The people’s fury

Never mind Senate President Juan Ponce Enrile and Sen. Miriam Santiago. We know them to be allies of Gloria Arroyo (or whoever will serve their interest).

But it was painful to see Sen. Aquilino Pimentel, who fought the Marcos tyranny and was a victim of electoral cheating, spouting the same line as Enrile and Santiago putting the pressure on the World Bank, which exposed the rigging of bids in the public works it finances, instead of Finance Secretary Gary Teves and Ombudsman Merceditas Gutierrez who, by their non-action, protected Gloria Arroyo, Mike Arroyo and other crooks named in the WB report.

I texted Sen. Pimentel telling him of my disappointment about his role in last Thursday’s Senate hearing and this was his reply:

“Sorry, dear Ellen, for creating the misimpression. That’s the last I’d do: protect GMA and company.

“If you read carefully what I did was tell Miriam 1) we need to get WB orig documents to pin down the crooks. What other legal way is there? 2) NOT to terminate hearings now but WAIT for WB REPLIES to my letter requests; 3) summon Hoffman to testify to find out if they can withdraw the confidential clause. No use relying on Teves and Ombudsman. They are bell ringers for GMA.

“It’s your right to be disappointed. I can only explain that your disappointment is misplaced. Teves and Ombudsman said they got a nine-page confidential report where witnesses are identified as CWO1, 02 etc. What do you do next? Tell me, maybe you have better experience nailing down criminals.

“As to WB-bashing, all I said is that we need their original documents to pin down the crooks. Am not too sure it’s bashing.”

I’m flummoxed that government officials don’t know what to do with the leads provided by World Bank.

A lawyer who is one of my blog regulars would like to give this advice to Pimentel and to senators who really want to find out the rigging of bids that the WB revealed so that they can craft the necessary legislation. Atty 36252 said: “Subpoena the bid documents. I’m sure a good engineer and cost accountant can wade through the figures to determine if all the bids were overpriced.

“Subpoena the payments made by the DPWH, and subpoena the books of the contractors. The money was paid to the contractors by the government, so it is in their books. When they paid their padrinos, surely there is an entry in their books for a withdrawal in cash. Ano yon? Petty cash? The amount is certainly not petty.”

Atty 36252 remarked: “Ang pilit niyo sa pag-interview ng mga crooks. Haven’t you learned from Iggy Pidal, Joc-Joc and Leo San Miguel? Para kayong pumipiga ng bato. They would have a script ready before they appear.”

He asked Pimentel: “Nakalimutan mo na ba ang litigation skills mo, Senator? Physical evidence is stronger than testimonial evidence; that includes the paper trail (financial transactions). A good forensic accountant (bagong term ng mga Kano) will help you find the goods in the books, no matter how well-done the books have been cooked.

“Do it fast, bago tustahin ang mga libro. Remember the massive shredding ng Arthur Andersen kaya sila napasara? Kaya sila’y tinawag na CPS not CPA. Certified Paper Shredders.”

Atty 36252 said the senators should read the charter of the World Bank which all members countries including the Philippines signed. He cited the “Section 5. Immunity of Archives” which states that “The archives of the Bank shall be inviolable.” and Section 8 on Immunities and Privileges of Officers and Employees.

It states: “All governors, executive directors, alternates, officers and employees of the Bank…(i) shall be immune from legal process with respect to acts performed by them in their official capacity except when the Bank waives this immunity.”

Atty 36252 said, “The phrase ‘inviolable’ means that it is not subject to judicial process.”

My blog is ablaze with reactions how Santiago railroaded the hearing. A contractor who logs in under the name “Tongue-Twisted” was furious: “That wasn’t a hearing we saw yesterday. It was gov’t propaganda. And carried live by all three government channels. Unbelievable.

“Dati, pag may hearing o exposé si Sen. Ping Lacson sa Senado, sabay-sabay yung tatlong station na nagpapalabas ng mga komentaryo nila Rosebud, Alex Magno, Leonard de Vera at VACC na puro anti-Lacson ang banat. Kahapon, baliktad na, ipinarating ng husto sa buong bansa ang mensaheng preparado ni Brenda na ang World Bank at America ay masama, mga pipitsuging abogado at mga squatter.

“Tapos dun sa mga suspects, napakabait ni Brenda, halos siya na ang sumasagot sa sarili niyang tanong. It was a stand-up comic act but nobody was laughing (except Pichay and Paras), contrary to the first hearing when she berated harshly all of the gov’t people named in the WB reports, she even asked Gloria to sack Teves, Gutierrez, and Ebdane.

“Biglang nagbabago si Brenda pag nabanggit yung magic names na FG at Gloria! Good thing the oppositionists saw through it and took no further part in that moro-moro.”

Hawaiian Guy asks if there’s hope for the country when black is presented as white and white is presented as black: “This is really funny. Where in the world can you see the accuser becoming the accused? The WB only pointed out what is glaring practice in implementing gov’t projects, where collusion between contractors and gov’t ranking officials, including those from Department of Public Works could not even escape the eyes of ordinary people. How much more if one goes into it and does some investigative work?

“The Paras brothers, Pichay, DPWH officials in the bid committee, and FG, among others, are reportedly behind this corrupted system again. What more can people say? Paulit-ulit lang wala naman nangyayari. The Senate committees led by stooges (e.g., Brenda), inaction by the Ombudsgirl, and apathy by others only sustain the life of this crooked system that keeps on surfacing with impunity.

“May pag asa pa ba ang Pinas?”

Diego K. Guerrero said, “GMA administration’s congressional allies and the Chief Ombudsman are blaming the World Bank for not giving them detailed copies of bid-rigging anomalies. They are shooting the messenger. The message is crystal clear: Jose Pidal Mafia cartel rigged public bidding. The Ombudsman should immediately investigate upon receiving the WB report. They see no evil if a sacred pig is involved in the anomalies and not doing their homework. Natutulog sa sila pansitan at binaligtad talaga!”

    Of course I still remember my law. That’s why I am trying to lay down the premise for further action versus crooks if WB denies our request for original documents.

    Grizzy’s defense of Senator Pimentel should also have been included. For whatever reason the good senator has, I’m willing to give him the benefit of the doubt considering the many sacrifices and contributions he made to the country. I hope he and the rest of the senators (from the opposition) who want to know the truth continue to dig deeper into this scandal…one of the many scandals that rocked this fake government from day one.

  3. With legalese dominating the hearing, it was easy to understand why the non-lawyers left early. But even then, Pimentel and the Cayetano siblings had the chance (and the number!) to determine how the hearing could have gone. The three were allies in the minority and with five members left, they could have prevented Miriam’s railroading.

    They didn’t!

    Tongue, either the remaining senators were scared of Miriam or were on her side regarding the conduct of the hearing. Anyway, another Committee, this time under Chiz Escudero, might continue with the WB investigation.

    FVR attending the Senate hearing? No way. I bet you he will leave the country if ever he’s called to the hearing. If you remember those coups and rumors of coup…he left abroad and returned when the coups failed.

    Take it or leave it, but as far as I am concerned, knowing the Senator, I will give him the benefit of the doubt. Hindi ko naman siya palalampasin kung mali siya, but definitely, he must have a valid reason for taking his present stand. Kita naman natin ang nangyayari sa ginagawa ng mga walk out lang ng walk out.

    This time, with me posting your comments to the Senator, lalo siyang ma-i-incense, not excited, to do what is right and proper. Puede naman kung gugustuhin lalo na kung tutulungan natin siya.

    Di na puede ang mga kalokohan ni Gloria via Miriam Brenda. Time to clip the wings of these lukarets.

  13. You bet, I can be the most loyal of friends, pero masama akong magalit. Hindi ko pinapatawad kahit kapatid ko pag may ginawang kalokohan. Kilala din ni Senator Pimentel ang kalibre ko.

    Intindi ko rin siya, and I know how much he loves the Philippines and is trying hard to be worthy of the trust and respect people who have voted for him give him kahit mangamoy siyang baboy sa babuyan na pinasukan niya. Kaya kaibigan ko siya.

    At least, amoy baboy lang, di gaya noong mga kasama niya sa Senado na nakadikit na yata iyong tae ng baboy sa balat nila. Tangnanay nila!

  14. Kamag-anak din namin si FVR sa totoo lang, pero wala akong tiwala sa kaniya. Pinsan niya trinaydor niya, iba pa? Buti pa nga si Enrile na pag gusto niya, may nagagawa siya. Kaya lang mukhang nagsawa na ring gumawa ng mabuti. Tangnanay talaga ang corruption na pinapairal ni Gloria. Tindi ng epidemic. Sobrang contagious ang graft and corruption ng talandi!

    Like Ellen, I never have addressed this idiot as president but a criminal kasi maski sa legal books namin, krimen ang ginawa niya from the start, hindi lang tungkol doon sa pandaraya sa election noong 2004. Maraming kasalanan ang animal na iyan.

    Hindi mabibisto ng iba iyan kundi mag-iingay ang mga pilipino. Nasasakanila na talaga ang pagpapaalis sa walanghiyang iyan.

    We only have to see Pimentel’s lifestyle and say that he’s not corrupt or the least corrupt. So far, I haven’t heard of him being involved or implicated in any scandal. Look at what he wears…simple “Barong”. I’ve seen him wearing the same light blue “Barong” many times.

    May nagagawa naman palang maganda ang dakdak, galit at batikos. Ito ay patunay na kung ating susubaybayan ng husto ang kilos ng ating mga elected/public officials at meron tayong Ellen na walang kapaguran sa pagususulong ng ating isyu ay makakakuha tayo ng pansin. Abangan ang susunod na kabanata dahil hindi pa tapos ang WB hearing.

  18. Ang linaw-linaw naman pala. Sinabi na confidential iyong report na binigay ng WB sa Ombudsman at DOF, pero iyong mga idiot, dahil gustong protektahan iyong mga amo nilang kriminal, binulgar pa ang confidential report na napunta siguro sa kamay ni Lacson.

    I agree with Senator Pimentel that the reason why it was confidential was not really to conceal the truth from the people of the Philippines for it is the responsibility of Philippine authorities to investigate on the complaints filed in the WB by the likes of Suzuka for instance.

    Pero ayaw talagang mag-imbestiga ng mga hayup at pinalalabas pang incompetent ang WB. Kaya lalong hindi ngayon magko-cooperate itong international agency na ito na masangkot sa gulo ng mga pilipino. Retaliation na lang ang gagawin nila by declining to give further financial assistance to the Philippine government, which is the best they should do at the moment.

    Ang masama si Pimentel pa ngayon ang pinalalabas na scapegoat ng mga hayup. Buti na lang mabait si Senator. Lalo siyang na-push ngayon na isulong ang issue na ito.

    Kaya kung ako sa inyo, tutulungan ko siya kung may alam kayo. Madali naman siyang kausapin sa totoo lang.

  19. Hindi trabaho ng WB ang mag-imbestiga sa teritoryong hindi naman nila sakop. Puede lang silang mag-request ng imbestigasyon at bahala na iyong mga sinabihan nila. Kaso sangkot iyong mga kriminal sa Malacanang, kaya ginamit ngayon iyong mga unggoy na nasira na yata ang mga ulo sa kabibilang ng mga perang binigay sa kanila noong kriminal via doon sa may deperensiya, pati na iyong expose lang ng expose tapos nag-wo-walk out. Yuck!

    Kaya nga sabi ko kung talagang gusto ni Lacson na malaman ang totoo, i-request niya iyong mga police sa Japan na tanungin iyong Suzuka. Iba naman ang pulis dito. Mas marami ang matino at masisipag mag-imbestiga dahil naiintindihan nilang trabaho nila iyon. Problema lang nga baka si Siazon utusan ni Gloria Dorobo na sabihan ang mga hapon na huwag pansinin si Lacson.

    Kung gusto niya, ako ang magpapasa sa pulis at Ministry of Justice namin ng isyung ito for the sake of truth and justice. Tiyak may mangyayari!!!

  20. Oo nga ano? Papaanong mag-iimbestiga (criminally speaking) e hindi naman police agency ang WB gaya ng Interpol kundi financial institution.

    Iyong mga unggoy ang dapat mag-imbestiga ng reklamo sa WB, halatang-halatang pinagtatakpan nila iyong benefactor nilang matabang ganid na tumitirada din gaya noong asawang nakaupo sa Malacanang imbes na sa Muntinlupa. Mga taumbayan naman, maliban doon sa mga tauhan ng Bayan yata, tuod lang. Walang pakialam!

    This may have been asked many times but this question keeps on nagging me still: If the past behaviour of Sen. Enrile has been obviously supportive of GMA and logically he will always block all corruption evidences leading to GMA in future senate investigations why did Sen. Lacson facilitate the Enrile Senate Presidency?

    Sa palagay ko si Senator Pimentel was just trying to stay calm kasi baka hindi na niya mapigilang murahin si Brenda ng PIN. Lalo na naka-TV, hindi niya gagawin iyon. Pero the fact na hindi siya umalis is more than what I can say for the walk-outers! Kesa nga naman sabihin ni Brenda, end of the story!

    Ang talagang hayup diyan si Brenda na ubod ng yabang wala naman palang ibubuga. Pati nga doon sa anak na namatay, nagsinungaling siya. Sabi niya noon sa mga taga-media nang mamatay ang anak niya di na siya babalik sa politika. Tapos beso beso na doon sa pandak na inutusan niya iyong mga fans ni Erap na lusubin noon May 2001. Nakakasuka!

    Tanda ko pa ang sabi ni Monsag noon tungkol doon sa rally sa EDSA for Erap na nasuka daw siya sa speeches nina Brenda at Enrile. Come to think of it, ito ngayon dalawang ito ang nagpapalakad ng Senado. Nangkupo!

    Ano kayang mga kababalaghan ang gagawin pa nila na hindi pa alam ng lahat? Pero por diyes por singko, walang nag-iingay maliban doon sa mga tauhan ng Bayan at bloggers ni Ellen!

    Brenda was seen on TV footage courtesy of Net-25 calling on people to march to Mendiola and attack Malacanang. That was May 1st, actually considered the failed Edsa 3. Was she ever arrested? No. She even became one of the Bitch’s closest ally. One Bitch plus one Bitch equals two Bitches.

    Trabaho iyan ng lukaret na ipalitaw sa mga kinauukulan ang katotohanan ng sumbong ng mga witnesses ng WB. Tangnanay niya na nagmamagaling, nahahalata tuloy na kabisote lang pala, may toyo pa sa ulo! Grrrrrrrrr! Nakakakulo ng dugo.

    OK iyong suggestion ni Senator Pimentel na humingi ulit ng kopya ng report sa WB na hindi na confidential dahil sa kaululan ng mga vested interests sa Senado, nabisto tuloy na gago sila!

    Iyong confidentiality ng report ng WB ay malinaw naman na para hindi makaligtas sa prosecution iyong mga may kasalanan at para naman fair iyong WB, ginawang confidential ang report dahil akala noong mga dayuhan may natitira pang delikadesa at katinuan ng isip iyong mga autoridad na dapat na magpakulong sa mga kriminal. Nagkamali sila dahil wala nang Rule of Law sa Pilipinas kundi tradition/institution of impunity na.

    Si Senator Pimentel naman, kahit papaano ay umaasa pa sigurong maibabalik niya ang Rule of Law sa bansa niya. Never give up pa siya! 😛

    Their game to gain advantage? Whose advantage, when all senate investigations on cases involving GMA looting of our money and her collaboration with the Americans and Chinese in taking over control of our vital resources such as food, information technology network, military and power will already be blocked before it could even take off because Enrile has been placed as the Senate President?

    I just received a couple of hours ago the reply of the Vice President for Integrity of the World Bank, Leonard McCarthy who wrote on behalf of WB president Zoellick and VP Adams. I had written them to request for a copy of
    the ORIGINAL world bank report on the anomalies of the road projects here.

    The reply places the onus of prosecuting the crooks on the Ombudsman. (Yuko: ngayon ipakita ni Maldita Gutierrez na hindi siya kabit ni Mike Arroyo! Makapal na ang mukha niya kundi pa niya a-action-an ang report ng WB. )

    Mr. McCarthy clarifies that “a distinction must be made between two types of documents produced with respect to INT’s investigation. As you may know, a Referral Report (9-pages) “summarized INT’s investigative findings” was
    shared with the Government in 2007. .. it was shared on a strictly confidential basis to allow the investigative authorities in the Philippines to undertake their own investigation and reach their own conclusions.”

    I guess that the other type of document that he had in mind must have been the Redacted Report that the World Bank has not yet released up to now.

    Nonetheless, in his letter, McCarthy says that “in addition to the Referral Report we have also recently provided the Ombudsman’s Office with documentary material relevant to the matter.” He adds “For that reason, we believe the Referral Report and the documentary evidence provided to the
    Ombudsman’s Office constitute the relevant body of information for the Ombudsman to consider in carrying out the investigation she deems appropriate.”

    In the closing paragraph of his two page letter, McCarthy says “I trust the above answers your questions but I would like to emphasize again our willingness to assist the appropriate authorities in dealing with the investigation.”

    At our next communication, i’d share with you my reply to Mr. McCarthy’s letter. I have to go now to meet other schedules as I prepare to speak at the Senate this afternoon on the plight of the farmers who were forcibly
    dispersed as they marched along Mendiola towards Malacanang last Thursday.

    (UPDATE) Representative Juan Miguel Arroyo of Pampanga province denied an allegation by the provincial governor that he blocked the governor’s attempt to appoint a new police director for Pampanga.

    “Why will I do that? What will I gain out of that? I’m completely surprised,” the eldest son of President Gloria Macapagal-Arroyo, said in a phone interview.

    He also said it was normal for police officials to get his opinion on issues, including the appointment of other police officers, but the last say rested with the governor.

    Arroyo added that running a province was not a one-man rule.

    “Running the affairs of a province is very different from running the affairs of a parish,” he remarked.

    The governor, Father Eduardo Panlilio, is a priest.

    Arroyo dared Panlilio to present proof to support his claim or at least call up the regional police director for verification. He said the governor could also have called him directly instead of airing his grievances through the media.

    “Maybe if that is his assumption, he should ask the regional commander. Or make phone calls to me instead of going to the media,” he said.

    Arroyo lamented that he was one of the few politicians in Pampanga who have not joined moves to recall Panlilio from his post, “and yet I am the one he is hitting.”

    He said Panlilio had fought with many board members, mayors and vice mayors, causing them to withdraw their support from the governor.

    Even the nongovernmental organizations that had supported his bid for governor have backed calls to recall Panlilio from his post, the lawmaker said.

    “The only ones supporting him are the media and the students in Manila,” the President’s son said.

    But the lawmaker said he was not picking a fight with the governor, a prelate, because he was taught not to tussle with priests.

    “You know, I don’t want to fight with a priest … My Christian beliefs taught me not to fight [with priests]. It’s very unchristian for him to blurt that out in the media,” he said.

    Even the Japanese thought so as a matter of fact. That was why Japan was reluctant to invite him to Japan, and lend him money for his proposed projects then. When Japan agreed to invite him on a state visit, EDSA 2 had begun and the visit was postponed.

The way he participated gave it a semblance of regularity when in fact everyone watching the ANC coverage were puking on their TVs.

    He should be more careful now more than ever as the House has passed HB 737 which opens the door to amending the constitution. I know this may be his last hurrah, but pwede ba, saka na lang niya ipukpok yung federalism niya pag wala na si Gloria?
