Judge who issued Lacson arrest nominated for CA

It’s too much to be just a simple coincidence.

Last Friday, Manila RTC Judge Myra Fernandez issued the arrest warrant against Sen. Panfilo Lacson for the murder of publicist Salvador “Bubby” Dacer and his driver Emmanuel Corbito.

It was revealed last Monday that the Judicial and Bar Council, by a vote of seven out of eight members, recommended her nomination to the Court of Appeals. Sen. Francis Escudero, a JBC member, as head of the Senate Justice committee, was the only one that did not vote for Fernandez.

Supreme Court spokesman Jose Midas Marquez took pains in explaining that Fernandez’ inclusion in the JBC list was not a political payback by Malacañang for the valuable service she has just rendered in issuing a warrant of arrest against Arroyo’s number one nemesis.

Tell that to the Marines (with apologies to the Marines).

Political twist to Ping’s arrest?

A few days after Manila RTC Judge Myra Fernandez issued the arrest warrant against Sen. Panfilo Lacson for the Dacer-Corbito slays, the Judicial and Bar Council recommended her nomination to the Court of Appeals.

Sen. Francis Escudero, a JBC member, confirmed Fernandez’ recommendation to CA was approved by the seven out of eight members of the JBC. He said he did not vote for Fernandez.

Escudero said Fernandez was the ninth nominee out of 31 applicants for the three vacant seats at the CA. He refused to comment further on the voting.

The CA vacancies were brought about by the appointment to the Supreme Court of Associate Justices Lucas Bersamin on April 3, 2009 and Mariano del Castillo on July 29, 2009 and the retirement of Justice Monina Zenarosa on Aug. 20, 2009.

Lacson left the country last Feb. 5 to evade what he said was an “evil conspiracy” against him. He accused the Arroyo administration of persecuting him for his criticisms against the administration.

Supreme Court spokesman Jose Midas Marquez said Fernandez’ inclusion in the JBC list was not a political payback.

“I don’t think her inclusion in the JBC list had anything to do with that. She had been interviewed. Her record is clean. She has been one of our outstanding judges. I think she really deserves to be in the shortlist,” he said.

Marquez said Fernandez’ application at the JBC was filed long before the issuance of the warrant of arrest against Lacson and even before the case against him could be filed by the Department of Justice.

Deputy presidential spokesman Gary Olivar branded as “speculation” and “slur” allegations from Lacson’s camp that Fernandez might have been pressured by Justice Secretary Agnes Devandera into issuing the arrest warrant in exchange for the support and approval of her bid to be a justice of the Court of Appeals.

Sen. Rodolfo Biazon urged Lacson to submit himself to judicial processes.

“The Senate I don’t think can be used as a sanctuary by any of its members especially if the offenses being charged against them are non-bailable,” Biazon said.

But Biazon said if the judge would allow “something like a house arrest within the vicinity of the Senate, I think the Senate leadership will be willing to extend that to him.”

Former CBCP president Archbishop emeritus Oscar Cruz said he remains convinced that Lacson is innocent.

Last week, Cruz admitted Lacson had told him of his plans to leave the country.

    I’m impressed at the intensity of the hunt for Lacson. Compare it to the “hunt” for Garci and Jocjoc

    Bakit matamlay maghanap ang administrasyon noong si Garci at si Jocjoc ang nagtago?

    Naalaala ko na nung si Garci ang nawala hindi naman nagpatulong sa Interpol ang gobyerno. Wala din nilabas na wanted posters na may picture niya. Parang ang ginawa lang ng administrasyon ay magpadala ng message sa mga Embassies natin na hanapin si Garci.

    Noon lumabas ang impormasyon na naglanding si Garci sa Singapore sakay ng private jet at pagkatapos sumakay ng commercial airline for London walang ginawa ang Palasyo.

    Ni hindi man lamang sumulat ng note verbale sa Singapore government para makakuha ng official confirmation kung pumasok nga si Garci doon, kung anong eroplano ang ginamit, anong serial number. Hindi din tinanong ang Singapore kung anong destination niya mula sa Singapore at anong airline ang sinakyan.

    Yun si Jocjoc din hindi pinahanap. Parang kay Garci ang style. Sumulat sa mga foreign posts natin pero ni hindi nagtanong sa America kung nandoon nga siya. Hindi din nagpatulong sa Interpol.

    Tignan niyo ang kaso ni Ping. Pinaghahanap pa si Mancao, Michael Ray Aquino, at Dumlao. Binisita pa ng tigapalasyo at nagpaggawa ng affidavit. Humingi pa ng extradiction mula sa amerika.

    Maaring guilty nga si Lacson tulad ni Jocjoc at ni Garci. Pero ikumpara natin ang galaw ng Palasyo ukol sa tatlo at makikita natin na si Lacson nasa lugar magtago habang nakpwesto si unano at si taba.

    Ngunit, after June 30, kailangan harapin na niya ang mga paratang sa kanya.

    The point I raise is this — Ping Lacson is just a name, while the Government of the Republic of the Philippines is an institution. With that as a view, NATO (as well as governments of North America, Asia, Europe, Africa, Middle East) all of them will defer to the Philippines and the Philippine legal system. Despite all the hell that the GMA administration has caused, the Government Republic Philippines remains legitimate in the eyes of the world, and the processes that resulted in the arrest warrant for Ping Lacson will be respected by other countries. Conclusion — Ping Lacson has very few options available to him.

    What you say is possible only if Ping uses his real name.

    Even if he doesn’t, he doesn’t have to enter a European country via airports or busy ports so Interpol will be hard put to get their hands on him if he decides to take a different route. There are thousands of ways to get into a country in Europe — with Ping’s connections, he will find one easily. He’s got a better reputation than Gloria and her government among many important folks here than Gloria’s friends might think.

    Besides, you must consider that most countries in Europe don’t have extradition treaty with the Philippines (they simply can’t trust RP’s justice system). It will be easy for Ping to be welcomed by a barrage of lawyers here and immediately file for injunction in the courts. There’s nothing Interpol can do when that’s done. They must wait.

    Legitimate govt or not, without a legal/extradition treaty, the courts will not even look at the Philippine arrest warrant (it would be considered a tad better than the toilette paper it could have been written on).

    Ping may be arrested but to extradite him? Will be a big, big, big enterprise — I assure you, won’t be an easy task.

    (Why do you think Joma Sison is laughing his ass out at Gloria and her kind? RP can’t get him to Pinas despite a standing arrest warrant for mureder! No extradition treaty with The Netherlands — no extradition treaty, arrest warrants go straight to the bin! 🙂 )

    Not as easy as RP folks think it’s gonna be just because Pinoys have been bamboozled by headline news that Interpol — yeah, octopussy Interpol, can do miracles. They can do miracles but Pinas can’t! End of story.

    As to deferring to the Philippine legal system, let me tell you, while EU justice is obliged to deal with every single known justice system of every banana republic in the world — Pinas included, they’d be happy not to have to deal with RP’s legal system. They know it’s crap most of the time.

    (Why do you think the EU pours loads of money to help upgrade RP’s justice system (and to think that’s EU taxpayers’ money, my tax money, my neigbour’s tax money, my dog sitter’s, etc.!!!!)

    The whole world may defer to RP and its institutions but certainly won’t defer to the whims of Gloria… I can assure you that.

Would u really think he would have taken on the Dorobos without a fallback position? That could only be possible through the networks and contacts in and out of the country that he had established all those years spent in intelligence work.     Love movie thrillers, and most of the time the ending is not what I’ve predicted prior to the show. This case might belong in that guessing game, but my personal view here are:

    – the clumsiness of all the law enforcements involved and Gluerilla’s regime for not keeping a tight leash for someone facing two possible murder charges (if true)

    – if I recall, Ping did the same Houdini act a few years ago but nothing happened when he surfaced out which to me was a complete mockery

    – either the government has a case against him or none at all, instead of reviving an old case when you feel like

    – only in da pilipins

    – maybe he is in Tawi-tawi

    – something is wrong here, parang may pakulo
