After last Monday’s Senate hearing on the Legacy group of companies debacle which saw millions of pesos of hard-earned savings by thousands of not-so-rich investors vanish into a few people’s pockets, House Speaker Prospero Nograles was asked by reporters if Parañaque Representative Eduardo Zialcita (1st district) would have to face the Ethics Committee.

Nograles replied, “Why ethics? Who is the complainant, who is complaining against him?”

For Nograles to ask “Why ethics” reveals the depth of moral degradation among government officials.

Zialcita’s cousin, Commissioner Jesus Martinez of the Securities and Exchange Commissin, is in the same state of cluelessness. He saw nothing wrong in his son (although he was the one following up the payments) acquiring a P5 million house paid for by a Legacy firm, the regulation of which is his responsibility.

He at first denied having sold an Expedition to Celso de los Angeles, chair of the Legacy group of companies, to maintain the lie that he does not have any business relationship with the man being accused of defrauding thousands of planholders and investors. Confronted with more information about the sports utility vehicle, martinez admitted it was sold by his son’s company, Spin, to de los Angeles. His next line was, there’s nothing wrong with it.

“If the Expedition was sold by my son to a rural bank.. I don’t know how it will affect me because fist of all I had nothing to do with the rural bank. Secondly, I do not know if a favor was asked of me because there was no favor asked of me.”

No favor asked of him? No wonder de los Angeles was able to continue duping parents to buy educational plans for their children even when his Legacy Plans was already on the brink of collapse and was unable to meet requirements of the SEC. They had a protector in the SEC.

It is no surprise also that Nograles is not enthusiastic about ethics. Because if Zialcita were to be investigated about his P100,000 a month consultancy with Legacy firms, Nograles should also face the same committee for lobbying with Ric Tan, then the president of Philippine Deposit Insurance Corporation, to go soft on de los Angeles and his beleaguered banks.

De los Angeles said he owes Nograles some P10 million as return of his investment in the amount of P18 million or P20 million.

In that meeting with Tan, Nograles even mentioned that de los Angeles had helped a lot Vice President Noli de Castro. Tan didn’t accommodate Nograles. We are not sure if that was the reason he was replaced by Mike Osmeña who died shortly. Nograles brother, Jose, is now PDIC president.

Another member of the clueless clan is Fe Barin, SEC chair. She said after the Senate hearing, the commission en banc passed a memorandum that compels Martinez to reply on the issue even after the expiration of his term as SEC commissioner.

“This is to give him a chance to clarify his name… (and) depending on his submission, the SEC will decide on conducting an investigation or not,” said Barin.

Oh Jesus, faced with those damning evidence, they still are not sure whether there is a need to investigate Martinez!

Nograles’ question, “Why ethics?” answers our lamentation why we have one corruption case after another and nobody gets punished.

Indeed, why ethics if you have a president who saw nothing wrong in calling a Comelec commissioner to ensure that she wins by one million votes whether or not she was voted by the people.

    Ungas! Ang Expedition ay galing sa pera ng mga investors sa Legacy na ipinantapal ni Angeles kay Martinez. Paanong hindi siya involve dyan sa bentahan nito sa rural bank?!

    Sa dami ng kabit-kabit na pangalan, kasama si Noli Kabayad ay talagang nakakalito…

    Kung ethics ang pag-uusapan, sori ka na lang Juan!Ang pekeng pangulo ay unethical mula una na iligal na traydurin ang halal na Erap, to Hello Garci, to etc, etc, etc…. hanggang paghahabol kay Obama! Hindi nakakapagtaka na wala sa dictionary ng mga hinayupaks na ito ang salitang ethics!

    Mga magnanakaw, mandaraya at sinungaling ba naman, tiyak na walang magandang aasahan ang publiko sa mga lider na garapal na ay tanga pa!

    The fact that sabit swingson is even in the picture should tell us everything! De los Angeles is definitely into illegal operations!

    REPUBLIC ACT NO. 1379

    Filing of petition. – Whenever any public officer or employee has acquired during his incumbency an amount of property which is manifestly out of proportion to his salary as such public officer or employee and to his other lawful income and the income from legitimately acquired property, said property shall be presumed prima facie to have been unlawfully acquired.     The resignation, dismissal or separation of the officer or employee from his office or employment in the Government or in the Government-owned or controlled corporation shall not be a bar to the filing of the petition: Provided, however, That the right to file such petition shall prescribe after four years from the date of the resignation, dismissal or separation or expiration of the term of the officer or employee concerned, except as to those who have ceased to hold office within ten years prior to the approval of this Act, in which case the proceedings shall prescribed after four years from the approval hereof.

    (1) Own, control, manage or accept employment as officer, employee, consultant, counsel, broker, agent, trustee or nominee in any private enterprise regulated, supervised or licensed by their office unless expressly allowed by law;

    (2) Engage in the private practice of their profession unless authorized by the Constitution or law, provided, that such practice will not conflict or tend to conflict with their official functions; or

    (3) Recommend any person to any position in a private enterprise which has a regular or pending official transaction with their office.

    These prohibitions shall continue to apply for a period of one (1) year after resignation, retirement, or separation from public office, except in the case of subparagraph (b) (2) above, but the professional concerned cannot practice his profession in connection with any matter before the office he used to be with, in which case the one-year prohibition shall likewise apply.

    Ellen, why are the people not suing and file charges against the corrupt. The crimes can be:
    1. illegal
    2. in conflict of interest
    3. solicitation
    4. fraud

    calculating income from work and matching it with personal assets may suffice the required elements of guilty. no need to have personal witnesses. it’s the personal asset that these people are enjoying illegally. we also have lifestyle check? is it implemented or only on paper?

Pimentel sa mga Senatongs at mga tonggressman kasi nagkaroon siya ng emotional attachment o simpatiya sa mga ito. Ito ang epekto ng tinatawag na ‘Stockholm Syndrome’. Mahirap atang mahawaan ng sakit ng pagkasakim nina Ganid gaya ng mga mukha sa taas. Partikular si Martinez na nagkaroon ng koneksiyon sa JIL at Cibac. Naging ganid at sinungaling na rin siya.

    These ethics will not apply in the arena of Philippine government if the same politicians are the one who are implementing this Republic Act.KIBIGAN INC.and KAMAG_ANAK INC., infested the public offices. Remember the televised firing squad shooting of a convicted Drug Lord? Lim Seng!, they should do the same now starting with the corrupt-crooked politicians. That’s the only way our country will improve. But it will never happen so the country will never get better. Sorry to say this but it is true. Greed and corruption is in most if not all of politician’s blood. Get rid of them, then less likely crooked businessman will sprout.

    Cocoy, this probably answers your question why we have to keep changing our leaders. All of them failed. They lack CHARACTER. Magaling lang lang bunganga but once in power, nawala na ang Ethics nila naging ITIK na lang sila!

    i have to agree with PARTLY but I am an optimistic person. I understand where you coming from but the rule of law can be implemented if few good lawyers will sue against these corrupt people. It only need 3 priests, 2 journalists and 5 people to press charges against these people. Use the media for publicity and trust me, manigas sila kasi mahihiya ang kanilang mga ANAK, INC, Republic Act. KAIBIGAN INC.and KAMAG_ANAK INC….

    The priests , the journalists and 5 other people must reside in the same locality where the corrupt officials live or the location where they conducted business. A good lawyer is also required. There are two purpose of the suit: for publicity para mahiya sila and to return the money to the people thru sales of assets. Even if we loss, the awareness and the action of the people will matter. The rest of the country will follow. what do you think?

Heh,heh,heh…Katulad ng Dacer case, ilalabas lang ni siRAULo yun para panira niya kay Erap(kung sakaling tatakbo man siya sa eleksyon) at kay Lacson. Obvious na obvious ang modus operandi ni siRAULo. Justice is only for the members of the Enchanted Kingdom!

Forgot the name of the place famous for balot and penoy, malapit sa Marikina na mabaho din because of the cow’s hide na panggawa ng sapatos!

    dito sa paranaque, halos puro pagmumukha niya nakasabit sa kalsada, sa mga poste..talagang papansin kahit nagsemento lang ng kalahating kilometrong kalsada ay isang higanteng billboard at tarpaulin na nakalatag umpisa pa lang ng project, at pag natapos isa na namang malaking billboard at tarpaulin.

    palit ilaw lang sa poste, libreng sakay, sports equipts sa brgy ay sangkaterbang poster at tarpaulin na agad ng sabi nga ng isang blogger ay mukhang mongoloid.

    uh yung gastos nila sa posters, billboard at tarpaulin ay dugas din nila sa pera ng bayan kaya biglang laki ang advertising at tarpaulin industry sa metro manila dahil sa ating magagaling at masisipag na pulitiko.

    sabi pa ng magaling naming kinatawan, na hindi siya tumanggap ng kahit ano pero iba naman ang kuwento…donation daw sa mga congressional projects nya?

    basta tandaan na lang natin ang pagmumukha at pangalan nila at kung may election man sa 2010 ay ipakita ng masang pilipino ang galit sa mga tiwali at ganid na pulitiko…tama na, sobrang garapal na at wala ng konsensiya ang mga taong ito basta busog at nakapuwesto sila kesehodang maghirap ang bansa at malugmok sa kahirapan ang pobreng juan dela cruz.

    Touche Ellen. Why indeed ethics, according to Nograles. Ethics is no longer part of the vocabulary of these criminals in government from GMA down to the LGU officials supporting her. What has been raised in place of ethics is money, and public money at that. Everything can be bought by GMA and cohorts using public funds. For them who gained and became filthy rich by fraud and theft ethics is just a commodity they can buy. Most media who are paid for by these criminals can easily sanitize their image and make them the most virtuous and ethical public servants there is. Look at all the advertisements by Sen. Villar who wants to be President of the Republic. The tragedy is, most of the Filipino people are likewise being infected by the kind of ethics our public servants display.

    I know a lot of you think nothing will happen and that it is all hopeless, but if you are apathetic about this, unable to stand up for your rights or help others do so, then you will be victims again and again of schemes such as these. Do not let them off the hook so easily.

    A complaint is just the first step of letting the SEC know that you are one of the folks who have paid in funds and who are expecting to get as much of it back as possible.

    If NO ONE file a complaint,then Nograles maybe right,Who is complaining? The court could not prosecute these crooks without complainant.

Start with the Nani Perez, the Pidal case,Hello Garci,ZTE/NBN, Euro general,The fertilizer scam, Swine scam, WB, Legacy and the list goes on and on but until now, everything is hanging and no one has ever been convicted.

    The only case I know which is not even a case is the supposed “mutiny” case that the Tanay Boys are in JAIL for now for more than three years. Did these soldiers steal, kill or lie? HELL NO! In my friend case still pending with the Manila city Office of the building official, Laws concerning the National building code is SELF interpreted to their OWN meaning as they want it to be up to a point the the self interpretation is way out of logic. You can ask Engineer Edgar Soriano of the building enforecement division or Engr Armando Andres , city Engineer or Engineer Flordeliza Alampay or Engineer Saturnino Disu.
    You dont know how they got their Civil Engineering Diplomas and are able to pass the civil exams

    that’s exactly the job description of our lawyers in this country. we all know that people are ignorant about the law but it doesn’t mean that such ignorance should or would be taken advantage of… this to me is the issue of moral conduct and ethics ignored by public servants.

    On Job description, Lawyers are professional service providers in the legal business. Don’t we have no more good lawyers left that will interpret the law , in behalf and to protect the people’s right? Are all of our lawyers interpret the law according to who is who and who has the money? wala na ba talagang matino diyan sa atin? If so, what’s the point of our blogs if no one is listening? para pala tayong mga “buang” LOL 🙂

    Now for those who take advantage of the law and interpret the law the way they want it to at the expense of the people, should go to jail and personal assets must be confiscated according to my interpretation of the law.

That’s the most decent thing to do. wala rin bang ganyan sa atin? pakapalan na pala sa mukha? my god, have they lost their pride? if so, these are the type of people that we don’t need to be managing and servicing our people in any jurisdiction or district.
