There is something sinister in Gloria Arroyo’s re-appointment of Efraim Genuino and four other members of the board to the Philippine Amusement Gaming Corporation in violation of the ban on midnight appointments.

Last week, my friends and I were talking about how the grim predictions about the May 10 elections were proven wrong.
I asked, “Were we wrong about Gloria Arroyo? ”

I asked that because we all believed that she would do everything to hold on to power beyond June 2010 including cause a failure of election.

Our paranoia was not unfounded. We have seen Malacañang’s efforts to change the Constitution to remove the term limit that prohibits Arroyo from staying on to power. There was an attempt to change the form of government from presidential to parliamentary that would have qualified Arroyo to stay on as prime minister.

The people registered their opposition vehemently forcing Arroyo and her cohorts to shift to whatever other options.

Our fears about the automated elections were borne by our deep distrust for her compounded by her refusal to retire from politics once out of Malacañang and instead decided on running for a Pampanga’s congressional seat, which she won handily.

Failure of election didn’t happen and Benigno “Noynoy” Aquino III,the candidate whose platform was anchored on “change” and making Arroyo accountable for the numerous anomalous deals during her nine-year presidency, won the election convincingly.

The public’s attention is now focused on the official canvassing and the look of the incoming administration.

Does that mean that we are finally through with Gloria Arroyo? That we were wrong in thinking that she would hold on to power by all means because she would be brought to court once she is out of power?

Aquino’s mandate was overwhelming and Arroyo, a seasoned politician, knows when not to confront the people’s wrath. What is more important for her now is to erase traces of her crimes.

Arroyo’s contentious appointment of Supreme Court Chief Justice Renato Corona was an indication that Arroyo is covering her tracks and it would not be easy to prosecute her for the crimes she committed against the Filipino people.

Her re-appointment of Genuino and for other directors to Pagcor is intriguing. It’s brazenness suggests that she is not done covering her tracks.

Pagcor , which supervises all gambling operations in the country generates some P17 billion a year and a huge part of it goes to the President’s Social Fund. In the past, she used the fund to keep the loyalty of congressmen and local officials.

Gambling aficionados talk of one service casinos give. It sounds like money laundering.

I’m not into gambling so I don’t know how that works.

Just like the many other midnight appointments she issued ( her manicurist to the Pag-IBIG Fund and her gardener to the Luneta Park Administration), the re-appointment of Genuino and company were dated March 9, one day before the start of the ban on presidential appointments.

No one believes that it was not ante-dated. In fact, the receipt by Pagcor of the appointment which was April 28, 2010 support the suspicion that the actual date of appointment was after March 10, which renders it illegal.

The eminent Constitutionalist, Fr. Joaquin Bernas , in an interview with ABS-CBN said, it is not only the appointment date that should be considered but also the date in which the appointment was accepted. “It’s [appointment] completed by acceptance,” he said.

Bernas said the Pagcor appointments violate the spirit of the Constitution, which bans midnight appointments. “An outgoing president is just a caretaker,” he said.

Arroyo loyalist Elena Bautista, head of the Presidential Management Staff, downplayed the legal questions saying they have studied it and besides, she said, “it’s just for one year.”

A billion things can happen in one year. Ask anyone in the laundry business.

    winnings are paid in cash and are not reported to the tax agency. pagcor corrupt officials can easily drain the agency’s funds by manufacturing phantom winners. in america, winnings of $1000 or more are reported to the tax agency with the winner’s name, address, and social security number. eventually the winner has to pay taxes on his winnings. how’s that for efficient tax revenue collection? here it is the pagcor corrupt officials who win, and you can bet not a single centavo of tax will be paid.

    This woman has absolutely no sense of what is right and wrong, so for as long as she lives, she will always try to one up the people.

    Sax wrote something about money laundering in the previous post and I have no doubt whatsoever that this Arroyo family is into that, hence re-appointment of Genuino to board. They need him to do the Arroyo’s dirty laundry.

She may be laughing now, but one day she will eventually cry together with her partners in crime inside a cell in an orange shirt with a letter “P” printed on it.     Dapat unahin ni Noynoy na sapukin ang midnight appointments ni Genuino at Corona. Once president na, he’ll have a way to get rid of Gloria’s puppets basta meron syang balls at brilliant legal advisers.

    Local – You bring in your stash of illicit cash, buy chips, and play low stakes. You lose a little, then get bored and cash your chips. Then you tell the tall tale of having won in the casino, and paying taxes on your “winnings”. Virtuous ka pa, because very few declare their winnings from the casino.

    International – this requires some connivance with overseas casinos. If the chip maker of the Philippine casino is the same as the chip maker of the foreign one, and if you have arrangements to honor each other’s chips, then you can launder money that way.

    Buy chips with your stash of cash, then play a little, and go home with your chips. Now Fedex your chips to your address abroad or bring them with you in your hand-carried luggage. Go to the foreign casino, play some, then cash your chips.

    Tada, you have just laundered your money.

    Of course, the reverse can be done. The Chinese (Triad member) with illicit money can launder it in a casino in HK and collect it here in the Philippines.

    The best way to launder money is to have your own casino. Then you can just send your soldiers (drug retailers, etc.) to your casino, and lose their earnings in the casino. Now the street revenue is washed into casino revenue.

    Pretty neat di ba? Wala namang mawawala sa tunay na revenue ng PAGCOR. Their bottom line is the same. The losses of the jueteng soldiers could be declared as winnings of some fat player. Of course, ibang pangalan ang gagamitin, para hindi maingay sa media. And since PAGCOR finances are not audited, who will know?

    Sayang naman yung one year’s worth of laundry di ba? So appoint Genuino again.

    1. There must be hard cash/currency available
    2. The dirty money must disappear fast and untraceable
    3. The clean money is taxed (or not) and recovered in trickles

    Depending on the size of the haul, the best way to do large transactions is going offshore, with layering of several shell corporations engaged in diverse but related businesses. The method is intricate in order to make it very difficult (and very expensive) for the investigating agency to tackle.

    Smaller jobs can be handled by using legit businesses that exchanges a lot of cash on regular intervals. In the US, and elsewhere, mafia mobs once used coin-operated laundromats, restaurants, strip bars, theaters, car-wash, even hotels, and yes casinos, as fronts.

    In the age of information, even eTrade or eBay has been on the launderers’ radars for they indirectly uphold virtual anonymity of their clients. Also, money transfer agents like Western Union also provide alternative routes for illegal money for as long as they don’t surpass the $10,000 per transaction threshold or per a short duration of time.

    In the Philippines, the most efficient way is through gambling where any “gambler” can lose it all in one sitting/game then get it all back again, of course, in cahoots with the operators. It’s not a surprise, therefore, that there are many lotto-winning millionaires in the corrupt offices of BIR, Customs, DPWH or what-have-you where ordinary employees buy winning tickets of other people for extra aside from the prize amount.

    Losing in the casino is a fast way to transfer dirty money into the system and then recouping them in smaller batches guarantee that cleaned money is back into some crook’s hands without fearing a doublecross since it’s his/her underlings who are doing it for him/her anyway. Hell, why go to all the trouble, you can just have ghost winners and collect the loot for yourself?

    Not so greedy. That is probably where the funds for the operators come from. The Other Transactions account where the “drycleaning” fee is for the boys. The smaller fry.

    Just read this in the Inquirer:

    Elena Bautista, chief of the Presidential Management Staff, said the extension of Genuino’s term could not be considered a “midnight” appointment because it was made on March 9, the day before the constitutional ban on appointments during an election period took effect.

    What? Hindi daw midnight appointment? Liar!

    Ellen, If Pagcor is not subject to any audit and the management is in conspiracy with the launderer, why then bother to have the complexity of the process that Sax suggested, but instead just haul the money to the Casino and drop them there and let the Casino staff launder them? That would not make any difference, would it?

    $600 or more is taxable (for a one dollar bet, you only win this amount on exotic bets in horse racing, greyhound racing, trotters (kalesa or chariot races as some call it).

    $1200 minimum winning is taxable on slot machines or bingo.

    If you know what you’re doing, you don’t pay taxes at year’s end of your winning/s. For arguments sake you indeed won $1200, you can either pay the tax upon filing or inform your tax preparer you also lost $1200 on the same tax year, and don’t pay Uncle Sam a dime. Proclaiming you’ve lost $1200 however, must be substantiated should you be audited by the IRS. The legal way to do this (not really legal…), is to scramble for losing tickets from friends, or pick-up some tickets on the casino floor that will be equal to or more than $1200.

    A close friend frequents San Lazaro (sees Mikey the horseman there all the time), but haven’t asked him about paying taxes on winnings from the track. Most likely, it’s all fixed.

    my hunch, just my hunch is that the re-appointment of the Pagcor Staff is to make sure that the trail of billions of missing money of Pagcor fund is duly coverered up before the incoming government put its own personnel just in case they want to pursue their campaign promises of fighting corruption in all segments of Governance and that is one Agency that is ripe, fully ripe of Corruption. Money laundering is no longer a “hard Job” for the country experts..they’ve been doing that since Marcos (even before) time and going on unabated…

    I was thinking of the US scene. If the drug soldiers have a police tail, walking into the casino and walking out five minutes later will make it obvious. But if they play and lose, then they just look like spendthrift wise guys.

    Or, as Tongue says, the wise guys’ underboss may also own a girlie bar. So they drop the money on the underboss, who plays the casino and loses. Week later, the big boss walks in, plays some coin machine that is rigged, and hits the jackpot. Now he can ask the casino to pay the winnings with a check.

    Some variation can be done in the Philippines. This provides the big boss the much needed deniability.

The FOIA in the US is what allows any private citizen to petition the government, and if it refuses, to ask the court to compel government to release info.     I have not read the provisions of the Philippine FOIA. But if it is similar to the US version [it probably is, if it is the old Angara(pal) bill filed in Cory’s time], then it will enable private citizens to open up cans of worms on government funds.

    True, the term of Genuino begins while the outgoing is still president, but that term begins after the power to appoint has ended.

    The Constitutional provision in 1987, vis-a-vis 1935, only advanced the deadline for appointments, from the expiry of the President’s term, to sixty days before the expiry of said term. But the principle still applies, executive prerogative does not empower encroachment into the incoming president’s prerogative. This is clearly an abuse of discretionary power.

    Most FOIA or Access to Information Act shipped the burden of proof on the government agencies to reason why if access is denied and also it comes with complimentary Privacy Law that will protect personal information of individual citizens…in the U.S. and most other coutries it also appended by other requirements that any agency or individual trying or attempting to defeat or destroy the information is guilty of a Very Serious Criminal Offense.

    Altogether the intention of this Law is to enhance Accountabality and Transparency in Governance and duly implemented it works wonderfully.

    The re appointment of Genuino could have something to do with money laundering but it also has something to do with the release of funds for the projects of the president. Kailangan ni Noy yang mga funds na galing sa casino specially during his first few months in office. Puede siyang ibitin ni Genuino. Binawasan na yung mga taxes sa petrolyo. Malaki ang mawawala sa govt ni Noy pag upo nya. Alam natin na kailangan masaya ang congreso para mapayapa ang pag takbo ng admin ni Noy at dito sa casino kinukuha ng presidente ang pakain para sa mga buhayang reps. kasama na ang militar at pulis. Tandaan natin na LAHAT ng reps ay tatanggap na ng pork barrel.

    Hindi na kailangan maglaro pa ang mga syndicato sa casino, hihingi lang ng recibo kay Genuino yan., ok na sila.

  47. The Philippines is still considered worldwide as a money launderer’s haven. Our strict bank secrecy laws have favored the criminal groups with a safer alternative as compared nowadays with Switzerland, for example, which is now working with German authorities and other EU countries to track, prosecute, and confiscate money of known tax cheats, thanks to Merkel’s pushing, shoving, and arm-twisting. Liechtenstein is following suit. That is why Spain appears to be picking up the slack. But Spain cannot sustain it, not while it is looking at EU to provide the financial buffer it needs to stave off any serious money crisis very soon. It will have to let go of criminal laundering in exchange for EU’s help.

    While it is common knowledge that offshore banks offer safe havens for dirty money, it is a myth that it is easy to open an account in say Bank of Butterfield in Bermuda or Cayman Islands. Tight Central Bank regulators in these island-nations make them safe, depositor-friendly, too. And quiet.

    As usual, the Pinoy criminal mind tops ’em all. Suddenly a lot of money is either parked in local banks if not invested heavily on bluechip issues owned by almost the very same group of cronies lording it over in utilities (water, energy, oil and gas), mining, ports and highways, or whathaveyou. Better to have physical control of the money than be at the mercy of foreign bank managers. They still have control over the casinos(at least until 2011) and it also helps to have a world champion boxer who moves his huge purse money to and fro as a close friend.

    For so long the Marcos money has been trapped in several banks abroad and despite almost 3 decades of hunting and litigation, very little progress to recover has been achieved, if any. That lesson may have taught this mini-plunderer and her giga-spouse that it would be best to keep the loot within arms’ reach.

    “I am troubled by reports that certain groups are pushing for the Commission on Appointments to convene in order to confirm the appointments of several of Mrs. Arroyo’s appointees, this while Congress is still in the process of canvassing the votes for president and vice-president.

    “The joint session has been called for one purpose – to canvass the votes, and nothing more. To focus on other matters not vital to national interest will serve no other end than to delay the proclamation of the country’s new leaders and therefore give undue disrespect to the mandate of the people.

    Napakaswerte naman niyang si Ester Feria, Trustee na sa Board ng LWUA (of which Pichay is Administrator), Pagcor Director pa. Malaki siguro ang per diem sa Board Meeting nito, dala-dalawa pa.

    Itong si Rafael “Butch” Francisco na nangangampanya noong una na tatakbong Congressman ng Pasay sa ticket ni Ding Santos na Bigkis Pinoy Movement. Buking naman sila na Lakas-Kampi kahit nagpalit pa ng pangalan. Nakatunog yata itong si Francisco na sa kangkungan pupulutin kaya umatras na lang.

    Totoo ang sinasabi ni Ellen na merong binabalak ang Donya Putot para sa Pagcor, kung hindi ay bakit nung isang taon ay pinatatakbong kandidato bilang Congressman ng siyudad kung saan itatayo ang Gamblers’ Paradise pero ngayon ay nire-appoint pa bilang President/COO. Simula nung umupo si Gloria nung 2001 ay naappoint na siyang Pagcor President/COO. Pagkatapos ma-reaapoint ay mas mahaba pa ang termino niya kesa kay Gloria. Siyempre pa, Rotarian din siya kagaya ni First Gentlepig at Genuino.

    Itong si Philip Lo ay yung naiskandalo noon na ipina-obituary sa PDI na namatay noong bago pa lang nauupo sa Pagcor. Malaki sigurto ang atraso sa taong nagpa-obit, hehehe.

    Itong kapangalan ng dating pangulong Manuel Roxas ay isang dating talunang senador ng NPC na kumandidato nung midterm election sa Ramos admin. Si Putot ang topnotcher noon at ang nakalusot lang sa oposisyon ay sina Miriam, Gringo at Coseteng. Heneral ng katulisan, er, kapulisan in yata itong si Roxas noon bago naging abugago.

    The refusal of the Congressmen to approve the Freedom of Information Act is another reason why we cannot become complacent again. There’s a real need for continuing this vigilance and watch of our Congressmen.

    Citizen Power. Watchdog groups. Congressman Mo, I-Patrol Mo.

    Let’s demand from our respective Congressmen how he/she voted on issues such as this Freedom of Information Act. Invite him/her to town hall meetings and air our sentiments and views.

    This is a continuing battle against crooks in Congress (and the Senate) who prefer to hide their votes from their constituents.

    hindi ba pag lumipat ka ng bahay..ay nililinis muna not once but a couple of times..lysol ang panglinis..at ipinafumigate pa..at yong mga duming naiwan ay sinusunog? dapat linisin ng husto kas marami pang germs na naiwan si putot..kasi marami siyang mautot at mabahong mabaho…bantayan ng husto ang mga aso ni putot at bantayan din siya at ang gamilia niya…may lason ang mga iyon..lason ang mga iyon…si gentle pig mukhang tahimik…pero the quieter he is the more dangerous he becomes..mahusay magdiskarte si taning..ang taning niyan pagibig!

  65. chi, ang Pagcor ay extension ng Rotary Club of Makati. Ang daming officers niyan ang kadugo ng First Swine at ni Jocjoc. Kanina ko lang nakita uli si Dodi King, dating spokesman ng Pagcor-Rotary. Kaya pala, promoted na bilang director din.

    Ha ha. Okay rin yan. But Gloria is manhid na to being patrolled. She doesn’t give a damn.

    So change strategy. Let’s shift the patrol to our respective Congressmen because I think they are more likely to behave if they know their votes and behavior are being monitored by their own constituents.

    You know what? This should have been our tack ever since Gloria started using Congressmen to protect her from impeachments. And this is how local voters should really go about keeping Congressmen and local officials in check.
