Beijing letter opposing RP territory bill bared

The chairman of the House committee on foreign affairs
said yesterday China’s opposition to the bill defining the Philippines’ boundaries prevented the chamber from approving the measure despite the deadline set by the United Nations Convention on the Law of the Seas (UNCLOS).

Rep. Antonio Cuenco (Lakas, Cebu) said Beijing expressed its objection to House Bill 3216 in a “note” to the Philippine embassy in Beijing last December.

“China is shocked by and gravely concerned with this negative development. We request the clarification from the Philippine side,” said the two-page letter which was faxed to Cuenco’s office by Ambassador Sonia Brady.

The unsigned note reiterated that China “has undisputable sovereignty over Nansha islands (Kalayaan Group of Islands) including Scarborough Shoal and its adjacent waters.”

It said the passage of the bill, despite the Philippines’ signing of the Declaration of Conduct of Parties in South China Sea, “will not be conducive to the stability in the SCS and will also disturb China-Philippine cooperation in the area, exerting negative impact on the healthy development of our bilateral relations.”

It also noted that the bill’s approval would not sit well with China amid the forging of the Joint Marine Seismic Undertaking (JMSU) in the area which critics said could be the basis to charge President Arroyo with treason.

Under HB 3216, the Philippines’ archipelagic baseline would include the Kalayaan Island Group and the Scarborough Shoal which are also being claimed by other countries aside from China.

The Philippines has until May 2009 to inform UNCLOS of the extent of its archipelagic boundary.

Cuenco, however, said that while the letter does not have an official attribution, he does not doubt the authenticity of the document. “But if you talk of legal and technical terms, this is just a scrap of paper,” he said.

He also disclosed that the Chinese charge d’affaires also expressed his country’s opposition to the bill when he met with him last January.

“It’s their way of expressing dissent,” Cuenco said. “In diplomatic lingo, galit sila.”

Cuenco said he would ask the plenary to postpone the passage of the measure on third and final reading until the session’s resumption after the Lenten break.

“We need a cooling off period,” he said, noting that his committee has already decided to ask the plenary to allow further amendments to the measure.

Cuenco’s panel has also decided to cancel its scheduled inquiry into the JMSU today, saying they failed to inform the members three days beforehand as mandated by the rules.

Rep. Roilo Golez (Ind., Parañaque), the principal sponsor of the investigation, said the panel’s backtracking smacks of Malacañang influence.

“Very clear na may intervention from the executive especially on the part of the Department of Foreign Affairs,” he said.

They said the DFA does not want the House version because this would antagonize the Chinese who have been providing loans to the Philippines. China is one of the claimants in the Spratlys.

Nothing to hide

Executive Secretary Eduardo Ermita said documents on the JMSU would be made public during the congressional hearings on the Spratlys issue.

“There is nothing hide about the JMSU. This JMSU is a scientific undertaking, not exploration,” Ermita said.

He said the Palace legal team is leaving it to the Department of Energy and the Philippine National Oil Company to recommend to President Arroyo whether the JMSU should be extended beyond June 30, when the agreement expires.

Ermita also said officials of Chinese Communist Party officials are not here because of the controversies surrounding the Spratlys and the Chinese loans, including the national broadband deal. “The Chinese government wants to have a feel of the situation.”

Reports said the officials led by Liu Hongcai, vice minister of the Communist Party of China International Department, wanted to be apprised of the progress of the investigations and gave the assurance that diplomatic ties would not be strained by such commercial transactions. – With Regina Bengco

    I don’t know much about the Philippines boundaries and territorial waters of the Philippines, however if the Philippines is in the right, China can go pound cake. It’s time to show that majority of the Pilipinos are not just push over, or Pilipinos don’t just roll over because someone is pissed.

    Logically and operationally, so-called seismic study is integral to the exploration project. Or, that’s how a preparatory (or feasibility) study appears to be in this scheme of development projects.

    I’ve seen dozens of such projects in the Philippines under the auspices of UN bodies and banks (ADB, WB), where all these studies form part of the whole configuration. One can’t separate the initial study, however it may be called, from the other essential aspects of the project. They are all part of it. The seismic study is similar to a feasibility or baseline study required to proceed to the next stage.

    Calling it as just a “scientific study” unrelated to the “commercialization” of the project is pure non-sense, from a technical point of view. Ermita, Gonzales and all those guys around Gloria defending the Spratly deal don’t know what they are talking about (or if they do, they delibertely mislead the public.)

    We are a mix of sorry loser from the very beginning of Philippine history. We have brilliant educated citizens from the time of Rizal and they never gave a hoot to our real properties. We only know of the 7000 islands. We only chanced upon the Spratlys when Admiral Cloma on a fishng fleet set foot on it to get water and claimed it for himself. The islands are already the usual rewatering points while in the area. When the squatering instinct of the government set in for dubious reasons bright minds initiated claims on Sabah and Spratlys. Naturally, China and the coloniser of Malaysia were much older than us and they know more of their ancient patrimony. And of course they got muscles in the right places. My advise to all is to correct first our squatering culture of the Lina type at home before nosing at the far distant shores.

  6. If it was purely a seismic study and well within the Philippine territory, WE DO NOT NEED CHINA to do it for us. Our local exploration firms have seismic equipment for that purpose. Last January, Serafica’s Burgundy Global Exploration (which I suspect is a crony or Greedy Group-dummy) has just bought one for only $86M. Such amount is peanuts to PNOC, or any gov’t agency seriously considering a seismic survey.

    After all the bukolan and patongan (tongpats)involving Chinese monetary lending and projects in the country, China will always get what it wants with the Philippine goverment. This includes Congress’s inability to pass the bill defining our archipelagic bounndary that may strengthen our claim with the Spratlys. With all these loans coming from China we could not help but cater to their own demands. This is akin to a family where they owe a large sum of money from a rich man, since they could not pay him the rich man claims a virgin daughter as a payment. This happens because of evil, bitchness, and greed.

    Golez quoted an article of China’s People’s Daily Online which reported on Nov. 20, 2005 that the China Oilfield Services Limited (COSL) had already completed the seismic data acquisition through its exploration ship codenamed Nanshai 502.

    If the Chinese exploration vessel did not find oil in Kalayaan Islands they will not go against the House Bill 3216. Evidently, they found oil.

    Napakalaking problema para kay GMA itong utang sa China, Spratly, and territorial baselines. Hindi talagang papayag ang mga intsik na lokohin mo sa pera at hindi nila ma-exploit ang Spratly. Ang Sambayanan Pilipino ay walang ibinigay na approval dito, so GMA’s problema talaga. Kung magkagulo malaman kung ano ang gagawin ni Esperon & company. Malapit na ang pag-distancia ng mga tuta at alipores sa Palasyo. Ang kaba ni GMA lampas na sa dibdib baka abot na sa nunal. Sooner or later maipit ka.

    Katumpakan ang iyong tinuran, hindi lamang ang gutom-sa-sikmura ang suliranin ng mga Pilipino, mas malala ang nararanasan natin sangayon, ito ay yaong kasalatan sa “ispirito ng pagiging tunay at ganap na Pilipino”, mayaman ang bansang Pilipinas sa likas-yaman at sa tao’ng-yaman subalit ito’y ginagahasa ng mga iilang ganid na Pilipino.

    Dito masusukat ang dignidad at soberenya ng kabansaan, kaya’t dapat na tukuyin muna ang lawak ng teritoryo at pagtibayin ang House Bill 3216. Ang direktang pakiki-alam ng Tsina, sa kanilang di-pormal na kasulatan sa pagtutol sa HB 3216 ay pagyurak sa ating kasarinlan at nagpapakita ng kawalan-ng respeto. Hindi nga makaka-ahon sa kahirapan ang Pilipinas, kung patuloy na mananaig ang “kulturang kataksilan” ng mga mamamayang Pilipino.

    Kasalanan man o di-kasalanan ng bansang Tsina, sa kanilang pakikipag-kutsaba kay Gloria, nararapat na tutulan ang anumang uri ng imperyalismo, partikular sa kasalukuyang lantarang pakiki-alam ng Imperyalistang Tsina sa ating kabansaan. Karagdagan nito’y, maging mapagbantay sa ikinikilos ng US sa rehiyong MINSUPALA, sa kanilang di-awtorisadong pagpasok at pagbisita sa kampo ng MILF.     I think noon pa inaangkin ng Tsina ang Spratlys. Ang pagkakaalam ko po, di lang Tsina ang umaangkin dito – pati na rin ang mga bansang Vietnam, Taiwan, Malaysia, at Brunei, bukod sa atin.

    Jerz, why will China enter into an agreement with the Philippines to explore the Spratlys for oil if the Spratlys is theirs. Plain common sense lang ito! China’s agreement with the Philippines and Vietnam acknowleges us as one of the owners of the territory. Only the boundaries will have to be determined.

    China’s agreement with the Philippines and Vietnam only shows that China can’t claim the whole of the Spratlys because the other claimant countries won’t give up their claims on their parts of the Spratlys that easily. So, instead of having clashes with these countries, like the ones they had with Vietnam in Sinh Cow, China entered into an agreement with two of these claimant countries (The Philippines and Vietnam) to have this Joint Marine Seismic Undertaking (JMSU). This agreement, as de Venecia said it, “was designed to turn an area of potential conflict into a zone of peace and development.”

    the letter is a threat but unsigned. the chinese must have learned from esperon technique.pinoys must think of their sovereignty without consideration to other countries. i don’t believe china is thinking of peace in the area, they are thinking of exploiting the area as soon as possible because of their own needs.whereas pinas is led by people more concern of their personal needs, china’s leaders are more concerned of their country’s needs.

    Medyo iba take ko sa isyu ng Spratlys. Sa akin, ok lang ang multinational cooperation to determine if their are substantial oil and gas reserves, and possibly cooperate further in terms of exploration. May model na naman yan e — yung North Seas oil rigs. Ok din sa akin yan para win-win ang lahat ng claimants nang Spratlys kesa mauwi pa sa shooting war na wala rin naman tayong kalaban-laban.

    What sickens me is the non-disclosure and confidentiality terms nung agreement. May tinatago ba? Another thing that really irked me is the carrot-and-stick approach of the Chinese in dangling our access to loans from their banks to fund projects like NBN – salo agad ang gobyerno natin kasi napakahina nang accountability and audit measures ng mga Chinese-funded projects di tulad ng sa US, Japan, EU.

    Pansinin nyo, lahat ng mga repressive regimes, especially in Africa (like Sudan), ang bumubuhay sa mga government projects e China. Kasi di makakalusot sa US or EU ang mga “tong-pats” at “bukol”, especially after the enforcement of the Patriot Act, Sarbarnes-Oaxley Act, etc. after 9/11.

    Jerz, please read the history on the Spratly islands and who are the MAJOR occupants so you can have better understanding why Vietnam and military power China choose the route of joint cooperation with the Philippines. It is very clear that Philippines has the advantage based on possession and close proximity of military support.

    Philippines is occupying 7 islands and 3 reefs.
    Vietnam occupies 6 islands, 17 reefs and 3 banks.
    Malaysia has 1 artificial island and 5 reefs.
    Taiwan has 1 island and 1 reef.
    China has 8 reefs.

    In Wikipedia, Philippines has some features “virtually occupied” as features very close to to Philippine occupied features about 14 km distance that includes North Reef, Sandy Cay, Loita Nan and Loita Cay. Features east of 116E meridian are largely controlled by the Philippines being 161 km from Palawan. Both Vietnam and China knew that Philippines has airfield and naval base in the west coast of Palawan.

    The strategic importance of Spratly islands lies on its oil reserves which is the 4TH LARGEST OIL RESERVE BED IN THE WORLD. It has 17.7 billion tons of oil compared to 13 billion tons held by Kuwait.

    The other strategic importance of Spratly islands is that it is as one of the world’s most productive areas for commercial fishing. China predicted it holds about 1 trillion dollars in combined fishing, oil and gas resources.

    To Jerz and those who think that JMSU (signed by Arroyo government and protected by confidentiality clause) is not a sellout, please consider the article wrote by Barry Wain, a researcher of in the Institute for Southeast Asian Studies in Singapore, wrote an article in the January-February 2008 issue of the Hong-Kong-based Far Eastern Economic Review.

    “The Philippines … has made breathtaking concessions in agreeing to the area for study, including parts of its own continental shelf not even claimed by China and Vietnam.”

    “Regarding the area of exploration he stated:

    [The area] thrusts into the Spratlys and abuts Malampaya, a Philippine producing gas field. About one-sixth of the entire area, closest to the Philippine coastline, is outside the claims by China and Vietnam.”

    Judging by China’s actions, there is reason to believe it lies well within the Phil’s exclusive zone. Mañalac knows as much. He was declared a hero in Thailand when he discovered Thailand’s first oil field.

    When the greedy group got wind of Mañalac’s scheme, he had to be stopped. No, he didn’t resign, he was pressured. They take over from where he left and are soon to make the biggest jackpot they ever made out of Gloria’s seven years in power.

    I have come across often alien fishermen apprehended at the Sulu sea, or right at the Tubataha Reef but of course thats still east of Longitude 116E. Have not heard any apprehensions at the Spratlys. We have an airfield right at Pagasa at Kalayaan but jets cant land there. Toratora could if we still have it around.
    We lost one of the islands to the Vietnamese when the marines waded to the next island a stone throw away to celebrate another marine’s birthday with bottles of bilogs. We just lost another reef to the Chinese not so long ago. They built an island on stilts. What Philippine miracle could stop any intruder to our Spratlys claim?

We have an airfield at Pagasa right there at the Kalayaan but not for jets. Toratoras perhaps if we still have them around. I am listening to a radio broadcast regarding territorial claims between China and the Philippines, and it makes me angry listening to claims that these territories are owned by the Philippine government but not the Filipino people. Thus, according to the idiot, Mr. Wetness who apparently does not understand that a democratic government is a government OF, FOR and BY the people, they have no right to know the details of the deals being entered into by the dorobo with the Chinese. and that only those friendly with the dorobo will be allowed to be shown the documents of these deals.

    There’s some basis to say that China could invoke some of RP’s northern islands in and around Luzon belong to them. Since RP is composed of several islands; these could be those scattered around after being separated from China thousands of years ago. China being among the oldest civilization like Egypt could make a claim that many parts of Asia once belonged to them.
