Take two from Clinton John Colcol

In July 2006, Artemio Rasalan, a self-confessed election operator and Clinton John Colcol, a Maguindanao municipal government employee, at great risk to their lives, came out with a signed affidavits and video confessions about their role in tampering with the 2004 election results in favor of Gloria Arroyo.

Media carried their revelations.Malacañang, then under the control of Arroyo , and members of Congress dismissed Rasalan and Colcol’s affidavits as “rehash.”

After I came out with the report on the role of the Special Action Force of the Philippine National Police in the switching of election returns at the Batasan Pambansa in 2008, Colcol wrote me requesting that his affidavit be removed from my blog because he was pursuing a religious vocation. I complied.

Last week, Colcol wrote me that he is now out of the seminary and in the light of recent events, the Zaldy Ampatuan and Lintang Bedol statements, he said I can repost his affidavit. He said he is now a consultant with the office of Maguindanao Governor Esmael “Toto” Mangundadatu.

Here’s Colcol’s affidavit:

I, CLINTON JOHN F. COLCOL, of legal age and residing at Kininan South Upi, Maguindanao, after having been duly sworn, do hereby deposes and states that:

1. The undersigned worked as project Development Officer of the local government unit of South Upi, Maguindanao from March 20, 2003 up to August 31, 2005;

2. The undersigned was recruited by Municipal Election officer Raupdin Mangelen to assist him as one of the COMELEC staff at South Upi, Maguindanao for the 2004 elections.

3. On instructions of Commissioner Virgilio Garcillano, the Provincial election Supervisor in a memorandum dated May 8, 2004, two days before the elections, issued an order directing the replacement of selected municipal election officers in Maguindanao including Municipal Election officers Raupdin Mangelen of South Upi. He was replaced by Election officer Haidy D. Mamalinta.

4. The municipality of Upi has 35 voting precincts and a voting population of approximately 6,000;

5. My special duty given by Election officer Mamalinta during the canvassing of votes for the national and provincial level officials which – includes position for President, Vice President, Senators, Congressman and party-Lists – was to write down the number of votes in words and figures on the Municipal Certificates of Canvass of Votes (MCOC) for national Positions garnered by the national and provincial candidates;

6. On May 10, 2004 at about 2:30 am, the undersigned was designated to replace the Chairman of the Board of Precinct 10A of the municipality of South Upi.As chairman of the board of Precinct 10A, the undersigned was able to perform all duties and responsibilities assigned to me which included preparation of election materials before the opening of the precinct; overseeing the actual voting during the day; closing the precincts; and preparing for the counting of votes casts. However, after the closing, no counting was actually done due to protests filed by the local candidates.

7. Immediately thereafter, the undersigned was called by Election office Mamalinta to report to her at the temporary Municipal Hall of South Upi, Maguindanao. Election officer Mamalinta then told me to set aside my duties at precinct 10A and to re-assume my duties as a member of the COMELEC staff.

8. On May 10, 2004 at around 1 pm because of confusion and threats of violence in the canvassing of votes in the local level, election officer Mamalinta and the Board of Canvassers and some of the COMELEC staff including myself left for Cotabato city;

9. In Cotabato City on may 16, 2004 at around 3 pm at Hotel Castro Room 320, election officer Mamalinta ordered me and the other Comelec staff to immediately fill up the Municipal Certificate of Canvass of Votes for the National Positions (MCOC) for the may 2004 elections saying it was urgently needed in manila even if the canvassing of the votes has not been completed;

10. As it turned out, I was the undersigned who actually filled up all the copies to the MCOC including all recorded voted in figures and in words, all poll watchers’ name and their signatures and the corresponding thumb marks made thereon. A copy of the same MCOC bearing number 000115 is hereto attached as Annex “C”;

11. In making the entries in regard to the number of votes garnered by the national candidates, the undersigned was instructed by Election Officer Mamalinta to make sure that Gloria Macapagal Arroyo get more than three thousand votes and Fernando Poe, Jr. get less than two thousand votes and in complying with this specific instruction, the undersigned wrote down the votes for Gloria Macapagal Arroyo as 3,286 and for Fernando Poe, Jr 1,877 votes.

12. Subsequent to my accomplishing the said MCOC for South Upi, the undersigned had the opportunity to examine the original. Genuine election returns given to and held by the dominant party to South Upi. Based on said election returns, the actual votes garnered by Fernando Poe, Jr. was 2,141 while Gloria Macapagal Arroyo garnered 1,445. This is the proof that the entries in the MCOC which the undersigned accomplished upon the instruction of Election officer Mamalinta were spurious and merely manufactured figures.

13. The undersigned knows for a fact that the surrounding circumstances behind the purported results of the elections of South Upi were previously mentioned in the “Hello Garci” tape wherein Gloria Macapagal-Arroyo and Commissioner Garcillano allegedly conducted the following conversations:

GMA: May problema sa South Upi. Pero local. Kasi iba raw ang na-proclaim ng Comelec dun.
Garci: Sino ba and atin dun?
GMA:Naku, ang importante hindi madamay yung sa taas.
Garci: Hindi ho, ako ang may hawak dun.

14. The foregoing conversations convinced me that the instructions given to Election officer Mamalinta to manufacture the entries of the MCOC (annex”C”) emanated from Commissioner Garcillano himself;

15. On May 20,2004, the undersigned along with Election Officer Mamalinta and a contractual COMELEC staff named Shariff Kusain left general Santos city for Manila. A day after, the three of us together submitted the original copy of the MCOC of South Upi;

16. Two days after may 20. we were made to report to one Atty. Dato in the K-4 Headquarters at the second floor of the LTA building. Perea Street. Makati. Atty. Dato who represented himself as belonging to the Office of Gloria Macapagal Arroyo and told me that he was tasked by Gloria Macapagal Arroyo herself to meet the election officers of Maguindanao still in manila at that time and for them to issue a group statement saying that “the elections in their respective municipalities in the province of Maguindanao were clean honest and peaceful”;

17. Of course, based in the foregoing facts, it is clear that the results of the elections in the province of Maguindanao, particularly in the municipality of south Upi were far from being “clean and honest” principally because of the unholy conspiracy among the COMELEC officials and personnel;

18. The undersigned is voluntarily offering this narration of facts in the hope that the real and honest truth will finally surface with regards the actual results of the 2004 national elections in Maguindanao particularly in South Upi.

    Confused with the chronoligical order of events.
    No. 6 is dated may 20
    No. 8 is dated may 10
    No. 9 is dated May 16

    Is it OK that may 20 comes first before may 10?
    I thought in the preparation of an affidavit the chronology is from the earliest date to the latest in that order.

    In sum:
    #8-May 10 – That’s election day, talked about confusion and violence and left for cotabato city

    #6-May 20 – Mr. Colcol replaced the COB in May 20 and on this date still talking about the opening and closing of election precints, preparation of election materials, etc. and not able to count the votes while that was already 10 days past election day.

    #9- May 16 – In a hotel in cotabato city was ordered to fill up MCOC.

    Correct me if I am wrong, but I think there’s something wrong in the dating of events.

    Couldn’t be that May 20 was the election day as appeared to be in the affidavit.

Conspiracy ito hanggang sa supreme court. Ang Presidential election tribunal ay nag bulag bulagan sa mga anomalya kahit na nasa harap na nila ang ebidencia.     Let me say what will be uncomfortable to most: KASALANAN NATIN ITO! The writing was on the wall yet we chose to remain silent and complacent. Among the many things, let’s just focus on the “I am sorry” incident. How could we, otherwise decent hardworking people, not act on such an obvious violation of not only our rights, but our dignity. And what about Abalos? The abduction of Lozada? It was all there in plain sight. We cowered under their “due process” and “proper venues”. We allowed them to talk to us in newspeak and took it with nothing more than a shrug. Hinayaan natin itong lahat mangyari. We have such a weak social/political consciousness. Now, it is not enough anymore to just say kulungin o bitaying silang lahat. We need a thorough review of our selves and how we imagine our nation. But most importantly, ourselves dahil we ALL allowed this to happen.

    Read item 3, dated May 8. It states that was two days before election day. So election day was May 10.

    On May 16, Colcol was made to fill up the municipal certificates of canvass, although it (canvassing) was only finished on May 20.

    That means the fabricated canvass was pre-prepared, regardless of the actual results.

    Huwag basta papalakpak porque kapanig ang may gawa. There really is no indication of plunder based on the complaint of Chavez.

    The complaint alleges the diversion of funds to Philhealth. But the funds were eventually given to the people; so there was no amassing of government funds.

    Plunder requires the amassing of gov funds. To amass in Tagalog means kamkamin. Kung binigay sa tao, walang pagkakamkam. Simple malversation lang ito. There will still be a punishment, but it is not plunder.

    True, the timing benefited Gloria in the elections. But the funds did not even pass through her, so walang plunder. The case of Joc-Joc is different, because there were kickbacks in the sale of the fertilizer, and the kickbacks actually were collected and amassed by Joc-joc.

    All participants in the plunder may be prosecuted. So kasali din yung nag-facilitate in the approval. That is the then President. Yan ang mas maliwanag na anggulong dapat suriin.

    Sax, but the Philhealth cards were allegedly NOT distributed to the OFWs and their families but to all citizens. The cards allegedly had the pandak’s picture. Isn’t this considered using the funds for electioneering?

    The fact that the funds were not distributed to where they should have been distributed makes that malversation; using funds for purposes other than what the law directs.

    But there was no amassing.

    Pero itong pag-gamit ng OWWA funds para sa Philhealth card na ipinamudmod before the elections, para sa akin ay isang napakalaking anomalya. Bakit ka nyo? .. Mayroon akong isang pinsan who is gainfully employed at siempre, mayroon siyang Philhealth card na binabayaran nya at nang kanyang employer. Saksi ako sa pagkakaroon nya ng another Philhealth card na ipinadala doon sa barangay kung siya naka-rehistro bilang botante. At mayroon pang isang Philhealth card siyang natanggap sa address nya sa kabayanan kung saan nakatira ang kanyang pamilya. Bagaman at wala siyang binayaran sa dalawang huling Philhealth card, pagsasayang ng salapi ng bayan ang ibinayad dito at kung aalagatain natin ang ilang milyong Philhealth cards na ipinakalat sa lahat ng sulok ng Pilipinas, napakalaking halaga ang natapon. Malaking bagay kung ginamit sana sa tamang pagagamitan. Yan ang ANOMALYA ng Philhealth cards sa panahon ni GMA.
