AFP studying charges vs. Lim on Cha-Cha call

Military lawyers are determining whether detained Brig. Gen. Danilo Lim could be charged again for violating the Articles of War.

The former Scout Rangers chief on Wednesday asked soldiers to make a stand on the moves of Palace allies to amend the Constitution, and not to allow themselves to be used.

The call was contained in a message read during the multi-sectoral, anti-Charter change mass action in Makati City.

Lim is facing court martial for a supposed plot to overthrow the government in February 2006, when he and his men allegedly planned to join protest actions and withdraw support for President Arroyo.

“Technically, General Lim can still be charged for his call on the soldiers,” said Lt. Col. Romeo Brawner, chief of the AFP public affairs office.

He said as soldiers, “we give up our right to freedom of speech, freedom of expression.”

He said Lim was “sort of” inciting the soldiers to take a political stand against the constituent assembly which he said goes against the mandate or nature of the military being a non-partisan organization.

But Brawner said Lim’s statements could just be used as an “aggravating circumstance” for the cases he is already facing.

Lim’s statements are being evaluated by the Judge Advocate General’s Office.

Three days before the Makati rally, Lim said the AFP could “no longer insulate itself from the political situation because Arroyo herself dragged the military into politics by using it to cheat her way to victory in the May 2004 elections.”

He called on the officers and men to follow their conscience and uphold their constitutional mandate of protecting the people and the State amid what he said was a “brazen” effort to extent the President’s term.

Lim is detained in Camp Crame for a charge or rebellion in connection with the November 2007 standoff at the Manila Peninsula Hotel in Makati City.

Lim and 27 other Army and Marines officers are facing a charge of mutiny (Article of War 67), among others, before a general court martial for the planned march in February 2006.

    Manner of changing the Constitution is not a partisan undertaking. The opposition may advocate this as well. The Harm forces of the Philippines is going to the dogs (tuta).

    But Brawner said Lim’s statements could just be used as an “aggravating circumstance” for the cases he is already facing.

    Aggravating circumstances are coetaneous (contemporaneous, kasabay – got that from CJ Ramon Aquino) with the crime. You cannot have an aggravating circumstance occuring after the offense.

  3. The charge against Lim is mutiny. His lawyer, Vic Verdadero, in one of his objections during the court martial hearing said, “mutiny is not a continuing offense.”

    For a crime to be “continuing”, the language of the statute must explicitly make it so; the crime cannot be made continuing by implication [Toussie v. United States, 397 U.S. 112 (1970)]

    The fact that there is a statute of limitations indicates that the crime is not continuing; otherwise, from when do you determine the date of repose? Toussie further held that:

    And Congress has declared a policy that the statute of limitations should not be extended “[e]xcept as otherwise expressly provided by law.” 18 U.S.C. § 3282. These principles indicate that the doctrine of continuing offenses should be applied in only limited circumstances, since, as the Court of Appeals correctly observed in this case,

    “[t]he tension between the purpose of a statute of limitations and the continuing offense doctrine is apparent; the latter, for all practical purposes, extends the statute beyond its stated term.”

    In Toussie, the asserted continuing crime was failure to register. The prosecution argued that there was a continuing crime until registration was made. That was struck down.

    The crime of rebellion or insurrection is committed by rising publicly and taking arms against the Government for the purpose of removing from the allegiance to said Government or its laws, the territory of the Philippine Islands or any part thereof, of any body of land, naval or other armed forces, depriving the Chief Executive or the Legislature, wholly or partially, of any of their powers or prerogatives.

    A man in prison took up arms?

    The operative phrase is “against the Government”, not against the Administration. There is a difference. Glue is not THE Government.

    The purpose of rebellion is to take allegiance away from the Government. No such thing was advocated. General Lim was stating that one does not need to obey an illegal order. Lim never advocated allegiance to another State (Government).

    There is nothing in the above-quoted Article 134 (Rebellion) that even remotely indicates the intent of Congress to make rebellion a continuing offense.

    Advocating such an interpretation is an instance of continuing ignorance of the law.

    as a law student, i don’t think tito danny violated the articles of war, nor the revised penal code. his statement was clearly based on constitutional grounds – the Armed Forces of the Philippines being the protector of the PEOPLE and the STATE. it, as an institution, should not engage in acts which would curtail the democratic will of the people, nor should any of its members follow illegal orders. their loyalty is to the people, and the state. not the chain of command alone, but the people and the state above all. such provision in the 1987 constitution reflects the expansive role of the military in society, as what we have seen in EDSA 1 and 2.

    freedom of expression and of speech is a cherished right in our constitution, as Dean RP would say. being a member of the AFP, in my opinion, does not remove such mantle of protection, as long as it does not compromise national security. the security of our nation is compromised when we have a military blindly following orders, even illegal ones.

    the question then should be, what crime did the Generals in 2001 commit when they withrew support from their Commander in Chief? we are still working under the same constitution, the same legal framework, thus, the “victors of war” theory should not apply. working under the same constitution, tito Danny deserves to have an equal protection of the law. Why is Reyes, et al scott free and Gen Lim et al in jail? Where is fairness and justice there?

    They should have been punished for the crime of Coup d’état. Unfortunately, the usurpers won, hence the “victors”, theincluded, went unpunished.

    If they had not won, they would have been rightly charged with coup d’état, convicted and meted the death penalty.

    (In Britain and France where the death penalty has been outlawed, obscure as it may, seem the military or defence forces still include the death penalty in their Articles of War.)

  12. Unknown to the world at large, in the late 60s, early 70s, the UK almost had a coup d’état that would have toppled the Government of PM Harold Wilson. The Conservative Party and members of the elitist Establishment were fearful that UK was veering too much to the left, i.e., Communism and so with a handful of generals and trusted commanders, politicians with the help of MI6 (and the resident US CIA chief) had concocted a plan to stage a coup d’état.

    Fortunately, the coup d’état plan was thwarted and the situation slowly went back to normal.

    Despite the fact that a coup d’état was not launched at all, the generals and the officers who had been part of the plot were cashiered albeit quietly (top secret).

    Fortunately for them, the plan had not reached the media nor the public, otherwise those involved would have been meted the most severe punishment, perhaps the death penalty had the plot been uncovered publicly.

    Do you realise that the British armed forces only have a regular professional man count of less than 200,000 (excludin reserve forces; RP has roughly 125,000) yet it seems to me that there are more star rank in the AFP in proportion to their size than the British Armed Forces.

  18. If the military lawyers are still studying if it is going to charge Gen. Lim on cha-cha call, nothing will come of out because it is already contradicting itself. Could only means AFP does not have a ready anti-dote to the far reaching effect of Gen. Lim call on cha-cha and the threat to charge him shows that they are already in state of panic. Our assessment is that even if Gen. Lim was only addressing the soldiers, his call gained adherence even to the non-soldiers and it is what prompted AFP to study what crime he committed.

    Soldiers vote — that’s freedom of expression.

    There are countries where members of the military are not given the right to vote in elections as part of their military mandate to keep them partisan free.

    Hindi naman natuloy at katunayan pa nga, the general voluntarily submitted himself under the custody of the then CS,AFP Gen Senga. Si Esperon lang naman ang parang asong ulol na kinasuhan sina BGen Lim at mga kasama bilang pagpasikat sa kanyang sinisintang si gloria.

    During the confirmation of AFP Chief Victor Ibrado and other officers, the Commission on Appointments said there is a need to rationalize the promotions of two-star and three-star ranks because their number exceeds the budget alloted.

    They decided to summon Defense Secretary Gilbert Teodoro the next meeting. I was not able to attend the next CA hearing. I was not also able to follow up that issue.

Its their only sociological and probably psychological defenses to justify their actions in protecting GMA who long before the hello garci crime, have already been collaborating with foreigners in: handing over to the Malaysians, Sabah; handing over to the Chinese, Spratlys; handing over to the Chinese rice industry, agricultural lands, forests, and retail bases of us original Filipinos in Pampanga and other places all over the country; terrain familiarization and military base establishment of the Americans in our territory.

    They never argued over ethical value, justice and fairness basis.

    Obsolutely. May karapatan na magasalita si Gen. Lim laban sa Peke at Panggulong Kinamumuhian ng lahat na si punyeta gloria . Kung ang legal na naging Presidente na si Erap ay hinayaang ma-withdraw ng support ang hudas na si angelo reyes at mga kasama nito, at hindi sila kinasuhan bagkus ay ngayon ay nagpapasasa sa kanilang mga puwesto kasama ang kanilang dimonyang presidente, bakit ikukulong, bubusalan at kakasuhan si Gen.     The more your institution aggravated the situation against sa mga tapat nating Kawal e lalong maghihimutok ang butse ng mamamayan.

    Talos nýo na wala nang respeto o tiwala ang sambayanang Pinoy sa ating awtoridad e heto at wala kayong ginawa kundi kundinahin ang mga Kawal na nagmamalasakit sa ating bayan.

    Di ba dapat kayo ang maging tagapagtanggol ng bayan, e ano ang inyong pinaggagagawa since 2001 ng agawin ng mga kurap/magnanakaw/sinungaling ang poder kapangyarihan sa tunay na halal ng bayan.

    Pahirit pa Sir LTC Brawner…di ba mga register voters ang halos members ang AFP/PNP, di po ba…opppsss, mawalang galang na sir…sayang ang inyong pagboto during eleksyon kasi nga, e walang saysay pala ang pagboto nýo dahil wala palang karapatan ang sinuman sa inyong hanay upang makapagpahayag ng saloobin kung mali na ang pinaggagagawa ng inyong mga superiors o kasamahan.

    Buti pa wag na kayong boboto at wala naman palang silbi ito, bakit ka mo, ganito yon…e bakit ikinulong nýo sina Gen. Lim and co. e gusto lamang nilang magpahayag ng pagtutol sa mga kabulukan ng rehime.

    Alam nýo yan at wag na kayong magbulagbulagan pa sapagka’t lalong magagalit ang taong bayan sa inyong hanay, ok. Magpakatotoo kayo at for sure mamahalin kayo ng Masang Pilipino.

    Though admittedly, sa many other PMAyers have fallen by the wayside, marami pa ring matitino. Hindi lang ninyo sila nakikita. Nasa loob at nasa labas sila.
