Aide Memoire of the People’s Republic of China delivered to the Philippine Embassy in Beijing

It is learned that the Foreign Affairs Committee of the House of Representatives of the Philippines recently passed a revised draft of Act to Define the Baselines of the Territorial sea of the Philippines, which puts Scarborough Shoal and some other NANSHA reefs and islands (referred to as so-called “Calayan Islands”) inside the baseline of Philippine territorial sea, and would be submitted to the plenary of Senate and House of Representatives for review and adoption. China is shocked by and gravely concerned with this negative development. We request clarification from the Philippine side.

China has indisputable sovereignty over NANSHA islands including Scarborough Shoal and its adjacent waters. For the sake of maintaining stability in the South China Sea (SCS) and the China-Philippine friendship, the leaders of our two countries have exchanged views for many times and reached important consensus on maintaining peace and stability in SCS through joint efforts and committing both sides to refraining from any action that would lead to complication and escalation of the situation. By singing Declaration on the Conduct of parties in the South China Sea (DOC), China and ASEAN countries all committed to exercise self-restrain, to refrain from taking actions that would have negative impact on peace and stability of the region and to deal with disputes by constructive means. On the basis of the above-mentioned consensus and with the spirit of DOC, China, the Philippines and Vietnam reached a tripartite agreement on joint development in the SCS. As of now, the tripartite cooperation has achieved substantive progress. This is a historical breakthrough in handling and solving the SCS issue.

If the Philippine side forcefully puts Scarborough Shoal and some other NANSHA reefs and islands inside the baseline of Philippine territorial sea, it will not only be conducive to the stability in the SCS, but also disturb China-Philippine cooperation in the area, exerting negative impact on the healthy development of our bilateral relations.

The move taken by the Philippine House of Representatives does not conform to the common interest of our two countries, nor does it serve the interest of the Philippines. Such a unilateral action will neither strengthen the legal position of the Philippine side, nor will it be recognized and accepted by other parties and the international community.

Currently, the China-Philippine relations are developing with good momentum, our cooperation in a wide spectrum of fields has yield prominent results, and our common interests are expanding continuously. This good situation is hard earned, and should be cherished by both sides. We sincerely hope that the Philippine side strictly abide by the above-mentioned consensus and commitments and handle this issue with utmost prudence. We request that the above-mentioned draft not be submitted to the plenary of the Senate and House of Representatives.

I would like to emphasize that China attaches great importance to the China-Philippine relations and is ready to push forward the China –Philippine strategic cooperation between our two countries. We hope that the Philippines work together with China for the maintenance of stability in the South China Sea and our bilateral relations.

    Militar ng Pilipinas, dun niyo sukatin ang tapang niyo sa pamamagitan ng pagtatanggol sa sovereignty ng ating bansa. Para naman hindi puro kapwa natin Pilipino ang biktima ng mga bala niyo, tulad ng mga kapatid nating Moro at mga NPA, isama niyo pa ang mga nakikibaka sa protesta sa kalsada.

    China doesn’t come clean. She corrupts foreign countries…in Latin America, Africa and other third world countries. ZTE is an international company known for bribing other countries’ government officials. The Chinese government is aware of ZTE’s role and activities for a long time. China chooses to keep silent for economic and business reasons. If we expect China to act on this ZTE scam in the Philippines, we would be disappointed. Why would they? The Philippines is only among the pieces of meat China enjoys eating these days…the 21st Century.

    Barry Wain, an Australian who is the diplomatic correspondent for Asian Wall Street Journal has uncovered in greater extent the sellout of exclusive Philippine territory, 1/6 of entire area covered by JMSU.

    It is not coincidence that after signing the JMSU, China committed USD$2 billion a year in loans to Arroyo government.

    In addition, congressmen have delayed passage of the bill (which now China heavily protested and Palace supported China’s position) setting the Philippines archipelagic baselines to meet the May 2009 deadline.

    Suddenly, the Palace made a 360 degrees turn around after so much pressures. In Inquirer headline today,

    “PALACE URGES PASSAGE OF RP TERRITORY BILL”.

    Remember our vigilance forced the Palace to:
    1. Abandon ZTE/NBN deal.
    2. Abandon Spratly JMSU deal.
    3. Abandon stopping passage of territory bill (HB 3216).

    We continue our vigilance to stop madam peddler from selling us out for commissions.

    China has not business sending any communication to the Congress or any of our legislative branches. They could channel it through the Foreign Affairs Department; but not straight to the Congress. There’s a clear violation of protocol here.

    Seriously, I can’t help but be amazed at how aggresive the PROC in pursuing their claims to these tiny islands in the southeastern part of our country. Malaysia putting a claim on it could be logical because they are geographically link to us. But mainland China? This crazy chinese might be looking at a different map? Or because the body of water east of our archipelago is named South China Sea that they are thinking this way? For me, the issue on the Spratleys being claimed by China is really absurd. I can’t help but picture China as a big bully among a group of elementary school children who’s using his size to snatch recess food or extort milk-money from his helpless and hapless schoolmates. Yes…that’s what you are you fuc!^*ng communist chink, you’re just a big bully in the school yard!!!
