo learned the lessons of the past, if not… where are we going?

    Would you believe that “extreme ugliness” is one of the criteria for outright rejection from entering PMA before? I don’t know about it now.

    I just can’t fathom how Esperon was able to cheat his way in even then.

    I’ve read the article about Gen. Lim. I was never mistaken with my first impression of this man. He is a noble man. His background is overlwhelmingly impressive. I hope PMA would clone as many Gen. Lims (if it is still possible to be done in PMA).

    Kahangahanga talaga ang mga asawa ng military men..officers and all..ang laki ng kanilang sacrificio..lalo na yong mga officers and soldiers who are now detained..hamak mo 4 years na nakakulong na walang charges. God bless you and may He protect you! Pero ano kaya ang pakiramdam ng mga asawa ni Esperon, Martir, Honasan, Barias at ang iba pang “body guards” ni GMA? Are they proud of the men they married? Kung sa bagay marami silang kuarta pero pagnamatay sila hindi naman nila madala…are their children proud of them? I wonder…

    I don’t know if it was specified as “extreme ugliness” but there was someone who didn’t get accepted because of too much acne. Of course there’s deformity, and marked effiminacy – more appropriate to Esperon I think (hehehe). Anyway, once nakasuot na ng uniform, lalo na full dress, nagiging pogi na rin.

    Over the dead and rotten body of Esperon…I swear, I AM NOT KIDDING.

    I couldn’t even believe it with my own two eyes when I saw the criteria that “extreme ugliness” would prevent you from geeting a scholarship to the premiere military academy of the country.

    And I couldn’t believe, in fact it boggles my mind, how Esperon was able to cheat his way in. Everytime I see him, I couldn’t believe how those PMA screening reps or the Medical Bd #1 could have erred.

    Now, I’m not saying that I hate ugly people. In fact, I tend to be partial to them. However, with Esperon, hanggang buto’t kaluluwa ang kapangitan nya.

    Sorry ate ellen, I just can’t help it.

    Lim to be moved back to Camp Crame, says military spokesman

    Army Brigadier General Danilo Lim, who is facing civilian and military court proceedings over the November 29 standoff in Makati City, will be moved back to police headquarters in Camp Crame from military general headquarters, a spokesman for the Armed Forces said.

    This after the Makati City regional trial court branch 150 approved on Friday the general’s motion to be returned to the Camp Crame custodial center from the Intelligence Service of the Armed Forces of the Philippines (ISAFP) compound in Camp Aguinaldo.

    The transfer would be made on Saturday or Sunday, said Lieutenant Colonel Bartolome Bacarro, AFP public information office chief. “We will comply with the order of the court,” Bacarro said.

    I heard that Gen. Lim was thrown into isolation when he was at ISAFP. That is why daw his lawyer agreed na sa Crame na muna siya instead of Capinpin.
