Prosecutor John Resado sinks himself deeper . The more he talked the more that his story becomes incredible.He admitted to making a P800,000 deposit on the day he finalized the resolution dismissing the case against Brodett, Tecson and Joseph and ordering their release,

The date of the resolution was Dec. 2, 2008. Information tipped to the National Bureau of Investigation said Resado and his wife deposited separately two P800,000 in a bank in Bacoor, Cavite. He admitted only to one P800,000 which he said came from their money-lending business. He said the deposit had nothing to do with the resolution.

To stress the disconnect between the Dec. 2 resolution and the Dec. 2 deposit, Resado said he actually signed the resolution on Dec. 1.

Resado forgot to check his calendar. Dec. 1, a Monday, was declared by Gloria Arroyo a non-working holiday to observe Andres Bonifacio day which fell on a Sunday.

Prosecutor declines to open bank accounts

State prosecutor John Resado is not willing to open his bank accounts for scrutiny in light of allegations he was bribed to dismiss criminal charges against the so-called Alabang boys.

In a letter to the House oversight committee on dangerous drugs which is investigating the alleged bribery, Resado said he was declining to waive his rights, also invoking his constitutional right to privacy.

Resado, when he returned to testify before the committee last Friday, denied allegations contained in an anonymous letter that he deposited P800,000 on Dec. 2, 2008 in his account with the Banco de Oro SM Bacoor branch in Bacoor, Cavite, the same day he came out with a joint inquest resolution dismissing the drug charges against Richard Brodett, Joseph Tecson and Jorge Joseph who were arrested in September last year.

The same letter said Resado’s wife also received the same amount on the same day but Resado has denied it, saying the P800,000 in his account was a revolving fund from their money lending business.

Rep. Antonio Cuenco (Lakas, Cebu), senior vice chair of the committee, said Resado’s refusal is “proof that he is hiding something.”

“Resado is afraid that his wrongdoings will be exposed,” he said.

Cuenco also said if the committee would not be able to pin Resado on bribery charges, it will use other options.

He said the committee will go after Resado Al Capone style, referring to what the FBI did to the Italian-American gangster of the 1920s and 30s whose criminal career ended with charges of tax evasion.

He said Resado did not report the income from the money lending business in his statement of assets and liabilities or income tax return.

“There is no permit from the Central Bank on his lending business and his business has been overcharging. The Supreme Court said the interest rates should not be more than 1.5 percent per month,” Cuenco added.

    How i wish na mag umpisa ng paraan ang mga pinoy na patalsikin ang fake ng presidente. Kaya lang marunong at lahat ng nasa staff nya puro dating sundalo. para kung may mag tangka sa pwesto nya ang mga dating sundalo na tuta nya ang haharap.

    I don’t want to belittle lawyers coming from so so law schools like FEU, but this Resado is only good as a notary public or provincial lawyer where his legal fees are paid with pigs and chickens. His Promdi face, lousy English and Tagalog and legal alibis show the kind of stupid lawyer he is. How he became a DOJ State Prosecutor is something we want to know. Anyway, his boss Raul Goonzalez is as stupid.

    If REboSADO was such a hot shot lawyer, or even one of those who finished in the top in the bar exams, why would he even work under siRAULo & under Gloria’s administration ? It probably was for his lust for greed & money.

    There are “unnamed” heroes, after all. The employees of the banks who told on the accounts of REboSADO & Blancaflor. Seems like BDO & Metrobank don’t give a f*ck on the kinds of depositors they accept. Maybe BDO & Metrobank banks have a lot of “dirty” depositors.

    Many new lawyers work in government to learn experience and look for connections so it would help their profession when they go into private practice. Some join NBI, JAGO and government agencies as counsels for this purpose.

  5. If Resado declines to open his bank account as his constitutional rights for privacy, justice department must provide a warrant to open his account. Hiding material evidence of bribery is very difficult to prove unless, our justice court are willing to exercise its duty and honestly weigh the Value of the Rule of Law. If I have to weigh the value, the alabang boys must serve their time in jail. Resado has just lost his credibility as a lawyer. He can be bought and stupid enough to deposit the money. He should have nit underneath his pillow for a while. 🙂

    I don’t know if the word ayop e existing sa ibang dialect sa Pinas but in Tagalog terminology, the word ayop is not common or available at all!

    Ganito kasimple ang mga senaryo ng kanilang katusuhan at walang galang sa ating batas, ang turing sa ating Pinoys are tangengok at stupido?

    The Philippines’ bank secrecy laws make it virtually impossible for governmental authorities to obtain any financial information that is collected and maintained by banks about any bank deposits by customers.

    Republic Act No. 1405 (Bank Deposit’s Secrecy Law) declares “all deposits of whatever nature with banks in the Philippines, including investments in government bonds, as an absolutely confidential nature and prohibits the examination or inquiry into such deposits or investments.”

    The ACT you mention is applicableto public officials.Is Resado apublic official? if so, Republic Act 1405 hasan exemption and was amended:

    Sec 2 All deposits of whatever nature with banks or banking institutions in the Philippines including investments in bonds issued by the Government of the Philippines, its political subdivisions and its instrumentalities, are hereby considered as of an absolutely confidential nature and may not be examined, inquired or looked into by any person, government official, bureau or office, EXCEPT upon written per-mission of the depositor, or in cases of impeachment, or upon order of a competent court in cases of BRIBERY or dereliction of duty of public officials. or in cases where the money deposited or invested is the subject matter of the litigation,” “Sec. 3. It shall be unlawful for any official or employee of a banking institution to disclose to any person other than those mentioned in Section two hereof any information concerning said deposits.”

    If Resado is not a public official, then someone in the justice office must provide warrant.

Over where I am based, Ellen, when a government official is caught doing this kind of thing and admitting that he is engaged in money lending, right there and then, he gets sacked, and no doubt, society will demand that he makes amends even by committing harakiri/seppuku to redeem whatever he can redeem of his tarnished reputation, honor and dignity.

    The media will be at his tail to force him to do so as a matter of fact, and what’s worse, the family of the offender is not spared. Pati asawa ni Resado, malilintikan. Instead of writing letters like the one written by the son of one of the suspected bribe recipients, magtatago na silang lahat kundi nila kayang magpakamatay.

    Many years ago, as a Christian, I thought it was wrong, but reading that portion in the Bible where God says “And if thy right hand offend thee, cut it off, and cast it from thee: for it is profitable for thee that one of thy members should perish, and not that thy whole body should be cast into hell.” (Matt. 5: 30), such practice has started to make sense to me. It is likewise a good way of getting rid of evil men like these crooks who now make up the Arroyo government.

    Time for cleaning up, sabi nga. Start at the DOJ and the SC! Ang tamad naman!!!

    According to R.A. 9160 – Anti Money Laundering Law:

    Sec. 4. Money Laundering Offense. – Money laundering is a crime whereby the proceeds of an unlawful activity are transacted, thereby making them appear to have originated from legitimate sources. It is committed by the following:

    (a) Any person knowing that any monetary instrument or property represents, involves, or relates to, the proceeds of any unlawful activity, transacts or attempts to transact said monetary instrument or property.

    (b) Any person knowing that any monetary instrument or property involves the proceeds of any unlawful activity, performs or fails to perform any act as a result of which he facilitates the offense of money laundering referred to in paragraph (a) above.

    (c) Any person knowing that any monetary instrument or property is required under this Act to be disclosed and filed with the Anti-Money Laundering Council (AMLC), fails to do so

    Note that Sec. 4.b & 4.c requires those in knowledge of the existence of such transaction must report to AMLC, with bribery included in the list of predicate crimes. Thus, my earlier theory that it was reported to AMLC and subsequently said info was provided Raul daGoon without Resado’s explicit permission holds water. The anonymous letter gets Gonzalez off the hook, the info provider, however, may be criminally liable.

    Put those imaginary handcuffs on the anonymous suspect, hahaha.

    1)Money laundering is not a crime under the law of the Philippines.—-According to Mr.& Mrs.Pidal.

    2)Any current requirements that Philippine financial institutions verify the identity of their customers, or maintain complete records of those identities or of customers. financial transactions, are at best ambiguous and very limited.—Bolante used this on his senate inquiry.

    3)The obligation of financial institutions operating in the Philippines to report suspicious transactions is also ambiguous at best.–This is what the DOJ are trying to do.

    4)Also, I think the BSP had not issued any counter-money laundering regulations or guidelines that would require financial institutions to take measures to verify and record the identity of their customers and to report suspicious transactions to the “competent” Philippine authorities. confidential nature and prohibits the examination or inquiry into such deposits or investments.–Problems lies here because Licaros is no longer Gobernador ng Bangko Sentral.I know a lot of people worked at BSP before.Their legal department were all honcho topnotch.Most of them are now my majong buddies here,scalera bunot,todas tayo cross!

    I don’t know about it, but anyone’s constitutional right can be override by the court’s decision for the interest of the State..Like the right to Privacy, the state can apply for court’s authorization to take a good look at Resado’s account for the Purpose of Criminal Investigation,if it can convince the courts the possible the existence of such and maybe the Ombudsman, and certainly the Police has such power.

    In our case the bank has the responsibility to Alert the Authorities of the movement of Cash or any form of currency over $10 thousands..no worry for anyone dealing with clean money, for launderers, they all have all kinds of tricks.

    paid chickens and pigs for legal fees”..aywan ko ngayon but during my father’s time, he was paid mostly with chickens and eggs because his clients could not afford to pay in terms of money…kaya laging manok at itlog ang ulam namin..kaya seguro na highblood kaming lahat na magkakapatid..but ang tatay ko graduated valedictorian of Phil. Law School and was in the top ten sa bar exams…kung hindi seguro siya nagkasakit (hb) baka mukhang leche flan na ang mukha ko…maraming matatalinong lawyers sa amin kaya lang they practice in Manila..brain drain? hindi naman for better opportunities…

    You made a very clear point there, educating and influencing people to do the right thing begins with the family. Being OFWs, you guys need to stress to those left behind the importance of good leadership and the right to demand for it. We cannot reach everyone and do the same for those in the other side of the digital divide, we can all start with our relatives whom we are inconstant contact with. There, “dakdak” plays a very important role.

    You’re right the alternative – being silent – achieves none.

    Though I never liked nor voted for Legarda, I don’t think Mr. Esposo’s comparison of the 2 is accurate. No one, as in no one can surpass the shrewdness and callousness of this little girl named Gloria. If you are to based Mr. Esposo’s theory about his assessment of Loren, than we can also say the same thing to Manny Villar. Both aren’t “oppositionist”, both are opportunist to say the least. Everyone knows that Villar became speaker of the house because of Erap, but when Erap needed his support, he stabbed him in the back by fast forwarding the impeachment process… And when his new found ally (GMA) was almost in the doldrums due to the “hello garci” scandal, he did that too to his new benefactor… dropped her llike a hot potato. And not only that, he slowly but surely tried to get Erap’s support “again” by visiting him quite often in his Tanay detention. So who is the clone here??? Duh!!!

I’ve a friend who’s an American citizen who availed of it about 2 years ago, sumuko siya dahil sa pangongotong ng mga hinayupak ng mga tiga immigration. Was he approved on the spot? Well, he was “pre-approved” on the spot pero ang daming pasikot sikot at ang daming binayarang kung anu-ano. Di na niya malaman kung saan napupunta ang mga binayaran niya kaya di na niya tinuloy.
    Not that I’m discouraging you but I’m just telling you about the experience of my friend.

    Resado’s defense is ridiculous if not pathetic and everybody is feasting on him. But let’s not forget that he is just one of the small fishes trying to dance in synchronize and to blend with the sharks in the big fishpond of Gloria and the fat guy. What is 1 million, 2 million or 5 million? They are just loose change, a morsel of what the big sharks are racking in. And as usual only the small fishes are being caught, made to sacrifice and the sharks are set free to fill their insatiable greed.

    It’s now official…Resado is the Fall Guy. The House has unanimously recommended filing charges against him with Ombudsman. Order from the top to save Goonzalez and other culprits. If I were Resado, I would tell all and be a state witness. But the way he looks, the guy is willing to be shot in the head to save his master.

    be, you are right. It looks like Resado was promised the the old way by telling him, “noy, huwag kang mag-alala, kami ang bahala”. But they stopped from there and avoided continuing what was supposed to be, “ikaw ang kawawa”. Noy is an ilonggo word for man, and you know who would use such word.

  71. Resado is not exempted from prosecution even if he is a prosecutor for violating Philippine laws on usury and moneylending being engaged in by people working for the government. In fact, I understand that there is a law barring any government official and/or employee from engaging in what is called “moonlighting” or earning extra income elsewhere.

    So, it is but proper that Resado with his admission be sacked en pronto, and prosecuted for violating some code of ethics, rules, laws on government employment plus the crime of accepting bribes from some criminal suspects. Kabastusan nang masahol iyan. Pag wala pa ring ginawa to put all these crooks to prison, guerra patane na.

    Why is Justice Secretary Raul Gonzales hot on a so-called independent body investigating the bribery scandal in his department?

    It should be the office of the Ombudsman probing the alleged payoffs of some of the state prosecutors who let the “Alabang boys” free after they were caught in a drug buy-bust operation by the Philippine Drug Enforcement Agency.

    We learned from our sources that he and Ombudsman Merceditas Gutierrez don’t get along. Moreover, Gonzales himself called up one of the members of the investigating panel to invite him/her to join the probe body.

    ImageJust wondering how independent that body will be if Gonzales had a hand in choosing at least one of the members.

    And now that Gutierrez seems keen on investigating the case, a third party enters the scene.

    Let’s see how this plays out.
