Sen. Antonio Trillanes reiterated today (Dec. 23) his support for President Aquino in his first visit to the Senate since he was elected senator in May 2007.

After almost 7 years and 5 months in prison,Sen. Antonio Trillanes IV is finally free.

He stepped out of his detention cell in Camp Crame at 9:24 p.m, Dec. 20 (Monday). His release was made possible by the order of Judge Oscar Pimentel to turn him over to the custody of the Senate.

Trillanes statement:

Likewise, I thank my family,friends and supporters who patiently stood by us through this long and difficult journey.

Trillanes a victim of betrayal: Robles

The release of detained Sen. Antonio Trillanes IV was long overdue since he was a victim of a “betrayal” by the Arroyo administration, according to a member of the Feliciano Commission tasked to investigate soldiers’ grievances that led to the 2003 Oakwood Mutiny.

In an interview, retired Commodore Rex Robles said Trillanes should have been released long ago since he has already been punished enough after being incarcerated for 7 years during the term of former President Gloria Macapagal Arroyo.

“I think it’s a long time due…It’s because they were victims of a betrayal. They are not being punished for the real offenses they committed. As far as I know and I can see, they already served the punishment for the true offense they committed,” he told ANC.

In a separate interview, he said the betrayal involved an alleged agreement between the Magdalo Group and then General Roy Cimatu who had negotiated the return to barracks of the more than 300 soldiers who participated in the Oakwood Mutiny. Under the agreement, only 5 leaders of the uprising would be tried under the military justice system while the rest of the soldiers would be freed.

“It was not appropriate that they would all be treated the same because the enlisted men only follow their superiors. They should have been freed under the principle of command responsibility,” he told abs-cbnNEWS.com.

Robles said President Arroyo reneged on her word and said she never authorized Cimatu to make that kind of deal. He said the mutineers were charged with rebellion and coup d’etat cases before military and civilian courts while Cimatu “hid from view and fled to the Middle East.”

“Ang sabi ko – masama ang ginawa ng gobyerno. Bakit ka makikipag-negotiate and then not keep your word? And then, why would you put the same person [Trillanes] in prison for 7 years?” he asked.

Heated debate

Robles said Justice Florentino Feliciano, chairman of the 6-man commission, and Capt. Roland Narciso, a member of the commission, had a heated debate about the inclusion of the alleged “betrayal” in the official Feliciano Commission report.

“Feliciano even threatened not to sign the report because Narciso wanted it in the final report,” he said.

According to the final Feliciano Commission report, there were varying accounts of the details of the discussions with the rebels due to the large number of people present at different stages of the negotiations.

The report noted that a military framework defined the terms of the agreement, i.e. that “the core group would bear full responsibility for the incident under military law while the followers would be processed according to the Articles of War.”

Mutual ignorance

However, it said the discussion between Cimatu’s group and the Magdalo leaders was a classic case of “mutual ignorance” of applicable laws since both sides were unaware of Article 134 of the Revised Penal Code that penalizes coup d’etat.

“Some have alleged that differences in the interpretation of the terms of the return to barracks agreement by the rebels, by the negotiators, and by the civilian prosecutorial agencies of the government may have created a perception that the rebels were ‘betrayed’ by the filing of charges in civilian courts,” it said.

“Assuming this sentiment exists and if it becomes widely shared by officers in the AFP, it could become a tool of recruitment and tend to discourage future negotiations with the government in a similar situation,” it added.

Thankful for amnesty

For his part, Robles said he is just thankful that the amnesty order from President Benigno Aquino III allows Trillanes to walk free after 7 years in jail.

He denounced critics who said Trillanes should not be freed since he had yet to admit his guilt for participating in a coup against President Arroyo.

“It’s like nitpicking. You mean there should be a time when it’s granted or not? An amnesty is an amnesty is an amnesty. It means forget everything,” he said.

All I can say and hope for, is for the Senator to be guided by a moral compass, forged by his “meditations” inside his cell, to realize and follow through with what he just released to the media until he’ll bite the dust! By why the “OUR” and not the “I”?

    When I said I reserve my judgement of Pnoy for a later date. I can say that he means well for the political prisoners. I also see his genuine intent to turn the country around. Gusto ko rin na siya mismo ang nagsasalita sa mga press conferences and interviews and not his side kicks who had given him so much troubles earlier on. If you remember, the bitch used to have Ermitanyo, Galis (Golez pala) and Liar (Lie Fajardo) talk for her. Si Pnoy, straight from the heart talk. I still reserve the right to criticize him later though…heh,heh,heh. So far, I like what I see. Yun lang kay Usec DILG ang hindi ko nagustuhan,the handling of the hostage crisis, yung pagbibigay niya pati ng billiones kay midget na pork barrel (what was that? a payment for making him win?) and some other small stuff. But reaching out to the political prisoners at a time when everyone should be merry is one of his biggest good deed. Keep it up Pnoy!

    The first sentence, I think, speaks of his experience as a soldier, a field commander, and intel gatherer. It would be safe though to assume that most of the legwork in this task will be done by his former comrade-in-arms as he is now preoccupied with his official duties in the Senate. What he will get are second hand intel reports from his colleagues who will be actually “on the ground”. Will this be good or bad? It remains to be seen on who will be the “corrupt” that will be indicted and incarcerated based on this self-imposed task. I will wait and see.

    The second sentence speaks of the purity of his intent and resolve to help the Prez in his anti-corruption campaign. He will gather info and relay it straight to the Prez. The assumption of course is for the Prez to use the pieces of info to prosecute the corrupt and put them away. The senator will not use those for self-aggrandizement, specially through the media.

    I do not doubt the good intent of the senator to help the prez, I can only hope that his intel gatherers will be very objective, not selective, definitely not on a witch hunt, fair, professional, and accurate. I hope that in this scenario the prez will use the end-product and go after the “documented” entrenched kurakots, otherwise it will only bring frustration to the senator and to the boots “on the ground” and I hate to see the “Magdalos” get frustrated during the watch of Prez Noy! (wink wink!)

    The good news: Makati Judge Oscar Pimentel who is hearing Marine Capt. Nicanor Faeldon’s coup d’etat case has allowed him to post bail when all he wanted was provisional liberty similar to what was allowed Sen. Antonio Trillanes IV.

    The bad news (with a little bit of OA thrown in): Faeldon said he was happy to have been allowed to post bail but he cannot afford the P100,000 bail bond. (He would need P10,000 for a bondsman to put up the cash bond.)

    Faeldon who is restricted to Marines headquarters in Fort Bonifacio couldn’t help putting in a few digs of his own.

    “Yung bail mas maliit pa nga yung bail ng mandarambong na heneral kesa sa akin,” he added, referring to now retired Maj. Gen. Carlos Garcia, who has been charged with plunder for amassing some P303 million while he was AFP comptroller. Garcia, who was allowed to plead to lesser offenses under a bargaining agreement, posted bail of P60,000 last Saturday.

    Faeldon said friends have offered to help raise the funds but it was still not enough. He said he could raise the amount after Christmas.

    Last week, Pimentel granted the petition for provisional freedom of Trillanes who is among beneficiaries of an amnesty proclamation of President Aquino. Trillanes is now under the custody of the Senate.

    Trillanes and Faeldon were among leaders of the Magdalo group that staged the Oakwood mutiny in July 2003. They were also key participants in the standoff at the Manila Peninsula Hotel in November 2007.

    Faeldon first escaped in December 2005. He was recaptured in January 2006 but managed to escape again at the height of the Peninsula standoff.

    He surrendered to his superior last July.

    Faeldon is facing a charge of rebellion before another Makati court for involvement in the Peninsula incident.

    He is also facing charges before two military tribunals for the Oakwood and Peninsula incidents. – With Victor Reyes
