Panibagong imbestigasyun ng Dacer-Corbito murder case

Statement of Sen. Panfilo “Ping” Lacson:

Secretary Leila de Lima should stop using brute reason in interpreting the court of appeals ruling dismissing the case against me which she claimed she has not even read.

Let me remind her that in a civil and common law system like ours, the hierarchy of courts places the supreme court at the highest level and is therefore the sole authority to reverse the court of appeals in its ruling and decision. – not any of the lower courts of the land and certainly not the secretary of justice.

The appellate court has ruled that there is no probable cause to indict me for two counts of murder and categorically nullified the warrant of arrest that the Manila RTC branch 18 issued against me. De lima cannot place herself above any court of law. Otherwise, the justice system becomes defective and worse, will self-destruct.

While I submit that the case dismissal is not yet final, as it may still be reconsidered by the same court of appeals division or can be reversed by the Supreme Court following proper legal rules and procedures, the same ruling clearly nullified the warrant of arrest which de Lima wants to defy by ordering to continue the manhunt.

I and my family have suffered long enough for a crime I did not commit. I appeal to her not to confuse the public with her flawed and ill-advised legal opinion. It is hitting below the intellect but is inflicting the damage that some of her prosecutors have intended to achieve to cover up for their malicious prosecution.

My column in Abante:

Sinabi ni Justice Secretary Lilia de Lima na kahit nadismis na ng Court of Appeals ang kaso laban kay Sen. Panfilo Lacson na double-murder kaugnay sa pagpatay raw kay Salvador “Bubby” Dacer, isang public relations man, at ang kanyang driver na si Emmanuel Corbito noong 2001, buhay pa rin ang warrant of arrest at kung lalabas si Lacson ay ipa-aresto pa rin siya.

May ibang abogado, katulad ni Harry Roque na hindi sang-ayon sa opinion ni De Lima dahil ayun sa kanila, “final at executory” na ang desisyon na walang bisa at dapat isantabi na ang warrant of arrest. Hanggang hindi nagpapalit ng isip ang korte, yun na yun.

Sabi nga ng isang abogado sa aking blog na si Sax n violins, kapag pinilit ni de Lima na hulihin si Lacson ngayon pwede pa siyang makasuhan ng contempt of court. Payo niya sa mga kaibigan at kamag-anak ni Lacson, kapag may kumatok sa bahay nyo at hinahanap ang senador, gamitin yun para sampahan sila ng kasong “contempt of court” o pagsusuway sa korte.

Ngunit may sinasabi si de Lima na interesado ako. Sabi niya dahil hindi pa na-arraign o nabasahan ng charges o kaso si Lacson, hindi mag-aaply ang double jeopardy dito . Kaya pwede pa ang panibagong imbestigasyun.

Yun ang dapat at ganun naman talaga ang hinihingi ni Lacson. Mag-imbestiga kayo ng masinsinan at hindi yung kung ano ang utos ni Gloria Arroyo noon, yun ang sundin nyo. Kahit wala kayong ebidensya pilitin nyo , at kung ano-ano ang inaalok nyo sa mga testigo para pumirma sa affidavit na gawa nyo.

Ayun sa report ayaw daw ng abogado ng pamilyang Dacer ang panibagong imbestigasyun. Bakit? Ayaw nyo malaman ang katotohanan?

Siyempre sumali na naman itong si Dante Jimenez na alam naman ng lahat na suportado ni Mike Arroyo sa kanyang anti-crime daw na grupo.

Sa desisyun ng CA, ipinaliwanag na may depekto ang basehan ng kaso ng pamahalaan ni Arroyo sa murder charge laban kay Lacson at yun ay ang testimonya ni Senior Supt. Cezar Mancao.

Paano nga naman mangyari na ang testimonya ni Mancao ang paniwalaan samantalang hindi naman siya kasama sa mga sitwasyun na pinagsasabi niya. Nakuha daw niya kay dating Police Supt. Glenn Dumlao ang impormasyun. Sabi naman ni Dumlao wala siyang sinabi sa mga ipinakukuwento ni Mancao sa kanyang affidavit.

Sinabi pa ng CA na inamin naman ni Mancao na inalok siya ng dating chief ng Intelligence ng military na si Gen. Romeo Prestoza na aayusin daw nila ang paglipat ng kanyang buong pamilya sa Singapore.

Klaro naman na ang warrant of arrest kay Lacson ay bahagi ng pagbaluktot ni Arroyo ng judicial system para parusahan ang isang taong tumutugis sa kanya at sa kanyang asawa.Proteksyun sa kanilang sarili. Kasabwat niya dito ang mga DOJ prosecutors na hanggang ngayon ay namamayagpag pa rin.

Nakakapagtaka bakit hindi yan winawalis o itinutuwid ni de Lima.

    Sa sinabi ni de Lima dito sa pag-dismis ng CA sa kaso ni Lacson na ipapa-aresto pa rin ito pag ito’y lumabas sa lungga … dalawa lang ang ibig sabihin …. una .. baka may alam ang palasyo at sila’y nagda-drama lang … pangalawa …. aso siya ni Glorya 🙂 🙂 🙂

    Typical reaction yan ng abugadong Pinoy. Kapag natalo, ang unang sinasabi, puwede pa namang mag- MR, hindi pa naman final.

    But an MR is only useful, if there is a dissent, or, if there is some matter overlooked by the Court, or new evidence that may convince the court. Kung wala, huwag nang mag-MR.

    But they do that, dahil may panibagong singil.

    Dito sa Tate, kung wala kang bagong argumento o ebidensya, at nag-MR ka, baka ka ma-sanction ka for frivolous filing.

    Ano ba ang bagong argumento ng DOJ? Igigiit nilang kapani-paniwala si Mancao? Anong bagong sustansya ng kanilang argumento, na hindi pa nakita ng CA?

    Ganyan din ang kaso ni Webb. Kung nagtuturo si Guingona at Persida Acosta, at may tanong sila sa eksamen, puwede bang mag-appeal or MR kapag abssuwelto na ang tao? Kung sumagot ang estudyante na oo, tiyak bagsak. Pero sa tunay na buhay, ano ang ginawa nila, pinairal ang damdamin at nag-file ng MR, para lang igiit na hindi sila nagkamali.

    Sa lahat ng DOJ Sec, trabaho lang yan. Dapat ay wala silang emotional attachment sa mga kaso – na sumasama ang loob kung talo, o nagtitili sa galak kung panalo. Ang trabaho ay ipakulong ang salarin sa pamamagitan ng mga hukom. Kung hindi nakumbinsi ang hukom, puwes humanap ng bagong ebidensya.

    There is that old joke that goes, “if you are strong on the facts, pound on the facts. If you are strong on the law, pound on the law. If neither, pound on the table.”

    De Lima is pounding on the table.

    The facts say, coached si Mancao. The law says, obey the CA. Get cracking. Suriin uli yang mga buto ng hayop, na nagpapanggap na buto ni Dacer.

    Ano ang kasalanan ni Ping kay de Lima at mukhang pinipersonal nya ang una? Maliban sa pagsunod sa mga ‘tunay’ na amo ay wala akong makitang dahilan kasi ay magaling syang abugada at tiyak ay kita nya ang butas-butas na evidence at affidavit ni Mancao.

    Buksan muli ang imbestigasyon at suriing mabuti ang kaso, sya mismo ay umamin na pwede. So bakit sya nagtataray?!

    Agree ako sa iyo, Attorney. Mukha lang talagang penepersonal ni De Lima itong si Ping. Agree rin ako sa sinasabi ni Atty. Roque na ang decision of the CA is final and executory and therefore Ping is off the hook in so far as arresting him is the topic. Mayroon lang talagang ugali itong si Leila na medyo magpa gwapa sa mata ng madla. Dapat ang reaksyon niya whenever a decision is promulgated by any court ay mag relaks lang siya at basahin mabuti bago mag comment.

    Aabot sa Presidente na walang iba kundi si Erap. This was the scenario then: Erap ordered Ping who then ordered his men to eliminate Dacer. Reason was simple: Dacer was about to expose Erap’s wrong doings. Iyan din ang nangyari kay Chavit. Hinarang siya ng mga Pulis at titirahin na sana pero hindi bumaba si Chavit at bullet proof pa ang sasakyan. Buti na lang nakatawag siya sa mga provincial mayors na mga kaibigan niya na noon ay nasa Metro Manila. Galit na galit na sinugod ni Chavit at Presinto para magreklamo. Did you remember that Casino witness who exposed the Estrada’s gambling in the said casino? His body was never found…quite similar to Dacer. What I said were not conclusive. In a high profile crime, the culprits always make it sure that no traces are found. In Dacer case, baka medyo palpak kasi wala naman perfect crime.

    In technical fields of endeavor, when work done is not according to CODE, it is either rejected altogether or something should be done to meet the minimum requirements of the code for which it should apply. Arbitration, if any, still comes down to the provisions of the code. Pagdating naman sa mga batas-batas (lalo na sa Pinas) the provisions of a law (as it applies) is always a big controversy. Lawyers can’t agree for various reasons because each (or so it seems)has his own personal interest or bias on the defendant (or the case). Lawyers concerned have their own interpretations of the law depending on who is to be tried. Kung mahirap ka o kalaban ng ruling administration (o kung sino man sa ahensiya ng administration na hahawak sa bayag mo), the law is foolproof. Pero kung kakampi ka o mayaman, lahat ng loopholes ng batas eh hahanapin makalusot lang ang kaso. Bakit ganoon ?
    Ask former lawyer Oliver Lozano. How many times did he saved gloria from a possible impeachment for filing a very weak impeachment rap (for which it was delegated to the basket for lack of substance “DAW”)and consequently derailed another more credible rap sheet for the same year ?

    Don’t forget the former Party-list Rep. Marcoleta. Even in simple criminal case involving prominent and rich people, the police deliberately file weak cases or don’t appear in courts thereby dismissing the cases. It’s an old trick that works.

    Kung ako si Lacson, I will keep hiding until everything is clear. Ang kaso, meron ding simultaneos case si Ping sa US. Mukhang malayo pa ang lalakbayin ni Ping. Malapit ng matapos ang termino niya sa pagka-senador.

    Thruthseeker, sa tingin ko talaga, wala namang rason para itumba ni Lacson sila Dacer at Corbito unless it was a tall order from his superiors, si Erap lang naman ang nakakataas sa kanya nuon, di ba?

    If de Lima has not yet seen the 80 page decision, huwag na lang muna siyang magsalita. But the fact that she wants to have the case re-investigated is a good thing for everybody. Lahat ng kaso noong panahon ni bansot, wala akong pinaniniwalaan. The bansot and her judiciary had no credibility. The case of Lacson was more of putting Lacson away so that his exposes on bansot will never be pursued.

    “If he (Lacson) decides to come out and they arrest him on the basis of the warrant that has already been set aside, we will file cases against the authorities and the DOJ, if they instructed to do so, for arbitrary detention or illegal arrest.

    “Under the Constitution, the general rule is that a person is entitled to personal liberty at all times except if there is an outstanding arrest warrant against him.

    “Since the arrest warrants have been nullified, there is no more basis to deprive him of his liberty. A person is entitled to immediate liberty, particularly considering that he is presumed innocent until the contrary is proved, and not until the appeal or motion for consideration is over.

    “Rule 39, Section 4 of the Rules of Court states:judgments in actions for injunction “shall be enforceable after their rendition and shall not be stayed by an appeal taken there from.”

    “Rule 117, Section 5 of the same rules provides that the quashing of the information is immediately executory unless there is an order to file new information. In the case of Senator Lacson, there is none.

    “The rules clearly provide that if the accused is in custody, he ‘shall be discharged.’ It necessarily follows that if the accused is not yet in custody, he shall no longer be put in custody, considering that no less than the Court of Appeals quashed or dismissed the information against Senator Lacson.

    “The nullification of the arrest warrants is an ‘interlocutory’ order which jurisprudence defines as an order not instantly appealable and therefore cannot be suspended or interrupted by a motion for consideration.

    “It is even well settled that a special civil action for certiorari does not suspend the immediate enforceability of an interlocutory order absent a temporary restraining order or an injunction.

    “Arrest warrants are obviously mere ancillary to the main criminal case and are therefore deemed automatically lifted when the criminal cases against Senator Lacson were dismissed.”

    “Therefore, the nullification of the arrest warrant is immediately executory.

    “Although the other parties may still file a petition for review with the Supreme Court, the pendency of such petition cannot stay the execution of the judgment which is the subject thereof, in the absence of any preliminary injunction issued by the Supreme Court.

    “This is precisely why Rule 45, Section 1 provides that a petition for review ‘may include an application for a writ of preliminary injunction.’ Note that there is no assurance that the Supreme Court will even entertain or give due course to a petition for review, as its power of review is ‘not a matter of right, but of sound judicial discretion.’

    What about investigating the Special Prosecutor and the Deputy Ombudsmen, who bargained with Garcia, and who are all removable by the President?

    Hindi pa retired si Prestoza di ba? Hindi ba’t conduct unbecoming yung attempt to buy Mancao’s testimony? Bakit hindi bigyan ng same treatment as Danny Lim, and that guy who distributed Erap DVDs?

    I don’t think so. Lahat naman tinitira ni De Lima ng DOJ. Nataon lang itong kay Lacson ang pinakahuli. Pero gaya ng mga naunang mga kaso (including Webb’s reinvestigation), wala din mangyayari diyan kay Lacson. De Lima is only justifying her existence at DOJ. Di hamak na mas magaling siya kay tandang Raul.

    Can the Secretary of JUstice change or interfere in the decision of the court??? I thought you have to go through a process and above the Court of Appeals is the Supreme Court…can Leila change the decision? or to put it mildly interfere in the decision? hindi ba ang function of the Sec. of Justice is under the Executive Branch ahd thus under the Office of the President? nagiba na ba ang ating Constitution? check and balance lang ang responsibilitiwes ng bawat isa sa mga branches of the gov’t, hindi ba? sorry pero ito lang ang pagkakaalam ko…mahina kasi ako sa Law though I took 15 units..

Mahihirapan na silang habulin si Lacson sa kasong double murder na ibinibintang sa kanya dahil ibinasura na ng Court of Appeals.Kung maghain man sila ng MR kailangan ay may bagong discovery o ebidens na mag-uugnay kay Lacson.Si Mangkaw ay hindi credible dahil he contradict himself under oath.Hindi na makalusot sa CA ang MR nila against kay Lacson.

    Sa Supreme Court na sila maghabol.Ganun din ang gagawin ng SC ibasura nila ang kaso kung walang matibay na bagong ebidens na mag-uugnay kay Lacson.

    Iyan kasi ang mahirap sa atin maraming magagaling na abugado na magkakasalungat ang opinion sa isang batas.Kaya nga may Court of appeals para iapela ang kaso kung mali ang desisyon o opinion ng RTC.Kung di pa sila kumbinsido sa desisyon ng CA iakayat sa SC.

    The most basic problem here is in the Philippines, the law (or the legal process) is not complied with according to THE LETTER OF THE LAW! That’s why we have a lot of lawyers/legal bodies with contradictory views of the same law.

    The Supreme Court is the final arbiter. Gumagawa lang ng ingay ang DOJ. At iyan naman ang trabaho niyan. But don’t forget most of the Justices at SC are GMA appointees; and Lacson was GMA’s biggest enemy.

    The Department of Justice will likely comply with the Court of Appeals’ order lifting the arrest warrant on Sen. Panfilo Lacson over the Dacer-Corbito double-murder case, once it receives a copy of the CA’s decision, Malacañang said Saturday.

    Presidential Communications Development and Strategic Planning Office Secretary Ramon Carandang said it is possible the DOJ is still pressing for Lacson’s arrest because it may not have formally received a copy of the ruling.

    sana nga drama lang yan…. hindi mo kami masisisi na magduda kay de Lima dahil hanggang ngayon hindi pa nya nasasampahan ng kaso si Gloria o kahit yung mga alagad nya… hinintay nya TC? hanggang kailan? okay sana yung ginawa nyang pag reopen sa Glorietta 2 Bombing, pero dinismissed din nya… yung mga prosecutors na madaming kinasasangkutang katiwalian nung nakaraang administrasyon na hanggang ngayon nasa DOJ pa din… bakit hindi nya ulit paimbestigahan? hindi natin nakikita na naglilinis sya ng bakuran. Sa Ampatuan massacre, madmi pa din kriminal na nakawala… bakit hindi nya pinapahanap? sa Aug 23 incident, hanga tayo dahi mabilis at magaling ang proseso na ginawa nya… pero tignan mo naman yung mga bigat ng parusa na gusto nyang ibigay sa mga kaalyado ni PNoy, nakakaduda din…

    patunayan nya na hindi sya kaalyado ni gloria… masusubukan yan sa kaso ni Angelo Reyes…

    Ang isa na gusto kong baguhin ni De Lima ay ang kunot niya sa noon. Kahit nakangiti ay parang mukhang galit. Pero mas okay naman siya kay Ombudsman Merci na talagang mukhang mataray.

    Sometimes, I cannot blame De Lima for behaving this way at DOJ. Akala niya kasi nasa Human Rights Commission siya. What you see in her, that’s what she is. Unlike DSW Sec. Soliman who my source says is super plastic. Kung anong sweet ang pakita niya sa mga tao at media, ibang-iba naman sa mga tauhan niya na minumura pa.

    Medyo baligtad yata. Kaya tayo nale-letse kasi nga ang gamit lang ay ang Letter of the Law. Ilang beses binutasan ang mga batas noong impeachment ni Pandak, Davide, Gutierrez; mga EO 464, MC102, at marami pa na ang armas ay ang letter of the law.

    Mas tama ay kung ang Spirit of the Law ang pangunahing batayan upang hindi kayang pilipitin ng kung sinong bayarang kongresista, senador o abugado ang batas, dahilan lang sa kulang ng isang tuldok, o kuwit ang titik ng nito.

    The letter of the law is made with words, mere symbols that may change and transform itself with the passing of time but the spirit, the essence or purpose is always eternal.

    Gamit na gamit pa siya ngayon para “masara” daw yung mga isyu nung panahon ni Pandak. Isa na yung Glorietta bombing na napabor pa sa mga alipores ni Putot. Di na kailangang mga doktor o scientist, si Malabanan lang sasabihin sa kanyang imposibleng mag-produce ng ganoon kadaming methane sa isang pasilidad na bukod sa puro tubig, di pa konsentrado ang tatse. Bullshit talaga.

    Tangna, lalong nagdududa ako diyan kay De Lima. Di pa rin niya sinisilip si Gloria. Kelan pa, pag kakampanya na siya sa senado para mainit-init pa?

    Etong si Honasan laging sinasabi na lumabas na si Ping at harapin ang kanyang kaso pero tahimik naman sa kaso ni Gen. Garcia. Honasan has not attended the Garcia Plea Bargain hearing even once.

    Did Honasan say why he’s inhibiting in Garcia’s case? I didn’t hear him say anything negative about Garcia even before the hearing began. O baka naman dahil kumpare niya si Garcia. Ngayon ko lang nalaman na may kaunting delikadesa si Honasan. Ganyan din dapat siya kay Lacson.

Sabihin na natin wala sya sa lugar para magpatawag ng reimbestigasyon, pero ngayong ngdecide na CA in favor of Lacson… gusto pa din nya sya ipaaresto… 2 bagay lang.. may pinoproteksyunan si De Lima o pinepersonal nya si Lacson…

    at huwag kang maniwala sa sabi-sabi.. madaming destabilizer sa panahon ngayon… kahit na sabihin na natin “plastic” si Sec Soliman, ang importante hindi nagnanakaw at nagagampanan nya ng mbuti yung kanyang trabaho.

    Court attorneys, usually, want to land judiciary positions like their bosses. They have temperament of their bosses, reading pleadings, and sifting through the evidence.

    Si Lacson ang pinakamalaking kaaway ni GMA noon. Buti na lang lumalabas na lahat ng mga scandals at corruption ng mga bata ni GMA. All these AFP hearings and other cases to come would eventually pin down GMA. Look at one of her tuta Pichay who’s now being implicated by Rabusa. Matagal nang magnanakaw si Pichay. The problem is she’s now a Congresswoman with immunity and her trusted loyal men with fat pockets are still very much around.

    “It is clear in the decision that the information is void and the arrest warrant was nullified. So strictly speaking, the CA ruling prevails over that of the RTC – meaning, the warrant should no longer be in effect at this point given CA’s decision,” the insider said.

    Lacson’s lawyers have asked the CA’s Special Sixth Division to clarify whether its recent decision dismissing the double murder charges against the senator effectively nullified the arrest warrant issued against him.

    The Dacer family’s counsel, Demetrio Custodio, said he will file an opposition to Lacson’s motion because the CA decision is not yet final and executory.
