CA denies FG’s plea to scrap class suit

The Court of Appeals has denied First Gentleman Jose Miguel Arroyo’s motion for reconsideration of an earlier ruling that mandated the Makati regional trial court to continue hearing the P12.5-million class suit journalists filed against him.

The class suit was filed by journalists who wrote reports critical of the First Gentleman and who were made respondents in libel suits filed by Mr. Arroyo. The libel cases, they alleged, were meant to intimidate and silence media criticism against him.

“To be sure, the present motion for reconsideration does not present any new issue, which has not been addressed in the Court’s decision,” read the six-page decision penned by Justice Fernanda Lampas-Peralta of the former Seventh Division.

“The Court need not discuss all over again the same issues it had previously resolved,” it added.

The appellate court on September 22, 2008 ruled that the Makati court could proceed hearing the class suit even without the payment of docket fees based on the damages being sought by the petitioners.

The First Gentleman earlier argued that there was grave abuse of discretion by the Makati court when it allowed the case to be admitted even without the payment of the necessary fees.

The appellate court said that the case of Socorro Abella Soriano, et al, versus Court of Appeals, showed that the Supreme Court established a more liberal interpretation of the rules and held that payment of insufficient filing fees would not indicate intent to defraud the government.

It, however, said that the question on whether the complaint for damages had merit remained with the Makati court. The appellate court said that its ruling only settled the issue of alleged grave abuse of discretion on the part of the regional trial court.

The appellate court said the First Gentleman could still present evidence before the lower court to prove his allegation of bad faith against the petitioner-journalists.

“The trial court may also order the re-assessment of the docket fees and if there is any deficiency, it shall order private respondents to pay the same within a reasonable period,” the court said.

The National Union of Journalists of the Philippines, the Center for Media Freedom and Responsibility and the Philippine Center for Investigative Journalism are among the petitioners that also include a good number of individual editors, reporters and opinion writers.

    myself tried to search and found my passport and was totally stunned to

  13. The case I referred to above, BE, is not Japan but the Philippines. Over here, we have family registries that are not available on the Internet. Doon sa Pilipinas, nakatiwangwang iyong listahan ng registries kaya iyong mga nangungurakot, libreng kumuha ng birth certificates, etc. na pinipeke nila. Shocking for one used to strict rules on protection of privacy!

    The National Union of Journalists of the Philippines welcomes the Court of Appeals’ affirmation of its earlier decision denying First Gentleman Jose Miguel Arroyo’s petition to stop the Makati Regional Trial Court from proceeding with hearings on the class suit filed by media against him.

    The ruling, along with the Makati RTC’s earlier decision granting the plaintiff’s plea for liberality in applying the rules of court and allowing the suit to proceed, proves that the judiciary may still be a refuge of those victimized by the powerful and the wealthy.

    Mr. Arroyo’s attempt to head off the class suit by insisting that the plaintiffs should have posted P9 million in docket fees betrays the mindset with which he maliciously and frivolously sued more than 40 of our colleagues with libel, a mindset that holds justice is attainable only for those with power and wealth.

    It was clear from the start that the class suit was filed not to seek personal satisfaction but to drive home the point that no one, not even anyone as privileged as Jose Miguel Arroyo, can attempt to silence the press with ill-conceived harassment suits and think to get away with it.

    And so we say thank you to magistrates who take their calling to heart and make the courts available for those who seek justice and protection from the abuses of the mighty.

Pero dito sa Pinas na isang katutak na mandarayang mga comelec opisyals at Armed Forces of Pidal ay mas mabuti ang manual dahil sa nasabi ko ng dahilan sa itaas.

    Tama ka grizzy. Maraming paraan ang pandadaya sa computer.

    Ang keyword sa pandadaya sa computerized voting ay kung sino ang may control ng computerized voting o CONTROLLER. Kahit pa ang supplier ng computer software ay si Erap pero ang controller ng computerized voting ay mga mandarayang bayaran ni bansot ay ganoon din ang resulta, panalo pa rin yong mga kandidato ni bansot.

    Melo added that the Comelec may combine manual counting with the Open Election System (OES), proposed by former Comelec chairman Christian Monsod and the Catholic Bishops’ Conference of the Philippines (CBCP), where the voting and counting will be manual while the canvassing and transmission will be computerized.

    Former elections chairman Monsod and other concerned sectors urged Comelec and lawmakers to use the OES in case of a disagreement over the method of elections.

    Monsod said the OES would only cost P4 billion compared to full automation at P11.3 billion.

    Useless yang OES, where the voting and counting will be manual while the canvassing and transmission will be computerized, dahil ang gagawin lang ng kampon ni pek president na kahit na lamang ang opposition sa manual counting eh pagdating sa canvassing at transmission ay napakadaling baguhin yan ng mga madadayang bayaran ni pek president. Panalo pa rin yong mga bata ni pek president.

    I met Koko only once when he came here with his parents and sister. Wala pa siyang asawa noon at kakukuha lang ng bar. I don’t know much about what he has been doing since although I understand he helps his parents in what they are doing gaya noong charity ng nanay niya. I can speak more for the good Senator because I have had the chance to watch his activities from the time I first met him and asked to be his interpreter in some meetings with some Japanese biggies.

    More than 20 years ko na siyang kakilala, and that is enough time for me to know if he is or not corrupt! He is definitely not! kahit na sabihin nilang amoy baboy na rin siya dahil nasa pig pen siya!

    There should be at least THREE CERTIFIED TECHNOLOGY expert instead of one. If there is only one tech expert, it can be manipulated easily. Furthermore, there must be one tech expert coming from the opposition.

    One tech expert for fake administration, one for opposition, and one is a neutral tech expert. If possible, outsource this neutral tech expert from EU.
