Supreme Court allows “Ang Ladlad” in May election

The Philippine Supreme Court on Thursday overturned a decision barring a gay rights group from contesting national elections in May and recognized it as a legitimate political party for the first time.

Voting 13-2, the court threw out decisions by the Elections Commission denying accreditation to Ang Ladlad (Out of the Closet) on grounds that it tolerates immorality and offends Christians and Muslims.

The justices said the party had complied with all legal requirements, and that there is no law against homosexuality.

“I felt vindicated,” said the group’s leader, Danton Remoto, an English professor at the Jesuit-run Ateneo de Manila University. He said that Ang Ladlad had struggled for recognition and accreditation for the past seven years.


The Elections Commission caused outrage among gays and liberals in November by saying the group cannot run as a political party because it “tolerates immorality which offends religious beliefs.” Three of the commissioners cited passages from the Bible and the Quran to justify their ruling, claiming that Ang Ladlad exposes young people to “an environment that does not conform to the teachings of our faith.”

Homosexuals are generally accepted in the Philippines and many prominent Filipinos are openly gay, despite the dominant Roman Catholic religion’s rejection of same-sex relations.

The group has received support from Leila de Lima, head of the independent Commission on Human Rights, who denounced the November ruling as “retrogressive” and smacking of “discrimination and prejudice.”

The group filed a case in January with the Supreme Court, which said that government is neutral and no legal impediment should be imposed on groups on religious grounds.

“The denial of Ang Ladlad’s registration on purely moral grounds amounts more to a statement of dislike and disapproval of homosexuals, rather than a tool to further any substantial public interest,” the court said.

Ang Ladlad is one of more than 100 parties seeking to win 50 of the 286 seats in the House of Representatives allocated for marginalized sectors.

    Isa lang ang dissent, not two. Justice Abad concurred in the result, stating that he arrived at the conclusion from a different path.

    The lone dissent is that of Renato Corona (no relation to my nephew’s favorite beer). Hindi daw marginalized ang bading, dahil wala sa enumerations ng Constitution – which is labor, peasant, fisherfolk, urban poor, indigenous cultural communities, elderly, handicapped, women, youth, veterans, overseas workers, professionals and other related or similar sectors.

    Napaka-literal mo twerp. The rebuttal to that is found in the separate opinion of Justice Abad.

    If one were to analyze these Constitutional and statutory examples of qualified parties, it should be evident that they represent the working class (labor, peasant, fisherfolk, overseas workers), the service class (professionals), the economically deprived (urban poor), the social outcasts (indigenous cultural minorities), the vulnerable (women, youth) and the work impaired (elderly, handicapped, veterans). This analysis provides some understanding of who, in the eyes of Congress, are marginalized and underrepresented.

    So the bading can be classified with either the vulnerable (women), or social outcasts (cultural minorities), most probably both. Hindi ba’t sila’y vulnerable sa api? Hindi ba’t sila’y kinamumuhian ng both ultra-right Christians and Muslims?

    Renato Corona is the Fabian Ver of the Glue. Remember the late Ninoy’s joke about Fabian Ver?

    Fabian Ver was known for his fawning loyalty to Macoy, that he would do anything for the boss man. One time, Macoy was so exasperated at Ver, that he said:

    Watch your mouth, I mean your keyboard Corona. Your literal interpretation will and can be used against you in the case of Mikey Arroy’s asosasyon ng mga secu, or Palparan’s party.

The accreditation of Ang Ladlad as allowed by the Supreme Court is a slap on the face of the Comelec commissioners who are getting flaks left and right for their many questioned actions and inactions. Justice Corona, in his dissenting opinion, is too bookish when he just relied on what the Constitution enumerated as qualified to be called among the marginalized sector.

    However, I can’t agree that the the third sex is not represented in the lawmaking body. It’s not unknown that the third sex is already fairly represented in the House of Representatives in every Congress. With regards to the nominees, being an open gay, Prof. Danton Remoto is qualified to be nominated by Ang Ladlad as partylist congressman unlike Mikey Arroyo whom we haven’t heard or read to have been a security guard in all his life. I’m not aware if he acted as one in his past movies.

    Joeseg, Being a secret gay or homosexual (in the closet) in either house of Congress and representing gay interests are as different as night and day.

    Also, there is no “3rd” sex; there are still only 2: male and female. You may be referring to sexual orientation or gender identity, of which there are now, I think 6 or 7.

    kung talagang legal na ang bading dapat sa lahat na application ng govenrmeent or even sa passport merong nagsasabing bading, dalawa lang ang pinamimilian eh, male or female. Ibig sabihin niyan there is no legal acceptance about bading.

    About cultural minorities, anong parte ba ng kultura ang bading? Diba ang bading ay “socially accepted” lang at hindi naman parte ng kultura?Does it mean ang cultural minorities is not applicable to bading?

    about naman sa kinamumuhian ng both ultra right and muslims, lahat ba ng kinamumuhian ay vurnerable? papano na yjng mga magnanakaw, kinamumuhian din sila, baka pwede rin ba sialng matawag na vurnerable ayon sa definition na yan?

    sometimes the law should be interpreted as it is written and not because of cultural and social effect.

    Sabi ni Justice Abad, vulnerable ang women and youth. Sa ganang akin ay vulnerable ang bading. Mas maraming bading na inaapi kaysa nabugbog dahil lang bata (sama ako sa nang-aapi noong high school ako).

    Sabi rin ni Abad, ang cultural minorities ay social outcast. Alin ba ang mas outcast? Ang heterosexual na Kankana-ey, o ang Tagalog na bakla?

    Bihisan natin ng blue jeans and white T-shirt ang isang Kankana-ey, isang Mangyan, isang Tausug, at isang bading. Paglakarin sila sa SM Mall. Sino ang kukutyain? Ang heterosexual na cultural minority? O ang bakla?

    Let’s make it worse. Pagsuotin ng traditional garb ang Ifugao (bahag) at mag-drag ang transsexual. Again, paglakarin sa SM. Tutuyain ba ang Ifugao at hindi ang trans? Tutuyain ba silang dalawa? O mas tutuyain ang trans?

    Sa Maynila, may nabugbog na ba dahil siya’y Mangyan o Igorot? Ilan ang nabugbog dahil bakla? Gumamit pa ng passage sa Bibliya ang COMELEC. Ano ba ang sabi ng Panginoon? Whatever you do to the least of my brethren, you do unto me.

    Kung pagpipiliin, mas nanaisin kong isilang muli sa mga magulang na Kankana-ey o Ifugao, kaysa isilang na bakla, sa hirap ng buhay na nakikita kong ibinubuhay ng mga bakla.

    Magkaiba tayo ng pananaw mac.bh. Hindi kita kinukumbinsi na pumanig sa aking pananaw. Nguni’t yan ang dahilan kung bakit ako ayon kay Justice Abad at yung mga ibang justice, at kung bakit di ako ayon kay Renato Corona.

    Hindi rin ako pabor dito sa grupo ng Ladlad …. tignan niyo na lang … noong unang panahon (lol) hindi itinatago lang ang kabaklaan dahil hindi tanggap ng lipunan … makaraan pa ng ilang taon medyo tanggap na ng lipunan kaya medyo dumami ang nakikita mong nagwawala sa kalsada …. makaraan pa ng ilang taon … kailan lang … gusto na nila na puwede rin silang ikasal …. ngayon naman kailangan nila na mayroon silang representante sa ating Gobyerno. Ano ang susunod o hakbangin nila …. palagay ko sa darating na panahon … sila na ang maghahari. Ayyyyy nakwo diyos ko day ….

    literal kasi sa kaso na eto ay literal na sinasaad sa batas ang mga considered na minority. kung vurnerable ang paguusapan lahat naman tayo vurnerable. That is why corona has a big valid point. Sa panahon ngayon ang bading lang na nabubogbog ay yung merong kalandian na tinatawag. nagbabago ang pananaw ng tao sa bading, socially accepeted na sila.

    Ang mga igorot na sinasabe mo ay mananatiling igorot kasi lahi nila yan, samantalang ang bading ay social acceptance lang, nagbabago sa panahon, ,the fact is mga bading na ang nambubogbog ngayon at madami na ring bading ang sangkot sa rape ng kabataan gaya ng pedophile. Hindi sila minority, hindi vurnerable, nagbago na ang panahon since your early time na ikaw ang nambubogbog.

    Kung bible namana ng pag babsehan, specically condemned ang bading basahin mo ang sodom at gomorrah.

    Ang pagkakamali alng ng COMELEC kaya sila natalo ay ginamit nila ang salitang “IMMORAL” which according to SC ay hindi naman batayan sa Party List acceptance. Ibig sabihin pati mga samahan ng kidnapper pwede, sabagay sa BIR ruling pati kita sa ransom ay taxable.

    gaya na rin ng nasabi ko, tatlo ang dahilan na binigay ko sa iyo pero iisa lang ang kaya mong ipagtangol.

    you are getting too defensive. Of course the mere fact that you posted in here is you wanted tobe heard and let people allied with your ideas. Whart is the ultimate purpose of this blogging? to let the ideas prosper and let people know, in the end it is about convincing someone to join the idea.

    If you accepted the facts the corona is also true then what is the talking all about? What is the use of your too long post identifying each of corona line if you are not convincing people to think otherwise?

In the first line you specifically say women, on the later part hindi naman pala pagkababae ang usapan…tsk..tsk..tsk…I do not understand your thought.

    ng tanungin ka kung kelan pa naging legal ang bading ang sagot mo ay meron bang batas na nagdsasabing illegal. hahahaha! very funny arguement. Clearly just a mery go round lang ang position mo. I have given you an excellent sample diba? That if bading is talagang classified na legal di sin sana ay merong pamimilian sa mga government documentation other then female and male.

    You can not even accept the fact that ang kabaklaan ay nagdudulot don ng madaming salot sa lipunan, I have given you samples and yet you close your eyes. All you can see are the vunerability and yet you can not see the fact that they are now one of the vices of the society. therefore hindi makatutuhanan na vulnerable ang classification nila at present time.

    As for the bible, you can not separate the new and old testament. Your sample is more on the action of the people that surround the sinner, whiile my sample is the direct participation of the sinner itself. these two are totally differrent. kung trabaho ang magkumbinsi sa hukuman you shuld known the difference beetween the two. your application is simply in the wrong track.

    in the end of the analysis corona is right regarding the definition of bading not classified as minority. but to make the point, the only reason why ladlad win this case is because the COMELEC use the “IMMORAL” word. The supreme court decided that immorality is not a reason to disqualify LADLAD. It means it is just a techical in nature. If the COMELEC should have questioned the minority issue they could have win the case.

    Without offense to the gay community, dapat ilaglag ang Ladlad. Kung ako ang tatanungin, matatanggap ko lang ang mga bading at tibo kapag makakaanak ang isang bakla at makakabuntis ang isang tomboy. Kung ang kaya lang nila ay umampon, alis diyan !
