Ang pangu-ngopya ay pagnanakaw

Ito ngayon ang kumakalat na joke: “Binawi ng Post Office ang pinakahuling labas nila na mga stamp. Kasi mga litrato pala ng Supreme Court justices. At ang dinuduraan ay mga litrato ng mga justices.”

Ito ay galing sa Facebook ni Ferrum Mann.

Ganyan na ngayon ang tingin ng taumbayan sa mga justices ng Supreme Court lalo na sa kanilang desisyon na idismis ang isyu tungkol sa pangungupya ng isa nilang kasamahan si Associate Justice Mariano C. del Castillo sa ibang desisyon ng mga banyagang abogado at ipinasa niyang kanya. Ang krimen ay tinatawag na “plagiarism.”

Ang plagiarism ay pagnanakaw. Kinukuha mo ang ideya ng ibang tao at inaangkin mong iyo. Di ba klarong pagnanakaw?

Itong kaso ng plagiarism ay nangyayari dahil ay ang mali ay pilit pinagtatagpan ng isang mali sa halip na aminin ang pagkakamali.

Ito ay nagsimula sa petisyon na isinampa ng 70 na comfort women, ang mga kababaihang Pilipino na ginahasa ng mga sundalong Hapon noong giyera. Ikinulong sila at ginawang silang parausan.

Sa pamamagitan ng kanilag abogadong si Harry Roque, humingi sila ng tulong sa pamahalaan na tulungan sila sa kanilang claim laban sa pmahalaang Hapon. Sabi kasi ng gobyernong Hapon, ang kinaki-usap lang naming ay pamahalaan, hindi indibidwal na tao.

Ang unang mali ay ayaw ng pamahalaan ni Arroyo na i-sponsor ang claim ng mga naabusong Lola. Sabi kasi ni Foreign Secretary Alberto Romulo, magagalit sa atin ang pamahalaang Hapon. Hindi na tayo bibigyan ng ayauda. Mali.
Kinampihan ng Supreme Court ang Malacañang. Yan ang pangalawang mali.

Ang pangatlong mali, nangopya si Del Castillo sa ibang author para suportahan ang kanyang desisyon. Ang masakit pa nito ang kinopya niyang mga salita ay nagamit yun sa desisyun na salungant sa desisyun niya sa Filipino comfort women.

Nag sumite ng supplemental motion si Atty. Roque sa Supreme Court at sinabi na nangopya si Del Castillo at pinakita niya ang pruweba. Kung ikaw ay titser, ano ang gawin mo kapag nahuli mong nangopya ang isang estudyante? Di ba parusahan?

Hindi yun ang ginawa ng Supreme Court. Iyan ang pang-apat na mali. Walang kasalanan si Del Castillo, sabi ng Korte Suprema. Ang may kasalanan ay si Bill Gates dahil ang Microsoft program niya ay hindi naisama ang pinagkopyahan niya nang nag “cut” and “paste” ang reasearcher ni Del Castillo.

Ngunit hindi huminto doon. Dahil nagpalabas ang mga titser sa University of the Philippines College of Law ng pahayag laban sa pangungupya ni Del Castillo, sila ngayon ang gustong parusahan ng Supreme Court. Binigyan sila ngayon ng order na magsumite daw sila ng rason kung bakit sila hindi parusahan. Iyan ang pang-anim na mali.

Naninindigan ang mga titser sa UP. Ano ngayon ang gagawin ng Korte Suprema. Para silang naghuhukay ng sarili nilang libingan.

    Bwahaha…2001 pa po biglang naglaho ang tiwala ng Masang Pilipino sa Korte Suprema, since na manghudas si CJ Davide pa nanumpain ang isang triggerhapi na Labandera?

    Hangga’t may hoodlums in uniform na kabisote sa Batas na Kanilang minaster e…mahirap ipagkatiwala sa kanila ang kinabukasan ng Bansa at kapalaran ng Sambayanan Pilipino.

    Ngayon ang isyu e pangongodiko…ang alam ng lahat e during our school days lang ito…he he he, ibig sabihin itong si AJ Del Castillo e mangongopya lang sa ibang atorni e bokya pa?

    Yaks…e demote yan at malaking insulto yan sa lahat ng mga practicing lawyers sa ating bansa…dapat sa kanya e atorni de kampanilya…at nababagay sa kanya e sa ilalim ng puno ng Acacia…tabi ng Munisipyo at dala ang isang makinilya.

    Kung puwedeng mangopya at mandaya, huwag nilang sisihin ang mga law students o bar examiners na mandaya din. It’s a shame. What used to be the most respected institution is now the most distrusted. Thanks to Davide and Gloria Arroyo.

    Kung ako ang tatanungin, dadalhin ko sa kalye ang bagay na ito. Tiyak na marami ang makiki simpatya at sasali sa gagawin kong protesta sa kalye. Uma abuso na ang ating korte suprema. Ito na lang ginagawa ni Corona ay sobra na. Kaya tama na. Dapat tapusin na.

    In the midst of the general despair arising from the plagiarism issue involving a Supreme Court justice and his absolution from his peers there is a sliver of hope still left in the refusal of a judge to accept P50,000 monthly from the local government units if only to maintain his independence and integrity as a judge.

    “Regional Trial Court (RTC) Judge Gabriel Ingles of Branch 58 has opted to waive his stipends from various local government units to maintain judicial independence.”

    ano mangyayari sa isang bansang ang chief injustice ay magnanakaw ?

    katungkulan ng bawat mamamayan na tanggalin sa gobyerno sila corona-rroyo at iba niyang kampon ng panloloko, dahil sila ay kaaway ng bayan.

    I think someone should do a diligent search on Del Castillo’s previous court rulings and speeches he has written even before he was SC justice. I was thinking, if he can do it (plagiarize) now that he is a SC justice, what more when he was still a trial court judge.

    Mike, someone should make halungkat of del Castillo’s decisions during his heydays as a trail court, baka hindi lang xerox ang nakatago dun…pati bayad for each decision in favor of clients who could pay. Who knows?

    Come now folks, we didn’t really expect any of gloria’s alter-egos to be any different than she was, did we ? Del Castillo’s benefactor was an asshole so he too is an asshole. And so with Corona et al.
    The so-called final arbiter of the law……..the court of last resort has now become a liability. The men and women in black robes are in reality the glorified executioners of those opposed to gloria’s and davide’s tenets.
    Plagiarism = pagnanakaw……this gives a new meaning to gloria’s being one herself.

    Grabe talaga. Maraming iniwan na mga basura si Gloria. Mahirap linisin iyan maliban na lang kung umpisahan linisin si Gloria. So, President Noynoy should now start working on Gloria’s tons of cases committed against the people of the Philippines.

    Well, what would you expect guys? If the leader of the past admin (Goyang) cheated and got away with it, would not her lesser leaders follow and do the same?

    From her cabinet members, allied tongressmen, appointees in PRC, judiciary, and all branches of govt. that pattern (cheating, stealing, robbing, manipulating, name it) had been the norm of conduct (it’s really misconduct, guys).

    Just read Rodel Rodis and you will know why.

    Am now beginning to see why pinas cannot move forward. Why not punish those cheats? or send del Castillo to hell!

A “short cut” would be for the president to get the full support of the military and “martial law” style round up Gloria and her minions, put them all in jail for plunder and continue the “purges” on all levels, dissolve the SC, create a new one, jail the ombudsman, and further round up all the senators/congressmen associated with her…
    A “cleansing” would be easy to sell this time to the military and to the masa, focusing on corruption and how it has made life miserable for the poor and wveryone else…
    All this giving rise to a new order, a new society, where democracy can flourish once more…but then, would this not defeat the purpose of democracy in the first place?
    Its this despotic but with good intentions alternative or more politicking, wheeling and dealing, etc, gaining an inch, losing one, gaining again, until we see some semblance of change…
    Nine years of the good life will be difficult to give up, already there are corners defending even the GOCC’s former lifestyle attacking the president’s move to cut their previous windfall…
    …the world is going through challenging times, its not just us, but I believe we can survive this by working together, focus on the essentials, cut back on the non essentials…
    …Gloria behind bars will send an effective and efficient message to one and all, now even more so, as she and her minions are flexing their muscles to show they are still in control – lets once and for all show them they are not!
    …in the meantime, why not up the ante? expose her some more, repeat the scandal details, talk about them in the pulpits, in the streets, in the papers, in the radio – why the ominous silence?

    It is clear that plagiarism is committed here. Plagiarism, while morally reprehensible isn’t a crime. So how is the Supreme Court’s ruling unacceptable while Aquino’s exoneration of his close friends is not?

    “Michelle Juan was a lawyer of the Romulo Mabanta Law Office who joined Justice Del Castillo. She taught legal research at the Ateneo Law School. She was editor of the Ateneo Law Journal. She was third in her 2002 law class.

    “She placed fourth in the 2002 bar examinations. She went to New York University to earn a master’s degree in International Legal Studies.

    “She was with the wife of Justice Castillo in the Romulo Mabanta Law Office.

    “A witness during the first hearing of the ethics committee where media was banned told us that Michelle Juan became hysterical when she was testifying. She admitted having made the mistake.

    “The decision said Michelle Juan apologized. I am sure she did.”

    Aquino had the prerogative and moral capacity to punish his underperforming friends, while the Supreme Court can only act on a judicial capacity. The comparison shows that Aquino looks worse than the SC.

    it maye be profitable to know about the legal status of plagiarism and its distinction from copyright infringement.

    The difference is an answer to the question why plagiarism is a grave offense only within the academia while the Entertainment Industry can drag you to court if you illegally download an mp3 file of ‘Imagine’.

    It would be interesting to check documents of past Justices and also those from Congress. It seems highly improbable that only del Castillo committed plagiarism.

  31. I won’t go technical with you on this. Plagiarism IS a crime. Printed articles and books (protected by copyrights) fall under intellectual properties (You can’t sell someone else’s work). If you take my intellectual property (like any property) and use it as your own, didn’t you steal it? Hell, you may not be selling it (yet) but isn’t the misrepresentation also fraudulent?

    And this issue isn’t against Noynoy, reserve that for later, we may even be on the same side.

  32. Sayang si Michelle, Hugo Grotius Scholar pala sa NYU. Sa Ateneo, wala na yatang LLB (Bachelor of Laws), JD lang (Juris Doctor) o Doctor of Laws. Kaya naman pala dinodoktor ang mga desisyon.

    the solution is simple yet a difficult one – prosecute gloria, make her an example, see if her minions will not slither in their holes or run with their tails between their legs?

    Korek, dapat focus lang sa current issue(s) at tuldukan ito one by one para naman may ending ang istorya.

    If na hahalukayin pa natin ang ka ek-ekan nila sa baol ng nakaraan e walang katapusan ang kwento…aid of legislation diyan magaling ang mga mambabatas kaya heto puro imbistiga at wala namang closure ang isyu di ba?

    Dapat bigyan natin ng kalayaan ang hustisya na humatol ayon sa katotohan ng ibidensya…ang kaso, bokya na e gawa pa ng alibi to correct their mistake(s) at gusto pang mangdamay ng ibang tao.

  38. Naiwan ka na ng biyahe, NFA. Ano’ng personal opinions? Scholarly work ‘yung kinopya. Pinaghirapan, pinag-isipan, ni-research, pinagkagastusan pa siguro.

    Nabasa mo na ba yung IPR Law? Merong exceptions doon hindi kasama yang binabanggit mo. Halimbawa? Yung desisyon sa korte, hindi yun covered ng IPR o Copyright, kaya malayang kinokopya yan ng mga abugado at huwes. Pero yung articles ni Criddle, Fox-Descent, Tams at yung isa pa, produkto nila yon.

    Para madali ang problema mo, itype mo na lang sa Google “why Plagiarism is a crime” – hindi mo na kailangan pang basahin yung resulting pages, sa search results pa lang nandoon na ang sagot.
