Lacson family appeals for justice

Justice still eludes himThe case of Sen. Panfilo “Ping” Lacson, who is the subject of an arrest order is gross injustice inflicted by Gloria Arroyo not only on the senator but on the Filipino people.

It cannot be denied that the many expose of Lacson contributed to the unpopularity of Arroyo which eventually caused her being sidelined from power today. It is therefore sad that Justice Secretary Leila de Lima is allowing herself and her office to perpetrate the injustice instead of reversing it.

The Lacson family has brought the plight of the beleaguered senator to the Filipino people with an open letter detailing the blatant inconsistencies in the prosecution’s so called “evidence” . The letter is signed by Romulo Lacson, Feliciano Lacson, Reynaldo Lacson,Juanito Lacson, Ma. Corazon Lacson-Magpayo,Ernani Lacson, and Ma. Cristina Lacson-Diaz.

“In every Filipino family, two things are most treasured: honor and home.

“Our brother, Senator Panfilo “Ping” Lacson is accused of masterminding the murder of
Salvador “Bubby” Dacer and his driver. The principal evidence against him that the
previous administration’s DOJ investigating panel and the court considered “probable
cause” was an affidavit by a lone witness, Cesar Mancao.

“ In that affidavit, Mancao narrated a supposed conversation inside a car between Ping and Michael Ray Aquino wherein Ping allegedly ordered Aquino to have Dacer murdered. He claimed to have overheard the conversation while seated at the front seat of the car next to Ping’s
driver, Reynaldo Oximoso, while Ping and Aquino were at the backseat.

“To establish “probable cause”, the investigators and the judge must find the evidence
credible. It must lead a reasonable person to believe that the person being accused
committed a crime.

“We believe that a careful consideration of the following facts will lead reasonable
person to a conclusion that Mancao’s allegation in his affidavit was a fabrication and an
absolute lie…

“In our last Christmas together, Ping already told us of frantic moves of the previous
administration to have an arrest warrant against him. He told us to take comfort in the
fact that he had nothing to do with that crime.

“Before the warrant for his arrest came out, Ping decided to become inaccessible. That
was his personal decision. We understand that it had nothing to do with guilt or
cowardice. He had enough information to base it on. For one, he knew then that the
RTC judge was an applicant for promotion to the Court of Appeals. An evil trap was set
by a perceived corrupt administration and it was about to be sprung on him.

“Subsequent events validated his belief. On Friday, February 5, 2010, the RTC judge
issued a warrant of arrest against him. On Monday, February 8, 2010 the Judicial and
Bar Council recommended the judge to President Arroyo and she was promoted to the
Court of Appeals one month later.

“Ping became unreachable to avoid being a victim of an evil conspiracy to put him away
because of his anti-graft and corruption crusade. Self-preservation is a natural human
instinct. He did not regard letting evil triumph as an act of decency.

“A person is presumed innocent until proven guilty. But with a non-bailable crime like
murder, the reality is that punishment comes before conviction. The accused suffers in
jail while a court trial is ongoing to prove his guilt or innocence. Our Constitution says
that the right to bail can be denied when the evidence of guilt is strong. In the case
filed against Ping, the evidence is not only weak; it is fabricated. Just one affidavit with
a conflicting story by a witness of doubtful credibility against multiple exonerating
affidavits and statements, including two previously made by the accusing witness
(Mancao) is why we say it is.

“Therefore, we are extremely puzzled why DOJ Secretary Delima continues to ignore calls
for a reinvestigation of this case. According to the DOJ secretary’s interviews, she is
waiting for additional evidence to start such a reinvestigation. If the foregoing facts are
not enough, we do not know what else would justify a reinvestigation. We can only
guess that public prosecutors at the DOJ who had a hand in filing this case are giving her
the wrong counsel.

“A friend sent this message: “From dark clouds, we get precious water. From dark mines,
we get valuable jewels. And from our darkest trials come our best blessings from God.”

“This we believe in. We believe that justice and truth will ultimately prevail in God’s own
time. Until then, we would like to express our gratitude to those who understand and
sympathize with us.”

  2. This is outrageous… Gloria and her partner in crime, Jose Pidal aka Mike “the pig” Arroyo, Sr, knew that if they didn’t do anything before power slipped from Gloria’s dirty fingers, they stood to find themselves in prison if they allowed Ping Lacson to remain free.

    So what did the most despicable couple in recent Philippine history do? They rigged everything! They wiggled their way through the corrupt Philippine justice system and instructed their henchmen to issue a warrant for the arrest of the only person who’s had the balls to run after the Pidals!

    The arrest warrant should be issued against the Pidals (Gloria and Mike Arroyo) and not against one of the two bravest senators the country ever had. (All the other senators today are scumbags and shits!)

    And to those who say that Ping Lacson should surrender, I say to them bullocks, bullocks, bullocks again! What for? To face the corrupt justice system in the Philippines, the same justice system that is littered with the bad grains that Gloria and that shithead Mike Arroyo had sown before they left Malacanang?

    This is a country where true bravery and courage are a rare commodity… Don’t waste this opportunity — you have a senator who’s fought well to nail the hideous and despicably corrupt couple that ruled the Philippines in recent times… He stood there alone while many of the Filipinos didn’t even lift a finger to help him nail the corrupt couple. Be one with Lacson! You might not see another one like him in your lifetime again.

    Thats has a very big difference you pointed out there… OFW’s flew out the country to look for money and come back resurface again… for Ping, he flew out the country to escape and avoiding the legal procedure from our justice system… He said at first before May 10 election, he said he will never trust the Pidal Administration and he will only trust the administration he endorsed and fortunately won the presidential election, now its the Pnoy Administration….Now,its been almost 6 months that the person he endorsed and gave support is now the President of the Philippines… Where was the trust that he said?

I advise Sen Lacson to ensure that he gets a fair treatment in the sense that they will not arrest nor imprison him when he returns to face the shitty justice system of this country before he returns. An official document must attest to that (hopefully issued in good faith — putangina talaga, difficult to trust anyone in this govt!!!)

    Obviously, there is no guarantee that a signed document even by the highest officers of this God-forsaken justice system will be honoured (I doubt in the honourability of people serving in this govt, particularly those who serve in the courts, save perhaps for one or two)… there’s really little one could do in the justice system that’s gone to the dogs. But better to have a letter signed and sealed — better than no guarantee at all.

    I reckon de Lima is under extreme pressure by a huge portion of the political and justice system (who happen to be goddamn remnants of Gloria’s corrupt government) not to do anything of the sort.

    Either she believes that Gloria’s vendetta operations against Ping Lacson are morally and legally right (they’re the truth and nothing but the truth), hence Gloria’s anti-Ping stand remains and Ping should be arrested or in her conscience believes that Gloria’s orders are morally and legally flawed, hence need to be re-examined. To me it’s as simple as that.

    Where has this country’s moral courage gone? There are very, very, very, very, very few people in govt today with moral courage. Physical courage is easy… even our cowardly police say they’ve got physical courage but moral courage? NONE whatsoever! This country’s enormous political and justice machineries don’t possess moral courage.

    No wonder this country is still in deep shit!

    I’m not the only supporter of Lacson here… Thank God. There are old Ellenville residents here who support Lacson and thank God they are not swayed by primitive perceptions that appearance of guilt means someone is guilty.

    It all comes down to the same basic question of asking if Ping was not the mastermind, who was? Same thing we asked about Ninoy assassination…if it was not Marcos, then who? Or we could make a funny conclusion that Dacer and Corbito killed each other.

    Ping used to be with the most feared MISG during the Marcos regime under the then notorious Col. Abadilla. He was an expert in intelligence operation. Sources close to him said Ping himself does not pull the trigger since he had no heart for that; but he ordered his men to do the job. It’s because of this background that he has which led people to suspect him to be the mastermind.

    But implicating Ping would also link Erap. If the two were innocent of the murder, then we could point to another guy who operates silently and effectively. He’s no other than the traitor of the century, former Pres. Fidel Ramos. FVR’s hit man was and still is Gen. Almonte. When can go on and on not knowing the truth. The only way we would know is to allow Ping to come out unconditionally under the custody of the Senate; then conduct another investigation. If there’s no closure, why be bothered since even Ninoy’s, JFK’s murders have no closure yet.

    Of course they refused. You don’t expect a US gov’t official to do that. They’d be accused of meddling in a purely domestic problem of a foreign country. I think the US official documents submitted and certified by no less than the US Sec. of State would suffice. I don’t see any reason why the US officials would fake the report requested by the NBI.

    Hubert an addict, spoiled, etc.. are mere speculations and was sensationalized by the media. He denied and never admitted of being an addict. While Alfaro, an NBI asset has admitted in public that she is a drug user. She also has a brother who was in jail that time on drug related charges and was freed after Alfaro testified against Hubert.

This habit was confirmed by no less than his long time yaya. I’ve been supportive of De Lima by suggesting that she be given some time to clean up the mess of the past DOJ leadership. De Lima was a former Human Rights Commission Chairperson. She was tasked to oversee human rights cases and protect victims of human rights which makes her more than qualified to head the DOJ. And she’s not afraid to differ in her opinion with the President.

    On the other hand, check yourself. You’ve been consistently attacking Noynoy and defending Gloria. Do I need to say more?

    The way I understand it, technically, the defendant waits ad infinitum until a date is set by the courts to prove his guilt or innocence. Ang problema, the case goes on limbo until that set date, at pag minalas-malas ka one would have already served his time before the case is even heard, depending on the gravity of the case (ewan ko, like I always say, I am not a lawyer so please correct me if I am wrong). And if the case is heard at all and you have the likes of Merceditas Gutierrez to handle your case, one would expect a never-ending hearing dates with no end in sight. Meanwhile one rots in jail——–and that does not yet include the actual sentence, if at all.

    Reminds me of case wherein a child is being contested as the legitimate offspring of two claimant mothers. The case dragged on for so long until the day of the hearing resumed for resolution. Before the proceedings began, the judge asked the gallery present as to other people who might be directly involved in the case to please stand up. A very frail man in his mid-90’s slowly stood up and the judge asked, ” sino po ba kayo at ano ang kinalaman niyo sa kasong ito”? Without blinking his tired and weary eyes, the old man said, “Ako po yung batang pinag-awayan noong dalawang nanay na gustng angkinin.”

    Recall (cancel) the Arrest Warrant on Sen. Lacson, Re-Investigate the case, Dig deeper into the testimony of Mancao the timing especially. Then perhaps Sen. Lacson would surface and face whatever charges, they may deem appropriate, and I doubt if ever there will be any.

    I find it incredible, that Mancao would implicate Lacson in the car conversation, when Lacson was with ERAP and Sen. Roxas in New York during the “said conversation” that Lacson and Michael Ray had, which was supposedly overheard by Mancao. Timeline and probability of Lacson being in both places (New York and Manila)_This is quite impossible to achieve. Neither Houdini nor James Bond can be at Two different places at the same time. No One for that matter.

    Could it be that they (present govt) is being hard on PL because, PL would put a stop to the shenanigans and fauxpass that PNoy and his team have been committing?

    Fair justice and level playing field from PNoy? Somehow I doubt this.

    Sec. De Lima is in a “situation” that I think she needs to play the game at this particular issue.

Sabi nila may mga buto daw nina Dacer ang nakita sa scene of the crime. Pero maaaring mga buto ng aso iyon. Uso pa naman ang Botso ngayon.     My suspicion here is that they can’t start to prosecute Gloria because the Truth Commission doesn’t have the force of the law. Sure De Lima’s department is part of that commission, but having a commission subordinating the DOJ looks unconstitutional. This is the reason why I want it scrapped and be replaced with something substantial.

    If Aquino wants to have Lacson’s case reinvestigated, he can simply give De Lima the order and start things running. I don’t believe De Lima acts independent of Aquino, and that would be unfair for De Lima to blame her for not doing what she is not ordered to do.

    When there is doubt, the sensible thing to do is to look again. Aren’t they the “new and compelling reason” cited by the law and the rules of court to reinvestigate the case? If the reinvestigation shows that Lacson had any participation in the murders, then he can be charged again, arrested and detained. But if he had no role in it, it would be a miscarriage of justice to arrest and detain him along with the criminals he had sent to jail.

    Alam ni De Lima ang pangako ni Aquino nung kampanya tungkol sa hustisya – ipakulong si Arroyo.     Yes it is twisted logic based on the twisted premise that the accused can simply demand the case against him dropped, simply because he won’t face the charges. How can a reinvestigation happen if he doesn’t surface?

    So Lacson is not Aquino’s priority, so no reinvestigation after all?

    There are only two sides at play here. One is Lacson who seems to be above the law by virtue of his hiding skills and the other the president who doesn’t seem to care. And if my disgust at Lacson and the president’s ineptness makes me a Gloria fan, so be it.

    She was asked her opinion on the Trillanes case and her recommendation was just to wait for the decision of Judge Pimentel.

    Siyempre naman ang pinagawa niya ng recommendations were the prosecutors persecuting Trillanes. Kaya yang sina Fadullon and Navera ngawa ng ngawa when the amnesty proclamation was released.

    And people who we were led to believe have a better sense of discernment and dignity, honour, moral courage, still cater to the whims of this ugly woman! Just unbelievable!
