Danny Lim released from detention

While I am glad that Brig. Gen Lim is out and would be able to celebrate his birthday in his home on Wednesday, I’m sad that 15 other officers who are accused with him in the February 2006 non-event are still in detention. Of the 15, eight are Scout Rangers junior officers and one, a member of the Army Special Forces.

I’ll write more about this on Wednesday. Sen. Antonio Trillanes IV is the only one left in Camp Crame. True to his word to his fellow Magdalo officers and men that “I will be the last man out of here.”

Anyway, here’s the report by Malaya reporters Victor Reyes, Raymond Africa and Ashzel Hachero:

Former Scout Ranger chief Brig. Gen. Danilo was released from detention yesterday and turned over to the custody of Brig. Gen. Reynaldo Ordoñez, chief of the military’s Philippine Defense Reform office.

Lim’s release from the PNP Custodial Center in Camp Crame at 5:35 p.m. came after AFP chief Gen. Delfin Bangit allowed him provisional liberty.

Lim is considered a member of the Philippine Military Academy Class of 1978 which includes Bangit and Ordoñez. He joined the PMA in 1973 but left a year after for the US Military Academy at West Point where he graduated in 1978.

Earlier yesterday, representatives of Lim posted P200,000 bail in the sala of Makati City Judge Elmo Alameda where Lim is facing a rebellion charge in connection the November 2007 standoff at the Manila Peninsula Hotel, a requirement for Bangit’s approval of Lim’s request for provisional liberty.

Lim was allowed by the Makati court to post bail as early February. He had refrained from posting bail until yesterday because the military would just take custody over him.

Lim is facing court martial proceedings for the alleged attempt to overthrow the Arroyo government in February 2006. He is accused of violating Articles of War 63 (disrespect to the President), 96 (conduct unbecoming an officer and a gentleman), 97 (conduct prejudicial to good order and military discipline) and 70 (escape from confinement) in connection with Manila Peninsula standoff.

He is also facing a separate charge before another military tribunal for violation of AW67 (mutiny) in relation to the supposed plan to grab power in February 2006.

Before Bangit’s grant of the provisional release request, Lim accompanied by Ordoñez paid a call on Bangit at the AFP chief’s office in Camp Aguinaldo.

“That was where the turnover occurred,” said Lt. Col. Marcelo Arnulfo Burgos, chief of the AFP public affairs office.

A source privy to the meeting said the three discussed, among others, the plight of Lim’s co-accused who have been in detention since February 2006.

“The similarly-situated may be accorded the same (provisional liberty). That was among the discussions,” the officer said on condition of anonymity.

The source added said that there was also an arrangement prohibiting Lim from publicly making statements.

Lim was deemed separated from service when he filed his certificate of candidacy for senator last year. He lost, placing 17th in the senatorial race.

Last night, Lim visited incoming president Benigno Aquino III at his residence on Times Street in West Triangle, Quezon City. Lim was an adopted senatorial candidate of Aquino’s Liberal Party.

Burgos said Lim can return to his house. “He can even go out of his house. That is actually dependent on the terms and conditions with his custodian officer,” he said.

Burgos said Ordoñez will be held accountable if he fails to present Lim in court or Lim violates the conditions of his provisional liberty.

Burgos could not say when the last time an officer facing court martial was placed in the custody of a fellow officer.

Among Lim’s co-accused is Marines Col. Ariel Querubin who also ran for senator but lost.

Earlier in the afternoon, a staff at the sala of Makati Regional Trial Court (RTC) Branch 159 Judge Elmo Alameda said Lim’s counsel, Vicente Verdadero posted the bail on behalf of his client Monday afternoon.

“Yes, Atty. Verdadero posted the bail of P200, 000 in cash at about 2:30 this afternoon,” a staff of Alameda said.

Reached on the phone, Lim said he was still at the Philippine National Custodial Center in Camp Crame adding that his lawyer is discussing the issue with the authorities.

Lim is currently detained at Camp Crame along with fellow detainee, Senator Antonio Trillanes IV. They were both charged with rebellion for walking out of the hearing of the Oakwood coup d’etat at the Makati RTC (Lim was in court as witness) on Nov. 29, 2007 and marched to Manila Peninsula where they called for a withdrawal of support from Gloria Arroyo.

Unlike Lim, Trillanes is also facing coup d”etat charges before the sala of Makati RTC Branch 148 Judge Oscar Pimentel for the July 27, 2003 Oakwood Hotel mutiny.

Earlier, Alameda also allowed the Magdalo officers, former Marine 2nd Lt. Jonel Sangalang, former Navy Ensign Armand Pontejos, former Navy LTsgs Eugene Louie Gonzales and Arturo Pascua, James Layug, Marine Captain Gary Alejano, former Air Force Capt. Segundino Orfiano, Jr., 1Lt. Billy Pascua, Cpl. Clecarte Dahan, Pfc. Juanito Jilbury, Pfc. Emmanuel Tirador, Pfc. German Linde, Julius Mesa, Cesari Yasser Gonzales and Lt. Manuel Cabochan to post bail.

They were later released by the military from detention.

  2. The evening news have it that Lim and Bangit are Class of ’78 batchmates. Seems confusing since Lim graduated at West Point and not PMA.

    BGen LIM is an honorary member of PMA Class ’78. Magkakaklase o batchmates din sila nina Gen Pangit sa academy bago siya napunta sa West Point as a scholar.

    Hindi ka dapat mahilo dahil walang pulutan.

    If I may Tongue. The news item is accurate, albeit not explained properly, thus the confusion. Sir Danny joined the PMA Class of 1978 as a freshman or plebe in 1975. However, he was sent to West Point that same year after topping the competitive entrance exam for West Point(USMA). The US service academies normally gives the RP,through the PMA, as one of its foreign military grants to us, one slot each in the Navy, Air Force, Coast Guard and Army(West Point)Academies in the US. Gen Lim was the PMA candidate to USMA. Tecnically, he is only an honorary member of PMA 78 just like FVR is an honorary member of PMA 51, his original class before he went to West Point.

  12. Ah, ok. Thanks for clarifying Henry, Mags. Kaya pala yung barkada naming nagpagulong-gulong sa bundok para mag-quit ay meron pa ring “class” sa PMA (Maharlika ’84)kahit tinutukso naming wa-class dahil sa takot nung mamatay sa hazing ang isa pa naming kaklase, si Andy Ramos.

    Gen Lim as well as Trillianes and their companion’s freedom is assured with Noynoy’s victory. It’s V day for them. Now the real guilty ones must be jailed for justice sake.

    Lim’s release albeit not yet complete is already some kind of victory. His association with pres-elect Aquino can only be positive as far as his future is concerned.

    However, his “victory” would have been more complete had he not left his subalterns, fellow accused, i.e., junior officers, behind.

    Let’s hope he discussed the matter of his fellow accused/junior officers’ future during his “audience” with pres-elect Aquino.

    Let’s note that Gen. Lim is only out on bail, hence he is not yet “released”. Hopefully, charges against him and his compatriots will be dropped/dismissed so that he can truly be free!

    I think it is easier for Gen. Lim to facilitate the release and eventual freedom of his fellow detainees if he is out of detention and able to move around freely.

    He headed straight for Noynoy’s residence. And as Anna says he was reported to have discussed the plight of his fellow co-accused. Presumably how and when they would be freed.

    That’s one personal mission he will see through, no doubt.

    Am also sure that’s one of the first things Gen LIM will do once he gets out of detention (even temporarily) proving his old self.

    Ganyan siya noon pa. Hindi nawawala sa isip niya ang kapakanan ng kanyang mga kasamahan at tauhan. Basta’t meron din lamang pagkakataon at may magagawa siya ay inuuna niya believing the only way to earn their respect is working for their welfare.

    Kaya nga si Gen LIM ay mahal na mahal ng kanyang mga dating naging tauhan at iginagalang ng sinumang nakakakilala sa kanya dahil sa kanyang pagiging diretso at makatao.

    Patunay diyan ang paninindigan niyang huwag lumuhod at himingi ng tawad upang iurong o gumaan ang parusa sa kinasasangkutan niyang inimbentong kaso ng mga aso ni gloria arroyo.

    Ang lahat ng mga nakakulong na upisyal at sundalo ng AFP na nakulong sa salang coup d’ etat at rebellion ay dapat ng palayaing lahat sapagkat ang pangunahing dahilan ng kanilang pagkakakulong ay ang kanilang uniforme na lantarang lumaban sa katiwalian ng papaalis na administrasyon. Pinanindigan nila ang kanilang tungkuling protektahan at pangalagaan ang interest ng sambayanan kung kaya nilabanan nila ang pamahalaang ninakaw lamang ang mandato ng bayan, ninakaw na ang mandato ng bayan, ang mga tuta naman ay walang patumanggang nagnakaw at patuloy na nagnanakaw sa kaban ng bayan. Dapat na nilang isunod na palayain si Antonio Trillanes, na patuloy nilang pinagkakaitang maupo sa senado, kung kaya pinagkakaitan din nila ang kapakanan ng mga taong naghalal kay Trillanes. Sila ang mga tunay na sundalo ng bayan, tagapagtangol ng interes ng sambayanang Pilipino, mabuhay ka Gen Lim, naway ipagpatuloy mo ang iyo nang nasimulan!

    Actually, there’s no point for Gonzales to even begin talks on acquisition. There’s no way bidding for a highly sophisticated item to start in 30 days; takes a number of procedures to even get down to drafting a short list, let alone negotiate contracts.

    He’s shitting people about (and suppliers most of all) because by announcing this impossible acquisition in such short a time, he’s directly inviting suppliers to submit money up front, aka bribe, he’s doing it without an iota of delicadesa; he knows he’s on his way out and wants cash as a goodbye gift. He knows pretty damn well, there’s no way for what’s he’s started to be finalised. Just no way!

    I’ve encountered this sort of individual in DND and Malacanang who’s on his way out. The guy will promise everything and anything, show you a signed and sealed authority to negotiate document, approval from Malacanang with presidential code bars on the side, etc., DBM doc that funds will be released, etc., to make it look as if something is a already done deal when in fact it’s all fake.

    If you’re not careful, they will do you in. So what you do is tit for tat. You sign some kind of IOU (with your left foot) “to signify” that if the deal pushes through under the next admin they’ll get their cut. Then you start again with folks in the next admin.

    The trick is never ever ever put in a cent up front>, not only is it illegal (particularly for foreign suppliers — read OECD rules on anti-corruption will land you in jail in home country), it’s also a useless, absolutely useless endeavour.

    The Philippines is one of the most anarchic places in the world to do business with.

    It’s all a shitty merry go round in Pinas when it comes to govt contracts.

    The henchmen running DND, DPWH and DOTC under Cory Aquino were the most anarchic of them all. Everyone who knew someone who was related to someone who could introduce you to someone working with someone under Aquino was the order of the day. Absolutely and incredibly shitty they were. I refused to even take the guys out to dinner unless they could show proof that everything was above board. If they wanted to talk about money, I’d leave and let them to talk to my agent in the country; that was their problem not mine.
