Marcelino dares officials under probe to go on leave

Marines Maj. Ferdinand Marcelino, head of the Special Enforcement Service of the Philippine Drug Enforcement Agency, yesterday challenged all government officials under investigation to go on leave as a matter of “delicadeza.”

“Kung sa Hapon ito, may mag-harakiri na,” he said.

Marcelino, who exposed the alleged bribery in the Alabang Boys case, said he himself is taking a leave of absence from PDEA after President Arroyo ordered him investigated for “taking into himself the job of prosecutor” by releasing Patrick El Khoury, driver of the vehicle where a drug deal was reportedly consummated.

Arroyo issued the order last week based on the recommendations of a fact-finding board she created to look into the bribery allegations and determine the legality of the conduct of the PDEA operations in September last year that netted the three so-called Alabang Boys.

Marcelino, in a speech at the PDEA’s flag-raising ceremony, said: “As a matter of principle and delicadeza, I am taking a leave of absence from PDEA as I deem it important for the investigation not to be tainted with suspicion of manipulation. I also believe that this is the right immediate action that any public servant, whether civilian or military, should conduct himself or herself in such a given situation.”

Marcelino said while on leave from PDEA, “I want to set my feet back on the grounds of Sulu where my ‘band of brothers’ courageously fights the Abu Sayyaf to rescue the International Red Cross volunteers – a battle I really miss together with the Marines!”

Among officials embroiled in anomalies but have refused to resign or go on leave are Ombudsman Merceditas Gutierrez, chair Fe Barin of the Securities and Exchange Commission, and Parañaque Rep. Eduardo Zialcita.

Arroyo, also based on the recommendations of the independent panel, ordered the filing of administrative cases against chief state prosecutor Jovencito Zuño and state prosecutors John Resado and Philip Kimpo, who are on forced leave.

Press Secretary Cerge Remonde on Sunday said it is up to the prosecutors’ “sense of delicadeza” to go on leave or resign while facing administrative investigation.

The three handled the case of “Alabang Boys” Richard Brodett, Jorge Tecson and Jorge Joseph who were arrested by the PDEA in buy-bust operations in Muntinlupa and Quezon City in September last year.

The drug charges against them were dismissed by the justice department last December.

Arroyo reversed the dismissal, and ordered the filing of criminal charges against the three drug suspects.

Justice Secretary Raul Gonzalez said Zuño, Kimpo and Resado came to him yesterday for guidance on what to do in light of the President’s directive. He said he told them to file an appeal as he could not do anything but comply with the President’s order.

Gonzalez said the prosecutors are in a quandary as to their status now because the President has not lifted her earlier order for them to go on leave.

He said even the memorandum issued by Executive Secretary Eduardo Ermita on Arroyo’s latest orders failed to state if the three should be suspended pending the investigation of the Presidential Anti-Graft Commission.

“Basically, what they are saying is that they have been on leave for three months, which is already beyond the normal preventive suspension period. And of course some of them were complaining that… since they went on leave they have not been receiving salary. So in effect the consequence of that forced leave was practically a suspension because they are not receiving salary. No salary, no rata, no nothing,” said Gonzalez.

He refused to comment whether there was a violation of civil service rules.

“Let’s just say that that is the fact. And it was the President who asked them to go on leave. It’s only the President who can restore them. Bottom line is everything belongs to the President’s prerogative over subordinate officials,” he said.

Zuño said their resolution dismissing the drug charges was “affirmed and adopted” by Gonzalez.

Gonzalez said he has not been furnished a copy of Arroyo’s order, but it would seem the President adopted the findings of the independent panel over his review of the resolution.

“The President always has prerogative to revise or reverse any order of the prosecutors. I’ve always said the last remedy is with the Office of the President, but it has not always been exhausted by parties. In my review of the resolution, I did not just uphold (Resado’s) findings. I modified it and concentrated on bribery. There was no bribery,” he said. – Evangeline de Vera and Ellen Tordesillas

  3. Are those leaves, voluntary or involuntary, deducted from prescribed annual paid leave, and unpaid after exhaustion of prescribed amount? If not, those absences are paid at taxpayers expense.
    The good Major should give it a rest while he is ahead.

    Insulto sa mga manok ang kaugukan nitong taong ito eh!
    Yung manok, pag-inupuan ang itlog, 28 or 29 days lang may mga sisiw na.
    Itong si Gutierez, inupuan ang mga malalaking kaso, mahigit 1,000 araw na ang lumipas, kaso pa rin. Walang resolution, order o ano pa man. Yung ibang kaso nabugok na, nakaupo pa rin siya.

  16. Yes, Marcelino is right. Should anything of this sort happens, there’ll be a lot of suicides by now, no more cutting of the belly, though. Now, they hang themselves by the curtain rail of some bathroom in some hotel or jump from the roof of high buildings.

    At the rate of the slow grind of justice, to let those culprits go on leave, they will be paid forever of their corrupt lives. Better put them on floating status where they cant do more harm. Perhaps they can police their office grounds and pick up scattered trash to earn their keeps.

    Have you noticed, eversince Gloria was virtually branded schizophrenic by the good Archibishop Cruz (si Cruz nga ba ang nagbisto sa unano?), the matakaw na unano na yan has stopped making yabang about her conversations with God?

    Sabi ni Arch Cruz immediately after Gloria kept on making yabang about her kasinungalingan that God was telling her to do this and to do that and to lie and to cheat and to steal and to do all sorts of crimes, petty and major:

When this blog was restored after it was hacked last weekend (Yuga said someone was able to know my password and made a mess of this blog), nawal na yung “making life worth living.” I was so busy the past three days, I’ll ask Yuga to restore it.
