Bolante’s habeas corpus bid dismissed anew

A U.S. court dismissed recently former Agriculture Undersecretary Jocelyn “Joc-Joc” Bolante’s petition for habeas corpus which, he said, would enable him to challenge the legality of his two-year detention.

Judge Charles N. Clevert Jr. of the U.S. District Court in Wisconsin cited lack of jurisdiction in dismissing Bolante’s petition last Sept. 3.

Judge Lynn Adelman of the same court dismissed on Oct. 18, 2006 a similar petition from Bolante also “for lack of subject matter jurisdiction.”

    Joc-Joc Bolante is obviously running scared. With less than 90 days to go before deportattion as a result of the US CA junking his Petition for Asylyum, he filed a second Petition for Habeas Corpus before the Kenosha, Wisconsin District Court. His first petition for Habeas Corpus was jumked last October 18, 2006 on the ground that Federal Courts cannot exercise jurisdiction over deportation cases.

    This time, joc-Joc Bolante, the suspected plunderer, even had the temerity to cite one of the Guantanamo cases as basis for the federal court to acquire jurisdiction. In like manner that he has been abusing the right to asylum as he clearly is not a victim of persecution but running away from prosecution, he is attempting to trivialize the decision in Boumediene where the US Suprmeme Courty, reiterating Marbury vs Madison, declared that Congress cannot legislate to limit the exercise of judicial power.

    Fortunately, his Petition was denied fortwith. He has appealed the case to the US Court of Appeals.

    One can only speculate why he is so desperately trying to avoid the wheels of justice in the Philippines.

    Joc-Joc is able to prolong his stay in the US due to not only the due legal process accorded to every individual, but perhaps the secret arrangement between Washington and Phil. Government. The US could be using the Joc-Joc case to blackmail the Evil Bitch to make it favorable for the US troops in Mindanao to remain unhindered while the RP government is keeping rape convict Smith as her card.

    Smith’s continuous detention at the US Embassy which is now the center of investigation to see if he is indeed detained there is something every Filipino must condemn. Instead of serving his sentence in Philippine jail, why inside the US Embassy where all the comforts and special treatment are provided? On the other hand, Filipinos charged with simple crimes in the US are thrown in US jails. This is a very serious matter that we must look into.

    After Tribune Editor’s Ninez Olivares’ surprising recent column in favor of Villar and against Lacson, the Tribune online can’t be accessed anymore. Furthermore, many of the regular columnists have not contributed to the Opinion Column lately. Is there anything wrong with The Daily Tribune now?

  3. Jocjoc will be the next Jun Lozada. But this time, he’ll be made fertilizer in Cavite. I guess he will have to change his statement and name names this time and sign an affidavit just in case. If he tells the courts he will be liquidated by the government to silence him and avoid implicating higher-ups, maybe he’ll even get his asylum.

    The longer it takes, Jocjoc’s fears get complicated. He doesn’t only fear the Senate now, maybe less than he fears Malacañang.

    Off topic: Ateneo beat La Salle in the first UAAP Finals. If La Salle wins in the second game, there shall be a third and final game. Another game is equal to hundreds of thousands or millions of revenue. The gambling syndicate prefers a third game for obvious reason. This now brings me to the question of whatever happens to the attempted murder of one FEU star player Baracel? There was a police investigation…but what happens? The fans and people demand an update on that…or would it be another case that goes nowhere. Big syndicate and people are involved.

    It wont be long he gets the time qualification to pettition for citizenship. TNTs are great in that. Only he uses forum shopping there as if he is already a citizen in buying for time. Thats what money and a power backing him could do. Anf for that alone, the US can not make us one of their states to protect Bolante and others soon going there.

    Myrna, some say the Evil Bitch’s trip is partly because of Joc-Joc. As President (illegal) of the Philippines, the US Immigration would give her the courtesy of talking to Joc-Joc.
    Who knows what they would talk about? Another reason for the trip is to check if their stolen money are well deposited at Morgan Stanley. Or they may withdraw part of it to make sure that they won’t get hit by the current US banking crisis. Of course the other reason which everyone knows is her secret meeting with Bush regarding the US troops in Mindanao. She scratches his back and he scratches her back.

    Hmmmnnnn….Maybe that’s the reason why that bansot purchased an advertisement on Forbes magazine, about three weeks ago, through the advertising agency she hired that cost us, the filipino taxpayers, about $50 million dollars in preparation for her UN speech on September 23rd.

    When that bansot visited the White House, three months ago, Pres. Bush must have confirmed to her that her wish to speak at 63rd UN General Assembly was granted. This bansot must have badgered Bush for so many months or years to let her speak at UN.

    So, why this criminal bansot was pretending three weeks ago, telling newspaper reporters that the scheduled trip for this month was cancelled, when in fact she knew at least three months back that she will be speaking at the UN assembly. The only logical reason why this bansot was making a noise on her pretended cancelled trip was just a diversion, so that we will not be able to link the Forbes magazine advertisement with her upcoming speech at UN assembly.

    Speaking at the UN assembly is a big, worldwide personal advertisement of bansot pidal. I repeat, it is a personal advertisement of bansot pidal, a big one.

    As I said before, the Forbes magazine advertisement of bansot pidal is a pre-emptive strike before she executes her evil plan. Her UN General Assembly speech is an omen.

  10. Wow, so the idiot has been advised now to categorize himself like those suspected terrorists now incarcerated at the US military prison in Guantanamo. Gago din ano? And the evil bitch must be on her secret mission in the US to make sure that the Bolate stays put in the US jail for as long as the US will allow him to be there submitting this and that silly petition to the US court. Ginagawa pang mga tanga ang mga kano. He should be deported to the Philippines, pronto! He cannot be deported to China even when he must have come from there to the US for China has the right to refuse entry permit to a wannabe convict.

    Matagal nang sinabi ng Supreme Court of the US na ang demanda for habeas ay dapat gawin sa lugar kung saan nakakulong ang petitioner.

    Si Bulate (sorry Bolante) ay nakakulong sa Illinois; ang demanda for habeas ay ginawa sa Wisconsin (another State). So talagang walang jurisdiction.

    Magaling ang abogado – magaling maningil.

    The question is, bakit handang magtiis ng hospitality ng Kenosha prison si Uod? Takot ba siyang salubungin ni Atutubo? Kung sa halip na nagpatulong sa administration, sinabi niyang doon siya takot, at baka gawin siyang pataba ng lupa, maaaring nagbunga ang request for asylum.

    That’s no big deal. In the UN. except for the U.S. president and some colorful personalities like Mandela, Fidel Castro and Iran’s Ahmadinejad, a country’s leader address an almost empty auditorium. Only his own audience listen to him. I’ve covered UNGA session a few times.

    After a leader gives his address, his hakot audience leaves. Take note that in UNGA’s sessions, the audience is hardly shown because there are more empty seats than people.

    GMA wants to impress us. Akala naman niya nai-impress tayo. That’s what she thinks.

    El Shaddai evangelist Mike Velarde has announced his willingness to run for the presidency, if the controversial anti-Church bill pushes through, confident that his flock, claimed to number in the millions, will give him that edge, especially if he is to be backed, too, by the Iglesia ni Cristo (INC), which is the word being floated around by the El Shaddai camp.

    There is of course nothing to stop the El Shaddai leader from running for the top post. But is anyone’s knees trembling at the thought of Velarde running for president?

    The El Shaddai group may number in millions — something like five million, and that is being very generous. But even if there were more, this Catholic charismatic vote is hardly a command vote.

    It is no different from the Catholic church vote. There is no such thing as a Catholic vote.

    This has been proved many times over, in Philippine elections, whether in presidential or senatorial polls.

    In the case of the Iglesia vote, which is a bloc vote, as this is what the INC faith calls for, there is no question that it is a command vote. However, that INC vote is hardly enough to make a national candidate win, but it does help as a swing vote in tight races.

    The irony of it all is that even as these El Shaddai faithfuls attend these anti-reproductive bill, many of them are into contraceptives such as the intra-uterine device. If they weren’t, the El Shaddai crowd would be filled with pregnant women.
