Sira na ang Korte Suprema

Tuwing may isyu ang sagot ni Gloria Arroyo at ng kanyang mga alagad ay “dalhin sa husgado.”

“Bring it to court” ang kanyang mantra.

Okay lang ang hayaan ang husgado gumawa ng decision sa mga usapang legal sa normal na sitwasyon. Ang problema hindi na normal ang nangyayari kasi sinira na ni Arroyo ang lahat na institusyon na pangdemokrasya. Noong Martes nakita natin na pati Korte Suprema, sira na rin.

Hawak na ni Arroyo ang Korte Suprema. Wala nang maasahang hustisya ang taumbayan sa Supreme Court. Mas marami na ang bulag at bingi at busog ang mga tiyan. Mas mahalaga sa kanila ang ma-protektahan si Arroyo kaysa ang kapakanan ng bansa.

Kitang- kita natin ito sa desisyon ng Korte Suprema sa kaso ni Romy Neri ng NBN/ZTE. Dating director ng National Economic Development Authority (chairman na siya ngayon ng Commission on Higher Education) si Neri at siya ang nag-apruba telecommunications project na gagawin ng ZTE, isang Chinese firm. Ang proyekto ay gagastusan ng $329 milyon na uutangin natin sa China.

Sa imbestigasyon ng Senado lumabas na umabot sa $200 milyon ang patong ng grupo nina dating Comelec Chairman Benjamin Abalos. Inamin ni Arroyo alam niyang may problema ang kontrata sa ZTE ngunit itinuloy parin ang pirmahan na kanyang dinaluhan. Natigil lang itong kontrata dahil sa imbestigasyon ng Senado .

Pinigilan ng Malacañang si Neri na sagutin ang tatlong tanong tungkol sa papel ni Arroyo sa NBN/ZTE deal kaya pumunta ang Senado sa Korte Suprema.

Sa desisyon ng Korte Suprema na isinulat ni Justice Teresita de Castro, na siya ring nag-conict kay dating Pangulong Estrada, sinabi na covered raw ang “executive privilege” ang mga taong tungkol sa papel ni Arroyo sa NBN/ZTE dahil nakakasira sa relasyon natin sa China sa ating pambansang interes.

Ano ba yan? Hindi pareho ang interes ni Arroyo at ng bayan. Nakakasira kay Arroyo ang pagbulgar ng katotohanan. Ngunit ito ay makakabuti sa bayan.

Amg sumang-ayon kay De Castro ay sina Associate Justices Leonardo Quisumbing, Renato Corona, Dante Tinga, Minita Chico-Nazario, Presbiterio Velasco, Antonio Eduardo Nachura, Ruben Reyes at Arturo Brion.

Ang mga hindi sumang-ayon ay sina Chief Justice Reynato Puno, Associate Justices Consuelo Ynares-Santiago, Ma. Alicia Austria-Martinez, Conchita Carpio-Morales, Adolfo Azcuna and Antonio Carpio.

Klaro na na sira na ang Korte Suprema. Wala tayong maasahang hustisya sa mga kampon ni Arroyo na siyang nakakarami diyan.

Kung gusto natin maisalba ang bayan at ang ating kinabukasan, isama natin ang pagbuwag ng Korte Suprema ni Arroyo.

    Recently, an administrative clerk of Supreme Court confided to a source that GMA regularly calls up SC to follow up cases related to Malacanang and other new development. GMA went as far as calling the Justices personally whom she appointed. If such report is true, then she could have influenced and pressured some of these Justices to decide favorably of Neri. There’s no doubt that GMA’s future is in the hands of Neri if the latter tells all what he knows. But now, GMA is in good hands…whether we like it or not. The Supreme Court is on her side. Foreign countries particularly the US who continue to support the GMA government could always say they are for the rules of law and constitution. Luckiest Bitch indeed !

    The SC ruling on executive privilege is meant to protect disgraced Gloria Arroyo and her Cabinet from criminal prosecution. It’s a bad precedent. It gave the next generations of kleptocrats (future government looters-thieves) a blanket of protection from criminal prosecution disguise as executive privilege. No thanks to moronic Supreme Court rulings. It castrated Congressional legislative-investigative powers. Checks and balances are the essence of republican democracy. The separation of powers in the 1987 Philippine Constitution was meant to safeguard harm caused by moronic tyrant rulers.

    Cant blame much some barristers leans to something else, what they think fits on the issue. The issue was Neri of the CHED. CHED oversee the review centers, too. I can not understand why reviews becomes the norm and even regulated so well earning accreditations and whatnots when the CHED would only have to check the schools if they are giving the goodies enough. Review centers sprouts from the schools and this is only advertising that the schools did not deliver well. Some schools allegedly require payments to their review corners before even school ends making it the damocles sword whether to graduate or not.The review gives out FAROLAs shortcuts to ensure passing for exorbitant fees. May mga talunan baka naman di nagreview or just sleeping it off. Or they dont have children taking up law.

    He had the numbers with Sandoval-Gutierrez (damn good writer). The petition was filed on December 7, 2007. Sandoval-Gutierrez retired on February 27, 2008. That was a whole two months and twenty days, or eighty days.

    He could have required memoranda within an inextendible period of ten days, and oral arguments shortly after new year’s day.

    Newsbreak has come out with an article which quotes reliable sources. The article states that GMA lobbied hard with her appointees in the Supreme Court to rule in favor of Neri. CJ Puno recognized that the 7-7 stalemate will not hold when he offered the compromise. GMA appointed Brion to break the tie. Corona refused to inhibit himself despite the public display of support for GMA by his wife.

    Kiddingly aside, the word kapon in Filipino means to castrate. As a figure speech it means Senate is rendered “inutil” by the unanimous decision of the magistrates. Were they under some kind of spell to pass such an unpopular decision? You can not help but agree on people’s perception (based on their decision of Neri’s petition) these honorable men and women in the highest court of the land had themselves defied judicial norm of independence, legal sensibility, and integrity? Promise ha, do not make unpopular decision like this anymore because you make dismaya the taumbayan. Sobra, the people are hurt because they are not that tanga not to spot any flaw in your decision.   34. My condolence and sympathy to the people of the Philippines, but for what has happened to their country, they are only the blame.

    Japan and the Philippines in fact started on the same footing, both being under the US rule at the end of the war although in principle, Japan was more under the Allied Forces’ supervision with Gen. MacArthur as the head supervisor.

    “That probably was the advantage of Japan over the Philippines, which got a lot of booties as a matter of fact but the Filipinos left to fend for themselves except in matters of interests to the Americans, who in a way should be blamed for the spoilers they helped put in power and continue to nurture so the Philippines and the Filipinos would remain under US sphere of influence until now when people with one-syllable surnames and/or those with ancestors who came to the Philippines buying and selling junks (magbobote, ukay-ukay, etc.) started dominating Philippine politics.

    The Japanese did not have much except the determination to “bear the unbearable” and take the consequence of their actions with dignity and pride. The last world war in fact proved a blessing in disguise to the Japanese and even perhaps to the Germans, who were subdued and humbled by their experience. In fact, they continue to be less aggressive except in the field of Economics for fear of being criticized and reminded of the atrocities their soldiers committed in countries they invaded. What happened next is now history.

    At least, Japan evolved as a first class economic power while the Philippines that had the potential to be so has ended up being one of the third world countries, and Filipinas being defined in the Oxford dictionary as “domestic helpers.” Next time, the word “Filipino” may come to be defined as “caregivers” in the Merriam-Webster dictionary.

    Grizzy, in my travels all over the world, usually Filipinos are really treated like a third class citizen too. Go to a hotel ang if a Japanese and a Filipino would have to be served at the same time, the Japanese will be served first. It is because now, Filipinos are reduced to a mere “super Maid” and “caregivers”. Not that these noble works are to be looked down on but we have become simply that, “a helper”.
    I can pass for a latin look so I usually do not experience the treatment as much but I see some of our kababayans being treated differently.

    Fortunately, over in Japan, when they talk of democracy, they literally define it as a government OF, FOR and BY the people. And with the Philippine government even now insisting that it is a democracy, people here understand that all properties and patrimonies owned by the Philippines in Japan and elsewhere belong to the PEOPLE of the Philippines, not to Gloria and Mike Arroyo a.k.a. the Pidals, etc.

    We invite Filipinos at home and overseas to join us in the movement to save the Philippine patrimonies in Japan that the Pidals salivate to squander. A property that used to house the reparations missions and the Philippine Chancery in Japan in fact is now rumored as sold in defiance of a SC ruling banning sales, etc. of the patrimonies without a national referendum.

    I can relate to that. During my initial conferences with foreign counterparts they seemed surprised at having a Filipino talk to them as an equal. I found out later that most of them had Filipina domestic helpers, be it Europeans or HK nationals. The HK nationals are more blunt, they admit that when they hear the word Filipino, they associate it with “maid.” Its a never ending battle of “proving them wrong” actually by excelling, no use being “pikon” and showing you’re affected by it. In the end, its better winning their respect.
    As OFWs, we all become ambassadors, because through us, doors will be opened for the next Pinoy.

    Sinabi mo pa, PSB. I had a Filipino friend with a very Filipino name and had remained a Filipino until she could not longer bear being discriminated for possessing a Philippine passport. Not wanting to lose the properties she and her foreign husband bought and owned in some country in Europe she decided to renounce her Philippine citizenship.

    Damdam daw niya ang feeling ni Rizal nang binabaril siya sa Luneta. Nagtiis daw siyang napapahiya na hinihiwalay sa asawa at anak niya sa pila because of her Philippine citizenship at kulay ng balat niya after the EDSA and after Filipinos, especially the women, started being known as domestic helpers and “puta ng mundo” (quote from a Filipino in the Bay Area).

    She was actually an associate editor of some Asian magazine, and you can imagine her humiliation when treated and mistaken for the nanny of her own children. Tapos itong si kutong lupa ang lakas nng loob na ipagyabang ang mga pilipinos as “the Philippines’ No. 1 Exports.” Nakakasuka!

  42. I wonder, if the SC is owned by Gloria already and her henchmen already, what will happen to Jonas Burgos? What will happen to the numerous unsolved cases involving military atrocities and disappearances? Who’s going to even the playing field? Marcos was an obvious enemy, we know what we were up against – a dictator, visibly disabling our institutions and ruling by himself.
    Now it feels like dictatorship, it sounds like it, smells like it, but everything is legal. The institutions have a semblance of autonomy albeit obviously lopsided. We have a semblance of democracy, but somehow it doesn’t feel like it, sound like it, smell like it – but we can’t prove it in court. Its just hearsay…How can we allow ourselves to be tied down like this?

Yes. In some areas of the Philippines, there is still some semblance of kindness and social awareness…

    Fr Bernas thinks more rationally than many members of SC, who are biased for Gloria and her corrrupt regime. Hope SC will reverse its very unpopular and bad decision, but first the Senate must lodge a petition to reconsider.

    Common sense and ordinary logic dictates that such decision favors suppression of truth behind that highly corrupt and scandalous NBN=ZTE deal. No way it can justified as beneficial to the Filipino public who want truthful answers to certain unresolved issues on that deal. Leaving them unanswered is like letting go of the anomalous “hello Garci.” It will also leave a taint on the good image of the SC, just as the Comelec is buried into deep shit by public opinion.

    Rep. Roilo Golez, we would like to believe, was simply being mischievous when he proposed that the President be stripped of the power to appoint members of the Supreme Court.

    Why not? Why should people there worry about this proposal? It has been done in Japan, etc. as a matter of fact and why criminally inclined politicians here like those dominating Philippine politics now can easily be stripped of their privileges and sent to prison if they cannot have the guts to commit suicide when shamed and fall out of grace.

    The judges of the courts in fact should not have been appointees but men from the ranks of bureaucrats who should be getting their positions by civil service eligibility and qualification. Over where I am based, the judges of the Supreme Court, when they have climbed up there, cannot start working as such without the approval of the voters to whom their names are presented for approval during elections. We actually are told to scratch the name of the judge we do not want to sit in the bench. Even just one scratch from a voter can mean disqualification.

    Philanderers are also barred from rising up to the Supreme Court unlike in the Philippines, where I am told that a lot of these judges are even members of some exclusive club where the bunnies have been contestants in some beauty contests. Whether this is true or not, the Filipino people have the right to know.

    Rep. Golez’s bill to clip the President’s power to appoint Justices in Supreme Court came a bit too late. By the time it’s passed and enacted into law, it would be around 2010 or later when the evil woman is no longer the President. In the meantime, 90% of the SC justices are GMA appointees and they are expected to continue towing the line of Malacanang. If Golez’s bill gets passed, it would affect the next President who is most likely to come from the opposition.

There are only what, less than 200 members of the legislature and 15 members of the SC? But we see only a few thousands actively doing what should be done to rectify the wrongs and to take the frigging Pidal family and cronies to task.

    Sure, it is admirable of Filipinos to go for the “rule of law”, to be patient, to be resilient but shit, even a dog bites when cornered!

    So, fine, they wait for 2010 and use the election hoping they can thrash the jerks out of office — but unless they guard the ballots and protect their lives with their votes, they will have the same set of bloody jerks and unscrupulous men and women ruling their lives.

    We’re planning a big rally in Tokyo on the 6th. It will be held not at Roppongi but at the ambassador’s residence from 3 to 6 pm. It is right next to the Yasukuni Shrine, because it is the next target for the stealing spree of the Pidal couple.

    I’ve printed out the 1935 and 1987 Constitution and compared them with the 1973 one that was in use during the Martial Law. Golly, walang pinag-iba, especially when it comes to the power vested on the president! Kita mo talaga ang pagkatanga. Nasubukan na iyong palpak na Constitution, paulit-ulit pa rin palang in-adopt. Di bale sana kung may delikadeza iyong mga umuupo like the honorable PM in Japan. Noong 90’s, for the first time, nagkaroon ng sigalot tungkol sa appointment ng isang SC judge din dito. The PM was consulted but all he could do was submit the recommendation to the members of the SC because it is a different department that he has no power over. Iyong mga judges din ang nag-resolve apparently, and the consultation with the PM was merely a formality. Final resolution was presented to the Emperor for approval but more as a formality, too.

    Taragis sa Pilipinas, iyong magnanakaw trying hard to act like an emperadora! Walang humihirit kasi di alam ang gagawin dahil ingles naman iyong Constitution at marami ang hindi nakakaintindi na pinagsasamantalahan naman noong mga abogago na siya lang daw ang may karapatang mag-interpret ng batas at Saligang Batas. Ulol!

    Hopefully, sana may mangyari doon sa panukala ni Cong. Golez. I suggest he reads the papers written by John O. Haley of Washington University on the Japanese judiciary, and compare the Philippine Constitution with the Japanese Constitution tailored by the Americans for the Japanese para mabara niya iyong mga bobong kasama niya sa Congress.

Any foreigner could raise that money even by just using his credit card. What’s $10,000 or $5,000 for one’s life? The truth is, that has been going on for a long time. Why is it only now being talked about? There was and still rampant kidney sales in China. Other countries like us could have followed China in this kidney business. Lucky for those rich people like Raul Gonzalez who got his second life due to successful kidney transplant. He said the kidney was donated by his personal driver. Many doubt this. He could have bought it in China because he was in Hongkong before the surgery.
