Imagine a justice secretary giving drug syndicates ammunition to use against law enforcers. The drug lords must be rejoicing.

In his anger towards Maj. Ferdinand Marcelino, who dared talk back to him at a hearing in the House of Representatives, Justice Secretary Raul Gonzalez said the Marine officer’s secondment at the Philippine Drug Enforcement Agency is unconstitutional. Thus, all the operations conducted by Marcelino could be rendered invalid.

Gonzalez cited a constitutional provision that “no member of the Armed Forces in the active service shall at any time be appointed or designated in any capacity to a civilian position in the government, including government-owned or controlled corporations, or any of their subsidiaries.”

Harry Roque, professor of Public International Law at the UP College of Law and at the Philippine Judicial Academy and chairman of the Center for International Law, disagrees with the justice secretary’s interpretation, saying secondment of Marcelino with the PDA is covered by the powers of the president as head of the bureaucracy.

Marcelino said his assignment at the PDEA was approved by President Arroyo, who is also the commander-in-chief of the Armed Forces of the Philippines (even if she is a fake president, I must add).

Roque said Gonzalez’ latest tirade against Marcelino “is a very clear indication that he will sustain the dismissal of the drug case against Richard Brodett, Joseph Tecson, and Jorge Joseph tagged by media as the “Alabang Boys” who were caught in a buy-bust in September 2008. The dismissal was aborted by the media leak of bribery that reportedly reached up to P50 million.

Rep. Roilo Golez expressed concern that Gonzalez “wittingly or unwittingly, is sabotaging the operations of PDEA by publicly declaring that ‘Marcelino’s act is not valid.’ Now he has given potentially crucial arguments to the defense counsel of all those facing illegal drugs cases resulting from PDEA operations led by Marcelino.”

Golez said: “A responsible justice secretary thinking of the national interest should have made his legal opinions in closed-door meetings instead of a press conference. In apparently spiting an agency he now considers a nemesis, he forgot his role in the fight against illegal drugs.”

“The justice secretary has become, in my opinion, an unwitting ally of those accused by Marcelino/PDEA of violating R.A. 9165,” Golez said. R.A. 9165 is the Comprehensive Dangerous Act of 2002 that governs government programs and operation to stop the proliferation of illegal drugs in the country.

Golez said with Gonzalez at the helm of the justice department, PDEA’s operations have been neutered. “This is a very sad turn of developments for the anti- illegal- drug campaign,” he said.

Now, let’s see how Arroyo, who has crowned herself drug czarina, will handle this. Will she sanction Gonzalez, who was responsible in installing her in Malacañang despite the fact that she was never elected to the presidency by the Filipino people?

Ding Generoso, a media executive, said if there was any violation of the Constitution with the secondment of Marcelino at the PDEA, it should be Arroyo who should be held accountable. It should be ground for impeachment. “He should be the star witness in a new impeachment complaint against Arroyo,” he said.

Government prosecutors who were so enamored with legal technicalities should take a look at this New York Times news report on a Supreme Court decision that evidence obtained from an unlawful arrest based on careless record keeping by the police may be used against a criminal defendant. The report said Chief Justice John G. Roberts Jr., writing for the majority, said that the exclusion of evidence should be a last resort and that judges should use a sliding scale in deciding whether particular misconduct by the police warranted suppressing the evidence they had found.

“To trigger the exclusionary rule,” Chief Justice Roberts wrote, “police conduct must be sufficiently deliberate that exclusion can meaningfully deter it, and sufficiently culpable that such deterrence is worth the price paid by the justice system.”

That price, the chief justice wrote, “is, of course, letting guilty and possibly dangerous defendants go free.”

    2- Defending democracy and human rights in Panama.

    4- Protecting the integrity of the Torrijos-Carter treaties.

    Operation Just Cause involved 57,684 U.S. troops and over 300 aircraft. These were deployed against the 46,000 members of the Panama Defense Forces.

    According to Gonzales Marcelino’s appointment is illegal and so its unconstitutional and it follows that all his operations are invalid.

    On the other hand unelected Gloria’s appointment of herself as president is illegal and so it’s unconstitutional. Applying the logic of Gonzales, ALL the acts of Gloria as illegal president is invalid including his appointment as DOJ secretary.

    The NY times article emphasizes collective effort of its justice system. They coordinate with one another for the benefits of the American People- to identify clear rules to separate lawful searches from unconstitutional ones. They are not perfect but their collective decision making works.

    In da pilipins, Gonzalez did not even try nor coordinate with his colleagues to weigh the Value of a Rule. Even if the searches were unconstitutional, Gonzalez ignores the real VALUE of the result from penalizing drug addicts and pushers. For the people, it is constitutional.

The 85% have a poultry farm, so they could easily give away some of their stock for the impending Fiesta of Department of Justice_Nationwide celebration.

    In effect, what this accusation and pronouncement entail is the culpability of Gloria in usurpation of power. She should be held liable for this violation in our Constitution. If the DOJ will not file charges against Gloria, can the people file charges as what Biraogo has filed against CJ Puno?

    The Cornwall police have a message: If you deal drugs, the whole neighbourhood will soon know.

    But their new practice of placing warning signs on the front lawns of houses where drugs are found risks stigmatizing people before they have a chance to defend themselves, says a civil liberties watchdog.

    “It sends a message that this is somebody engaged in illicit conduct when that may not be the case,” said Graeme Norton, of the Canadian Civil Liberties Association. “You have the potential that an individual will be severely affected by how their community perceives them and the stigma that can result is quite serious.”

    The strategy came into effect Wednesday when Cornwall police raided a home in the city’s east end resulting in the arrest of three people who now face drug possession charges. As officers left, up went the sign reading “Drug Search Warrant Executed.”

    Chief Dan Parkinson defended the practice, saying it was in direct response to residents complaining of low police visibility and presence in the city. Addressing concerns that the signs might stigmatize people, the chief said the notices are erected only if drugs are seized and individuals are arrested.

    Denis Thibault, a city councillor and chair of the police board, said concerns over the stigmatization of individuals are moot because detailed records of police raids are publicly available and are sent out to media organizations everyday.

    “The only difference here is that a little piece of that information goes out on the front lawn,” he said, noting that signs remain outside a house only for a few hours following a raid.

    Vicky Chartrand, an east-side Cornwall resident for 20 years, told the Star she welcomed the new police policy and said she hoped it would help deter the city’s youth from dealing or using drugs.

    “It’s about time that kind of thing got stopped around here,” said Chartrand, 39, a mother of two.

    Toronto used to place signs outside homes that once housed marijuana grow-ops, but the practice stopped three years ago when questions were raised over the city’s legal jurisdiction to do so.

    The Alabang Boys case is on a roll. This has been affirmed when CA has ordered the PDEA to produce the accused, by granting the Habeas Corpus filed by Verano.
    Likely scenario when they face each other, is that CA would inform the PDEA lawyer, that they do not have sufficinet basis to keep the Alabang Boys_Brodet, Joseph and Tecson, under custody while the DOJ re-evaluates the case. Therefore, the CA is ordeing the release of the suspects, post haste. Voila! Transaction completed! Php50Million!
    PDEA should seek and file for Hold Order Departure. This Alabang Boys (think Drug Pushers should be added)are a flight risk. They are well connected and have the means to flee the country. I hope that the PDEA has also requested to have bank transactions investigated for all parties involved, including close relatives and friends of Brodet, Joseph and Tecson. And the DOJ people too.

    Erap has been forgiving even before Dona Mary’s death. His ill-feelings towards his political foes cooled-off through the years. Older and wiser, he may have thought that there’s nothing to gain in snubbing his political foes during the wake.

    The death of FPJ happened during the height of his election protest. During that time, Susan’s anger, frustration, and stress attributed to her attitude towards her most hated political foes.

    Just in case Erap becomes president again, I hope he will be just and not forgiving because if does forgives GMA and her cabals, then he will be unforgiving and may result to his ultimate ouster.
