Ang Galing Party Rep. Mikey Arroyo should rest assured that the story of VERA Files, of which I’m a trustee, on the sale of his Foster City house is a factual report of a real estate transaction which he himself confirmed.

The “an ongoing vilification campaign against me and my family” angle is all in his mind.

As we say, trabaho lang ito.

The article on the $1.125 million sale Beachway LLC, a company that Mikey says he is a part-owner, to Mary Grace Apolinario and Jerome Ngo, owners of the popular chain of restaurant, Gerry’s Grill, is the latest in the series of reports on his beachfront property by VERA Files.

Our first story, published on Aug. 30, 2009, was the real estate purchases of Mikey and his brother, Camarines Sur Rep. Diosdado Ignacio “Dato” Arroyo, in the United States after they were elected to Congress.

While Dato included his and his wife’s real estate acquisitions in his Statement of Assets, Liabilities and Networth (SALN) as required by law, Mikey did not mention the house on 1655 Beach Park Boulevard, Foster City, San Francisco under the name of his wife Angela.

We followed Mikey’s explanations including his efforts to fix the papers on the property in the U.S.

We are not the only one following the real estate acquisitions of Mikey. James Triguero, an American who is in the finance business, wrote to give his inputs on the issue: “Mikey shouldn’t be allowed to get away with some of the lies he’s peddling regarding Beachway LLC. I keep seeing him referred to as having a ‘minority’ interest. This is highly unlikely. In fact, I’m sure he has a 50% interest and Angela has a 50% interest. The sole purpose of the LLC was to hide the ownership of the property. This is why his claim is ridiculous:

“Say I form an LLC with four other people and we start buying property. We would contribute a proportionate amount to the percentage of our shares (i.e. 20%) and any income or gains would be distributed accordingly. Mikey messed up because it was clear that he and his wife had 100% ownership of the property before transferring it to the LLC. The only way that would make sense if other partners ‘bought out’ the interest. No one in their right mind would be a ‘partner’ when the title is in the name of Mikey or Angela. The sole purpose of the LLC was to hide ownership. The story is only plausible if the title was originally held by Beachway LLC. If he claims to be a minority shareholder, he should produce the LLC documents.

“Secondly, he is claiming that Beachway is a business to buy and sell real estate. That was the only property they owned and Beachway obviously refers to the Foster City property. In addition, they took a 200,000.00 loss on the property (and possibly 60,000.00 in real estate commissions unless the deal with the buyers was privately negotiated.) That’s not a very ‘smart’ business transaction as he makes it sound. The sale was designed to free up the laundered cash.

“I’m interested in what bank Beachway has an account with. I’m sure they violated the Bank Secrecy Act (and Sec. 312 of the USA Patriot Act) by failing to disclose that partners were Senior Foreign Political Figures and all US bank accounts ask that question when it’s being opened.”
Triguero added: “Someone from the Anti Money Laundering Commission should also look into Mikey’s transactions and should coordinate with US law enforcement. It would be very interesting to see where the money came from to pay of the million-dollar loan. (Hong Kong or Singapore perhaps).”
Pasabayan, who is working in the U.S in an investment company, explained: “That’s how it is here in the U.S with LLCs, corporation or incorporated. Hindi ka basta basta masasampahan ng kaso.

“This is why it is very expensive to put up one. Almost all moneyed people establish this system of protection against suits. The BIR knows this. That’s why even if the evidence is so glaring, it will not be easy to pin Mikey on this one. Unless the US, just like they did to the Ligots and Garcias, will cooperate in liquidating these assets.

“ In the cases of the corrupt generals, the properties were in the individuals’ names. In Mikey’s case, he protected himself well by incorporating his assets here. Medyo mahihirapan kayong maghabol. The only thing is, the people of the Philippines are aware that Mikey owns a property in the US and sold this for a handsome amount. This is pretty much it for now!”

    Ellen, I bet you, if this property was bought by Mikey with a loan and the new owners took out a loan as well, the mortgage company which gave a loans to these owners are probably owned by Mikey too. This is another company to be investigated. How Mikey got a loan and the new owners got loans is highly suspicious unless the mortgage company committed fraud to inflate the incomes of the borrowers. This is more than money laudering. It is FRAUD! So, Mikey can go to jail in the US too. If the Philippines can not put him in jail, the US can. It just takes time to investigate the issue. The US and Philippines have an agreement to recover the loot if the monies came from corruption. Kaya may pagasa and Pilipinas na makuha ang asset na ito. We were able to recover the assets of the late Marcos, although it took us almost 20 yrs to do so, we too can recover this. Again, the source of the money is the key.

    I disagree with Pasabayan and the BIR, having a LLC business does not mean you are immune to lawsuits here in the US. The LLC only insulates the interest of the members/partners in the business registered as LLC from civil lawsuits.

    If Mikey Arroyo run over someone with his personal car and killed the person in the US, the victims family can only file financial damages against his insurance and personal properties. But the LLC is not a total immunity, the court can still force him to divest his ownership of the business to pay the claims.

    Likewise, if Mikey Arroyo’s business, Beachway Park LLC is involved in fraudulent acts anyone can bring them to court but the damages will only be limited to their interest in the business. The LLC insulates their personal properties from lawsuits against their business.

    on 9/29/2005 a Deed of Transfer (#2005-170538) was registered with San Mateo County from Grantor Wendell, Paula J. to Grantee Montenegro, Angela Arroyo for which a transfer tax of $990.00 was paid for a property in Redwood City. In this transaction, Mikey BOUGHT the Redwood City property not SOLD as VERA files have it. It was only sold on 12/20/2006 (#2006-192699) to a certain Quien, Austine, the Grantee, from Grantor Montenegro, Angela Arroyo.

    They bought the Foster City house from George Skyllas (#2006-126984) on 8/23/06.

    Therefore between 8/23/06 and 12/20/06, they owned TWO properties simultaneously. It’s not true that they sold one to buy another.

    Another interesting thing I discovered from the San Mateo database is that there is another property that Montenegro, Angela Arroyo transferred to Beachway LLC which has not been registered as bought by her. The APN (assessor’s Parcel No.) for the infamous 1655 Beachway Blvd property is 094211420 but in the transaction recorded on Sept. 18, 2009 (suspiciously, a few days after the Vera Files exposé) Angela also transfered another property, with APN 094021211 in the same document (#2009-125647) with no tax paid for. Apparently, this property has not been sold yet, if we follow the records of San Mateo.

    How did she transfer that property to Beachway LLC when there is no record (in San Mateo atabase) of her buying or owning this? Were the previously recorded names of owners dummies or aliases?

    I suggest you revisit the website. Take note of the types of transaction.

    DEED = Deed of Transfer (aka Deed of Sale)
    TRUST = Deed of Trust (aka mortgage) for loan purposes
    RECONVEYANCE = Deed of Reconveyance (aka Release of Mortgage) the Title is restored to borrower upon full payment of mortgage; the name in the deed not necessarily the name of present owner
    SUBSTITUTION OF TRUSTEE = the loan is refinanced, thus a new trustee is nominated; the name in the paper in the original borrower, not the present owner

    Check my old email on how to get to the database. Check all entries on Angela, Mikey, Skyllas, Beachway LLC the 3 APNs, you might also want to do a background check on Luis Aguilar/Carol McCutcheon Aguilar, Murray Alan Cleaner/Andrea Robin Cleaner regarding the new property.

    How to check the database of San Mateo County California (and annoy the Horse).

    1. Go to google and type in the following search string:
    “san mateo california assessor’s office”

    2. On the results, the first hit says “San Mateo County Clerk Assessor Recorder Elections”

    3. There would be two subhits (under the first hit, indented).

    4. Click the second subhit that says “San Mateo County Recorder – Search Recorders Database”

    5. When you get to the target page, click the picture which says “Search the online Grantor-Grantee index”

    6. It will open a separate window. Click the bottom which says “search engine”

    7. Now type “arroyo juan” (no commas please) or “montenegro angela” (again no commas).

    8. Have fun.

    Ellen, I watched Strictly Politics where you were interviewed. Way to go!

    LLCs can be created for every piece of property, if the owner has deep pockets. Horsie may have several LLCs. Also, it is possible that there are many Garcias, Ligots and Reyeses who were the initial buyers of these properties all cash and transferred later to LLCs. Horsie may have created more than one LLCs to hide these properties. Sino sino ba ang mga malapit kay putot and family including her cabinet mambers, tongressmen, generals etc including the maiden names of their spouses. Remember what Mrs Ligot did? She conveyed the property to her maiden name before selling the property. This may have been a practice of the family until they were caught. It will be a tedious work na isa-isahin ang mga pangalan ng mga cronies ni putot but this is the only way we can find out. If we wait for leads, we may not finish uncovering their real estate loot for a long time. We have to have specific names. Let us also look into the activities of the mortgage and real estate brokers they used. Kung pumayag na mag-participate sa illigal na activities ni putot and company, they may have bought and sold several properties for them over the years. I do not know the people close to the putot in her early reign. You do. Ayan, nagbigay na ng “search” procedure si Sax. Marami ding counties dito sa US but the most popular destination of these vultures are the main cities. Good luck!

    Tongue-Twisted, thanks for your detailed explanations about the real estate database. I think the Reconveyance was also recorded by the MERS database when the loans were paid off and the deed released to Angela. There are two related figures but I don’t have much information on them. One is Albert Mac Rogers Jr. (I believe he’s a Realtor married to a Filipina–don’t know if she’s related to the Arroyos). He was the agent listed in the California Secretary of State’s database. Another is the agent for “Big Mike’s” holding company Name: LTA REALTY CORPORATION

    I believe Ramos is a CPA and may have been advising Mikey.
    Does anyone have info on the 30 million peso house Rufa Mae was making Yabang about. The word here in the Bay Area is Mikey bought it for her and she stays her frequently. (She was in the news recently on the PAL flight with Arnel Pineda that had a bomb scare.)I haven’t found anything in her name (unless RMQ is an alias) in SF, SM, SC, or Alameda County databases. There may be another LLC. If someone had the address of the house, it could be checked out. (I heard that her house is in Fremont).

    Arroyo’s real estate properties

    Documents obtained by KMP and Pamalakaya also revealed that the First Couple started acquiring properties in the United States in 1992. The first property acquired by the Arroyos was a housing unit on 727 Gellert Blvd. Daly City, CA, which was acquired on July 7, 1992 and transferred to LTA on June 18, 1998. The property was sold to a Roberto S. Aleonar on Dec. 15, 1998 for $242,000 as against its transfer value of $302,500.

    The second was a housing unit in 2425 Tipperary Ave. in South San Francisco, California on July 13, 1992. The property was transferred to LTA Realty Corporation on June 18, 1998 and was sold on March 11,1999 to Rodolfo Valera for $224,000 as against its transfer value of $280,000.

    The third was the building on 737 Bush St. in San Francisco, CA, which was bought on Nov. 11, 1992. The property was transferred to LTA on June 1998 and was sold to Prana Income Fund-six Llc on June 14, 1999 for an undisclosed amount.

    The fourth property was a building on 1776 Sacramento St. San Francisco, CA which was paid by the First Couple for $1,912,000, transferred to LTA in June 1998 and was sold on Sept. 11, 1998 to Garlock Trust, an American firm for $2,300,000.

    Mike Arroyo’s affidavit

    According to Attorney Arroyo’s executed affidavit on April 1998, the coupled acquired properties in San Francisco Bay area in California in 1992 in behalf of his brother, now Negros Occidental Rep. Iggy Arroyo.

    In November 1992, Attorney Arroyo initiated the incorporation of LTA Realty Corp. and issued a Trust Agreement for the Van Ness and Bush properties in favor of his brother. Also in the same year, 100 percent shares of LTA were transferred to Atty. Arroyo’s brother to pave the way the transfer of Van Ness and Bush properties to LTA-USA.

    But the documents gathered show that the filing of LTA Realty Corporation in the Office of the Secretary of State of California was under the name of the Mike Arroyo and the properties acquired and sold were done in the names of himself and wife now President Gloria Macapagal-Arroyo.

    “While Atty. Arroyo was saying that the properties acquired and subsequently sold in the U.S. belong to Rep. Iggy Arroyo, transactions were done in the name of the presidential couple and their real estate firm,” KMP’s Marbella said. Bulatlat

    I heard that when putot was still in her lower positions, corrupt na corrupt na daw yan. So all these activities of buying and selling proeperties here in the US and elsewhere may have started way back when she started her political career and had her hands on the money (bribes etc).     Parasabayan: That sale of a commercial building to the Garlock Trust in 1998 looks very supicious. They “flipped” the property for a $400,000 profit in only 3 months! It also happened just months after GMA became Vice-President. Was that a backdoor bribe by someone who planned to do business in the Philippines.

    A similar transaction happened here when Chicago developer Tony Rezko sold property at very low prices to Barack Obama. (http://en.wikipedia.org/wiki/Tony_Rezko) Rezko is now in prison for fraud and bribery. Normally, Obama’s involvement in such a suspicious transaction with a convicted felon would’ve disqualified him from running for higher office, but most of the US press were fauning over him as their “chosen” candidate so he wasn’t vetted the way other candidates are.

    That is unless the BIR people go all the way and leave no room or hole for him to slip through. Unfortunately this agency is all talk and no conviction yet to show. They bragged about people being charged, but being charged is different from conviction. We still have to see one big fish caught and put into an aquarium and the best show they can produce is entitled “Mikey”.

    Maybe it’s about time for them to show that they mean business, walk their talk and starts sending thieves not only Mikey and family but all those who freely served themselves from the state coffers.

    Are you sure you know what you’re talking about? You and psb need to do a lot of googling about primaries, debates, delegates, democratic convention and finally the simple majority vote of 2117 out of 4223 delegates to secure who is the presidential candidate. Vetting??

    Proposal?? If I’m not mistaken, the conservative controlled supreme court reversed this ruling last year…and it favors nobody else than the GOP’s.

    I’m a fan of someone who is doing everything in his power to stop the GOP’s agenda of eliminating programs for those less fortunate in America, i.e Medicaid, Medicare, plan parenthood, SSI.

    I firmly believe in the democrats stance in sharing the wealth and providing healthcare to the poor, and not the GOP’s evil agenda of taxing the middleclass on down and give millions/billions tax breaks to their greedy corporate friends/donors.

    Brief story: A filipino couple who just arrived from Pinas lived in a federally subsidized housing while working menial jobs decades ago. They applied also for food stamps and medicaid as they couln’t afford healthcare. Fastforward
    10 years later, they’re on their own, wife became full RN, and husband an Engineer living the american dream and affiliated themselves to the GOP. NOW, this are the same couple who slam Obama and the democrats for subsidized social programs such as food stamps, section 8 housing, subsidized housing, medicaid/care, healthcare…….same freaking programs they were recipients for when life was tough during their early years. There are many of these types of hypocrites in the Pinoy community of America and it’s shameful.

    Look at your parents when you brought them in to the US. SSI, Food Stamps anyone???? These are all democratic programs since the JFK years if I’m not mistaken, and it’s the same entitlements the GOP’s are trying to eliminate; to which I say….go for it! Do it and hope it passes.

    Tru Blue, there are more “free loaders” than the real people who need “help”. Across the board, every race is a culprit, the “government dole outs” are taken advantage of by the people. US should really scrutinize these dole outs. How many people do I know who take the benefits and go gambling? Drinking? and Doping? How many people do I know make having babies a profession because for every child, there is subsidy? Too many! I am out on the streets a lot because of my profession and I cry whenever I pay my taxes coz it goes mostly to these free loaders. I am not opposed to helping the real needy people like the soldiers who are now on the streets after serving the country. I want the disabled, used to be workers, to be cared for. I wnat teenage moms to be get assistance to eventually finish their schooling and be taxpayers. But I am against instant pensioners. My mother and father did not want to come to the US to be instant pensioners. My mother said I never worked in the US why will I go there to get a pension? My mom still wants to stay in the Philippines with her small Philippine pension. It is not only Filipinos who exploit the SSI. It is all races. The US should review these benefits very well as these will eventually eat up the economy. Only those who paid into the system should get the benefits.

    Actually, I am also against the free education for the grade school and high school. The poor families can be subsidized but not give everyone free education. Sino ang mas maraming nakikinabang sa mga ito? Those who NEVER paid into the system.

    On the medical front, I pay almost a thousand for my own family insurance a month. Here comes a TNT or someone who just crossed the boarder who gets sick and goes to the community hospital and gets ALL FREE hospitalization and medication to boot. Where is the equitability of this?

    How many times had I seen people cashing their government checks, they are stronger than me, they drive a Mercedes Benz and even wear Rolex watches and mind you, these people live in a million dollar house. They are not Filipinos. At least if they are, I would be happier because I know that most of that money would probably go to a family member who goes to school or something. There is a big problem on this “dole out money”. US should review all these dole outs.

    mayroon akong kilalang tumatanggap ng SSI sa California. Dumating sya sa California mga 60 years old na sya noong early 1990’s. Ang tinatanggap nyang SSI ay $600 per month mula ng dumating sya. Samantalang hindi sya nagtrabaho sa US kahit isang araw man lang…..sarap ng buhay no.

    That’s why it’s called a community hospital. I don’t see anything wrong admitting a toddler of an illegal who is dying.

    Taxpayers of Nevada forked out thousands of dollars for a Filipino boxer who was in a coma after his boxing bout two years ago. His health insurance provided by his promoters was not enough to cover for his months of hospitalization which included brain surgeries and everything medically associated towards his wellness and recovery. We’re a civilized society, and IF that boxer was your relative, you will thank the taxpayers of Nevada. Stop your whining for humanities sake.

    Part of what you said is true but who would believe in your assessment that their government check was used to buy rolex, mb, and million dollar house? These people you talked about are drug dealers. No one in welfare or on SSI live in a million dollar house, let’s be realists here.

    @73: Pareng Cocoy, to refresh your memory; when an active military member decides to bring his parent/s to the US, he will execute and “affidat of support”. The affidavit clearly states in part “to fully support my parent/s in order that they would not become a burden of the government”. Why do I remember this phrase? I’ve signed these documents a thousand times over. Anyways, back to nitty gritty. Pag qualified na si Tang at Nang in a matter of two years (at that time), apply agad ng SSI. At the same, Nang and Tang were towed by their masunoring military son to the base office to secure a “dependent’s ID card”. Pag na approve, sa exchange na ang hangout ng dalawa, dami ng kaibigan. They might see one another in the old Regional Medical Centers, may libreng gamot na rin.

    Now, back to the affidavit they signed some two years ago where the sponsor declared to take care of his parent/s so as not to become a burden to the government….it was never an issue. I’ve seen it. Just be quiet na lang. Kaya PSB should just zip da mouth na lang, hehe….

    Mga Aso, Kabayo, at mga pusa nga na that are in distress, they’re being rescued, how much more for human beings. Let’s all be humanitarian. Let’s tax the rich and not the other way around. This is reverse Robinhood.

    I’d rather America spent on illegals inside America, who work and help the economy, than spend outside (Irag, Afghanistan and Pakistan) on people who are against America.

    And don’t give me that crap about security. The war has not made anybody more secure (ask London and Madrid).

    I have always advocated a cheap solution – assassinate the bastards – Saddam, Qaddafi, etc. It is cheaper in terms of money, lives of US troops, and lives of civilians (Iraqis, Libyans, etc.) War only enriches the defense contracting hijos de putas who fund the Reps and the likes of Palin.

    US and Canada’s social security programs are similar kaya hindi nakapagtataka na ang mga flights to and from US and Canada ay almost 75% mga senior citizens na nagbabakasyon at bumabalik at maraming uugod-ugod at naka-wheel chair dahil kailangan ang presence nila in either country to continue receiving the doleouts from these most generous or stupid governments.
