DAVOS, Switzerland (via PLDT) — President Gloria Macapagal-Arroyo has extended for three months Military Chief General Hermogenes Esperon Jr.’s term of service, saying she wanted to sustain the military’s momentum against communist rebels.
At the same time, the President announced that the commanding general of the Philippine Army, Lieutenant General Alexander Yano, would replace Esperon at the end of his extended term on May 9.
Arroyo said the extension was not due to reports of alleged fresh attempts to unseat her, which she laughed off in an interview with reporters at her chalet here late Friday evening (early Saturday morning in Manila).
Arroyo said she wanted to give Esperon, who had been scheduled to retire on February 9, time to focus on the counterinsurgency campaign and did not want to “change horses” at midstream.
One of Arroyo’s most loyal generals, Esperon was implicated in alleged cheating operations that won for her a fresh six-year mandate in the 2004 polls. A military fact-finding board has cleared him of wrongdoing but its full report was never made public.
“There is a momentum in the campaign against the NPA [New People’s Army], and we expect this to snowball in the next several months, so its very difficult to suddenly change horses when there’s a momentum that we have to sustain,” she said.
Asked why Yano was chosen to replace Esperon, Arroyo said without elaborating: “For the [same] reasons why he was chosen as head of the PA [Philippine Army].”
The President said she has not chosen who would replace Yano as Army chief. The Army is the biggest branch of service in the Armed Forces of the Philippines (AFP). The last three chiefs of staff, including Esperon, were Army chiefs before they were appointed as AFP chief.
Arroyo was emphatic when asked if Esperon, who will reach the mandatory retirement age of 56 on February 9, lobbied for an extension.
“Oh no, in fact his relatives already from abroad came to Manila to celebrate his turnover, so now they have to go back and come back in three months time. No, no,” she said.
In interviews with reporters this month, Esperon said the strength of the NPA, the armed wing of the Communist Party of the Philippines (CPP), was reduced to around 5,000 at the end of 2007.
He said sustained military offensives will reduce the communist insurgents to an “inconsequential level” ahead of the government’s 2010 deadline.
The President said she was “expecting” Esperon to meet the AFP’s targets against the NPA before his extended term expires.
Asked if the extension was due to reported destabilization threats, Arroyo said: “I don’t even know about those reports of destabilization. Tell me more reports. I don’t know.”
The President has extended the term of three of the seven chiefs of staff that she appointed: retired generals Roy Cimatu, Benjamin Defensor, and Efren Abu.
Abu’s term was extended in mid 2005 when wiretapped tapes of Arroyo’s alleged phone conversations with ex-elections commissioner Virgilio Garcillano put into question the legitimacy of Arroyo’s win in the 2004 elections and set off the worst political crisis of her presidency.
Esperon was among four generals mentioned in the wiretaps.
The extension will make Esperon, who has headed the AFP since July 2006, the longest-serving military chief under Arroyo.

The Constitution states that:
“Laws on retirement of military officers shall not allow extension of their service.” (Section 5 (5) Article XVI)
“The tour of duty of the Chief of Staff of the armed forces shall not exceed three years. However, in times of war or other national emergency declared by the Congress, the President may extend such tour of duty.” (Section 5 (7) Article XVI)
“The Congress, by a vote of two-thirds of both Houses in joint session assembled, voting separately, shall have the sole power to declare the existence of a state of war.” (Section 23 (1) Article VI)
If the Constitution prohibits the passing of a law extending the service of officers, with more reason may an executive order not be passed.
They may justify by stating that there is a war on terror (copya kay Dubya), but only Congress has the power to declare war or a state of emergency. Walang basis ang extension na ito.
This is another flagrant violation of the Constitution.
Can this be judicially challenged? Yes, for the Constitution provides that:
Judicial power includes the duty of the courts of justice to settle actual controversies involving rights which are legally demandable and enforceable, and to determine whether or not there has been a grave abuse of discretion amounting to lack or excess of jurisdiction on the part of any branch or instrumentality of the Government.
Will a challenge win? It may or may not, considering the flexing of independent muscles of Puno and Carpio. But this case will be heard, and oral arguments will be had at the Supreme Court. Manalo man o matalo, it will be discussed in the classrooms as a landmark case defining certain terms in the Constitution.

Ang sabihin nila, mayroon pa silang pina-plano na kung ano man yon sila na lang ang nakaka-alam.
Sana huwag na nating hayaan na lang ang pina-plano nila, lusawin na natin sila pati si Ramos sa lalong madaling panahon.

—-Not even all in the military but only a portion. The ones supporting her are mostly higher ups who were involved in the election mass cheating of 2004. Majority of the mid level and junior officers especially the lower ranks do not support GMA.

I completely agree with the legal points you raised and I believe that this is a justiciable case for the Supreme Court to settle. The bone of contention would be centered on the retroactive effect of the said provisions in the Constitution. Did the provisions repeal existing laws such as “PD 1650. Sec. 5 a). Upon attaining fifty-six (56) years of age or upon accumulation of thirty (30) years of satisfactory active service, whichever is later, an officer or enlisted man shall be compulsorily retired; and, provided, finally, That the active service of military personnel may be extended by the President, if in his opinion, such continued military service is for the good of the service.”
But another problem can arise, it may become moot if Esperon’s term indeed will be extended to just 90 days, meaning that before the Supreme Court can make a ruling, we already have a new Chief of Staff.

It is true, that the government may raise the issue of mootness. But “courts will decide a question otherwise moot and academic if it is ‘capable of repetition, yet evading review.” [Alunan III v. Mirasol 276 SCRA 501 (1997)]
Is the infraction capable of repetition? The facts prove that. How many has she already extended? The infraction may evade review, because she would terminate the extension once the case is challenged in court (luma na yan – a favorite trick of Macoy).
That there was no question then (previouse extensions) does not render this a valid exercise of power. One cannot amend the Constitution by non-observance.
This, by the way, is also an impeachable offense.

The issue of mootness, I think, will just be a “technical” issue. The bigger issue is whether the said provision automatically repealed an already existent law and I agree that the Supreme Court should take cognizance of this case and make a ruling.

it is elementary that when a law contravenes the Constitution, it is void and unconstitutional.
Article 7 of the Civil Code also provides that:
“Art. 7. Laws are repealed only by subsequent ones, and their violation or non-observance shall not be excused by disuse, or custom or practice to the contrary.
When the courts declared a law to be inconsistent with the Constitution, the former shall be void and the latter shall govern.”
The Constitution itself says:
“All existing laws, decrees, executive orders, proclamations, letters of instructions, and other executive issuances not inconsistent with this Constitution shall remain operative until amended, repealed, or revoked.” Section 3, Article XVI, Transitory Provisions.
Laws are only remain operative if not inconsistent with the Constitution. Conversely, therefore, if inconsistent, they have ceased to be operative as of the date of ratification of the Constitution.

I have big doubts on his motive to move the hearing of the Tanay Boys to Camp Aguinaldo on the 29th of January. Why bring the incarcerated officers to the city after almost two years of mouthing that it is very convenient to try them in Tanay? Will the Tanay Boys be his next justification of his sinister act? It is so easy to create a scenario of “ESCAPE” in the mountainous roads of Tanay! And why isolate only a few of them for the hearing? It does not take an Einstein to figure out what the plot would be.

Many would agree that Manny Villar is one of the lesser evils. Maliban sa questionable na biglang pag-asenso niya at pag-yaman, wala naman tayong narinig na wide scale corruption niya at kanyang pamilya di tulad ng mga iba diyan na sobrang bulgar. All I know is that Villar hit big time in real estate. Hindi din malinis ang real estate dahil dito ang sangkot sa landgrabbing, non-payment of real estate tax at kung anu-ano pang kalokohan sa industry na iyan. But to me as a whole, Villar is not that bad of a candidate lalo na kung talagang opposition na siya. Mas gusto ko naman kay Villar kesa kay Legarda. Mar Roxas is okay…very educated and nothing much negative we hear about him except being a Mama’s Boy. He listens to his family more than anybody else. Baka kung maging Presidente na siya, ang nanay at pamilya niya ang magpatakbo ng bansa. Ping Lacson? Kung sa hindi niya pagtanggap ng pork barrel ang pagbabasehan, I think he’s the best candidate. Who cares kung talagang sangkot siya sa Kuratong Baleleng at ano pang pag-salvage ng mga criminal. Mga criminal naman ang dinedo niya. Even Manila Mayor Lim is known to have practiced such type of eliminating criminals.
Sikat ang kanyang “Dirty Dozen”. Kaya kung ako ang tatanungin niyo, kay Lacson na lang ako. Pero okay ba siya kay Erap at opposition? Medyo malamig ang relation niya kay Erap. Let’s face it, the opposition candidates need Erap’s support and endorsement, whether they like it or not.
