Reyes got P50M as ‘send-off’ money, says AFP exec

A former budget officer of the Armed Forces of the Philippines (AFP) on Thursday accused former Defense chief Angelo Reyes of receiving not less than P50 million as “pabaon” (send-off money) when he retired as military chief of staff in 2001.

“Upon retirement we give some amount to the retiring chief of staff,” bared former Army Col. George Rabusa during the Senate hearing on the controversial plea bargain agreement entered into by former AFP comptroller Maj. General Carlos Garcia and the Office of the Ombudsman.

Other highlights of the hearing:

-Special Prosecutor Wendell said in the light of the Rabusa testimony they may re-open the probe on Garcia.

-“I’m not applying to become a state witness,” Garcia said when asked by Trillanes the possibility of changing his mind and cooperate with the government.

Rabusa said he and then AFP comptroller Lt. Gen. Jacinto Ligot, his superior, personally brought the money to Reyes at the AFP chief of staff quarters dubbed as the “White House.”

He said since it was “very bulky” to carry the P50 million, they had it converted to dollars.

The military on Thursday admitted the practice of giving millions of pesos of “pabaon” (send-off money) to retiring chiefs of staff, but said the illegal practice is no longer being done.

“It doesn’t happen anymore because of the innovations that were done, that were undertaken after the General Garcia case came out in the open,” said Armed Forces of the Philippines (AFP) spokesman Brig. Gen. Jose Mabanta.

Garcia, a former AFP comptroller facing a plunder case before an anti-graft court, is accused of amassing over P300 million in ill-gotten wealth while he was in active service.

Mabanta said the practice stopped with the abolition of the office of the AFP deputy chief of staff for comptrollership (J6) in 2004 following the Garcia scandal. J6 was replaced by the office of the AFP Resource Management Office, office of the AFP Management and Fiscals Office, and the office of the AFP Internal Auditor.

“A lot of things have happened to the comptroller. From a very big office, it was divided into smaller offices. One of the intentions of this is to show there is check and balance, not one office will decide on the financial issues,” said Mabanta.

Mabanta made the statement after former Lt. Col. George Rabusa, a former military budget officer, accused former AFP chief Angelo Reyes in a Senate hearing of receiving P50 million of send-off money upon his retirement from the military. (Read more)
Military sources described the send-off money as “the uncalled for practice being undertaken by a particular chief of staff and the comptroller division.”

“Wala sa record pero diskarte lahat ng comptroller yan. Walang ibang nakaka-alam [niyan] kundi and CS [chief of staff] at comptroller lang,” a ranking officer told GMANews.TV.

(The amount is not entered in records but the comptroller knows it. Only the chief of staff and the comptroller know it.)

The same sources, however, said that the “practice” does not automatically apply to all chiefs of staff.

Converted cash funds

Rabusa, who hinted that Reyes was not the only chief of staff who benefited from the “pabaon” practice, said the money came from the AFP’s Provision for Command Directed Activities (PCDA), which is pooled from the different units within the military organization.

“When he (chief of staff) retires during his tenure . . . the balance in the PCDA are all converted into cash and given to the retiring chief of staff,” he said.

Rabusa, who was called to the Senate inquiry by Senate President Pro Tempore Jinggoy Estrada, said chiefs of staff also get around P10 million monthly while in service, half of which supposedly goes to their pockets.

Calculating the amounts, Estrada said Reyes probably received around P100 million during his 20-month tenure as AFP chief of staff.

Rabusa said others on the PCDA’s payroll were the office of the vice chief of staff, which allegedly received P1.5 million; deputy chief of staff, P1.5 million; secretary of joint staff, P1 million); personnel of the House legislative office, retired generals, and members of the Defense Press Corps, among others.

Rabusa said former AFP chiefs of staff Gen. Diomedio Villanueva and Gen. Roy Cimatu, the current ambassador to the Middle East, also received P10 million each as “start-up” funds when they assumed office.

Denial

Ligot, for his part, repeatedly said during the inquiry that he could not remember being with Rabusa when they allegedly gave the money to Reyes.

“I’m trying to recall, hindi ko po talaga maalala ang specifics (but I really can’t remember the specifics),” he said, even when Estrada threatened to detain him at the Senate until he remembers giving the money to Reyes.

Reyes, on the other hand, denied Rabusa’s accusation and said he never asked anything from him.

“Hindi ko po natatandaan na tumatanggap ako ng ganyan. Hindi ako santo (pero) hindi po ako tumatanggap ng iligal (I don’t remember receiving anything like that. I am not a saint but I don’t accept anything that is illegal),” he said during the hearing.

Reyes, however, admitted that his office received a certain amount of funding, but quickly added that it didn’t reach P5 million.

He likewise lamented the “wrong impression” that the allegation was causing his name. “I have my name to protect. I’ve served this government for a long time,” he said.

Trillanes vs Reyes

Sen. Antonio Trillanes IV, a former Navy officer, said Reyes has no one to blame regarding his tarnished reputation but himself. “If you’re so concerned with your name sana nag-ayos kayo (you should have been good) while you were in office,” he told him during the hearing.

“I was incarcerated for more than seven years. During those times all of you (said my) allegations are baseless. I believe this is the time of reckoning, you better find good lawyers,” added Trillanes, who led a military uprising in 2003 and accused the AFP and Defense leadership of corruption.

Special Prosecutor Wendell Barreras-Sulit of the Office of the Ombudsman, who was present in the hearing, said they would conduct an investigation into Rabusa ‘s allegations.

“Mag-umpisa kami ng bagong imbestigasyon at sumasang-ayon ang aking mga kasamahan (My colleagues and I agree that we need to conduct a new investigation),” she said during the inquiry.

Rabusa as state witness?

Rabusa’s lawyer Noel Malaya said his client wishes to become a state witness. “Considering he is not the most guilty of them… we want to tell the truth,” he said.

Estrada has asked the Department of Justice (DOJ) to place Rabusa under the witness protection program. Senator Franklin Drilon said Rabusa can be placed under Senate custody until he is not yet under the DOJ’s protection.

Senate President Juan Ponce Enrile said he will take responsibility over Rabusa “because he is a witness who was personally appeared before the chamber.”

Rabusa first testified in a Senate investigation in 2004 when the chamber held an inquiry into the Garcia corruption case.

Rabusa was earlier charged with three counts of perjury and unlawfully acquiring property and vehicles amounting to more than P43 million despite only having an annual salary of P275,000.

According to the Office of the Ombudsman, his net worth increased from P618,000 in 1990 to P7.18 million in 2003. His wife and father-in-law were likewise charged with conspiring with him.

A Newsbreak article said after Garcia’s arrest in 2004, the military also put Rabusa under house arrest. The Ombudsman included him in the charge sheet but only Garcia was implicated in the plunder case. The case against the Rabusa in the military never prospered. He opted for early retirement in 2004 to run for mayor.

Estrada, however, noted that they did not intend to “pin down” anyone during the hearing. “We are just doing this to purge corruption from the military,” he said in Filipino.

Reyes, a former military chief, headed the Defense Department from 2001 to middle of 2003. Garcia was military comptroller from March 2001 to September 2003.

In the case of Reyes, Rabusa said it was a “bigger amount.”

Pressed by Estrada if he had any estimate of the money given to Reyes, Rabusa said, “Probably not less than P50 million.”

“We brought the money your honor in the quarters of the Chief Staff in GHQ [General Headquarters] at Camp Aguinaldo that we call ‘White House’,” he said.

Rabusa said the P50 million was sourced from the Provision for Command Directed Activities (PCDA) fund contributed by military officials.

He said the PCDA fund was P40 million a month or P480 million a year, which was “readily available at the disposal of the Chief off Staff.

Aside from the P50 million “send-off” money for Reyes’ retirement, Rabusa said then Chief of Staff had also been receiving P5 million a month, and another P5 million for his staff. The same was also sourced from the PCDA.

Rabusa said other military officials also received at least P1 million a month. Rabusa himself admitted that he also received at least P500,000.

“Kapag kayo nag-aabot ng pera halimabawa kay General Reyes, kay General [Carlos] Garcia, hindi ka ba binabalatuhan?” Estrada asked.

Reyes faced the Senate to answer allegations that he was behind Garcia when the former military comptroller allegedly amassed P303 million worth of bank accounts and properties.

    I am now watching the senate hearing. Ang daming “bomba”. Corruption is so easy to do in the AFP, maraming loopholes. Kaya naman pala kawawa ang mga sundalo natin.

    Trillianes told Reyes, “you do not have a reputation to protect”…I hope I did not hear this wrong! But if I heard it right, and gulong ng palad nga naman…Ngayon si Trillanes na ang “your honor”.

    psb, you heard right. Supalpal si Reyes kay Trillanes THREE TIMES! Yung una, pinipilit ni Reyes magtanong kay Col. Rabusa na ayaw payagan ni TG Guingona. Nakulitan yata si AT4 kaya habang makulit si Reyes na “…if I may, your honor, if I may…” hirit si AT4 ng “NO, you may NOT!” Tapos sabi pa ni AT4, “I suggest you get yourself a good lawyer.” Mukhang tutuluyan siya ni Trillanes.

    Yung pangalawa nga yung sinasabi mo, psb. Sabi kasi ni Reyes paulit-ulit, “It’s my name that’s being besmirched here, it’s my reputation that I have to protect…” Sabay hirit uli ang AT4 ng, “You do not have a reputation to protect!” Mapula na ang tenga ni Reyes kaya pinagbigayan na rin ni Guingona later on.

    Pero di pa rin huminahon si AT4 kaya tumira pa rin pagkatapos maglitanya ni Reyes ng mga accomplisghments niya sa anti-smuggling, jueteng, yung SOCOM chief pa siya, etc. Tapal Vulcaseal ang binitiwan ni AT4, “We do not care about your accomplishments here, those are irrelevant. What we want to know is if you accepted money.” Sinegundahan naman ni Jinggoy who has the floor nung oras na yon. “We were in jail for more than seven years, now you have this (Rabusa’s testimony).” Ang pagkakaintindi ko sa sinabi ni AT4 e nakulong sila dahil sa paglahad ng korapsyon sa AFP, eto ngayon ang ebidensiya, si Rabusa nga.

  5. For info, Benjie(Class 69) and Angie never really saw eye to eye. Benjie was the lone major service commander who questionned the legality of Angie’s prodding the commands to mutiny against Erap in 2001 and that up to the last minute (while Gloria was waiting in the ante room where they were all holed up) Benjie was arguing heatedly with Angie. Benjie has a higher sense of honour in that regard and felt that what Angie was ordering them to do was unconstitutional.

    Benjie was the only major service command who was prepared to defend Erap and the presidency at that time but of course not only was his command not quite the fightingest “infantry” in the armed services but also the smallest. Even the “brave” FOIC Wong caved in! Sanamagan!

    Despite that, he had ordered an aircraft to hover just in case Espinosa made good his word that he and his contingent from Queson would march to Malacanang and fight it out with Calimlim’s command. (People thought that the aircraft was to protect the mutineers led by Gloria — they were goddamn wrong, it was in preparation of an armed attack by Jose Pidal’s dog Espinosa.)

    All the officials below the Ombudsgirl can be replaced by the President. Bakit papatay-patay? There is Emilio Gonzalez. Ano na ang nangyari diyan? There is the Specious Prosecutor. Lahat yan puwedeng tanggalin.

    Once out, and replaced by good people (I hope), boxed out na ang Ombudsgirl. True, it is still the head that decides whether to prosecute or not. But if all the spadework is done below, when the charges are watered down, then there would be evidence of favorable treatment.

    Ang tagal naman. For a guy who loves guns, mabagal pa sa sumpit ang action niton admin na ito.

    Tuwang tuwa talaga ako Tongue sa mga sagot si Trillanes. Supalpal si Reyes! It is like putting a fish in the ocean. Itong corruption na ito ang rason kaya nag-alsa ang mga sundalo. Trillianes knows this corruption damn well! Ngayon nga lang, hindi na haka haka dahil lahat ng paper trail eh nandyan na, unless yung ibang records eh nadukot na. If the price is right, something can be done.

    In one of the cruises I took once, yung asawa ni Reyes eh katatapos lang din sa cuise kasama ang mga ibang asawa ng mga ibang generals at pamilya niya daw ( I did not have the exact number of people). Balita ko enjoy na enjoy sila sa cruise na yun. I wonder who paid their bill? Mine, inipon ko ng ilang taon…heh,heh,heh.

    Things like these trips to Europe and the US and in the Bahamas should be investigated very well. Sana kunin ni Trillanes lahat itong mga records ng mga excessess ng mga general na ito pati ang mga properties nila in and out of the country. Isama na rin ang ranch ni Asspweron sa Australia. I wonder if this property is in his name o yung dummy niya.

    Very interesting inputs you have there. Which leads me to the truth commission that Aquino’s admin set up. If you think about it, despite or in spite of the bleeding useless commission, seems the willing can get to the bottom of all the corruption issues that’s plagued the nation since Gloria squatted in Malacanang.

    And I am quite convinced that if our dutiful and honourable members of Congress can get all their acts together with the concurrence of our mighty and impressive people at the DoJ, there is every chance that all these investigations (which are sadly scattered) will lead to Gloria. Never mind that she’s a piggy backing bitch. It takes great political and judicial will but if right thinking officials of this govt persevered, there’s every chance this govt can finally hang Gloria Macapagal, the woman who perverted the institutions, may just be hanged from the highest lamp post.

    Rabusa’s bombshell revelations yesterday should be the basis for the following:

    1. Plunder case against Angelo Reyes, Gen Ligot and Gen Garcia (additional in the case of Gen Garcia) for the more than P400 million Reyes allegedly received as Chief of Staff and the P50 million pabaon.

    2. The BIR should immediately institute a tax evasion case against Reyes, and consider his AFPOVAI residence and restaurant investments and numerous foreign trips of his wife as among the evidences.

    3. Reyes should publicly apologize to all AFP personnel for this raid on the AFP treasury as testified by Rabusa. With Rabusa’s credible revelations, Reyes has emerged as a candidate for the title of The Most Corrupt Chief of Staff in the history of the AFP.

  44. There are military officials everywhere in Asia who steal from military coffers but not quite as blatantly and as shamelessly as in the Philippines.

    It is only in the Philippines where I see military officials rising to senior ranks who can send their children to expensive schools (with no debts to speak of), possess cars, live a high flying lifestyle, etc., on apparently the salary they make in the military.

    Filipinos are smart so why can’t they just do the sums, you know, do some arithmetic. If they can’t provide the numbers, and the legal source of the numbers, then pounce on them.

    I don’t know if raising the salary of members of the military to the level of corp executives will help curb this penchant for stealing. Maybe it’s in the character of Filipinos to be blown away by money when they see it, maybe not. But it’s time to kill corrupt officials (military and otherwise).

    No wonder we cannot win the war against Joma’s troops and the Islamic fundamentalists in the south.

    All they have to do is to examine their lifestyle. Aggressively pursue leads, etc., As I said, do the sums. Make life difficult for those who are suspected of illegally gotten wealth. Easy enough to do arithmetic. His life story or his lifestyle story can be itemised from the time he was born.

    If Gen Kolokoy makes 500K a year but is known to own a house (whether in name of wife or kids) worth 5 million, sends 4 kiddies to Ateneo and to expensive schools doing law or medicine, owns 3 cars, is known to have a vacation home somewhere, is member of several golf clubs, etc., etc., easy enough to require him to show proof how these material things came into his possession. If he can’t supply the answers, then book him until he becomes transparent.

    It’s done where I sit… Why can’t it be done there?

    Look, for a miserable 15K Sterling Pounds worth of loot done by an MP here, the guy gets charged with corruption. And how did parliamentary auditors do that? By examining everything and anything with no let up.

    Any fellow on govt payroll that’s suspected of stealing a dime from govt (OK am exaggerating here), is hounded with no let up.

    Where I sit, we pay TV tax, meaning you pay TV tax for every television set you own (otherwise how could govt broadcasting companies operate without funds). You are obligated by law to report the number of TV sets you have at home so you could be taxed accordingly. If an inspector comes and finds that you have not declared the number of television sets correctly and only pay for say, 1 when in fact you’ve got 3, you will be severely fined and that is retroactively.

    And by gum, tax brigades here are relentless.
