John Martir, a no-show

Update:

Looks like Maj. Gen. John Martir’s luck has been stalled. A reliable source said the Board of Generals recommended Maj. Gen. Juancho Sabban as Marine commandant.

Martir, the source said, was given the choice of a Sulu assignment. He chose to be where he is now.

Maj. Gen. John Martir was a no-show yesterday at the court martial hearing of the 28 officers accused of allegedly committing mutiny on February 2006.

Yesterday’s hearing was supposed to be the start of the cross examination of Martir by the defense lawyers.

The prosecution panel told the Court that Martir notified them that “he was on a mission” but didn’t say what that mission was.

In the past two hearings, Martir testified that the 8 Marines accused, Maj. Gen. Renato Miranda. Col. Ariel Querubin, Col. Orlando de Leon, Lt. Col. Custodio Parcon, Lt. Col. Armando Bañez, Lt. Col. Achilles Segumalian, Maj. Domingo Fernandez, and Lt. Belinda Ferrer attempted to commit mutiny by planning to join a rally organized by civil society groups on or about February 23, 2009 and withdraw support from Gloria Arroyo.

Part of Martir’s testimony was about the standoff at the Marines headquarters on Feb. 26, 2006 over the replacement of Miranda by then Maj. Gen (now Lt. Gen) Nelson Allaga.

Martir ended his direct testimony last May 14 and his cross examination was supposed to have started May 19.

The accused officers and their lawyers were notified May 18 that the May 19 hearing would be postponed to May 26. At the hearing yesterday, lawyer Vicente Verdadero, counsel for Brig. Gen. Danilo Lim, asked for the reason for the cancellation of the May 19 hearing.

Col Feliciano Loy, head of the prosecution team, said transcripts of the past two hearings were not finished. He also said that Martir asked for copies of the transcript of his testimony.

Verdadero pointed out that the court martial takes precedence over any mission except combat mission. He doubts if Martir is on combat mission because he is assigned at J-6, the AFP’s communication, electronics and information services.

Lawyer Rolando Cipriano, counsel for Miranda, underscored that the country is not in a state of rebellion, emergency or at war. As such, there is no mission that Martir can use to justify his absence in court.

“To be absent today, is a disrespect for the court,” Cipriano said.

Atty. Gilbert Gallos, counsel for Col. Orlando de Leon, said the non-completion of transcript of the hearings is not a “credible” excuse for Martir’s non-appearance in court.

Verdadero said, “If a witness is telling the truth, he doesn’t need transcripts of his earlier testimonies.”

Defense lawyers moved that Martir’s direct testimony be stricken from court records but the the Court denied it.

The panel headed by Maj. Gen. Jogy Fojas said Martir will be required to be present on the June 5 hearing. If he does not appear, the “court will not hesitate” to act on the motion to strike out his direct testimony.

    kawalan ng respeto sa justice system? pero sila ang laging nagbibida na dalhin sa proper forum kuno…talagang sala sa init, sala sa lamig at paano ka naman lalaban pag ganito ang uri ng mga kalaban mo.

    The rat will not testify coz he will be “grilled” on his AWOL. How can an officer be respected when he abandoned his service for a year and a half? How can he justify the discrepancies in the dates of his affidavits? Someone like this rat will rattle when cross examined. The bottom line is, He is not credible!

    Purpose:
    #1 So that Col Querubin could not campaign openly and in the process tell the world about all the ills and corruption of this administration

    Would Mr or Ms Signos please tell us how it is that he/she got to be in a Court Martial hearing? Unless in an official military/court hearing role or as member of panel, witness, accused or performing some adminstrative task or member of media authorised by court, I don’t see how someone could be physically admitted in a hearing as restrictive as a military court hearing, i.e., Court Martial!

    It would also be greatly appreciated if Mr or Ms Signos would be kind enough to publish his/her own report of the proceedings (transcript if possible), so we at Ellenville would at least know what he/she is referring to?

    Let it be on record that I personally DO NOT doubt the accuracy of Ellen’s report.

  39. Anna, as long as Gloria Arroyo is in power, the accused officers will not be released.

    It is becoming obvious that the court wants to delay the conclusion of the trial so that they won’t have to decide because Malacañang might not like their verdict.

    I think they are trying to gauge the political situation. If there’s a chance that Gloria Arroyo will remain in power beyond 2010,these officers will rot in jail… Unless they genuflect in front of Arroyo and say “Sorry”.

    Afraid of Gloria? I am astounded, nay, shocked by the very very ignominous state of the military today and by the extreme cowardice of their leaders. How on earth can they even sport a military uniform and not fall in shame is beyond me.

    Anywhere else, they would be shot if not hanged, drawn and quartered!

    I will not have the testimony expunged from the record. Mabuti yung on record. the inconsistencies prove that the case was trumped up. This will be useful later, when a civil case for damages is filed. The year 2010 is just around the corner.

    I would sue the military establishment, and Martir in his personal capacity, so he doesn’t get his pension, or any other promotions.

    Martir can also be prosecuted under Article 180 of the Revised Penal Code for false testimony against a defendant.

    Pabayaan niyong mag-story-telling ang mga witnesses. Give a man a rope long enough and he hangs himself.

    At social family-friendly gatherings with all these military folks, questions about the Philippine situation are often raised and when the topic veers towards the Philippine military or what’s going on in the coutnry, I can tell you here and now that I cringe in horror when I must answer questions.

    I am not ashamed of the Philippines, never felt ashamed for the country or its people but I am extremely embarassed and loathe to speak to these British military professionals about the country’s armed forces. Truly, I am just ashamed of its military leaders and the lowly caliber of its senior officers.

    Speaking about the AFP, which incidentally I know quite well, is one rare, very rare topic I would rather skip as I am not prepared to defend the issue when I’m in the company of Western professional military folks.

    Mission??? Martir deliberately avoided cross-examination by the defense lawyers; his manufactured testimony is a product of pure imagination. Sigurado mabuking ang kanyang kasungalingan. Pareho sila sa kanyang among Gloria at Assperon. Paki-check sa St. Luke’s Hospital baka nagpa-tuli.

    Martir is just afraid that his AWOL and wrongly dated affidavits will haunt him more than anything. He will be demolished by the brilliant lawyers of the accused.

  49. If we have a standard on which we base our perception of the situation, we will know the underlying problem and not the symptom. Many of those in our military attack our own countrymen fighting for truth and human dignity. Many of those in our military have been defending GMA who suppress proofs of the truth. Many of those in our military have been killing journalists and students who were just defending the truth and human rights of our countrymen being violated by the GMA government. Many of those in our military have kidnapped witnesses to the involvement of GMA with looting of our money as in the case of ZTE broadband deal.

    These actions are being claimed as just being profesionals and constitutionalists. Assuming just for the sake of argument that these claims are legitimate, how can defending GMA be legitimate with the following actions:

    1) Giving of our Sabah to the Malaysians;
    2) Giving of our Kalayaan Islands to the Chinese;
    3) Allowing the Chinese to continue control our rice industry, food industry, building industry, real estate and all our basic resources;
    3) Allowing the Americans to be tactically familiarized with our terrain and seas;
    4) Allowing the Americans to conduct operations to make our people grateful to their civic and medical missions, military support and computer donations to our people inspite of their unsettled invasion of 1899, continued rape of our Filipinas with impunity and continued occupation of our military base in Zamboanga;
    5) Allowing the Americans to control our military in terms of doctrine, orientation and policies.

    The aforementioned actions are foreign invasion, and occupation. It is being collaboratd by GMA which are acts of treason.

    If we base our standards on our original nation of 1898 with it’s identity, culture, defense orientation, constitution and the whole of our organic system as well as our general national well being, we will notice that there is a problem underlying the painful symptom we have been experiencing with our nation in general and with our military in particular. If we validate our standards with that of highly competitive and respected nations of France, Finland, Israel, Japan and Vietnam, we will indeed realize that our nation in general and the way many of those in our military in particular respond to our situation is pathological.

    Then we might be led to diagnose our painful experiences thru our history. Then we might be led to realize that we are experiencing an Alienated Identity and Defense Syndrome manifested by lack of love of nation, contempt for countrymen and collaboration with the foreign invaders. Then we might realize that we have already a nation in 1898 with our own identity, constitution and an organic system. Then we may be led to realize that in 1899, the Americans invaded us causing the death of up to 900,000 of us Filipinos. Then we may find out that this paved the way for the americans to transmit into our system the Heredity Injuring Virus which replaced our original but injured organic system and constitution. We might realize that this has been replicated from one generation to the next.

    If we base our standards on the two mutually validating standards just mentioned, our nation in general and our military in particular would not only NOT defend the invading and occupational foreigners, we would immediately act to drive them back to their country. We would not only NOT defend GMA, we would immediately ARREST GMA.

    This is our situtation.

    With what she has been doing with her time and with the resources of our Philippine Marines, what could our marines be if she ever gets the commandant position? The marines would be smelling with perfume and their skin be pinkish white and silkier?

    With what her contenders have led our Philippine Marines to accomplish in terms of welfare of the men, tough and effective combat capability, terrorist capability reduction leading to neutralization and providing a safer quality of life to the people within it’s area of responsibility, what could the marines among us be if anyone of them gets the commandant position? Sweat even more?

    By not arresting GMA for acts of treason, Joan has committed acts of negligence. By defending GMA, she has committed acts of treason. With her at the head of our marines, what could be life for us Filipinos? More burden for spending thru taxes for our Philippine Marines for expenditure on perfume, skin whiteners, and caskets for our sons?

    Maganda sana yang plano mo kaibigan. Ang kaso, I got it from very reliable sources that Martir will retire earlier than his compulsory retirement age, i.e., before he turns 56.

    What would this imply?

    This would most probably mean that Martir might spend his last days in the military already in the US — from leave to retirement. Kaya yang plano mo, hindi aabutan si Martir. Alam kasi niya ang consequences ng mga ginagawa niya ngayon, eh. Kaya naghahanda din ito ng escape niya.

    Extradition naman is not a simple matter. Kaya in all probability, ligtas si Martir.

    The non-appearance of General Martir in the Court Martial hearing is a clear and tangible manifestation of arrogance and abuse of power. Why do we have to convene this Court Martial hearing when the prosecutor has no power to compel their witnesses to attend? Accused have the right guaranteed by the Constitution for a speedy trial. If they cannot prosecute they should release the accused so that they can be utilised in the service of the country.
    This exercise in futility should be stopped as it only cause more damage to the refutation of the Armed Forces in particular and to the entire government bureaucracy in general.

    The President should say “enough is enough”and let the Armed Forces do its misssion of protecting the country against terrorist rather than dealing with some elements of the Armed Forces whose aspiration is to prevent corruption and to change the tainted image of the Armed Forces of the few into the Armed Forces of the people.

    Please extend my congratulation to our brave soldiers who are defying the orders of an illigitimate president who has the backing of the rogue elements of the Judiciary and the Armed Forces.

    This term is a bit emotive for me; never believed Gloria is president of the country, at least she’s not supposed to be the president. Calling her president offends my sensibilities.

  69. Your update is a good development. But this is not yet final. GMA and her attrocious associates can perform magical stunts. We who are affected by how the Philippine Marine behaves must work, united and double time in order for us to see to it that this unit can trully be our ever reliable, ever dependable protector against alien predators and collaborating countrymen predators of opportunities. We must see to it that our Philippine Marines will be led by someone who could drive this unit to protect the weak, the civilians in pursuit of peaceful existence and assure comrades in other units that they have a professional partner in any combat operation.

    Those in the media, let us exploit all the potentials of the media. Those in the military, let us extract all unclassified information and pass it on to our comrades and to the media for widest dissemination. Those in the investigative journalism, we have a very valuable role here.

    I think I have done my part no matter how of little value it may have been and inspite of my limited time and resources. I have posted the set of criteria which to the best of my knowledge would be important in basing decision on who should be picked as the incoming commandant. I hope others could come up with a better list and disseminate to the greatest number of the critical mass as possible.

    I hope we could link with one another and coordinate.

    The Board of Generals probably got an inkling that the rank and file in the Marines do not exactly favour Martir.

    They reckoned it would be dumb to push AFP luck too far.

    But it’s still up to Gloria. If she likes Martir so much she feels she can’t live without him, she could easily return the papers to the Board of Generals. There’s no need for her to even put marginal notes — just that, return the papers. That would ba a signal that Gloria wants something changed in the recommendation. The paper could be thrown back and forth until the approving authority, i.e., Gloria ganid, is satisfied.
