The swords are drawn.

President Aquino gave orders to investigate crime against the Filipino people. Pampanga Representative (2nd district) Gloria Arroyo files a resolution to amend the Constitution.

First day of the new administration and Gloria Arroyo has served notice that she won’t be just waiting for sheriffs to pick her up and dump her in jail just like what she did to her predecessor, President Estrada.

Together with her son, Camarines Sur Rep Diosdado “Dato” Arroyo,she filed a resolution calling for the convening of Congress into a constitutional convention for the purpose of amending economic and political provisions in the Constitution.

Her previous failed attempts to change the Constitution revealed that she prefers a parliamentary form of government.

In his inaugural speech, Aquino ordered Justice Secretary Leila de Lima to give justice to the Filipino people who have been wronged by the policy of impunity that Arroyo practiced during her nine years of stolen presidency.

“To those who are talking about reconciliation, if they mean that they would like us to simply forget about the wrongs that they have committed in the past, we have this to say: there can be no reconciliation without justice. Sa paglimot ng pagkakasala, sinisigurado mong mauulit muli ang mga pagkakasalang ito. Secretary de Lima, you have your marching orders. Begin the process of providing true and complete justice for all,” he said.

Aquino also announced the creation of a Truth Commission to be headed by former Chief Justice Hilario Davide which would investigate and put closure to the many anomalies involving Arroyo and persons close to her.

Presidential Spokesperson Edwin Lacierda said they are drawing up the mandate and parameters of authority of the Truth Commission that will be set up to look into allegations of corruption and abuse of power during the Arroyo administration.

Lacierda said the commission will investigate and build a case against erring government officials and not only Gloria Arroyo.
I seriously doubt if this Truth Commission is the right body to make Arroyo answer for her crimes against the Filipino people. Lawyer friends said since it will be created by an executive order, it would not have the prosecutorial powers.

It would not be as powerful as the Presidential Commission on Good Government created by President Cory Aquino to recover the ill-gotten wealth of the late President Marcos which had sequestration powers.

What is important is the political will to set an example of accountability; for official of the government to be aware that if they commit acts detrimental to the interest of the Filipino people, they would have to answer for that.

There’s a long list of Arroyo’s crimes. Number one is stealing the elections. And there’s the “Hello Garci” tapes to prove that. The body that would investigate Arroyo should ask her what she was “sorry for when she came out with that infamous, “I am sorry” video message.

When she tampered with the results of the elections with help of former Comelec Commissioner Virgilio Garcillano and a number of military officers, she not only stole the presidency from Fernando Poe Jr but she robbed the Filipino people of their constitution right to elect their president.

That’s why I am disappointed that it’s Davide that Aquino chose to head the Commission. In the first place, it was Davide who installed Arroyo to an unelected presidency, administering her oath of the presidency even when there was no vacancy to the position in violation of the Constitution. It was his court that legitimized Arroyo’s illegal presidency with that “constructive resignation” doctrine.

Davide served as Arroyo’s representative to the United Nations even after she was exposed to have cheated in the 2004 elections.
Actually, the Cha-Cha resolution may just be an added weapon that Arroyo is trying to build to protect herself. She has reasons to feel confident that she would be safe with Davide as investigator.

This was articulated by her son,Mikey Arroyo who had good words for Davide although he just mentioned the NBN-ZTE case: “With his impeccable background and given his renowned objectivity in handling issues, however controversial they are, I am highly optimistic that the Truth Commission, with Chief Justice Davide at the helm, would come out with the most objective conclusion to the NBN-ZTE saga, clearing all those wrongfully accused by those who used the GMA administration as a jumping board for their political objectives.”

Mikey further said “I just pray that if ever that happens, our critics will honor and respect the Commission’s findings and put the case to rest.”

I would be more than glad to be proven wrong about Davide. Maybe his opportunism could work in interest of the Filipino people. He showed himself to be unethical when he enlisted the help of businessman Lucio Tan to have Estrada appoint him chief justice. But when he saw the imminent fall of Estrada, he did not have qualms of executing the final push.

Who knows he would be consistent to his being a political opportunist and do to Arroyo what he did to Estrada.

    1. Truth Commission – we still do not know yet how it will operate. My opinion is that Aquino will ask Congress to pass a law which will give this Commission powers and funding. If not, it will be a fact finding body. Even as a fact finding body, it is good enough for me as it will document the scandals surrounding the last administration. Exposing Arroyo with proof and evidence, without necessarily immediately convicting her as the same will be up to Sandiganbayan, will suffice, for me.

    2. Davide – We have different view regarding EDSA 2 so I won’t dwell on it. I am sure you know that Davide was (maybe still is) a politician before he joined the judiciary. As a member of the court he knows the law well and he can be considered as a good jurist. As a politician he knows how to play his card well, being in good grace with Cory, Erap, Arroyo and now Aquino. He may have served under Arroyo but his new master now is Aquino. He knows too well the current that swept Aquino to the Presidency and I doubt, as I politician, he will go against this current. A whitewash by Davide under Aquino administration? I don’t think so.

    Another thing, those pronouncements coming from the Arroyos regarding Davide’s role in the Commission, they are wishing they will come true. Coming from Mikey Arroyo, every 10 words he utters, 11 lies come out of them.

    Sana nga. O baka tapos na ang termino ni Noynoy ay hindi pa tapos ang imbestigasyon ni Davide kay Gloria dahil sadyang patatagalin para ilibre ang kanyang patrona. Hindi ko yata magawang maging positibo kay Hilario at Berto. 🙂

    This is the looming technicality with regards to this seeming “lapse in judgement” (to quote gloria) on the part of Noynoy.

    Kung wala pang ALZHEIMER’s disease itong hinayupak na si Hilario, dapat niyang tandaan na siya mismo ang nagpa-sumpa kay gloria para maging presidente ito kahit na wala namang “vacancy” sa posisiyong pagka-presidente na inu-upuan noon ni Erap.

    So the question is, “how will Davide, with all his “imPWEHcable” knowledge in jurisprudence (as some people would say) begin his first day in the TU-RU-RUTH” commission to investigate gloria and her minions knowing fully well that HE was part of the MOB that ousted Erap ? How would he show by fucks, este FACTS (pala) that because of him (Davide), gloria would not have assumed the presidency and committed all the charges she will now have to face and for which Davide will (hopefully) find her guilty of ?

    The truth is, Davide swore gloria in, Gloria ruled, she lied, she pre-meditated a take-over, stole not only the presidency but the national coffers as well, she corrupted people and a whole BULOKRASY, was a protector of drug lords and mafia-like groups, was a criminal coddler (like herself),……..need I say more ? I could go on and on even to the extent of making shambles of her sagging boobs. But that would eat a lot of space.

    These and more just because Davide “legalized” her being a president.

    Now, what charges is Davide going to throw at gloria that he himself is not implicated ? It will be like Davide spitting up in the air and the same drops on his face.

    I’m NOT favor sa pag-entra ni Davidead sa UNTRUTH Commisyon, 101% don’t trust sa taong ito…walang pinagkatandaan sa pagiging abugago?

    Ang ginawa niya noong EDSA II e tahasang pagyurak sa dangal at pagka-abugado ngang naturingan e bopol pala sa paginterpret ng Saligang Batas o batas na siyang pundasyon ng demokrasyang bukang-bibig na dapat e maghari sa bansa.

    Kung nagawa ni Davidead ang isang pagtatraydor sa ating Saligang Batas…ano ang aasahan natin sa UNTRUTH Commisyon na yan?

    Dapat kasamang kasuhan yan ng treason at pagtatraydor sa lehitimong Pangulo ng bansa na kanilang inagawan ng kapangyarihan.

    You got a point there, igang isaganigatmaitan. The problem is, were it not for Davide, wala sana tayong minu-murang unano ngayon na ang pangalan ay gloria.

    While it would have been somebody else who might have administered the oath of office to gloria instead of Davide, the thing is, it was CHIEF JUSTICE Hilario Davide himself who, knowingly it was un-constitutional, did so anyway negating his sensitive position as the chief justice of the supreme court.

    He played GOD. And boy, he did!!! Just look at what happened to his godly creation. He created a monster out of a fucking dwarf.

    And now, without batting an eye, he accepted a position to investigate his creation and her devilish minions to find out if they indeed committed crimes against the Filipinos.

    Lucky him. He is being given another chance to play god.

    I have two words for you Hilario……..F–U !!!

    Fine. Then appoint one who is patently judicial and patently neutral. I can recommend a few:

    Justice Vicente V. Mendoza, Justice Carolina C. Griño-Aquino, or Justice Delilah Vidallon-Magtolis.

    Sabi ni Oblak sa # 1, Davide can be considered a jurist. Begging to differ Sir. Kahit wala yang Erap issue, hindi ako impressed diyan sa Cheap Justice na yan. He is not in the league of JBL, CJ Bengzon, or Alejo Labrador. I wouldn’t even rank him with the Macoy justices – CJ Ramon Aquino, or Justice Serafin Cuevas.

    Lightweight yan, sounding like a heavyweight dahil sa titulo – parang Renato Corona. Yung mga heavyweights, mabigat dahil sa kanilang erudition -like Learned Hand, a court of appeals judge quoted by the US Supreme Court. Locally, there is Turing Tolentino, Vicente Francisco, and Ambrosio Padilla.

    Come to think of it, both CJs from Cebu are lightweights – Davide and Celing Fernan. Parehong pulitiko na naging CJ.

    From Batangas, we have two – Ramon Aquino, an authority in criminal law, and Corona, appointed by the criminal in authority.

    If this Davide has a sense of decency, he should have declined the position because perceived na siya na maka-midget. Those who know a lot bout the crimes of the evil midget may just clam up because they do not TRUST the leader Davide.

  17. The gamble on Davide cuts both ways. First, we all know him to be Dr. Frankenstein breathing life to this monster Gloria. But the doctor had science behind him, not voodoo as this hilarious Davide had practiced – cutting the Holy Book that morning and eureka, the bible passage justifies the devil’s takeover at lunchtime. Talk about voracity!

    Yes he was an opportunist but it is the same opportunism that could work the other way this time. His namesake/son has the hots for Cebu’s governorship and despite the loss to Gwen Garcia last month, Hilario III, now well-entrenched in the incumbent president’s powerful LP, would surely give it a second try in 3 years. Enough time for the father to lock up the Pidals in jail and bite the hands that fed him to impress his new boss in exchange for full logistic support for his son’s take two.

    About that Truth Commission, walang mangayayri dyan unless i-authorize yan ng Congress na may power itong mag-summon ng witnesses at mag-contempt. Otherwise, wala rin credible conclusion at closure sa mga issues na iimbestigahan nito. As things stand now, mukhang walang congressman o senator ang mag-iisponsor nito even soon-to-be Speaker Belmonte will not support this idea. Kung guston nilang imbestigahan si Gloria, I think the DOJ under Secretary de Lima is the right avenue for this. After all, may arching order na sya from day one to go after gloria et. al. So sa mga ginagawa pang isyu ang Truth Commission, I think dapat maliwanagan na sila na walang pupuntahan yan. You can ask any lawyer about this.

    Gusto ko kasing matuloy ito para magkaalaman na kung ano ano ang mga milagro at kabalastugang nangyari noong nakaraang administration.

    Gigil na gigil tayo noon sa mga cover up at maneuvering ni Arroyo at mga kampon nya. Ngayong na yung pagkakataon na magkaroon ng linaw.

    Maganda rin na sana DOJ ang gumawa nito kaya lang kadami ring pending na kaso na dapat harapin ang DOJ at baka mahilaw pa ang mga resulta.

    Hayaan natin kung paano didiskarte si Noynoy sa bagay na ito.

Truth commissions are typically created by presidential decree.Truth commissions do not have the power to punish,They do not have the power to act as a judge and to summoned,to my understanding they’re a team to investigate, seek to collect evidence from a variety of sources at kung may matibay na evidensya,isusubmit nila sa DOJ o sa sangay ng may makapangyarihang ahensya para dingin ang kaso.Kung baga sa crime scence sila ang SOCCO basta’t huwag lang silang sumuko.Kung DOJ o ang sangay ng NBI ang mag-imbistiga usad pagong ang imbistigasyon baka pagbaba ni P noy sa hagdanan ng Malacanang wala pang makalap na matibay na basehan para sampahan ng dimanda ang mga sangkot sa nakaraang katiwalian.

  27. Truth commission is not a permanent position,pag natapos na nila ang inaatang na trabaho sa kanila na kung sino-sino ang kanilang iimbistigahan at maisubmit na nila ang mga report tapos na rin ang trabaho nila.

    SNV, jurist ang sinabi ko, hindi naman great or greatest jurist in the Philippines. Kung aalisin natin ang political color sa career ni Davide at ituon sa pagiging abogado/commissioner/justice hindi naman mapagkakaila na may expertise siya sa batas. Iyan ang basehan ko kaya sinabi ko na pwede syang iconsider na jurist.

    Yung other names that you mentioned, ang tanong ay papayag ba sila na maging head ng Truth Commission.

    Nakalimutan mo yatang isama si CJ Fernando sa Marcos CJ na according to you ay hindi lightweight. CJ Ramon Aquino naman, hindi ba pareho lang sila ni Davide na nagadminister ng oath sa putative president.

    Nakikiusap din sana na huwag naman yung mga sweeping statement na both CJs from Cebu are ligthweights. Maraming ways kasi to construe such statement and every which way, not pleasant.

    Ibig sabihin bayad-utang ito sa pakikikutsaba niya sa pagpapabagsak ng lehitimong gobyerno. Kasi sa totoo lamang, itong si P-Noy e huwag na siyang magmalinis kasi isa rin siyang accountable sa EDSA DOS conspiracy.

    Mapa-gloria or P-Noy…ang mga Bulong-Brigade e kabilang sila sa civil socialites community na ngayon e bubuyog ng Malacanang.

    Walang mangyayari sa kaso against gloria kung di magpapakatoto si P-Noy sa kanyang mga pangako ng pagbabago.

    Davide has no “delicadisa” in assuming the ambassadorship in the United Nations even when he was not confirmed by the Commission on Appointments.

    Davide could be competent but could he fair considering that he administered the oath to Gloria as president when there was no vacancy? How could he base his decision that Estrada resigned “constructively” through a diary of a certain person whose integrity and credibility is questionable? Was that fair?

    All politicians have no integrity and credibility. They can change their position in a wink of an eye. He was with Arroyo and now with Aquino!!! What a man. He was a jurist and now a politician. Appointing Davide is the first big blunder of Aquino’s presidency.

    No choice na siguro si Aquino. Masyado niya kasing napangako sa publiko na bibigyan niya ng katarungan ang mga kawalang-hiyaan ng mga Arroyo. Kaya siguro kinuha nila ang taong siguradong mangcconvict, hindi na bale kung credible o kagalang-galang, basta yung alam nilang susundin lahat ng ipinauutos sa kaniya.

    Sabihin nating susundin nga ni Davide ang utos na iconvict ang mga Arroyo (at idagdag pa natin ang pagiging oportunista niya), hindi ako mapalagay dahil ipinangako ni Aquino ang ‘daang matuwid’. Kung gagamitin naman nila si Davide para sa agarang pagcoconvict sa mga Arroyo + injustice (tulad ng ginawa niya kay Erap), bale wala din ang platapormang good governance ni Aquino diba? Saakin lang, the end does not justify the means.

    Hindi ko talaga mabigyan ng benefit of the doubt itong si Davide. Nakakainis.

    But the thing is, in a Truth Commission, limited ang information na pwedeng makuha nito. for example. Sa Garci Tape, pwedeng makakuha sila ng transcript nito. Pero they may not be able to summon those people na nabanggit dun sa Garci tapes, yung mga generals, yung mga election officers, etc. At pwedeng i-contest yung commission if they are summoned to appear since di naman ito ordinary court with that power. So kung incomplete ang information, how can you arrive sa truth that you want to establish. That’s why unless Congress legitimizes that commission to have the same powers as the court, then pwedeng maa-achieve nya ang purpose nya. Take note sa DOJ at sa mga courts, bago mag-proceed ang kaso dapat may probabale cause na ma-establish. I think if thae Truth Commission fails in that first step, anumang findings o efforts nito will simply be disregarded because di ito na verify especially when we speak of yung mga testimonies ng mga witnesses o nung mga supposed culprits. I think the best is to pattern after the speciel prosecuting team nung kay Erap under the Ombudsman where Erap and all those involved had their day at the Sandiganbayan where they can all defend themselves.

    The wheeling-dealing helps explain why every politicians in government since the country returned to Independence has been wracked by major scandals.Corruption seems to be an intrinsic requirement in our politics. In the United States they get away with having rotten government because they are a rich society. But Philippines is a poorer country. It has really horrific problems that need to be solved.

    Why don’t we give P Noy a chance to get rid those rotten and corrupt politicians. In his two days in office binabaklas na ng mga kinauukulan ang wang-wang kahit na tutol si Binay.Iyan ang simula ng pagbabago at sumunod lahat sa batas ng walang pinipili.

    You must be referring to CJ Enrique Fernando, the law partner of Sen Lorenzo Tañada, successor to CJ Fred Ruiz Castro who died before retiring. He turned down an offer to head a commission to investigate the assassination of Ninoy Aquino which was later taken by retired CA Justice Corazon Juliano-Agrava (Agrava Fact-finding Commission).

  39. Ang sabi ni brand-new DOJ Sec De Lima, the Truth Commission will be patterned after the Truth and Reconciliation Commission of South Africa, which investigated apartheid after Nelson Mandela came to power. I’m not familiar with that body but we all know the apartheid was put to an end.

    Although this Commission merely duplicates the functions of the DOJ, an honest-to-goodness investigative work by a group dedicated to prosecuting only the Arroyos and their cohorts puts the much needed legwork and the resources FOCUSED on a few specific crimes.

    It would have been less effective if the cases against Arroyo are allowed their routine treatment in an understaffed and underfunded DOJ/Ombudsman. The creation of this special commission and I assume, a special court later, with special funding from the chief executive, will expedite the whole process of providing justice to the victims of the Arroyo regime, which happens to be all of us.

    While they may not have the full powers of the Justice Dept., working closely together with De Lima’s department will assure that the synergy will sustain each other’s shortcomings in order to achieve a more efficient prosecution of the Arroyo crimes.

    Who can argue with that?

Short of saying that these two are respected in Cebu specially in the academe. These two, including Justice Hermosisima are sources of pride among the Cebuanos.

    Kung matantandaan mo noong mag file ng impeachment against Davide sina Erap at Teodoro (yes Gilbert), wala silang nakuhang support. Ang impeachment ay offshoot ng pagkakatalsik kay Erap. Respectable people rallied behind Davide.

    I just cannot accept that there is a perception among practioners that Davide and Fernan are lightweights. Are these practitioners also litigators? If they are, I cannot see how they can form such perception when Davide and Fernan were never trial court judges prior to their appointment to the Supreme Court. I think it was you who pointed out in previous posts long time ago about anecdotal something.

    If such is the case, then Davide is but a mere lousy mercenary garbed in a magistrate’s black robe. Meaning, he is a double-edged sword just waiting for the next big deal.

    He can be part of a de-stabilizing plot (like he did with pandak-kikay), but would be a willing snitch if he cuts a deal with the new powers would-be. The sad part is that he would surely bat to be absolved of his accountabilities as his bargaining chips for self preservation.
