Seditious

The Webster dictionary defines “seditious” as “tending to cause discontent among the people; fostering the spirit of rebellion.”

I think Justice Secretary Raul Gonzalez was barking up the wrong tree when he said that the pronouncements of Jaro Archbishop Angel Lagdameo, president of the Catholic Bishops Conference of the Philippines ; Lingayen Archbishop Oscar Cruz;Bataan Bishop Socrates Villegas; Masbate Bishop Joel Baylon, and Legazpi Bishop Emeritus Jose Sorra at a press conference last Tuesday were “seditious.”

I checked again what the five bishops said. Their statements were mostly on graft and corruption which they said were the “biggest culprit and major cause of the our nation’s poverty and hunger.”

Asked if they think Gloria Arroyo is corrupt, Archbishop Cruz did not hesitate to say, “Yes, because the incumbent Malacanang occupant has received not long ago the very distinguished award, never have been given before in Philippine history, as the most corrupt President.”

Cruz further said, “To say that the Malacanang occupant is but the follower of corruption and not a leader of corruption is asking too much. It will take somebody from the moon to believe that the head of corruption is down below and not from above.”

Since “seditious” means “tending to cause discontent among the people or fostering the spirit of rebellion.”, what causes people to be enraged, the corrupt practices or the criticism of the corruption?

The impeachment complaint filed by citizens concerned of the the country’s degradation enumerates the documented crimes of the Arroyo against the Filipino people. Here’s the short list

1.The $329 million deal with the Chinese firm, ZTE Corp to establish a national broadband network;

2. The sale of the country’s gold reserve in Mt. Diwalwal to ZTE Corp. in an agreement described by the complainants as “grossly disadvantageous to the country’s interests”;

3. Entering into the Northrail Project without the approval of the Monetary Board and which failed to give preference to Filipino labor and investment;

4. Distribution of bribe money to congressmen last year, which she supposedly authorized, to speed up the referral of the impeachment complaint filed against her last year by lawyer Roel Pulido to prevent the filing of a genuine complaint;

5.The diversion of P3.3 billion intended for farmers, P728 million of which were supposed to be spent for fertilizer, to the campaign kitty of Arroyo in the 2004 elections;

6.Similar to the fertilizer scam is the illegal and improper use of the P5 billion loan obtained by the Quedan Rural Credit Guarantee Corp. to fund her 2004 election campaign.

7.Cheating in the 2004 elections.

It’s good that former Agriculture Secretary Jocelyn “Joc-Joc” Bolante is back. He has a lot of explaining to do on the P3.3 billion supposedly for agriculture that were released just a few weeks before the 2004 elections and the P5 billion unaccounted Quedancor funds.

Every impeachment complaint filed against Arroyo the past three years includes cheating in the 2004 elections that is referred by Bishop Cruz the “original sin” because all of the other crimes cited in the impeachment complaint were committed to either cover up or pay back her accomplices in the rigging of the 2004 election results. The NBN/ZTE deal, for example. Why was a retiring Comelec official into a telecommunication project? Simple. Abalos gave her the presidency that the Filipino people denied her in 2004. He had to be rewarded for that.

Arroyo has yet to explain why she said “I am sorry” when the “Hello Garci” tapes surfaced in June 2005. In that tape, she was heard talking to Comelec Commissioner Virgilio Garcillano about tampering the election results in the Autonomous Region for Muslim Mindanao.

In this year’s complaint, lawyer Harry Roque has included the testimonies of some members of the Special Action Forces of the Philippine National Police who participated in the switching of election returns at the Batasan Pambansa storage room.

Now, what could be more seditious than thwarting the will of the people?

Gonzalez was so riled up with the statement of the five bishops saying that “The time to start radical reforms is now. ..The time to prepare a new government is now. ”

Arroyo was never elected by the people. Every day of her illegitimate presidency is sedition at its highest form.

    Sedition or any other legal offense depends on who’s talking and who’s being charged. There’s always a double standard of policy in this evil government. Between the five Bishops and journalists, the latter have more rights to express their views given their profession. And yet, why were journalists like Ellen easily got charged for libel and even perceived seditious comments? The Bishops should be more liable because there’s a clear separation between the church and state. If sedition charge should be seriously applied, then the late Cardinal Sin was guilty of this many times.

    The United States had a Sedition Act which was in effect from 1798 to 1801. It was not challenged in the Supreme Court, because the power of judicial review was only established in the case of Marbury v. Madison in 1803.

    In New York times v. Sullivan, however, the US Supreme Court, by a unanimous vote, stated that:

    “Although the Sedition Act was never tested in this Court, the attack upon its validity has carried the day in the court of history. Fines levied in its prosecution were repaid by Act of Congress on the ground that it was unconstitutional. See, e.g., Act of July 4, 1840, c. 45, 6 Stat. 802, accompanied by H.R.Rep. No. 86, 26th Cong., 1st Sess. (1840).

    Calhoun, reporting to the Senate on February 4, 1836, assumed that its invalidity was a matter “which no one now doubts.” Report with Senate bill No. 122, 24th Cong., 1st Sess., p. 3.

    Jefferson, as President, pardoned those who had been convicted and sentenced under the Act and remitted their fines, stating:

    “I discharged every person under punishment or prosecution under the sedition law because I considered, and now consider, that law to be a nullity, as absolute and as palpable as if Congress had ordered us to fall down and worship a golden image.”

    So both the US President and Congress considered Sedition laws as unconstitutional. That is why there was no need for the Supreme Court to step in.

Raul Gonzalez was a recipient of Joc-Joc Bolante’s over-priced liquid fertilizer. Scam is the trademark of the Arroyo bogus presidency. In reality, there’s no separation between the church and the state in the Philippines. They have the same constituency. They are involved in government affairs like Pampanga Governor Rev. Fr. Panlillo and some party list representatives belong to religious group (El Shaddai’s Buhay and Jesus Movement’s CIBAC).

    So much talks about separation of church and state; yet, even in the US where the Constitution we adapted, there continues to have the church’s influence over the state and politics. The church keeps meddling for centuries. But nothing compares to the Philippines where the meddling of the church is more evident. For why do El Shaddai, JIL and Catholic Church have representatives in Congress? Of course to protect the interest of the religious groups and church members not to mention the business interest. El Shaddai has Bro. Mike’s son in the Congress so is Bro. Eddie Villanueva’s son Joel. Even the former El Shaddai spokesman Mel Robles is the Chief of MRT.

    Sedition is a term of law which refers to covert conduct, such as speech and organization, that is deemed by the legal authority as tending toward insurrection against the established order. Sedition often includes subversion of a constitution and incitement of discontent (or resistance) to lawful authority. Sedition may include any commotion, though not aimed at direct and open violence against the laws. Seditious words in writing are seditious libel. A seditionist is one who engages in or promotes the interests of sedition.

    Because sedition is typically considered a subversive act, the overt acts that may be prosecutable under sedition laws vary from one legal code to another. Where those legal codes have a traceable history, there is also a record of the change of definition for what constituted sedition at certain points in history. This overview has served to develop a sociological definition of sedition as well, within study of persecution.

    The difference between sedition and treason consists primarily in the subjective ultimate object of the violation to the public peace. Sedition does not consist of levying war against a government nor of adhering to its enemies, giving enemies aid, and giving enemies comfort. Nor does it consist, in most representative democracies, of peaceful protest against a government, nor of attempting to change the government by democratic means (such as direct democracy or constitutional convention).

    Put simply, sedition is the stirring up of rebellion against the government in power. Treason is the violation of allegiance to one’s sovereign or state and has to do with giving aid to enemies or levying war. Sedition is more about encouraging the people to rebel, where treason is actually betraying the country. Sedition laws somewhat equate to Terrorism and Public Order laws.

    What is pathetic is that there are only a few of these bishops standing up for the people. Yung mga silent eh sila naman ang nakikinabang sa early “aguinalso” ng evil bitch. It is that time of the year again na ang mga mga sugo ng Diyos ay nangangailangan ng maraming datong para sa mahihirap na kababayan natin. Kaya kailangan na namang magingay ang mg obispo.

    The Sedition law in the Philippines is old. Personally, I think sedition laws in the Philippines are a breach of universally accepted human rights. The act is only to protect the existing elite and corrupt government within the country that enacts them, theoretically leaving no legal avenue of dissent.

    This is an extremely dangerous situation because people without a legal means of expressing dissent often turn to
    illegal means. Sometimes violent means. This begins a vicious circle of repression and violence that can tear a society apart rather than protect it.

    Look at us now, we are all complaining- unhappy of the results of past performances and current performances. What’s wrong with our political leaders? People will not be seditious unless they feel that their rights have been protected. There’s no protection of human rights in our country. It’s been like that since 19 forgotten. Nothing has changed since I left for 17 years. It’s actually getting worst. ano ba ang gusto natin? hindi lang si Gloria. marami sila diyan. even if we get Gloria out, trust me… CORRUPT majority are still there and will continue what they are used to. that’s all they know.

    The solution is DECENTRALIZATION OF POWER.

    Malacañg just might get what it is asking for, Lingayen-Dagupan Archbishop Oscar Cruz said yesterday following the statement of Justice Secretary Raul Gonzalez that he and four other bishops are treading on thin ground because of their “seditious” statements calling for a change in government.

    “The bishops know what sedition is. If Malacañang really wants them to be seditious, then it can simply request the bishops, who might oblige,” said Cruz, former president of the Catholic Bishops Conference of the Philippines.

    Cruz, Jaro Archbishop Angel Lagdameo, Bishops Joel Baylon (Masbate) and Socrates Villegas (Balanga), and Bishop emeritus Jose Sorra on Tuesday called on Filipinos to start preparing for a new government as they said there is a need for transformation amid rampant state corruption.

    I knew it. A motion for recon has been filed on the MOA-AD (Inquirer). So if the petitioners filed a comment, there would be a reply, and later, a prayer for oral argument. Kung mangyari yan, retired na si Ruben Reyes by the time a decision is due. Very cunning indeed.

    BUT.

    If the petitioners manifest that they would not file a comment and pray that the motion for recon be submitted for resolution without further pleading from them, tapos yang maneuver na yan.

    Of course, pina-file sa other group, not the government, to bait the Petitioners into commenting, arguing that the group which filed a motion for recon has no standing. But I know Dean Agabin is too seasoned to fall for this ploy.

    Of course she will deny. Her colleagues, the whole Senate, and those who know them already know it and have accepted it. It’s no longer a secret. Loren incurred so much debts after the 2004 election. She tried to mortgage her ancestral home. Angara came to her rescue. Since then, the two’s relationship has become special. This is no longer a rumor. All four corners in the Senate know this. Wherever Angara is, Loren goes and vice versa. Sometimes, it all starts with people’s needs and then it blossoms.

    Ang kay Glorya ay isinusuka natin dahil sa kawalanghiyaan niya at ang kanyang asawa sampu na ang mga tuta niya sa pamamalakad ng Gobyerno na kanyang inagaw.

    Loren can be Sarah Palin. But do you think Loren would settle for Vice? Nah. She repeatedly said “It’s President or none”.
    But we know that she doesn’t have the budget. Her financial backer Angara doesn’t have all the resources. So, maybe…yes maybe she could finally be convinced to run for Vice. It also depends on who the Presidential Candidate is.

    i don’t know loren very well. i was just saying that we might be better off with a male president. I don’t know much of who would be the best next president. ang alam ko, mga corrupt pa rin and matira kay gloria. so what’s new really?

    HIndi mo kailangang humingi ng dispensa dahil hindi ako maka-Loren.

    Kung ako ay may kakayahang maglagay ng kandidato sa pagka-Pangulo, dalawa lang ang bata ko: Si Orbos o si Lacson. Kung nasa edad na si Trillanes, pangatlo siya.

    Kung ang pamantayan lang ng pagiging pangulo ay ang hindi pakikipag-kabit, maka-Gloria ka nga dahil yung tatlong lalaking pangulong sinundan niya ay may mga kabit.

    Pero dahil wala siyang kabit (o wala pang may matibay na ebidensiya) hindi sapat iyon na maging “masama” siya dahil “trabaho lang”.

    Wala ngang kabit, magnanakaw naman.

    Tama ka may naging Pangulo tayong paka-bit-a-bit pero hindi ko sila ibinoto. Maliit lang kasi ang tingin ko sa mga taong nagwawala. Hindi ko rin ibinoto yang Glorya na yan, mukha pa lang niya asar na ako lalo na pag bumuka na yong kanyang bunganga.
