At the court martial hearing of the 28 officers accused of mutiny for a February 2006 non-event last Feb. 26, it was agreed that the next hearing would be on March 10, 2009.
A day before March 10, the lawyers of the accused were notified that the hearing would be on March 20. No explanation was given why the agreed hearing on March 10 would not push through.
March 20 came and all the lawyers and the accused (except for two officers) were present at the Daza Park hall in Camp Aguinaldo. But there were only three members of the panel who would be hearing the case: Maj. Gen. Jogy Fojas, Commodore Ramon Punzalan and law member Col. Marian Aleido, when there should at least be four of them to constitute a quorum. One member was out of the country. Even the trial judge advocate could not explain the absence of the other members of the panel.
Atty. Vic Verdadero, counsel of Brig.Gen. Danny Lim and several other officers of the Scout Rangers, proposed to the court that they waive the quorum requirement so they can hold a hearing so as not to waste the time and effort of three witnesses who were present.
But the court played safe and decided that without a quorum, the hearing had to be adjourned. It was agreed that the next hearings would on March 24 and 26.
A day before March 24, the lawyers were notified that the hearing was cancelled. No explanation was given. Everybody looked forward to the Thursday hearing.
After that, nothing was heard from the Trial Judge Advocate that serves as the court’s secretariat. One lawyer, however, called the TJA Wednesday afternoon and was told that there would be no hearing the next day. No reason was given.
As of today, no hearing has been scheduled.
The right to speedy trial is a supreme human right that the Constitution mentioned twice in the Bill of Rights.Section 14, paragraph two, states that “In all criminal prosecutions, the accused shall be presumed innocent until the contrary is proved and shall enjoy the right…to have a speedy, impartial trial…
Section 16 underscores that right again: “All persons shall have the right to a speedy disposition of their cases before all judicial, quasi-judicial, or administrative bodies.”
The dictionary defines speedy as “ accomplished rapidly and without delay”. The accused have been in detention for three years. They submitted themselves to military justice and they are ready to accept whatever is the decision. But undue delay is something difficult for them to take.
Col. Aleido reasoned out that the defense lawyers were also to blame that the trial of this case had gone this long with their motions during the early stage of the proceedings. The defense lawyers quickly took exception saying that it was the delay in giving the accused the copies of the Pre-Trial Investigation Report and the Pre-Trial Advice that delayed the proceedings.
It took the Trial Judge Advocate five months to give the defense the PTIR and another three months to give the unsigned copy of the PTA which were the basis of the charges against the officers. “Surely, we cannot proceed without our knowing what’s the basis of the charges against our clients,” Verdadero said.
Atty. Rogelio Bagabuyo, counsel for Maj. Gen. Renato Miranda, never tires of reminding the court that every day of delay in trial is a grave injustice to the accused officers.

“Speed” applies only to Speedy Gonzalez who speeds up cases against opposition and the Evil Bitch’s enemies.
One common practice of the prosecutors and even respondents is to delay/postpone the hearing. All the tricks in the book like medical reason are being used to delay a case. In the case of the accused officers, the trial is obviously being delayed because the government has no strong case against them. Their only purpose is to keep these soldiers in jail or detain them as long as possible so as not to threaten the Arroyo government.

Political instability brought about by the restiveness in the military, the corruption in the highest echelons of power, the immorality of the bulk of our politicians, the rampant poverty, crimes, kidnappings, avoidable tragedies, etc, etc. all contribute to a deadly image for the country: an underdeveloped nation in every sense.
The state our military speaks a lot about the kind of State we have, perhaps not a failed state in the real sense but decidedly the same as that of a banana republic in South America and definitely just a teeny weeny notch higher than the chaotic nations in Africa, eg., Zimbabwe, Ivory Coast, etc.
In that sense, the Philippines is a cousin of Zimbabwe in that both are led by extremely legalistic “leaders” who cling to power at whatever cost. The only difference is that Zimbabwe’s Mugabe says “Shit!” to the faces of western powers while Gloria kneels in front of China! Her head serves China’s glass coaster.

Erap ang Lacson should visit BGen Lim. They should at least test the water, to find out the reaction of the people with Lim as President and Lacson as VP.
Lim will never be president of the Philippines. A great part of evil “Civil Society” won’t let it happen.
Don’t get me wrong. I like Lim, I think he’s got what it takes to lead this banana republic and take it out of the rut it’s in but FVR was a quirk of fate, firstly he had 2 women behind him, Cory Aquino and Baby Arenas (to help finance his campaign), 2nd, unless Lim accepts to steal votes like FVR did, he’ll find it difficult to make it to the presidency; 3rd, the military is so divided, those who are against him will move heaven and earth not to let it happen and you know as well as I do that you need the military to steal votes.
If he has a commanding lead in the Air Force, then he can use some of the PAF flying materiel to get him around, the gazoline to make that happen and he’ll need the Navy to be on side to ferry campaign paraphernalia and of course, he will need the SOCOM chief and officers on side to make sure that Mindanao votes won’t be stolen!
He could be a Senator but president? He’s got to do something drastic, very drastic to be the apple of the great voting masa!

President Estrada ran for president with “Civil Society” (together with Catholic Church, comelec, and military) against him but he still won. So, if Erap and Lacson will support BGen Lim, I think he will win it.
There are a lot more anti-bansot military than a pro-bansot military. I think, the pro-Lim anti-bansot military can neutralize the pro-bansot military cheating apparatus.
Estrada held the key South votes so tight because he had a man in there long before he launched his campaign, Gen J Nazareno, a Mindanao veteran.
Lim will have to count on such support… In the current climate, I doubt he has this. Erap has the support of the masa too, he was already a politician, Lim is “still” an unknown quantity.
He’s got to do something drastic and bold to even begin contemplating running for the presidency!
I doubt too that Lacson will agree to this sort of tandem.

Couple that with what’s happening in the military, sure to keep foreign investors at bay.
EU investors don’t like an unpredictable climate because they wannna be sure they’ll get their ROI. Political instability because of corruption, military restiveness, crimes, etc. certainly don’t inspire investors to do business in Pinas unless it’s monkey business.
I read it somewhere that Lacson agreed to run as VP for Mar Roxas? So, why not with Lim? Mar Roxas does not have an iota of support from anti-bansot military to neutralize those pro-bansot military that will cheat on us.
If for the sake of argument Lim does decide to make a bid for the presidency and is forced to take advantage of the largesse of the AFP:

Lim is an ideologue, nothing bad in that at all. And for him to remain true to his ideologies, he’s got to do it “his” way.
In other words, if you want Lim to be at the top, for him to be able to perform according to the dictates of his ability, the best way is for him to be at the top as a military honcho! (which could mean that you would be compelled to say goodbye to some of your freedoms.)
But for him to dip his fingers in politics? I fear he will end up the Filipino politico way…

Three reasons off the bat:
1) both Lacson and Roxas are civilians now and are true and tried politicians — they will know how to compromise (which we don’t know if Lim will or is capable of coming to a “compromise”, I doubt an uncompromising stand is acceptable to Lacson.
2) also Lim is/was a military junior to Lacson; the AFP culture is not like most western armed forces culture. A senior officer in the military finds it difficult to yield to one who was once his military junior (this might change though, hopefully it will) Anyway, I bet Lacson will say, “Why should I run as VP to this guy?”
(Amazing that in Pinas, a lower-class who made it to major service command would still call his underling who happened to be his deputy “Sir” — only time that didn’t happen was with the Abadia brothers, Gen Lisandro Abadia being called “Sir” by his older brother, LtGen Loven Abadia then CGPAF, who happened to be his upperclass man but that was because Lisandro was CSAFP.)
3) most importantly, Lim needs a bit more experience in the political field if he wants to run in a democratic election, warts and all (below the belt hits, cheating, stealing, etc.), or as I said, he’s still an unknown quantity
(I bet Trillanes still calls Lacson “Sir” even if they are already colleagues in the Senate and thus should be on equal footing! In other countries, that military “Sir” thing would disappear totally!)

Won’t happen! Due to pervading AFP culture… These incarcerated men are an exception. And how many are they? Not even a fraction of 1% of the entire AFP population.
True, it might be hard for Lim to adjust from military to civilian role but we have to remember that there were other countries which were lead by military men like Chang Kai Shek, George Washington of US, etc….
If those military men can do it, then Lim can do it too.
Can you recall the total number of military casualties during the numerous so called “bloody” coup d’états Pinas had during the Aquino government?

The men you quoted had been in constant rebellion with no let up! There was nary a moment when they weren’t doing an armed rebellion. And most importantly, they were right at the beginning of the formation of an independent state! No comparisson there.
I could cite you other military guys who had successful political careers but after they left the military: Duke of Wellington (considered one of the best prime ministers Britain ever had), Dwight Eisenhower, Charles de Gaulle, etc.
But these guys were wartime top military honchos with extensive experience running governments at wartime.
That’s an element missing in Lim’s experience and voters will want more!
Estrada and Lacson yielding to Gen. Lim? Fat chance!!! For all we know, they are already fixing their minds to make another run for the presidency.

Let’s face it! Lim committed an error of judgement when he reported to Senga who was then his CSAFP, instead of taking over command right then and there. He was counting on the Marines led by Querubin to be able to hack it, unfortunately Miranda also made an error of judgement by asking his followers to stand down. Lim missed his chance then. That chance is gone! The coup d’état that never was.
So what happened? Bansot had the upper hand.
With or without experience, I think Gen. Lim would become a better president than all the past/ previous RP presidents combined. Though his surname alone shows that he is a Chinoy, I know that his heart is more Filipino than those who claims to be one.
But I have to agree with AdeBrux that it would be next to impossible that Gen. Lim will win in the 2010 presidential elections.
A military officer committing an error of judgement at a hugely critical moment? Very bad news.
Seriously, in a proper military, that kind of error is unpardonable.
That said, like Mike I think Lim has what it takes to be a better leader than the rotten ones we have right now — doesn’t diminish my respect for the man.
Pinas has to make a choice:
They want a democracy with a democratic election, warts and all?
Or do they want a government with military ideologues at the head?
One or the other is risky. So which will it be? That is the real question.
I personally would not want the latter but that’s me.
As far as I know, Lacson is more Presidentiable than Lim and Estrada. I wish Lim and Estrada should rally for Lacson to defeat the Pidals. I learned from the horses mouth that Gloria will run again. She will never relinquish the throne.

It’s not only EU that have no confidence to invest in RP. the rest of the world do not have confidence with RPs’ politicians. We, the business people have to check with our Embassies to see the business climate and RP is the number 1 no no. If I have to put up a manufacturing outfit there, I have to be in their commerce zone and be at their mercy what to do. Supposing I’m out of their zone and I have to pay a lot for transportation to go to their zone so whats the point of having a business. Did you notice that RP lost most of the clothing business? The AFP is never more fragmented than it is today. So fragmented either way, i.e., pro Gloria and anti-Gloria, I guess this is the reason why Faeldon is still at large; neither of the two camps want to shake the status quo.
If I dared, I would compare the current state of the military to the fragmented revolutionary armies of the late 19th century that saw the Aguinaldo and the Bonifacio factions pitting for supremacy.

For all his “failures”, one must admit that Trillanes at least dared a very very daring and bold move that captured public attention (Proof is he was elected honestly to the august Senate.) One must consider that he was a mere lieutenant (PNSnrgrade) and didn’t have the “solid” experience of battle tested and coup d’état tested Lim.
At the end of the day, one could say (and rightly so), technically or from a military viewpoint, he did a lousy job.

But you know Mike, that said (for the sake of argument that Trillanes and Lim did a lousy job), I would like to be charitable to them and say, Pinoys don’t deserve these well intentioned officers even with their hardline ideals.
At the end of the day, these military guys meant well. They might have formulated lousy plans and executed their badly laid plans but at least they tried and acted their convictions while the general masa (evil society included) kept on harping, whining, whimpering, professing high moral grounds and lofty ideals but were scared to even lift a finger to do something against bansot and his cabals.

That’s why I kept on harping on my previous post that Erap must support BGen Lim. I never espouse any sort of ideas for Lim to run without the support of Erap.
Without the support of Erap, the candidacy of BGen Lim as president is doomed to failure.
If Lacson can support him, it will be a plus to Lim.

Agree, the plan that they executed was lousy. They did not cover all the possibilities like with that traitor Senga.
Great soldiers make mistakes too like General Douglas McArthur. His plan on paper was great too but he miscalcuted the Koreans that caused him to lose thousands of his soldiers. That was a big one.

Yep! Anyway, at the end of the day, he was relieved of his command. He wanted to make up for that blunder by committing a bigger blunder by planning to engage, drag Red China directly into an open war — a huge blunder that he paid dearly.
It’s very very very seldom that military officers at that level can make monumental errors of judgement and get away with it.
A few weeks ago, a British nuke submarine half collided with a French nuke submarine. Both sub commanders were highly experienced cdrs and were great assets to their nation’s navy. Their past impeccable military records mattered zero because of the blunder. They were summarily relieved and their careers were over — finito! No appeal.
And you know what their worst mistake was? Not necessarily the collision, that was incidental, their biggest mistake was that they were detected. Their having been detected was the worst thing that could happen to submarines and their careers were killed. Unpardonable error of judgement — verdict: unfit for higher command.

His being “matino” or not is not the cause of it. Since day one of Erap’s presidency, EDSA 2 is already being hatched. His only fault I guess is that he trusted his people surrounding him too much, including his vice president then. These very same people cost him his downfall. He only knew of it when it’s already too late. And that to me, is a big blunder.

It’s not what Gen. Danny Lim did to the Cory Administration, it’s what Cory Administration did to us:

The objective of this trial is not to bring justice to the group of Gen Miranda and Gen Lim. Rather, Gloria’s minions are just going through the motions just to keep them in jail.
The very fact that Gloria wants to keep them in jail is indication enough that the group Gens Miranda and Lim still commands a sizable number of supporters from the AFP. Otherwise, Gloria could have just released them to irrelevance. But that is not the case….

“Unspeedy trial” is a satire, a cute but feeble term for the charade of the so-called court martial for mutiny. Despite the vaunted courage and daring of Pinoy journalists, anxiously waiting for an Emile Zola to burst out of the journalist crowd is a futile hope. Like Sulbatz, I too believe that prolonging the trial is intended to keep anti-Gloria forces contained.
Ate Glue is out-foxing the opposition to her real goal: protecting her and hubby’s ass and her brood from the retribution she knows is inevitable. Knowing no protector is in sight after she leaves office and relinquishes power, she can prolong the agony, not just of mutineers in jail but also her imperious governance. Cha-Cha is the trick. And to add injury to insult, she intends to do the trick by massive spending and bribery (you guessed it) using your taxes and mine as well as the taxes of future generations (stimulus package plan). She even placed a veil of secrecy on such expenditures by vetoing the section of the 2009 GAA (about transparency) when she signed the bill.
But there’s no more time for Con-Ass to railroad chacha you say? No problemo. Postponing the elections is the simple solution.
However, a glimmer of hope is peeping in the political horizon. The proposal to redistrict Camarines Sur is an indicator – ostensibly to accommodate son Dato but also Andaya (Budget) – the latter planning to run for re-election, which means Andaya believes there will be an election in 2010.

They should dismiss the case of the AFP is no longer interested to prosecute them. But then, will GMA allow it? It would be a slap on the face of GMA and her favorite general, former AFP Chief Esperon, if the mutiny charge is dismissed.
It’s a grave injustice.
Don’t lose hope, Patriots. Time is on your side, which cannot be said of GMA. What is important is you outlive Gloria Arroyo.
