Villar orders arrest of Bolante

Senate President Manuel Villar has ordered the arrest of former Undersecretary Jocelyn “Joc-joc” Bolante upon his arrival at the Ninoy Aquino International Airport. He is expected to arrive tomorrow late evening, Northwest Airlines flight 71.

Villar’s statement:

I issued an instruction to Gen. Jose Balajadia Jr., the Senate Sergeant-at-Arms, to implement the arrest warrant issued by the Senate in December 2005 against former Agriculture Usec. Jocelyn “Joc-Joc” Bolante for the failure to attend the public hearings of the Committees on Agriculture and Food and Accountability of Public Officers and Investigations (Blue Ribbon) on the P728 million Fertlizer Fund Scam.

The arrest order, which I signed as vice chairman of the Agriculture Committee, is still valid. To argue that the citation for contempt or arrest order approved by the Senate had lapsed automatically with the adjournment sine die of the 13th Congress would result in an absurd situation where a person held in contempt would just ignore and evade the Senate order until the adjournment of the session.

Personnel from the Office of the Sergeant-at-Arms will be dispatched at the Ninoy Aquino International Airport Terminal I. They have a specific instruction to arrest Bolante on sight and bring him to the Senate.

Senate Majority Leader and Committeee on Rules Chair Kiko Pangilinan explained “The basis of the contempt order and warrant of arrest is his refusal and failure to appear before the Senate Committee.”

” The Senate, if it is to remain independent and truly able to exercise its constitutional duty to act as a check and as a balance, must be able to enforce its orders. Otherwise all that any Jose, Juan or Maria needs to do to render a valid arrest warrant void is to refuse to appear and to go into hiding,” Pangilinan warned.

The Senate issued an arrest against him in 2005 for snubbing the Senate hearing on the controversy.
“It should be the positive and overt act of the Senate, and not the act of the individual, that would render an arrest warrant invalid. Until such an act is performed the warrant remains valid and enforceable anywhere in Philippine territory,” Pangilinan added.

“No less than a sovereign nation like the United States has recognized the validity of the Senate arrest warrant. It arrested him and he went through deportation proceedings. The entire proceeding shall be completed by the Philippine Senate finally taking custody of Bolante,” he said.

    The constitution is wanting badly a change. Whenever some people get mad, they issue a warrant of arrest on a whim, then no one is definite if it holds water at all. Too many loopholes creatng dilemmas after dilemmas. Our goverment is full of clowns.

    Joc-Joc Bolante may invoke his right against self-incrimination during the Senate inquiry. I remember during the Jose Pidal money laundering scandal, the fake Jose Pidal-Iggy Arroyo invoked his right to privacy and right against self-incrimination. Joker’s Senate Blue Ribbon committee got no information from him. I don’t know if this old Malacanang trick works at the Senate hearing.

I bet you…the government will once again prevails…this time over Senate again. Villar’s loyalty to the opposition remains in question. It took him a while to decide ordering the arrest of Bolante.

    If Garci is able to do it unharmed, why not this Bolante? He is involved not only in the fertilizer anomaly but also the much bigger swine scam.

    Bolante can already invoke the executive privilege on his arrival. He may have taken his oath of office before our consulate back there on his reappointment after a long vacation. He will liquidate the fertilizer fund as his contingency fund while on official covert business in the US.

    The key word is “Proper Forum”. Bolante promised to talk…at a Proper Forum. Proper Forum is court not the Senate. This line has been over abused by Malacanang.

    Bolante will talk after the Ombudsman filed his case to Sandiganbayan (proper fourm). Suntok sa buwan ito. Hangang ngayon wala pang imbestigasyon ang Office of the Ombudsman. Sinadyang huwag pansinin ang kasong isinampa ni Atty. Frank Chavez. Sankatutak na ebidensya galing sa Senado at CoA ang hawak ng Ombudsman. Nagbulag-bulagan ang mga imbestigador ni Malditas Guitierez dahil sabit si Gloria Arroyo.
