Ombudsman still running after NBN-ZTE star witness

Whistleblower Rodolfo “Jun” Lozada could be the perfect example of how, in this country, people like him who dare spill the beans on wrongdoing get punished, not rewarded. It is a practice that he said must change under the administration of President Benigno Aquino III.

Three years after he faced the Senate as star witness exposing the corruption-ridden contract for a national broadband network, Lozada still faces a slew of lawsuits while the people he has accused of making millions of pesos in commissions have mostly escaped sanctions.

“Masigasig sila sa kakahabol sa kaso ko, eh (They’re determined to pursue the cases against me),” said Lozada, who still faces a P19.5-million malversation case related to the jathropa project of the Philippine Forest Corp. which he used to head. He also faces a graft case allegedly for the anomalous purchase of motor vehicles, fencing materials and other equipment worth P15 million.

The cases were filed by the Ombudsman after Lozada testified in the Senate on the wheeling and dealing behind the $329.5-national broadband project entered into by the Arroyo government with the Chinese firm ZTE Corp.

Lawsuits are just one of the consequences that this year’s batch of whistleblowers—auditor Heidi Mendoza, Col. George Rabusa and Lt. Col. Antonio Lim—have to brace themselves for, Lozada said.

Even as he expressed solidarity with the three, he said, “Whatever drove them to do what they did, I’d like to remind them to hold firmly to it because they will be buffeted by storms of emotions, legal cases, physical threats and everything.”

He appealed to the families of the three whistleblowers to support them. “Once they have decided to carry the banner of truth, life would never be the same again for them,” he said.

“The Ombudsman has filed so many cases against me,” said Lozada, who is up against Ombudsman Merceditas Gutierrez.

Gutierrez is known to be a close friend of former President Gloria Macapagal Arroyo and her husband Jose Miguel, whom Lozada has accused of having been bribed by ZTE so it could corner the project.

Gutierrez, however, faces the possibility of impeachment for allowing Ombudsman prosecutors to agree to a plea bargain that let Gen. Carlos Garcia, former Armed Forces of the Philippines comptroller, off the hook for plunder.

To further illustrate how skewed justice is in this country, Lozada said his former subordinate Erwin Santos who testified against him continues to be president of PhilForest.

“’Yun ‘yung tao ko na bumaligtad… For me, isa ’yan sa sukatan ko. That’s the fellow na ginamit nina Gloria, nina Atienza laban sa akin (He was the person who turned against me. That is one of my indicators. That’s the fellow Gloria Arroyo and then Environment Secretary Lito Atienza used against me),” he said.

Around this time in 2008, the nation was gripped by the live coverage of the Senate hearings on the NBN-ZTE scandal, much like the hearings on corruption in the AFP that now hold the nation in thrall.

Lozada was then the center of national attention, as he laid the blame on the doorstep of Malacañang, and pointed to the involvement of several government officials, foremost among them former Commission on Elections chairman Benjamin Abalos and former Economic Planning secretary Romulo Neri.

The threat to Lozada and his family forced him to seek refuge with the De La Salle brothers in Greenhills. They stayed there for two years and nine months until the Arroyos were out of Malacañang.

Lozada said he gets a sense of deja vu watching Mendoza, Rabusa and Lim during congressional hearings on the plea bargain agreement entered into by Garcia and the Ombudsman.

He understands the intense emotions that testifying and truth-telling stir up. “For a man to cry was taboo. When I was there, tears would just flow. Literally, you were being broken,” he said.

He said it was his faith that proved his anchor in those difficult times.

It is impossible for a whistleblower to return to the old life, but Lozada said he has a new-found compassion for others. One of the projects he is busy with is e-textbook. He is working with a number of schools in converting textbooks into electronic form to save schoolchildren from the burden of lugging several kilos of textbooks to school every day.

He is also into keeping schools safe by making sure that electrical connections are in order. “If there’s something that I cannot do, it is to be idle. I can be physically limited but it doesn’t mean my mind will stop. My mind continues to create new things,” he said.

Many were expecting that with Aquino now in Malacañang, Lozada would rejoin government. “I have never been offered a position,” he said.

Looking as an outsider, Lozada said he has not seen much action in terms of fighting corruption. “I was expecting a very big war against corruption. Programs that would curb corruption and appointment of people well beyond corrupt practices,” Lozada said.

Borrowing from a famous prayer asking for serenity to accept things that one cannot change, the courage to change things that one is in a position to change and the wisdom to know the difference, Lozada said, “I have learned to accept things that are within my circle of influence and things that are outside my sphere of influence.”

Lozada said he sees the decision of Mendoza, Rabusa and Lim to come out and tell the public what they know despite great risks as “a march of truth against the darkness of corruption. Sana marami pa ang maki-martsa sa amin (I hope that more will join us).”

    While on my way to GSIS last Friday, February 18, 2011, I was asked by the taxi driver who was tuned in to the Senate Hearing. Here’s his question “Eh Ma’am, kung ang populasyon ng Pilipinas ay 90 milyon, tig-magkano po ang bawat-isang Pilipino sa P150 milyon pesos na ibinangko raw?”

    Admittedly, I am not a Math genius. But my common sense was not working that time so I told him “Teka Kuya at iko-compute ko sa calculator sa cellphone ko. Ay Kuya, masyado po palang maraming digits hindi po magkakasya sa calculator sa cellphone ko.”

    MANILA – The Office of the Ombudsman has been sitting for 3 years now on records that could be used as basis for the filing of a multi-million graft case against former military comptroller Jacinto Ligot, Senator Franklin Drilon said on Friday.

    At the resumption of the Senate’s inquiry on corruption in the military, Drilon presented financial records under the name of Ligot, his wife and 3 children, and a brother-in-law.

    Drilon said that based on the records, which he obtained from the Makati City Regional Trial Court Branch 61, the retired lieutenant general and members of his family had at least P740 million deposited in various dollar and peso bank accounts from 2001 to 2005.

    Drilon said that the Anti-Money Laundering Council (AMLC) was able to freeze only P73.6 million of the amount.

    I think the P150 million which the cab driver asked me was the amount discussed by Ms. Heidi Mendoza deposited sa UCPB.

    Yong P740M, yon yong alledgedly amassed by Ligot na hindi pa pala nakakasuhan ng Plunder sa Ombudsman. Instead, forfeiture case lang.

  8. Maliit na amount yan. Studies by the ADB and World Bank and an admission by Mersadista Gutierrez herself, upon receiving the 434M dollar grant from the Millenium Challenge Corp., that one third of the of the national budget goes to corruption.

    Yan ang kwentahin natin. Nung panahon ni Putot, One Trillion Pesos lagi more or less ang budget or P333 Billion ang nakurakot (one-third) for each of the NINE YEARS.

    Kung si Ms. Heidi Mendoza ay naaawa sa mga sundalo na dapat nakinabang sa pera ng AFP, ako naman hindi rin mapigilang magmalasakit sa mga kasamahan ko sa paglilingkod sa lokal na pamahalaan. Na ang mga katulad kong rank and file employee ay nagtitiyagang pumila upang magloan saan man may offer ng loan. Pebrero pa lang pero sinasangla na ang mga biyayang matatanggap pa lang ng Pasko.

    The Ombuds could have used Lozada as its main witness to nail many of the alleged suspects, including Neri, Abalos and could even led to the big Fat One, the suspected mind of all thse shenanigans of the bilions and bilions pesos disappearing evidence including the monies magic or illusions….but being the firewall installed for such purpose, Merci had done her job…she deserves a generous commisssion…such is life and it seems that the bad guys seem to be winning…now the question..what to do? President Aquino…answers please…(comm-group…is there any plan of Actions?)

    Lozada, just like Rabusa never said he was a saint. He admitted just like Rabusa that he too stole money from the government. But both of them were insiders. Kaya siguro nila nalaman ang mga kaalaman nila sa sindikato ay dahil they are with the bad guys.

    If the Malditas gets booted out, which is probably remote at this time as there are still more “used to be allies” of the bansot in tongress and in the senate, Lozada and the other whistleblowers with cases in Ombudsman may be scott free. More allies of the bansot who benefitted from the non-filing of cases against them because of being a bansot crony will be slapped with cases left and right. But on the other hand, more cronies of Pnoy who are likewise crooks and criminals will receive immunity as well under a ne Ombudsman. Kaya nga ang kasabihang “weder weder lang” is so true in our country. Kung sino ang nakaupo, siya ang masusunod. Hopefully, Pnoy will be different. After receiving so many criticisms on Puno, bigla na lang nawala si Puno. Robledo is now calling the shots. So somehow, Pnoy is listening.     We should legislate that for the “suspected” plunderers, there should be immediate sequestration of their assets, freezing of bank accounta and a travel ban for them and those close to them even before the investigation begins. Kaso mo ang nangyayari, investigations take so looonnnnggg. Nai-withdraw na ang lahat ng pera, naibenta na ang mga assets, nakaalis na ang mga kasamang nagnakaw, INIIMBESTIGAHAN pa rin ang kaso. Pagkatapos ng imbestigasyon, no more money and assets can be recovered coz they were all disposed of prior to any investigation.

    Any suspected thief should also be removed from his office to avoid destroying the evidence. Kaso mo, hinahayaan na maglagi ang punderer sa pwesto ng matagal. If this plunderer has power over his employees, all records can disappear!

    If Pnoy is serious in cleaning up his government, he should employ “spies” in offices suspected to be the playground of the thieves. These employees will just be regular employees but with dual functions. They report to a security arm of the government. Add a little bit more to their salaries and they will be very happy to help and can be hailed as heroes too. Snitches are important to get first hand information in any organization. Jug and those in higher managerial positions know how to value these employees.

    Most importantly, these “suspected” thieves should not be given any government position in any capacity!

    It may be so old school to have a “suggestion” box in any government office. These boxes should be installed in all visible areas in government offices but not easily stolen. This way, complaints can be made right there on, complete with all the information on who the person involved in the “lagay”, the time and place of the crime no matter how petty it may be. Petty crimes if not corrected will become bigger ones.

    The government agencies riddled with corruption should be audited by a private company, not the COA that is also another government agency whose employess already enjoy the perks given to them by the government bosses. There should not be any tenure of these auditors longer than a year. These auditors should be rotated so there will not be any familiarization whatsoever.

    When we do not have squatters lining up our main streets, trash on the steets are collected on time, government services are delivered to everyone, crime is low and almost all out citizens are somehow employed (not as drug pushers or mules)then we can say we are ok, not rich but ok lang.

    Ang magnanakaw kahit maliit o malaki ang ninakaw ay magnanakaw. Ang depresnya lang nila ay ang pag-admit ng guilt and turn this admission into something positive gaya ng pagiging whistleblower. In a way one redeems himself in the eyes of the public even a bit. He makes peace with himself so he can sleep soundly and die with a smile.

    Till the end si Reyes nagaaktong malinis, ayun nag-suicide sa tindi ng guilt. If he admitted o kaya he pointed to the powerful person na destinasyon ng kanyang kinurakot sana he’d be enjoying his ‘commission’ and singing of hallelujah to him would have been justified. Tuloy patay na minumura pa, what a lonely death.

    Unana, her pig and ilks…round and round in circle na ang tuktok nila pati pwet. The bitch thought that she put up an airtight structure to protect her before she left. Yes, hawak nya ang structure pero hindi nya hawak ang conscience ng tao. Hopefully, Pinas is not lacking of Robusa at Lozada.

    In the late 80’s I had a girlfriend studying in South Western University in Cebu (as well as in Cebu Doctors’ and USC, hehehe) and there were already stories about the Aznar boys and their barkada abducting women (taken by a van and all) and raping them, no one would dare
    speak out against these scions of the rich and powerful. Wow, it took 10 years for justice to catch up with them?

    Even the hospital that this family owned was a bit strange, years after while working for Zuellig, they would order a lot of Nubaine (vials in boxes of 100’s) usually surpassing Cebu Doctor’s Hospital at times (which has a lot higher bed capacity). It was also during this time that the drug was spreading throughout Cebu. It was strange because at that time it was controlled, it could only be sold to hospitals and selected (also controlled) to some surgeons with clinics. It was strange for me because I signed for the release of every single one of them as I was handling the company that made them (Boots) at the time…

  61. jug, the same story with Pasay General Hospital. At the time of Mayor Cuneta, one of his sons (among the very many, haha), Gener Cuneta, was appointed administrator of the Hospital. His stewardship was attended by overpricing, ghost deliveries and lack of people and equipment to run it efficiently. Instead of doctors, they had “technicians” whose backgrounds are dubious one of my friends had his earlobe punctured in a melee had it sewn up there but later it looked like chicharon bulaklak.

    What’s worse, Gener had his doctors write him prescriptions of Valium by the thousands, and other “-caine” painkillers. It was eventually found out after Mercury Drug computerized its inventory system. He was charged with graft and corruption, then later, drug pushing. He committed suicide afterwards.
