Is The Firm making a comeback?

Former Solicitor General Francisco Chavez Monday assailed what he said were attempts by members of The Firm, a law office formerly associated with the First Couple, to return to the corridors of power with the impending inauguration of the Aquino presidency.

Chavez said that former Defense Secretary Avelino “Nonong” Cruz Jr. was eyeing the post of justice secretary while former Ombudsman Simeon Marcelo wanted to become a member of the Judicial and Bar Council.

He also said that Cruz and Marcelo could not present themselves as “crusaders or apostles of deliverance” in the controversy over the appointment of Chief Justice Renato Corona because they were ranking members of the Arroyo administration when it was rocked by scandals.

Influence-peddling

Chavez, the solicitor general during the administration of President Corazon Aquino, alleged that The Firm (known as the Villaraza Cruz Marcelo & Angangco law office) was supposedly engaged in “influence-peddling” and “illegal transactions” before it had a falling out with President Gloria Macapagal-Arroyo.

Asked about Chavez’s allegations, Cruz Monday night declined to comment and said he would issue his reply Tuesday. Cruz and Marcelo have been very critical of Ms Arroyo’s appointment of Corona as the new chief justice.

“Let us put this in proper perspective. I filed four plunder raps against GMA (Ms Arroyo) but Ombudsman Marcelo did not lift a finger on these. In fact, he inhibited himself, an indication that he was biased for Gloria,” Chavez said.

He added that Cruz was also Ms Arroyo’s chief presidential legal counsel and later defense secretary when the Arroyo administration was rocked by controversies like the “Hello Garci” scandal, the NAIA Terminal 3 takeover and the issuance of Executive Order No. 464, which allowed government officials to avoid attending congressional hearings.

Not a squeak

“All these lawyers who are now making these noises did not make a squeak then, not even a whimper of protest,” Chavez said.

“Why are they making noise now? They are positioning themselves for the incoming administration?” he added.

Chavez said that Cruz and Marcelo were “fighting” Corona because they were rooting for Justice Antonio Carpio, a former member of The Firm, to become Chief Justice.

“If that happens, then happy days are here again. They should realize that their influence-peddling days are over. They should not be allowed to spread their venom of illegal transactions in the new administration,” he said.

“We should also remember that Avelino Cruz is there for Mar Roxas and not for Noynoy Aquino,” Chavez added.

Appointments

The former solicitor general said persons linked to The Firm were also asking members of the legal community if they wanted to be judges of the Regional Trial Courts or the Court of Appeals and if former Special Prosecutor Dennis Villa-Ignacio was acceptable as an Ombudsman.

Chavez said he was ready to present the persons who were asked.

“They should not behave as if they own the Philippines. It’s as if they’re the ones deciding where the spoils go,” he said.

“So, what if they belong to The Firm? I will be firmer,” he added.

Supreme error

But Chavez said the Supreme Court erred in allowing Corona’s appointment.

“I would like to make it clear that the general assessment of all lawyers is that the Supreme Court committed a supreme error in allowing that appointment. It was engaged in judicial legislation and it, in effect, amended the Constitution,” he said.

Chavez said the “midnight” appointment of Corona could be nullified through an executive order.

The new administration could even file a “test case” to overturn the Supreme Court ruling that allowed the appointment, he added.

“They could file a test case so that the Supreme Court can redeem itself,” he said.

Knowing his sense of equity, I’m sure he is an advocate of promoting from within – promoting career officials. Sa dalawang taon niya, makikita niya kung sino ang may career of doing justice, at kung sino ang may carrier ng moneybags.

    Are you referring to my comment about the last man to leave Erap sychitpin? That was not loyalty to Erap (although he is Erap’s friend). That was loyalty to the Constitution. Saguisag believed that Erap had to be removed by impeachment, not people hakot.

Not that Carpio is less deserving than Corona, because he is, but that prerogative is best left to President Aquino to decide. (Wow, I haven’t used “President” and someone’s name in the same sentence for a long, long time!)

    Pancho Villaraza after all, is still Gloria’s cousin and following Yuko’s favorite “blood is thicker than water” analogy, The Firm’s intentions are suspect.

    Yes, Marcelo slept through many impeachment complaints, and some very controversial test cases. This is why Chavez used to sarcastically chide Marcelo for making those cases “do a Mona Lisa”.

    Nonong Cruz was principal adviser to Gloria at the worst days for Philippine justice practically arming her with impunity to continuously violate the law as she so desires. That’s aside from the fact that he is also an election operator. He first hired the now controversial Al Agra for the 2004 K-4 ticket Quick Count ops that saw Migs Zubiri elbow out Koko Pimentel in ARMM and zero votes for the opposition and again just recently, he was seen “doing the rounds” in Mindanao where counting has slowed down.

    My unsolicited advice to Noynoy, beware of these characters. There are many deserving lawyers, too many in fact, to fill those coveted positions that these controversial figures are out to grab for themselves.

  29. Henry, re #18. You may not like Chavez. Yes, he lost in two elections. What has got to do with the issues he raised against “The Firm”, which many can attest are valid.

    Before their relationship with Arroyo soured, the Firm was putting the judiciary under their control. They had the say on appointments of judges while at the same time they are handling cases. Talk to non-Firm lawyers. They will tell you the serious danger to the justice system what this group was doing.

    You also have to remember that they were the primemovers of the Arroyo’s power grab in 2001.

    I told Harry Roque, since we are now in the mood to correct the wrongs of the past, let’s start with 2001. Let’s nullify the Supreme Court’s decision on Estrada’s “constructive resignation”.

    That would nullify Gloria’s administration and all the laws and orders she issued.

    I do understand the issues Chavez is raising against Cruz and Marcelo but are their appointments in an Aquino admin a done deal already? Or is Chavez just raising a ruckus to bring attention to himself as Cory’s ex-Solgen in the hope of landing a job in his admin instead? This hullabaloo on a yet non-existing appointment is ridiculous. Ditto with the witnesses Chavez is now presenting in connection with the ‘Hocus Pcos’ claim of the losers. No wonder even his kasimanwas in Negros dont think highly of him.

    Ha ha ha, yung mga naniwalang kayang i-revoke ng isang Executive Order (EO) yung appointment kay Corona ay uto-uto.

    Ang isang EO ay basically an order addressed to those in the Executive Branch. Ang SC o judiciary ay di covered ng Exectuive Branch o ng EO. Take note that an EO is always sa mga bureacracy o part ng civil service.

    Let’s Review the case of –Marbury v. Madison

    Facts

    In his last few hours in office, President John Adams made a series of “midnight appointments” to fill as many government posts as possible with Federalists. One of these appointments was William Marbury as a federal justice of the peace. However, Thomas Jefferson took over as President before the appointment was officially given to Marbury. Jefferson, a Republican, instructed Secretary of State James Madison to not deliver the appointment. Marbury sued Madison to get the appointment he felt he deserved. He asked the Court to issue a writ of mandamus, requiring Madison to deliver the appointment. The Judiciary Act, passed by Congress in 1789, permitted the Supreme Court of the United States to issue such a writ.

    Issue

    Whether the Supreme Court of the United States has the power, under Article III, Section 2, of the Constitution, to interpret the constitutionality of a law or statute passed by Congress.

    Opinion

    The Court decided that Marbury’s request for a writ of mandamus was based on a law passed by Congress that the Court held to be unconstitutional. The Court decided unanimously that the federal law contradicted the Constitution, and since the Constitution is the Supreme Law of the Land, it must reign supreme. Through this case, Chief Justice John Marshall established the power of judicial review: the power of the Court not only to interpret the constitutionality of a law or statute but also to carry out the process and enforce its decision.

    This case is the Court’s first elaborate statement of its power of judicial review. In language which remains relevant today, Chief Justice Marshall said, “lt is emphatically the province and duty of the judicial department to say what the law is.” Nowhere in the Constitution does the Court have the power that Chief Justice Marshall proclaimed. Despite there being no mention of such power in the Constitution, since 1803, our Nation has assumed the two chief principles of this case: that when there is a conflict between the Constitution and a federal or state law, the Constitution is supreme; and that it is the job of the Court to interpret the laws of the United States.

It is a known practice for various groups to position themselves within the inner advisory circle of power and the one who could position one from their group to be legal advisor to the president will wield a great deal of power and untold influence.     You want your contract to get Malacanang approval but can’t seem to get it even after it’s been negotiated, checked rechecked and cross checked again and again a million times and approved, recommended for approval to Malacanang by end user?

He will give his imprimatur and recommend that president approves contract implementation; not only that, said legal jerk to president himself will put the bloody contract on top of the pile of contracts awaiting presidential decision in Malacanang!
