Miriam ‘loses’ road rigging contract probe

Blue Ribbon likely to take over investigation

miriam-santiago The Senate economic affairs panel chaired by Sen. Miriam Defensor Santiago will no longer investigate the criminal side of the World Bank report on alleged collusion and bribery in government infrastructure projects and will instead focus on the report’s economic implications.

Santiago said this was the consensus reached by the majority bloc in a caucus called yesterday after some senators complained that last week’s hearing turned into a forum for bashing the World Bank.

“The first item is, pursuant to my recommendation, the Senate economic affairs committee will no longer issue subpoena to the country director of the WB,” Santiago said.

She said the country director, Bert Hofman, will be invited through Finance Secretary Margarito Teves to an informal technical briefing for all senators.

She said her panel would no longer hold a hearing with WB as a resource person.

Santiago said she has also acceded to calls by colleagues to relax the rules in conducting the investigation by waiving much technicalities.

Sen. Panfilo Lacson earlier bewailed the “orchestrated” hearing last week, which he said could give the public the impression the Senate was protecting personalities with ties to the Palace.

He said Santiago’s panel diverted from the core issue of collusion between three Filipino contractors and government officials, including presidential spouse Jose Miguel Arroyo, to corner WB-funded road projects.

Lacson said his colleagues are now preparing resolutions to seek a Senate probe on the criminal aspect of the controversy.

He said the Blue Ribbon committee, chaired by Sen. Richard Gordon, would likely take over the investigation.

“Ang economic affairs, ang aspect ng economic affairs tatapusin ng committee at magkakaroon ng committee report na isa-submit. Now if there are 1-2-3 senators na magpa-file ng resolution calling for an investigation sa aspect ng accountability of public officers, that will fall within the jurisdiction of the Blue Ribbon committee. And I think that is what is going to happen,” Lacson said.

He said he would present his witnesses once the resolution is referred to Gordon’s committee.

Gordon said he is ready to take over the investigation on the criminal aspect of the WB report.

“It is not for us to investigate the World Bank but the allegation of collusion. The Blue Ribbon committee will investigate the allegation to aid the Senate in drafting laws that would strengthen the country’s campaign against corruption,” he said.

The WB has stopped the award of $33 million worth of contracts for road projects after uncovering a major cartel involving local and international firms bidding for the projects.

The WB blacklisted three Filipino contractors for “engaging in collusive practices” during the bidding on contracts under Phase 1 of the National Roads Improvement and Management Program.

The firms were EC de Luna Construction Corp, Cavite Ideal International Construction and Development Corp., and CM Pancho Construction Inc.

Gordon scored the Office of the Ombudsman and the Department of Finance for doing nothing on the WB report.

“The report has been with the Ombudsman and the DOF for quite some time. How come they have not made their move yet? The World Bank has given us a chance to fix this, but we are still not moving a finger,” he said.

Former senior government executives who served five presidents are considering filing an impeachment complaint against Ombudsman Merceditas Gutierrez for her failure to initiate a probe on the alleged rigged biddings.

“Even though some of our members have signed the petition calling for Ombudsman Gutierrez’ resignation, we think that the more appropriate decision is to initiate an impeachment complaint,” said Karina David, a member of the Former Senior Government Officials (FSGO) and former chair of the Civil Service Commission.

David said calling for Gutierrez to resign is futile since “she will never listen.”

“If she is indeed serious in investigating the mess, why did she not write the WB and ask for the evidence it has? It’s much simpler that way,” David said.

David said they have not yet made any calls for the resignation of Teves.

“While he is a friend to many of us, and while we hope he is one of the decent people in the government, it is time to draw a line in the sand,” she said, adding that the finance secretary should make a stand on the anomaly.

Opposition and civil society groups expressed disappointment with the Senate probe on the WB report.

“You cannot fault some sectors and the people if they begin to see the Senate as having lost its independence,” Makati Mayor and United Opposition president Jejomar Binay said.

Binay said during the last hearing, some senators appeared to gang up on the World Bank, while being soft on Mr. Arroyo.

“They were quick to clear Mr. Arroyo, even quicker to indict the World Bank,” he said.

Binay said in his meetings with local opposition leaders and representatives of civil society and people’s organizations, questions were asked on the independence of the upper chamber.

“They are disappointed with the Senate. The upper chamber has traditionally been an independent institution. And when the people voted for the candidates of the opposition in 2007, they were voting for a Senate that will continue the tradition of independence,” he said.

“When the Senate surrenders its independence, it will only be the judiciary that stands in the way of Mrs. Arroyo’s plans. But even the independence of the Supreme Court will be tested this year, when Mrs. Arroyo appoints seven new justices,” he said. – With Ashzel Hachero

    Good for her ! If Dick Gordon takes over, I’m not so sure about his impartiality. Gordon is also a Malacanang ally, but lately has been critical of the Palace (due to his desire of higher office in 2010?).

    FG Mike Pidal is not appearing after all citing health as the reason again. He said he might stressed out. Bolante had the same reason but this guy at least attended most of the hearings. If the WB official turns around and clears Mike Pidal, Uncle Sam’s hand is certainly on it.

    Kung nakaparada na ang halos lahat tungkol sa eleksyon at bababuyin pa ni Gloria ay dyan magkakasubukan kung hindi takot sa dugo si Juan.

    As to Gordon, tingnan natin kung hanggang saan niya kayang banggain o protektahan ang Arroyo-Pidal.

    Good thing Pimentel has you to speak for him here but believe me, elsewhere people are still angry at him for doing as the crooks Miriam and Enrile did during the hearing. The way he participated gave it a semblance of regularity when in fact everyone watching the ANC coverage were puking on their TVs.

    He should be more careful now more than ever as the House has passed HB 737 which opens the door to amending the constitution. I know this may be his last hurrah, but pwede ba, saka na lang niya ipukpok yung federalism niya pag wala na si Gloria?

    Kahit na maganda ang Federalism proposal ni Nene Pimentel ay hindi yan pagtutuunan ng pansin ng mga pinoy ngayon sa dami ng problemang politikal at kurakutan. The fact is, it needs a nationwide information dissemination as to what federalism is all about. Kailangan na pati sa grassroot level ay kumpleto ang information. Kapag wala na si Gloria, kahit ako ay pag-aaralan ko yan.

    Tama ka, ang image ni Pimentel after he sided with Enrile and Mirriam on the WB issue became mushy for some and needs repair.

    It was really a mistake for Sen. Pimentel to have taken the same line as Miriam Santiago. Same thing with Pia Cayetano and Jamby Madrigal. What happened to their brains?

    But I know that Pimentel is not in the same league as Miriam and Enrile. He is a decent person.

    I think it was a lapse in judgment. I think he realized that. Bumawi na lang siya in the next hearings.

  32. Last night, in Strictly Politics, we invited three distinguished lawyers: Roger Vinluan, incoming IBP president and of counsel of ACCRA; Tranquil Salvador , partner in Romulo Mabanta etc law office; and Alex Avisado senior partner in E.R Gana and partners law office.

    They were all of the opinion that with the World Bank documents, one can build a case against those who colluded in the rigging of bids. Get the testimonies of the people mentioned there instead of using the document itself as evidence.Elementary.

    They said it all depends on political will.

    They proposed an independendent counsel just like what is being done in the U.S. But still, it all boils down to political will because it is Gloria Arroyo who will appoint the head of the independent commission.

    Baka magiging katulad yan nintong independent commission kuno on the DOJ bribery case who were recommended by Justice Raul Gonzalez. Included is a Gloria Arroyo defender Fr.Aquino.

  33. Marvin Bionat is no Marvin Javier, Tongue. He is a Filipino scholar at Harvard, and one of those who led the movement so Filipinos overseas can have a say in their country’s politics. He and many of us in the said movement actually worked hard with Senator Pimentel to have that bill passed in the Senate, and knowing Senator Pimentel to be honest and true, we have tried our best to support him in doing what he can even for the ungrateful.

    However, we are also not easy on the good Senator as we are ready to criticize and not tolerate him when he’s wrong.

  34. FYI, Chi, I am a critic of the Federalism of Senator Pimentel myself kaya pinadala niya sa akin ang original document ng proposal niya. Pero di ko pa rin ma-get kung ano ang ibig niyang mangyari kasi ke liit-liit na bansa, at hindi na nga mag-unify ang mga iba’t ibang lahi ng mga pilipino, gusto pang lalong magulo na watak-watak sila. I can’t understand that mentality as a matter of fact.

    Tama ka, federalism should not be endorsed during the reign of the wannabe queen. In fact, it should not be adopted at all until Filipinos have learned their lessons politically well.

    Hangga’t di sila natutong huwag binebenta ang boto nila, di maganda ang sistemang di naman nila maiintindihan. Puro yabang lang, wala namang ibubuga.

    Kaya matindi ang reaksyon ng tao sa posisyon ni Pimentel sa WB issue ay dahil desente nga siya, hindi tulad ng mga sinamahan niya na Enrile at Mirriam. Sa positibong anggulo ay dapat ikatuwa niya at marami pa pala ang sumusubaybay sa kanya at nais na bumalik sya sa ‘sarili’ na siyang hinangaan nuon, samantalang pinagtatawanan at kinasusuklaman na lang ang kanyang mga kasama.

    Si Pia Cayetano ay hindi ako nagtataka at para sa akin ay a notch or two higher lang siya sa league nina Revilla. Jamby was a big letdown, I was never ‘attracted’ to her anyway.

    Kahit walang background sa law, Ellen, common sense naman na ipatawag iyong mga witnesses kung ayaw umamin ng suspect/accused. But as Senator Pimentel has stated in his reply to the bloggers here, he has to ask for the original WB document because the Ombudsman and the DOF would not provide them with the original documents. Apparently, what Lacson, et al had received even from some devious characters are the doctored ones with all erasures of the doggie’s espouse name and his cohorts.

    Point is bakit di nila ipahuli iyong asawa ni Gloria Dorobo? Private citizen naman iyan and should not have any immunity.

    Kung ia-analyze KO yung nangyari, isinet-up ni Miriam yung second hearing na nagsimula sa kanyang “lecture” on the types of evidence na meron pang Powerpoint presentation ng kanyang legal gobbledygook na ang purpose lang naman talaga ay i-block yung pagpe-present ni Lacson nung documents na hawak niya. Miriam did all she can to prevent Lacson from reading it into the Senate records especially those that were damning to the FG.

    Remember that during the first hearing, si EC De Luna ang target, nagulat ang lahat nung ilabas ni Lacson yung Appointments Diary ni FG na may mga date and time kung kailan nagdeliver ng kuwarta sa LTA. That was one surprise she has not prepared for.

    Malacañang war room operators didn’t want the same blunder from Miriam in the next hearing. None of those supposed tell-all thick reports shall be allowed using the legalese Miriam had expounded on her “lecture”.

    Although Miriam said she had been provided a copy by Lacson, she obviously was not ready for any new surprises.

    But of course Lacson knew it was forthcoming, his staff then provided each senator a copy including the news teams of the major networks.

    The ploy is this: Miriam wants it to appear that they are facing a dead-end wall. The WB provided a mere 9-page report and wanted it strictly confidential, Lacson has copies of detailed interviews but are not “acceptable” under HER Rules of Evidence.

    Buti na lang BOBO yung Gutierrez dahil siya na rin mismo ang umamin na just two days before the hearing, the World Bank provided her documentary evidences and that she was even offered help by WB officers in her investigation. DIYAN SILA NAGIBA. Thanks to Sen. Roxas for pointing that out.

    But instead of pouncing on Gutierrez, and start to work from Lacson’s “unofficial” documents which they could have confirmed directly from the contractors themselves upon subpoena, they proceeded to attack the World Bank.

    From the PDF files which I linked in an earlier thread, there were real big contractors included in the interviews like RD Policarpio and EEI who gave testimonies on the bid-fixing who when called, are stable enough to tell the whole truth because their companies’ future do not end with the Arroyo regime.

    Miriam did well in that nationally-televised coverup aided by, of all people, the opposition!

    A lot of time, effort, money and other resources are spent on a fruitless pursuit precisely because we fail to realize that the stumbling block to achieving what we want, i.e., to bring these criminals to account for their actions, is Gloria herself. Oust Gloria NOW and everything will fall into place.

    We have lost focus. The original sin is the Garci Scandal. The original sinner is Gloria. The succeeding sinners are Gloria’s minions. And a lot of other potential sinners are on their way to wreak more havoc because we haven’t stopped the PIED PIPER OF CORRUPTION, Gloria herself.

    We cannot hope and pray, with the current crop of government officials under the payroll of the CRIME FAMILY in Malacanang, that justice will prevail. We have to exact this justice ourselves, in whatever form and in whatever manner. We owe it to ourselves, to our families and to the future generation.

    Some will say…follow the rule of law, follow the system and allow the system and the rule of law to work. Yes, that’s a very convenient excuse invoked especially by criminals, who themselves hide behind the rule of law and the system. And who executes the rule of law and populates the system? Gloria’s gang!!!

    What are we, citizens, to do about it? Are we going to dance to the tune of their prostituted rule of law? NO WAY!!!

    We have two options, among others. Wipe them out this coming elections via a concerted effort to guard the ballot or….wipe them out NOW by issuing a CITIZEN’S ARREST WARRANT for these criminals. It’s up to you to interpret what I mean by a CITIZEN’S ARREST WARRANT.

    But of course, my second option is easier said than done. In this case, the citizens themselves must realize that Gloria, the leech that she is, will not easily go. As such, everyone must be prepared to confront every man’s two basic fears…that of dying and that of being jailed. Ok, are we up to the challenge? Die or populate our jails. I don’t think Gloria will have enough cemeteries or jails for 80 million Filipinos. I know that this is too much to ask for. But are we left with other options?
