Tuloy ang kaso vs Mike Arroyo

Siguro naman sisipot na si Mike Arroyo sa hearing ng aming class suit sa Makati Regional Trial Court sa Marso 11,susunod na Miyerkoles, 2 p.m.

Kung ayaw naman niya, sabihin na lang niya sa korte ibigay na niya ang hiningi naming danyos na P12.5 milyon na ilalagay namin sa isang trust fund para tulong sa mga journalists na walang pambayad ng abogado kapag sila ay sinampahan ng kaso ng libel katulad ng ginawa sa amin ni Arroyo.

Noong Biyernes, binasura ni Court of Appeals Justice Fernanda Lampas-Peralta ang petisyon ni Arroyo na ibasura ang aming class suit dahil kulang raw ang binayad namin na filing fee.

Dati na itong desisyon ni Peralta kaya lang nag-appeal si Arroyo at ito, binasura na ulit. Sabi ni Peralta, wala namang bagong isyu na nai-presenta si Arroyo kaya ganun pa rin ang desisyon niya. Sabi niya sinabi mismo ang Supreme Court, sa kaso ni Socorro Abella Soriano, et al, versus Court of Appeals,maluwag sa bagay na kulang ang bayad sa filing fee. Hindi ito panloloko.

Sabi ni Peralta na maaring ayusin ang filing fee ng Makati RTC.

Ang aming class suit laban kay Arroyo ay nangyari dahil nagsampa siya ng mga 15 na kasong libel laban sa sobra 40 na journalists. Sa tulong ng abogadong si Harry Roque, nagsampa rin kami ng kaso laban sa kanya dahil para sa amin ang kanyang mga libel suit ay panggigipit sa media.

Sinabi namin na malaking perwisyo sa amin ang ginawa niya at iyun ay panunupil sa malayang pamamahayag. Noong una ng ang gusto naming hingi-in na danyos ay P86 milyon para sa bawat Pilipino na na-apektuhan kapag wala ng press freedom.

Ngunit wala kaming pera para sa filing fee. Mabuti tinulungan kami ng Southeast Asia Press Alliance na siyang nagbigay ng pera sa aming filing fee. Ang SEAPA kasi ay isang international na organisasyon para ma-prutektahan ang press freedom dahil naniniwala sila na ang malayang pamamahyag ay mahalaga para sa demokrasya.

Kung kulang ang ming binayad na filing fee, pwede naman namin bayaran ang kulang. Hahanap kami ng paraan.

Pinipilit kasi ng abogado ni Mike Arroyo na si Ruy Rondain na dapat P9 milyon raw ang aming dapat bayaran lahat-lahat. Sabi ng NUJP (National Union of Journalist in the Philippines), heto na naman si Arroyo na kumakapit sa technicality. Parang sinasabi ba niyang, kung wala kayong pera , magtiis kayong supilin.

Maala-ala natin na inurong ni Mike Arroyo ang kanyang mga libel suits sa amin nang nagkasakit siya sa puso. Pinapatawad na raw niya kami at gusto niya, i-urong na namin ang aming kaso sa kanya.

Sabi namin, hindi namin kailangan ang patawad niya dahil wala kaming kasalanan sa kanya. At wala kaming paki-alam kung natauhan siya sa kanyang ginawang panggigipit sa amin.

Sabi ng ng NUJP, klaro sa mga journnalists na itong kaso ay hindi para sa personal naming interest. Para ito sa taumbayan na makikinabang sa malayang pamamahayag.

    You can withdraw the lawsuit if Mike Pidal suffers a heart attack and hopefully dies. Filing fee is just a legal procedure. Mike Pidal raised this issue because he knew the journalists had no money. It’s easy for Pidal to pay filing fees considering the huge amount of money he has accumulated from his corruption. The case must go on while he’s still alive. If he dies, then the group could decide if he shall be forgiven.

If in the process he dies of a heart attack his estate should still pay the damage..if you forgive him (the sinner) he still has to pay..his heart condition has nothing to do with the case or the payment..justice is the thing.. yong hinniling ninyo na kabayaran ay baria lang sa bulsa ni Tabby..

    Napaka-ipokrito ko naman kung hindi ko aaminin na mas masaya ako kung maatake de corazon si Pidal at matuluyan habang ipinagtatanggol ang kanyang kaarogantehan sa harap ng korte. hehehe!

    Kung ang Senado ay takot sa pekeng puso ni Pidal, hindi ang mga mamamahayag. Tuloy ang kaso laban sa kababuyan ni Mike Arroyo.

    Sa Japan, meron kaming tinatawag na legal aid. Kaya pantay-pantay when it comes to court and justice. I bet meron din ganyan sa Tate dahil base din naman sa sistema ng America ang naging justice system dito after WWII, at mas sinusunod at mas magaling pa ang implementation and application ng batas.

    Nahahalata tuloy na kamote iyong abogado ni Fatso. Techinicality pa kuno, pwe, walang sinabi! Feudalism at fiefdom lang ang alam ng binusog sa nakaw ng mga Pidal! Yuck!

Iyon ngang mga bloggers ni Ellen sa abroad, kahit 5 dollars each lang ang abuloy, kayang bayaran ang sinasabi noong insultador na abogado ng magnanakaw na legal fees daw. Sabi nga ng mga kapampangan, “Subukan pamo para mabalu!”

    Tapos kung sino ang natalo sa kaso ay siya ang magbabayad ng lahat ng legal expenses in both side,kaya kapag alam nila na alanganin ay out of court settlement na.Sa ganyang klasing kaso na libel case kahit na 1% ang liabilities ng idinimanda ay panalo na,It doesn’t need to be a hundred percent at fault.

    If I am not mistaken, the P12.5 million class suit against Arroyo is for each of the 40 journalists. The Sunstar newspaper said – Allegedly, the amount of damages claimed by the journalists totaled P487.5 million, thus the amount of docket fees is estimated at more than P9-million.

    I noticed that multiplying P12.5M and 40 = P500M and not P487.6M. It could be that the P12.5M was rounded.

    This is how I look at it: If the opposition fails to unite which is most likely the case with so many ambitious politicians, Erap would be constrained to run even if he knows his eligibility is in question. There are many politicians who were able to assume offices while the election protests were pending. A case in point is Migz Zubiri and other governors, mayors. Erap would file his candidacy a few days before deadline. After filing, his detractors would file a complaint with the court questioning his eligibility. Then Erap through his smart lawyers would respond to the complaint. Before this case is resolved, Erap wins by a wide margin assuming there’s no rampant cheating. Then, Erap is elected and taken his oath becoming the President again. After a few months or a year, the decision comes out disqualifying him. So, his Vice President whoever this lucky guy is becomes the President. By then, Erap has proven to the people and the world that he’s still loved and accepted by the majority of the Filipinos; and that his ouster was illegal.

    My above analysis would be confirmed if one of the aspiring presidential candidates finally decides to be Erap’s running mate. Please take note that all the candidates: Legarda, Roxas, Lacson have declared that they would not settle for second. If one breaks his position, the scenario that I described above might prove to be true.

    By the way, the office of the DPWH under Sec. Ebdane was ransacked by unknown thieves. I smell something here. Could it be that the documents related to the ongoing investigation of WB road rigging scam were stolen? Who stand to benefit from this? Of course the ones involved in the scam. It could be an inside job. There were similar cases in the past when the offices were set on fire destroying important documents related to the pending cases.

    Pera ng bayan ang magagamit ninyo kung sakaling manalo kayo sa kaso ni Pidal. Dahil doon mangagaling ang perang pambayad ni Pidal. Perang ninakaw ng mag asawa. Kung mas maganda ay ang HUSGAGO na hahawak ng kaso ay matino ay baka dagdagan or taasan pa ang hinihiling ninyo danyos.

    Yung 9M na computation ng abugagong si Ruy Rondain ay para sa danyos na 86M. tama ba? if so, roughly 10% ang filing fee…

    For 12.5M, 1.25M lang filing fee na binayaran nyo… tama ba?

    sobrang butas nman tong batas na to… pera-pera labanan… lumalabas, pagwala kang pera… manahimik ka lang..

    If the robbers are interested in selling the things stolen from Usec. Rasuman’s office, what is the interest of the robber/s on Sec. Ebdane’s folder? Do the stolen folders have something to do w/ the WB scandal?

    Ang daños ay 12.5 million lang. Tama ang argument ni Rondain, kailangang magbayad ng mas malaking filing fee.

    Kaya lang, nag-amend ang mga abogado ng journalist, dahil siningit ang mga katagang “in the aggregate”. Touchė. Tapos ang technicality ni Rondain.

    I hope naglagay ng prayer for exemplary damages – yung tinatawag na punitive damages. Nai-kuwento ko na noon, na sa isang kaso ni Clarence Darrow, ang daños na binigay ng jury ay one dollar lang. Pero ang punitive damages ay kalahating million (in the 30s yan). Pabor daw, sabi ni Darrow, dahil ang daños ay income, at taxable, pero ang parusa (punitive damages) ay hindi.

    Ang exemplary damages, puwedeng kahit magkano, depende sa galit ng judge – kung gaano ka-garapal o gaano ka-grabe ang pambabastos sa batas.

    What is there to pardon? Gloria Arroyo, the ‘charger’, is a fake president and commander-in-chief, therefore all charges against him (and others in encarceration)are illegal and void from the beginning.

    Indeed, Al Capone was convicted on tax evasion; but that was in America. In the Philippines, criminals get away due to connections and corruption. In the first place, I dare BIR to look after the assets and liabilities of the Arroyos. Will they? A case in point is this Iggy Arroyo who could not even afford to pay his house rental. Now that he’s a Congressman, he owns a lot of assets. Where did his money come from? Tax evasion…never heard in the Philippines.

    Atty. Harry Roque planned to run for the lone congressional seat of Pasay in 2007 and he emailed me to invite me to join his team. But before I committed, I checked first with Mayor Trinidad and Councilor Bayona if there was room for Harry in the ticket. Both mayor and councilor are my kumpadres. Sadly, both Peewee and Onie said that the spot had been committed to Dr. Lito Roxas much much earlier. Harry knows it would be difficult to run without the Trinidad machinery backing him up. The opponents were supported and funded by the Fat Pig. Harry wisely decided to forego his congressional plans.

    Trinidad, Bayona, and Roxas all won hands down. But it was a good thing Harry pulled out because he is now serving the whole of the country, not just Pasay. I know Harry Roque’s reward will come in due time. So far, he has served the country far better than any congressman or I’d even dare say – all of them combined.   58. Ellen, I have been following Justice Peralta’s decisions on this case. The first time, she concurred with Rondain regarding the insufficiency of filing fees. But the next time, she upheld the RTC when it accepted the amendments changing the word “each” to “aggregate”, and the modification from P487.5M to P12.5M. Now, she reaffirms her earlier decision with this. The lady CA Justice seems fair, after all.

    Sana, pareho ang sense of fairness and justice niya with the husband who is a brand new member of the Supreme Court.

    This reminds me of what happened to the presidential ambition of Senator Pimentel or the dream of his supporters who wanted him to become president.

    The truth is I went to the Philippines in 2003 to join some people endorsing the candidacy of the Senator for President, and discuss the strategy on how to help him win. Akala ko all out sila sa candidacy niya, pero hindi siya tumakbo as he eventually opted to run for Senator again instead.

    The reason given by the group of OFWs supporting him was that he was more needed in the Senate—or so he could continue pushing for bills, etc. propositions on behalf of the OFWs in the Senate. Mas kailangan daw siya doon.

    Sa totoo lang, nadismaya ako when the Opposition chose FPJ as substitute for Erap. But between the Pandak and FPJ, natural mas OK iyong charitable na artista na di naman siguro bobo di gaya ni Gloria Dorobo na nagdudunung-dunungan lang!

    For that I stand corrected. Dapat palang tawaging hardened criminal si Bolante na tatakbo pa for public office. Wala talagang dangal! Too bad, the Philippines does not have a culture of the shamed and scandalized to commit suicide to redeem even just a little their tarnished reputation and pride. Pakapalan na lang mukha!     Buti na lang magaling din talaga si Harry Roque. God bless this guy! Walang lusot iyong kamoteng abogago ni Fat Guy! Golly, pinagtatrabaho ng mabuti ang mga distractors nila sa mga blog to discredit opinions, etc. expressed by fearless bloggers who criticize them.

    I was told that Mike Arroyo’s lawyer, Ruy Rondain, said htey will appeal the CA decision to the Supreme Court. That means, Mike Arroyo won’t appear in the March 11 hearing.

    Unless the Supreme Court issues a TRO, there is no stopping that hearing. A mere notice of appeal cannot stop the CA decision; it is presumed valid until reversed.

    Try again. Sarap ng buhay ni Rondain. Maraming motions. Marami ring billable hours.

    who would not support this pricipled lawyer whose keenness in fighting the corrupt regime is beyond the courage anyone possesses? in his capacity as no nonsense lawyer, he can just sit down and wait for sensational/high profile cases the likes of fortun, verano and others defend while expecting big bucks as professional fees from “highly respectable” clients whose dirty sources are being concealed by their association with those in power.

    a pro bono lawyer that he is, atty harry roque is undeniably a good public servant in the making should he chooses to run for a public office, as TT stressed, the payback is a WHAM!
