Lozada surfaces; recounts NBN/ZTE deal

A “missing” key witness in the national broadband network (NBN) controversy surfaced early Thursday morning and detailed his recollections on the now-nullified government contract with China’s ZTE Corp. in a televised press conference.

Seated with bishops and nuns at the La Salle Greenhills gym in Mandaluyong City, in Metro Manila, starting at 2:30 a.m., Rodolfo Noel Lozada Jr. narrated chronically his experiences in the preparations of the NBN project with China’s ZTE Corp., including a direct threat made by the now-resigned elections chairman Benjamin Abalos and the apparent involvement of First Gentleman Jose Miguel Arroyo.

Reading from a prepared text, Lozada said his involvement in the NBN project began when Romulo Neri, the secretary of economic planning at the time, introduced him to Abalos at the Wack-Wack Golf and Country Club in October 2006. he said also present were ZTE vice president Yu Yong, ZTE director Fan Yang along with certain Philippine officials and another NBN project proponent, Jose “Joey” de Venecia III.

He said the National Economic and Development Authority, which Neri headed at the time and had him as a project consultant, received its first copy of the ZTE proposal sometime in November 2006.

He said the first item he noticed that the financial projections were based on data from the Abante Tonite tabloid on how much the government was spending on telecommunications.

He said he found it funny that the financials were based on data from a tabloid, and that he subsequently told ZTE representatives to improve their project presentation

Lozada also said he encouraged Joey de Venecia, son and namesake of the erstwhile House Speaker, as representative of NBN project proponent Amsterdam Holdings Inc., to pursue his project development.

He said Neri told him to reconcile ZTE’s and Joey’s proposals. He said that as Abalos’ “objective” was to get a loan for the project, he proposed that De Venecia III be the main proponent — as the project was to be done on a build-operate-transfer (BOT) arrangement — and Abalos be the supplier.

Trouble starts

Lozada said “I guess the trouble started when Abalos wanted to protect” his $130-million “commission.” He said he told Abalos the amount was too big — “Sabi ko, bubukol po ito.” [“It’s going to show.”]

He said Joey de Venecia’s “reaction was ballistic.” He said the project cost was $262 million, and so there was the question of where De Venecia could get Abalos’ $130 million.

He said he told them “’bahala na kayo diyan,’ that’s your problem.”

He also said the Chinese were alarmed, because “advances had already been given to Abalos.”

Lozada said Abalos then “started considering doing the project on his own.”

“I told him that Neri said — because GMA [President Gloria Macapagal-Arroyo] had told him — that the project was to be done on a BOT arrangement.

Lozada also recalled a phone call Abalos had with First Gentleman Arroyo in which he heard Abalos say, “Kung ganyan kayo kausap, kalimutan na lang ang lahat ng usapan natin.” [“If that’s the way you make deals, forget everything we have agreed on.”]

Lozada narrated an early-December 2006 meeting in which First Gentleman Arroyo told Abalos, “Pare, okay na kami ni Joey.” [“Buddy, Joey and I are okay now.”]

He also said the ZTE representatives were “demanding from Abalos,” and wanted an “a la NorthRail agreement.” He said he did not know what that meant.

Abalos’ threat

Lozada said that on Jan. 18, 2007 — “the day I quit the project” — Abalos called him up and asked, “Alam ba ni Neri ang ginagawa mo? … Alam mo ba na malapit ako sa military?” [“Does Neri know what you are doing? … Do you know that I am close to the military?”]

He said Abalos then started cussing. “… Mga hayop kayo, tinatraydor ‘nyo ako [you are double-crossing me].”

He said Abalos told him, “Huwag ka magpapakita sa akin sa Wack-Wack o ipapapatay kita.” [“Don’t let me see you at Wack-Wack or I will have you killed.”]

Abalos was president of the Wack-Wack club at the time.

Lozada said at the press conference, “I don’t think this project is worth risking my life for.”

Lozada went on to recall that on Feb. 7, 2007, and executive order was issued by the Office of the President assigning the NBN project to the Department of Transportation and Communications with a project cost of $329 million.

“When the project started, the project cost was $262 million,” he said. “When it was approved, the project cost was already $329 million … I am not imputing anything.”

He said the matter showed what he called “dysfunctional government procurement.” He said it was “systemic… about how we procure projects.”

Lozada emphasized, “I don’t want to speak along party lines. I don’t want this to be taken as something partisan.”

Lozada tearfully finished reading from the prepared text: “Ang salitang Pilipino ay hindi lang tungkol sa isang pamilya. Ang salitang Pilipino ay tungkol sa isang bansa. … And sometimes it is worth taking a risk para sa ating bansa.” [“The word Filipino is not about a family. The word Filipino is about a country. …And sometimes it worth taking a risk for our country.”]

Resignation

Lozada said at the press conference that he was resigning as president of the government-owned Philippine Forest Corp.

At the start of the press conference, Lozada read an opening statement, “Maraming katanungan ang taong bayan tungkol sa proyektong ito [ZTE-NBN]. Mabigat sa aking damdamin at isipan itong gagawin ko… para magkaliwanag na ang isipan ng bayan tungkol dito. …Walang malisya kanino man.”

[“There are many questions in the mind of the public about this project [ZTE-NBN]. It is with a heavy heart and mind that I will do this … to give light to the public’s mind about this. … This is without malice toward anyone.”]

Lozada also said his apparent disappearance upon his arrival at the Manila international airport Tuesday afternoon was a result of “just miscommunication between the groups that were supposed to pick me up.”

He said “we had a good drive around the city” and took the Luzon South Expressway, and went to Calamba City in Laguna province. He said he was later “brought back to my family.”

At the end of the press conference, Lozada said, “I want to be out of this situation. Believe me I do not want any other Filipino to be in my situation right now.

He also said, “I don’t want to go to the Senate. I don’t want to go there and be part of a political exercise … I may not be able to lie. I’m not a good liar. …The decision was to send me out of the country … I might say something that they would not like …the people who are concerned… ‘yung mga masasaktan ‘pag naipit si FG’ [First Gentleman].”

Lozada’s safety

Senator Alan Cayetano, chairman of the Senate “blue ribbon” public accountability committee that is investigating the ZTE-NBN deal, said in a radio interview Thursday morning that they would ensure Lozada’s safety and security after the clergy agreed to turn him over to the custody of the Senate sergeant at arms.

Cayetano said they would consider Lozada’s physical and mental condition before scheduling a resumption of the Senate hearing on the ZTE-NBN deal.

Lozada earlier said he had been under undue stress since he left for Hong Kong and upon his arrival Tuesday and was already very tired over the ordeal.

As of this posting, a convoy of some 20 vehicles of the clergy and media people was proceeding to the Senate.

I cannot understand why key witnesses cannot be interviewed privately and their affidavits obtained so as not to endanger their lives especially from an abusive police and a Department of Injustice even just so the Philippine Senate will not look as useless as it is now with a criminal calling herself “president” at the helm. I also cannot help boiling inside when I see the idiot smirking in her pictures that she must be having a heyday doing as she watches the fiasco the Senators are doing as they allow the idiot to abuse and ran away with all the loots from the treasury, majority of which are even loans that this and future generations of Filipinos will have to bear to pay with their sweat and tears.

Why, Uncle Johnnie himself is even bragging that his wife can get through the appointment to the Vatican with or without the blessing of the Commission on Appointments because of these useless members of the Senate and Congress, the latter especially with a crook now proclaimed as its Speaker. Wala talagang itulak kabigin.

    Palabasin na si Senator Trillanes. Siya na lang ang pag-asa ng mga pilipino! And next time, please, no more surrender! That is, if the majority of Filipinos are ready and determined to kick out Gloria Dorobo and her cohorts. Please maawa naman kayo sa bayan sinilangan!

    Was it Abalos threatening FG or somebody else? Was he blackmailing the Arroyos with his knowledge of the Hello Garci or the incoming elections? If it were the latter, he was not even successful, save for Tita Migz!

    I have a very simple, call it naive observation…once the nuns appear in headlines (be it on pictures or with statements) something momentous happens. I just notice Lozada had nuns surrounding him in the Inquirer.

    i still think that this ZTE broadband deal can be done with very little cost to the government. they can do it themselves using existing government facilities. unless of course, we have lazy, incompetent people in our government

    Making comments based on the press conference is not fair enough because I would be lying if I say that I came out satisfied with everything that was said. I would rather wait for the senate investigation, but one thing that caught my attention though was he’s kind of “soft” on the other side (FG’s) and put Abalos on the lead role as if he has all the power and arrogance to make and break a deal. Remember that this about a government project and contract, and Abalos is not the government. Another re-escape-goat in the making? Something’s going on as a result of the kidnapping? Just being conscious. But as I said better wait for the Senate’s.

    I suggest that now is the time to do both simultaneously. Aside from just trying new leaders, we should start the long-overdue damage control of cleansing, rescuing and renewing the Filipino masa mind from its current corrupted state. The viruses “BAHALA NA”, “ISANG KAIN ISANG TUKA” and others with similar heuristic flags have been feasting on our minds since the Spanish times. The next generation of Filipinos deserve to have a breakthrough. Patriotic content in radio, TV, print and internet, etc. should start dominating the day to day scene of the ordinary Filipino. Our minds, our goals, our entire system was already corrupt the moment we were born…If these media moguls have a heart towards the ordinary Filipino and the country, they should start filling the airwaves with no nonsense content, that’s one good legacy they can give to the Filipino children of tomorrow.     QUESTION : while the NBN proposal was at its infancy – why didnt he back out? he cannot claim that there is no money involved for everyone – government projects dont work that way. up front – alam na how much is supposed to go to whom…

    i have no doubt Lozada also stood to earn substantially from the deal – AND HE KNOWS IT. but when things started to go south, Lozada suddenly realized that he has become a liability to the powers that be. kaya nag lie low na siya.

    The opposition is in search for another “STAR” witness – with the same integrity as PCI Bank official like Clarissa Ocampo.

    Sad to say LOZADA IS NO CLARISSA OCAMPO. he is a “commissioner / lobbyist” who got caught in the crossfire and is now being tapped by the opposition in its move to instigate chaos.

    Appy Gilmore, you were not listening to what Lozada was saying. Immediately when he learned that FG and Abalaos wanted to make a hefty comission from the deal, he stopped transacting with the mafiosos. I do not think Lozada knows that this deal will blow up in humungos proportions!
    I believe that Joey and Lozada are credible people! I would believe these duo but NOT THE DOROBOS and their MAFIA gang! Puro pa sinungaling! They said the PNP had no hand in the abduction. So, siguro yung nakaabitong madre ang nagpunta sa tarmac at kinuha si Lozada. Is that what you are trying to say Appy Gilmore?
    How do you know that Lozada is no Clarissa Ocampo? You just heard his general statement and now you have already pre-judged him?

With Lozada there now trying to save his hide by asking the priests and nuns to protect him and provide him sanctuary, and crying foul, let’s pray that the Filipinos will be able to finally prove they have a case against the Fat Guy and his wife, et al after more than 7 years of trying to evade prosecution even by assigning people they can hold by the neck in positions and departments most responsible for locking up people like them in jail.

    All the more reason why we should be vigilant, and not allow these crooks to go on with their illegal activities. Yup, Rose, Elvira, Chi, at iba pa, tuloy ang dasal! Saka na muna ang sinasabing santong paspasan. Mas matindi ang “Vengeance is mine” ng Panginoon. Tignan natin kung kaya ni Fat Guy na magmura na naman sa Congress as he did before when Alan Cayetano was accusing him. Ano nga ba ang kaso niya noon? Sa dami, hindi ko na tuloy matandaan at mabilang ang atraso ng ungas sa mga taumbayan.

    Panahon na para sibakin na ang mga walanghiya. Meanwhile, abatan na hindi makakatakas ang mga walanghiya at makalusot kasama na iyong kening buri mo ring si Abalos.

    Funny, pumalpak ang strategy nila kay Lozada kesa iba siguro ang mamang ito di tulad ni Garcillano, who must have been told to cool it off likewise in London. (Makes me wonder now who their contact there is that is willing to give refuge and sanctuary to people they would not like to squeal on them. Si Prince Andrew kaya?) Same pattern, same tactic. Ngayon lang yata mapapaso.

    Iyong matabang mama naman hindi na Tate ang takbo kundi Europe via Hong Kong or Singapore din. Arestuhin na iyan.

    Tama ka. Lozada is not the culprit here. Natakot lang iyong tao dahil ang daming threat na tinanggap. Di siya katulad ni Joey who has his father to at least protect him. Kaya nga doon na sa mga pari at madre tumakbo but kwidaw siya. Baka magaya siya doon sa witness ni Ping Lacson na ipinagtabuyan ng mga pari nang takutin ng mga pulis at military na pasasabugin ang kumbento nila kundi siya ilalabas o palalayasin doon. Hopefully, hindi mangyayari iyan kay Lozada.

    Sinabi mo pa. Let’s stick to the facts that this guy is willing to sing a song now, not the speculation of someone planted by Luli and company to spy on the bloggers here. Malinaw naman at logical ang sinasabi niya kung bakit he did not volunteer to be a witness. Trabaho nga lang siya, at kung maiiwasan ay ayaw niya ng monkey business, e kaso hindi lang monkey at babboons ang kausap niya kundi mga buwaya, bayawak at baboy pa!

    Hindi niya kasalanan kung bakit siya umiwas na mag-testify. May threat na siya noon pa, and he was willing to take any protection for him and his family as what we know now he was forced to take as concession from the very same bunch of goons who wanted him to keep his silence especially against the Fatso, huwag na si Abalos.

    Don’t get me wrong. I am not giving the same consideration to Garcillano even when they were put on the same boat maybe to London. Malaking kaibahan ni Lozada.

    Si Lozada did not agree to be part of the dirty deal, apparently. Si Garci, siya pa ang nagtrabaho as a matter of fact. Still, the fact that Lozada kept silent about a crime committed by the criminals, in fact, and waited until he found himself in deep shit, over where I am, what he did could constitute and be considered a criminal offense as in concealing or albeit help conceal a crime, voluntarily and otherwise.

    Now, let’s see what kind of documents with Lozada’s signature Gloria’s boyfriends will produce to protect her from being prosecuted and locked up in jail for the rest of her life together with her husband, et al. Abangan ang susunod na kabanata! Sabi nga sa ingles, “To be continued.”

  31. Sa totoo lang maraming ganyan na kaso. I have interpreted for people who have been involved in very serious crimes in Japan. Takot silang mabalikan kaya kundi sila tanungin ng pulis, hindi sila kikibo. Common iyan sa mga pilipino lalo na because of these goons in the police na imbes na mag-encourage sila na magsabi ng totoo ang mga tao, sila mismo ang nanakot para iyong mga patron nila hindi mapahamak.     At least, buti nga ngayon, nagkaroon na ng lakas ng loob na magsalita sa Lozada. Masarap malaman ang reaction ng mga intsik, iyong tunay, hindi iyong mga publicity stunt nina Gloria Dorobo at Fatso Pidal.

    The affidavits regarding the stink in Glorietta were made after the fact; after the academe (UP professors) questioned, if it was methane, why was there no stink?

    Typical yan, they fabricate evidence after the fact. Pati yung diary ni Angara about constructive resignation was made after the fact.

    Nalibing na ang mga namatay sa Glorietta. Nalibing na rin ang issue. Nasaan ang pinu74ng in4ng FBI and Aussie report?

    I cannot vouch for Lozada’s integrity because I don’t know the person. I am convinced that he is no saint, maybe even up to the point where he can even tolerate dirty deals up to a certain level. Kaya lang, baka hindi na abot ng level of tolerance niya ang US$130M for Abalos alone.

    As to whose pronouncements are closer to the truth: Lozada vs Razon, et. al – even a moron would have enough logical faculty to judge.

Typical reaction from people who have not known courage as a matter of fact. Maraming ganyan sa totoo lang lalo na kung may pinoprotektahang personal interests as in the case of Lozada–iyong business niya. Golly, sa Pilipinas pa!

    JDV is just as bad, and now claims to champion good government.

    Lozada, however, may be an exception. He is a small fry, with much to loose(his life and that of his family), and if Neri corroborates Lozadas testimony, in addition to Jdv3, this case may get somewhere.

    For now, we can only hope that the truth comes out and those guilty punished to the full extent of the law.

    while it is true that there are those vehemently and loudly opposed to the system we have now, under this administration, their numbers do not speak for all of the silent majority. when the majority is no longer silent – then there is action…

    take the two successful Edsa’s, the majority moved – but towards what end? what was achieved? is this the price we pay for freedom? more graft? more corruption? political unrest? power play?

    it is in my opinion that the majority has learned from the Edsa’s. the way to go is not the way of the mob mentality. the way to go is through our institutions – the executive, the legislative and the judiciary (however graft ridden the first two branches may be)….

    my two cents on how to progress..

    we start with ourselves, we become aware and follow the law in our own capacities.

    for example – i never throw any garbage out of the car. i have a trash can inside. if everyone does this, then we can save billions in flood control and flood damage costs.

    i do not jaywalk. – if everyone does this, we can save millions daily in fuel saved from smooth traffic flows.

    i do not violate traffic laws when i drive – if everyone does this we can save millions in fuel and lost productivity due to traffic from unruly drivers.

    i hope people here can see my point.

    if all of us follows the law to the letter – then those in government will do so likewise because they know that they will be in trouble since we are a people of laws and that no one is above it.

    isnt this way better than that himagsikan sh_t where the tormentors of today will only be replaced by new tormentors?
